Item4d(1) Augusta Place Amendment - Resolution authorizing the
Mayor to sign and the City Clerk to attest the First
17-3Sa Amendment to Agreement for Private Development
between the City of Iowa City and Augusta Place LLC.
Comment: The proposed resolution will approve an amendment to the
Development Agreement for Augusta Place to extend the storm sewer
down Van Buren Street and across Washington Street.
Item 4d(2) Lovik First Subdivision - Resolution approving the
extraterritorial final plat of Lovik First Subdivision, Johnson
)-7-352 County, Iowa. (SUB17-00016)
Comment: A preliminary plat of Lovik First Subdivision was approved
September 5, 2017. Staff recommends approval of the extraterritorial final
plat subject to approval of legal papers and construction drawings by the
City Attorney and City Engineer. It is anticipated that legal papers and
construction drawings will be approved prior to the November 6 City
Council meeting. Approval will allow the development of Lovik First
Addition, a 3 -lot (including 1 outlot), 11 -acre residential subdivision located
at 4665 Herbert Hoover Highway SE in Fringe Area B of the Iowa
City/Johnson County Fringe Area Agreement.

Item 4d(3) Sanitary Sewer Easement - Resolution authorizing the
Mayor to sign and the City Clerk to attest to a sanitary sewer
)7- 35t easement on the lot located at the southeast corner of
t7-3SS
Bayard Street and Lusk Avenue.
Comment: A sanitary sewer has been extended from the City's existing
sanitary sewer on Rowland Court to serve lots on Lusk Avenue. The sewer
runs northwesterly along Rowland Court, then west through the northwest
corner of the lot located on the southeast corner of Bayard Street and Lusk
Avenue, and then south along Lusk Avenue. The sewer was installed by a
private developer and will be dedicated to the City. This resolution
approves an agreement whereby the owners of said lot grant to the City an
easement for the purpose of maintaining the sanitary sewer. The easement
area is shown on Exhibit B to the easement agreement.
Item 4d(4) Dedication of ROW - Resolution Accepting the Dedication of
Right -of -Way for Bristol Drive Adjacent to Dean Oakes Fifth
Addition, Iowa City, Iowa.
Comment: Dean Oakes submitted Dean Oakes, 71 Addition Preliminary Plat
to establish one lot and dedicate right-of-way to the City. Rather than
proceeding with the final plat, he desires to dedicate the ROW to the City
through a ROW Acquisition Plat. This dedication will allow for a connected
Bristol Drive street system if and when the land to the east is developed.
Staff recommends approval.
Item 4d(5) Melrose Court Sewer Repair - Resolution approving,
authorizing and directing the Mayor to execute and the City
17 - 35Cp Clerk to attest Amendment No.1 to the November 16, 2016
agreement by and between the City of Iowa City and
Anderson -Bogert Engineers and Surveyors, Inc., to provide
engineering consultant services for the Melrose Court
Sewer Repair Project.
Comment: The City of Iowa City previously entered into a contract for
engineering consulting services with Anderson -Bogert Engineers and
Surveyors, Inc., of Cedar Rapids, Iowa, to prepare preliminary and final
designs for the Melrose Court Sewer Repair Project. City Staff desires to
amend the Consultant Agreement to expand the scope of engineering
services of the Consultant to provide additional design services for the
Melrose Court Sewer Repair Project. The negotiated increased cost will be
$71,300 and will be funded by the Melrose Court Sanitary Sewer
Replacement account #V3146.

Item 4d(6) Melrose Court Sewer Repair - Resolution authorizing the
acquisition of property interests necessary for construction of
1-7 - 357 the Melrose Court Sewer Repair Project.
Comment: The City of Iowa City must acquire right-of-way, fee title,
permanent easements and/or temporary construction easement to
construct the Melrose Court Sewer Project. This project includes the
replacement of sanitary sewer, storm sewer and relocation of sidewalk
along Melrose Court. The project will be funded with Water revenues and
General Obligation bond proceeds. The project will be funded by the
Melrose Court Sanitary Sewer Replacement account #V3146.
Item 4d(7) Support of Carbon Fee and Dividend Program - Resolution
t� 3(p0 calling on the United States Congress to pass a Revenue
Neutral Carbon Fee and Dividend Program.
/ Comment: In correspondence included in the Council's November 21
agenda packet Iowa City Climate Advocates requested that Iowa City join a
number of municipalities in endorsing federal legislation establishing a fee
and dividend approach to addressing climate change.
Item 4e. Setting Public Hearings:
Item 4e(1) Univer-City Sale — 521 South Governor - Resolution setting
_ public hearing for December 19, 2017, on a proposal to
I - 358 convey a single-family home located at 521 South
Governor Street.
Comment: In the UniverCity Neighborhood Partnership Program, the City
purchases rental units located in designated neighborhoods surrounding
the University, rehabilitates them, and then sells them to income -eligible
buyers. Under the UniverCity Neighborhood Partnership Program, the City
proposes to sell 521 South Governor Street. The amount of the sale will be
$225,000.

Item 4e(2) Happy Hollow Park Restroom and Shelter Replacement
2018 - Resolution setting a public hearing on December
- 35R 19, 2017 on plans, specifications, form of contract, and
estimate of cost for the construction of the Happy Hollow
Park Restroom and Shelter Replacement 2018 Project,
directing City Clerk to publish notice of said hearing, and
directing the City Engineer to place said plans on file for
public inspection.
Comment: This project replaces an aging combination restroom, shelter
and storage structure at Happy Hollow Park with a restroom and shelter. A
neighborhood meeting was held on May 25, 2016 with approximately 25
residents attending. The design of the restroom and shelter includes
architectural features and finish choices which fit the character of the
historic neighborhood surrounding the park. The estimated cost for this
project is $220,000 and will be funded with CIP projects R4192 and R4130.

Comment: At its October 19 meeting, by a vote of 3-3 (Dyer, Freerks and
Martin voting against approval, Signs abstaining), the Planning and Zoning
Commission recommended denial of this rezoning. Approval will allow
development of 196 multifamily dwellings units subject to conditions
necessary to comply with the South District Plan including substantial
compliance with a proposed concept plan and other conditions related to
building design and the percentage of one- and two-bedroom apartments.

approving plans, specifications, form of agreement, and estimate
of cost for the construction of Mercer Aquatic Center Boiler and
HVAC Replacement Project, establishing amount of bid security
to accompany each bid, directing City Clerk to post notice to
bidders, and fixing time and place for receipt of bids.
Comment: This project includes replacement of the existing boiler and HVAC
systems in the Mercer Aquatic Center and Scanlon Gymnasium. The estimated
project cost is $680,000 and will be funded by the Elementary School Facility

Item 8. Rental Permit Requirements - Ordinance amending Title 17,
entitled 'Building And Housing," Chapter 5, entitled "Housing
Code," to establish a rental permit cap and to strengthen the
minimum requirements for rental housing. (Second
Consideration)
Ge,& Comment: The City, like many cities around the country, currently regulates
✓il occupancy based upon its definition of "family." In April the legislature adopted a
t , law to prohibit municipalities, after Jan. 1, 2018, from enforcing any regulation that
limits occupancy of rental property based upon the existence of familial
relationships. This ordinance mitigates the impacts of increased occupancy levels
in rental housing on neighborhood stability and housing affordability by establishing
a rental permit cap and strengthening the minimum requirements for rental
housing.
