CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING A MORTGAGE FOR THE PROPERTY LOCATED IN JOHNSON COUNTY, IOWA. Comment: The owner of the property located in Johnson County, Iowa, received assistance through the City of Iowa City's Community Development Block Grant funds. The terms of the loan have been satisfied; thus the lien needs to be released. O S' 3~D 2. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE PARTIAL RELEASE OF LIEN REGARDING A MORTGAGE FOR THE PROPERTY LOCATED AT 2426 ASTER AVENUE, IOWA CITY, IOWA. Comment: The Iowa Valley Habitat for Humanity owns the property located at 2426 Aster Avenue and received assistance through the City of Iowa City's Community Development Block Grant (CDBG) funds. The CDBG assistance is secured by a mortgage on this property and five (5) other lots. Habitat is conveying this property to a family. Because the family has executed a mortgage in favor of the City to secure the CDBG assistance, thus the City can release this particular lot. (No items need to proceed as outlined in the City Attorney's memo of 2/28/07 entitled "Rezonings, Due Process and Ex parte communications.") a) AMENDING TITLE 14, ZONING CODE, TO ESTABLISH A MINIMUM PARKING REQUIREMENT FOR HOUSEHOLD LIVING USES IN THE CENTRAL BUSINESS (CB-10) ZONE AND TO AMEND THE DEFINITION OF "HOUSEHOLD" TO REDUCE THE NUMBER OF UNRELATED PERSONS ALLOWED TO RESIDE IN ONE DWELLING UNIT FROM FIVE (5) UNRELATED PERSONS TO THREE (3) UNRELATED PERSONS IN THE COMMUNITY . COMMERCIAL (CC-2), CENTRAL BUSINESS SERVICE (CB-2), CENTRAL BUSINESS SUPPORT (CB-5) AND CENTRAL BUSINESS (CB-10) ZONES Comment: At its October 16 meeting, by a vote of 6-0 (Plahutnik absent), the Planning and Zoning Commission recommended approval of these zoning code amendments. Staff recommended approval in a memo dated October 16. Approval of these amendments will add parking requirements for new residential units in the CB-10 zone and reduce the number of unrelated persons allowed to reside in a dwelling unit from five (5) unrelated persons to three (3) unrelated persons in the CB-10, CB-5, CB-2, and CC-2 zones. 1. PUBLIC HEARING Action: 2. CONSIDER AN ORDINANCE (FIRST CONSIDERATION) Action: ITEM 6. CONSIDER AN ORDINANCE AMENDING TITLE 5, "BUSINESS AND LICENSE REGULATIONS," CHAPTER 2, "TAXICABS," IN SECTIONS 5-2-4, "VEHICLE INSPECTION REQUIRED," SUBSECTION A AND 1(A) OF THE CITY CODE TO CLARIFY CURRENT REQUIREMENTS, TO INCREASE SAFETY, AND TO REQUIRE ANNUAL INSPECTIONS. (FIRST CONSIDERATION) Comment: This ordinance clarifies exceptions for pedicabs and horsedrawn vehicles from some requirements for inspection, and language for vehicle inspection. CONSIDER AN ORDINANCE AMENDING TITLE 9, ENTITLED "MOTOR VEHICLES AND TRAFFIC", CHAPTER 4, ENTITLED "PARKING REGULATIONS", SECTION 9, o ~i- ~-3al ENTITLED "PARKING DURING SNOW EMERGENCIES", TO REQUIRE, UPON DECLARATION OF A SNOW EMERGENCY BY THE CITY MANAGER, ALTERNATE SIDE PARKING UPON CITY STREETS NOT CURRENTLY POSTED FOR SAME DURING THE DECLARED EMERGENCY. (SECOND CONSIDERATION) Comment: To facilitate the efficient clearing of snow and ice during significant winter weather events, this ordinance establishes a system for the City Manager to declare and notify persons of snow emergencies, require alternate side parking on city streets not currently posted for same and provide enforcement of those regulations. Under this ordinance, after declaration of a snow emergency (including sufficient lag time for persons to become aware of same), streets with parking on both sides will be reduced to alternate odd-even calendar day parking consistent with the numbering on the side of the street. Streets with parking on only one side will be reduced to parking only on the non- prohibited side during either the odd or even calendar day, depending on the numbers of the side of the street where parking is allowed. The Central Business District and existing odd-even parking streets are exempt, as metered parking and the existing odd- even system facilitates removal of parked vehicles sufficient for snow removal. The snow emergency declaration shall be in effect for a minimum of forty-eight (48) hours or until the snow is cleared and, as required by state law, appropriate signage indicating "snow emergency-alternate side parking required" shall be located on all major streets and highways entering the city at or near city limits to provide notice during the snow emergency. Violators will be ticketed and towed. Staff recommends expedited action. 0 Action: ITEM 8. o$' 331 CONSIDER A RESOLUTION AUTHORIZING THE IOWA CITY HOUSING AUTHORITY TO SUBMIT A GRANT APPLICATION FOR STATE HOME FUNDS, IN THE AMOUNT OF $200,000, FROM THE IOWA DEPARTMENT OF ECONOMIC DEVELOPMENT FOR THE DOWNPAYMENT ASSISTANCE FOR INCOME ELIGIBLE FIRST-TIME HOMEBUYERS AND AUTHORIZING THE CITY MANAGER TO SIGN THE GRANT AGREEMENT AND ANY AMENDMENT THERETO. Comment: The December 2007 Affordable Housing Market Analysis for The Iowa City Metro Area identified the need to increase Affordable Home Ownership opportunities for low and moderate income families. The Iowa City Housing Authority is applying for $200,000 of State HOME funds to provide Downpayment Assistance to income eligible first-time homebuyers. This is a separate program from the existing Downpayment Assistance Program funded through the City's Fiscal Year 2009 HOME funds. The new State funds can be used throughout Johnson County, Iowa - i.e., not limited to the City of Iowa City. Action: ~~ November 18, 2008 City of Iowa City Page 6 ITEM 9. g- 33a _ ITEM 10. 0 8 ~ 333 CONSIDER A RESOLUTION AUTHORIZING THE REMOVAL OF SPEED HUMPS ON FOURTH AVENUE AND A STREET BETWEEN COURT STREET AND THIRD AVENUE Comment: The City has received a petition from the residents of the 400 block of 4~h Avenue and the 2000 Block of A Street to remove the speed humps installed in 2004. The neighborhood was surveyed during September and eight households (66%) wished to have the speed humps removed while four (33%) would like them to remain. The overall response rate was 75%. Staff memorandum included in Council packet. Action: /~ ~u~~' CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CHAPTER 28E AGREEMENT BETWEEN THE CITY OF IOWA CITY, IOWA AND THE CITY OF CORALVILLE, IOWA FOR THE PROVISION OF ANIMAL CARE SERVICES. (DEFERRED FROM 11/3) Comment: The City has a 28E Agreement with Coralville for the provision of animal services, and staff with both cities have negotiated a new agreement. The major substantive change in the proposed agreement is how the fee is calculated. The fee is based on a daily boarding fee per animal and the proposed fee is based on the average cost over the last 3 fiscal years to care for Coralville's animals. Either city may terminate the agreement upon 90 days notice. The agreement also terminates the current 28E Agreement with the new one being effective at the beginning of this fiscal year. City staff anticipates signing similar agreements with the same fee proposal with Johnson County, Solon, and other small communities. Coralville staff has approved the proposed agreement. CLERK TO ATTEST THE FIRST AMENDMENT TO THE AGREEMENT FOR PRIVATE REDEVELOPMENT BY AND BETWEEN THE -CITY OF IOWA CITY AND DEVELOPER SOUTHGATE DEVELOPMENT COMPANY FOR THE REDEVELOPMENT OF PEPPERWOOD MALL. Comment: In 2003, the City and Southgate Development Company entered into an Agreement for Private Redevelopment (the "Agreement") within the Highway 6 Commercial Urban Renewal Area which provided for tax rebates to the Developer on the investment to complete specific added minimum improvements to Pepperwood Plaza after certifying specified occupancy rates and payment of all property taxes associated with the property over a six (6) year period. Under the Agreement, all exterior changes or new construction requiring a building permit were to be submitted to the City Staff Design Review committee for review and approval under codified design review criteria and specific criteria contained in the Agreement. This review and approval has proven difficult and the City Council has determined that the City Council Economic Development Committee is an appropriate body to review proposed exterior changes and/or new construction for compatibility with design criteria specific to this property. Thus, the parties wish to amend the process and guidelines under which exterior changes and/or new construction on the subject property are reviewed and approved prior to the issuance of a building permit. All other terms of the original Agreement shall remain the same. This Resolution authorizes the Mayor to sign and the City Clerk to attest the First Amendment to the Agreement for Private Redevelopment between the City and Southgate Development Company.
