There was neighborhood objection to the development centering
around two issues: (1) that the development is out of
character with the existing uses in the neighborhood, and
(2) that access should be provided to Scott Boulevard because
Oberlin Street was not designed as a collector street and
therefore should not serve as a collector street for all of
the undeveloped land between Amhurst Street and Lower West
Branch Road. The Commission's recommendation is not entirely
consistent with staff recommendations. Some concerns were
presented in a staff report dated June 21, 1979, which was
attached to the agenda of July 31, 1979. A publish hearing
on this item was held August 28, 1979. Attached to the
agenda is a memorandum and a map concerning the area in the
vicinity of the Court Hill -Scott Boulevard subdivision.

Street (Sand Road). (second consideration)
Action:
Comment: Construction of the South Gilbert Street Project
will create an entirely new intersection with U.S. Highway 6
and thus eliminate the need for the portion of Sand Road
lying between U.S. Highway 6 and Waterfront Drive.

consideration)
Coment: Construction plans for the South Gilbert Street
project call for the elimination of Sand Lake Drive.

4 d. Consider a request to amend Chapter 32 of the Code of Ordinances.
Comment: As requested in a letter attached to this agenda,
the developers of Ty'n Cae wish to amend Sec. 32-59(C)(2)d
of Chapter 32 of the Code of Ordinances (Subdivision Ordinance)
to allow for a larger center median in the turnaround of a
cul-de-sac. The proposed amendment and a memorandum explaining
the nature of the proposed amendment is also attached to
this agenda.

RALSTON CREEK NEIGHBORHOOD REDEVELOPMENT PLAN, AS REQUIRED BY
CHAPTER 403 OF THE IOWA CODE.
Comment: The Planning and Zoning Commission, at a regular meeting held on
August 23, 1979, recommended by a 5 to 0 vote the following:
"The Planning and Zoning Commission has examined the urban renewal
(neighborhood redevelopment) plan for Small Cities -Lower Ralston
Creek Project and finds it to be in conformance with the Iowa
City Comprehensive Plan." The public hearing is the next step
required prior to receiving authority under Iowa Code Chapter 403
to proceed with a redevelopment plan.

POSITION TITLE FOR CLASSIFIED PERSONNEL AND PROVIDING FOR VARIOUS

Comment: The person in this position will do a wide variety of difficult
and complex clerical and administrative aide duties for the
Director, and in many cases for superintendents and supervisors
in the department. The change in range number is necessary to
put this position on a par with comparable positions in other
departments. This is not an additional position. The Human
Relations Director recommends this change.

RYAN AS ASSISTANT CITY ATTORNEY III AND ESTABLISHING COMPENSATION.
Comment: This resolution designates T4s. Ryan as Assistant City Attorney III
and sets her compensation for that position. Her responsibilities
in that position will include day to day administration of the
Department, assignment of work projects, and related duties all
subject to the direction of the City Attorney. with the substantially
increased work load of the City Attorney's Office, the City
Attorney believes this reorganization of the Department, as has
been previously discussed with the City Council, is necessary for
the, effective work oftheDepartment.

ACT OF 1964, AS AMENDED.
Comment: This resolution represents the final step in the application for
federal assistance to purchase three transit buses for the City
i of Iowa City, as well as additional rolling stock for other local
agencies. A similar resolution was passed earlier, but because
the funding for the project is caning from two grant programs,
section 3 and section 18, a second resolution is needed.

CLERK TO ATTEST AN AGREEMENT WITH THE IOWA DEPARTMENT OF TRANSPO,

Canment: This resolution authorizes the Mayor to sign the City's annual
agreement with the Iowa Dept. of Transportation for State Transit
Assistance. Under this FY80 agreement, the City will receive a
maximum of $177,932 to be used towards capital and operating

Conment: Sections II, III, and IV were omitted from the contract the
Council considered at its 8/28/79 meeting. A legal opinion
indicates that the Council should reconsider the resolution for
contract in its entire form.

Item No. 22 - CONSIDER A RESOLUTION AWARDING CONTRACT FOR BLOCK 64, 440 -CAR
PARKING FACILITY (RAMP B).
Comment: An addendum was sent to prospective bidders advising them that
the bid opening was changed to September 21, 1979 at 2:00 PM in
order to eliminate any potential conflict between this and the
bid opening for the Publics Library. This item should be deferred.

Item No. 23 - CONSIDER AN ORDINANCE AMENDING CHAPTER 15 OF THE CODE OF ORDINANCES
OF THE CITY OF IOWA CITY, ICWA (second consideration).
Comment:
Action:
This ordinance change is needed to clarify City policy on solid
waste pickup at combined caw.ercial/residential buildings. The
ordinance makes it clear that the City will not provide solid
waste services at combined canre'xial/residential buildings.
Council had asked that the rationale behind this ordinance be
provided to Council. A memo has been sent to Council.
Item No. 24 - CONSIDER AN ORDINANCE AMENDING SECTION 31-30 OF THE CODE OF

Comment:
This ordinance amendment will make it clear that concrete patches
on concrete streets and sidewalks must be cured using one of the
procedures outlined in the specifications prepared by the Iowa
Department of Transportation.

Item No. 25 -
CONSIDER AN ORDINANCE AMENDING ORDINANCE NO. 78-2891 OF THE CODE
OF ORDINANCES OF IOWA CITY, IOWA (second consideration)
Comment:
This ordinance is being submitted by the Department of Housing
and Inspection Services due to the need for clarification of the
terms EXIT and PUBLICWAY. The definitions have been taken from
the Uniform Building Code and have been integrated into the
appropriate Housing Code sections.
This ordinance is also intended to grant relief to those individuals
who own or operate structures which the City Council feels have
architectural and/or historical signifiance and the addition of
required storm windows and doors would have negative effect on
the appearance of such structures.
The section of the ordinance that relates to the combination of
roan areas in determining light and ventilation reguirenments is
again taken from the Building Code and spells out in the code
what had been administrative practice. This ordinance will allow
many roans currently being used as habitable space to continue
that use without altering the basic structural aspects of the
buildings i which said space is contained.

Item No. 26 - CONSIDER AN ORDINANCE AMENDING ORDINANCE NO. 77-2859, THE BUILDING
CODE, BY REDUCING WIND LOAD PRESSURE STANDARDS FOR GREENHOUSES
AND PREFABRICATED METAL STORAGE SHEDS. (first consideration)
Comment: The Code presently requires that greenhouses and metal sheds be
constructed with the same wird load pressure tolerances as would
be required for garages. Since most prefabricated sheds and
patented greenhouses are of a lighter design, they do not meet
present code requirements. This amendment would allow citizens
to erect metal storage sheds and patented "kit" type greenhouses
on their properties. The Board of Appeals on August 30, 1979
voted unanimously to recmrend to Council that this amendment be
considered for passage.
