hearing for 10/23/79 on consideration of ordinance amending final Planned
Area Development plan of Ty'n Cae, Parts 1 & 2. Motion carried
unanimously, 7/0, all Councilmembers present.

pp. 1250-1251, APPROVING THE AMENDED LARGF. SCALE NON-RESIDENTIAL
DEVELOPMENT PLAN OF SOUTHWAY PARK. Affirmative roll call vote unanimous,
7/0, all Councilmembers present. Letter of approval from B.O.I. has been
received.
Moved by Perret, seconded by Neuhauser, that the ORDINANCE AMENDING
THE CODE OF ORDINANCES BY ESTABLISHING SECTION B. 10.35.11. D. 7, Sign
Regulations, be considered and given second vote for passage. Motion to
consider carried, 7/0. Affirmative roll call vote on second vote for
Passage unanimous, 7/0, all Councilmembers present.
Donn Stanley, 511 S. Johnson, appeared requesting Council action
regarding voter registration. Moved by Erdahl, seconded by Vevera, to
urge citizens 18 years and older to register and to vote in the upcoming
i elections. Motion carried unanimously, 7/0. Johnson Suchomel, 330§ N.
Lucas, agreed with action taken.
i, Mayor Vevera advised that the appointment to the Board of Appeals to
fill an unexpired term ending 12/31/80, and the appointment to the Board
of Adjustment to fill an unexpired term ending 1/1/84 would be
readvertised. Moved by deProsse, seconded by Perret, to appoint Carolyn
I{ Cavitt, 215 Teeters Court, to the Library Board of Trustees to fill an
unexpired term ending 7/1/81. Motion carried unanimously, 7/0• Mayor
Vevera commented that the Council wished that some of the many fine
applicants who applied for the Library Board would apply for other boards

City Mgr. Berlin stated that discussion of a left -turn signal for
northbound traffic at Park Road Bridge would be scheduled later. City
Atty. Hayek commented that regarding the Beldon Ave. housing issue,
Kucharzak wants to review the problem, and Staff will report back to
Council. The interested persons will be so notified. Roberts reported
that last summer Council made the right decision in not doing the
Ventura/Tanglewood paving project, as improvements have been made and the
street S area look good. Neuhauser called attention to a complaint that a
patch of asphalt was made on a brick street at Church/Dubuque.

Regarding recent action taken by the Airport Commission, a motion was
made by Neuhauser, seconded by Perret, and after discussion, amended to
read as follows: Moved that the City Council urge the Airport Commission
not to have the airport planning consultant recommend and evaluate
alternative sites for an airport. After further discussion, Perret called
for the question. Motion adopted 6/1: Roberts voting no. Balmer
requested a report from Public Works comparing chip -seal process with
asphalt process with regard to cost and life of repair.
City Mgr. Berlin advised that after his meeting with Kucharzak and
Steinbach, a tour will be scheduled for Council to view specific problems
regarding housing code enforcement. He announced that the Environmental
Protection Agency had approved the River Corridor Sewer Project contract
today. The contractor is deciding which areas can be worked on yet this
fall. Madison St. will probably be unuseable for a year. The Resolution
awarding the Bid for the South Gilbert Street Project had been deferred to
the 10/2 meeting, and the City Manager advised that the Resolution should
be deferred for another three weeks. Moved by Roberts, seconded by Balmer
to defer the Resolution

Public hearing was held on the plans, specifications, form of
contract and estimated cost for Alley Improvement Project - Blocks 28 &
29, O.T., 1979. No one appeared. Moved by Neuhauser, seconded by
Roberts, to adopt RES. 79-434, Bk. 58, pp. 1151-1152, APPROVING FINAL
PLANS AND SPECIFICATIONS FOR ALLEY IMPROVEMENT PROJECT - BLOCKS 28 & 29,
O.T., 1979. Affirmative roll call vote unanimous, 6/0, Vevera absent.
Public hearing was held to receive citizen comments regarding the
Lower Ralston Creek Neighborhood Redevelopment Plan, as required by
Chapter 403 of the Iowa Code. Brad Meyers, 840 Maggard, appeared
commenting on taking of houses for benefit of the business community.
Linda Manuel, 212h S. Clinton, asked that citizens not be displaced
unnecessarily, and commented on future use under Comprehensive Plan
commercial designation. Dir. Kraft advised that a statement clarifying
Council's policy is being drafted, as discussed at the informal meeting of
9/10.
deProsse commented on problems re violation of the Melrose Court
barrier, resulting in a letter from Mrs. Wright's attorney.
Berlin will check with Public Works & Police DeptCity Mgr.
. re solutions. Berlin
advised that the. Police Chief was preparing a report regarding school -
crossing guards. Some Councilmembers wished to schedule the issue for
informal discussion when Mayor Vevera is present. deProsse called
attention to the very favorable bids received today for construction of
the Library. Neuhauser related concerns from citizens regarding
amplifier noise in the City Plaza. An application process provides for
permits for events. Other noise violations were discussed (bars,
fraternities,. outdoors at Sheepshead). It was pointed out that Cedar
Rapids had adopted a noise, ordinance. A significant problem with bicycles
in the Plaza was noted. City Mgr. Berlin will check on the status of
installation of the signs prohibiting them. Berlin also commented on the
excellent bids received for the Library construction.
City Attorney Hayek presented an Ordinance Amending the Electrical
Code. to amend the requirement .that a person has to have an Iowa City
Journeyman's license to apply for a masters license, by deleting the words
'Iowa City', and recommended its adoption. Chairman of the Electrical
Board Jim Hynes presented amendments re paragraph one of 9.20.9 and
paragraph 3 of 9.20.12. Boardmember Ferrell Turner commented on
cooperation with the staff. Dir. Kucharzak will clarify procedures re
preparation of minutes. He called attention to the effect of the shortage
of electricians, and asked for an increase in the frequency of scheduling
of tests. Moved by Neuhauser, seconded by deProsse that the rule
requiring that ordinances must be considered and voted on for passage at
two Council meetings prior to the meeting at which it is to be finally
passed be suspended, that the first and second consideration and vote be
waived, and that ORD. 79-2967, Bk. 15, pp. 113-115, AMENDING SEC. 11-41 OF
THE CODE OF ORDINANCES OF IOWA CITY BY DELETING REQUIREMENTS THAT A PERSON
MUST CARRY AN IOWA CITY JOURNEYMAN'S LICENSE BEFORE HE/SHE CAN APPLY FOR A
MASTER ELECTRICIAN'S LICENSE, be voted upon for final passage at this

Re Ci vi ervice Commission/Ron Fort. The question is whether or not 1-360
the Commission has the authority to reinstate Fort to Sergeant. Hayek
indicated that the promotion of employees is an administrative matter
under jurisdiction of the City Manager. Commission and staff actions
were discussed. Re: McLaughlin case, a report will be given later.
Hayek advised that he was opposed'to each commission hiring legal
counsel without Council's permission. Brachtenbach's letter will be
discussed at the formal meeting.

Notification of applicants whether or not they would receive a tree, was
discussed. Hauber is in the process.of doing this, and a pamphlet re
maintenance will be distributed also. Beautification on Muscatine between
Court & Burlington, will be behind the barricade. At the intersection
of Court/Muscatine, plantings should be made around the signal control
box. Knight called attention to the time needed to get the programs
set, and to fit them into time schedules. Time schedule for sidewalk
repair was outlined. Problems with income requirement process were .
explained. Longfellow, Creekside & Southside areas soon, Northside &,
Hickory Hill next spring, for sidewalk repair construction.

City Atty. Hayek commented that he had reviewed L. Brachtenbach's
letter concerning procedures at the Airport and application of the Iowa
City Code provisions. He suggested that as the Airport Commission has the
authority to run the Airport, Brachtenbach should address his concerns to
the Commission. It was moved by deProsse, seconded by Erdahl that the
Council write the Airport Commission, bringing Brachtenbach's concerns to
their attention.
Erdahl called attention to the fact that all four incumbents to the
Council have decided to run for another 4 year term and wished them luck.
deProsse questioned if the fountain in Robert Lucas Square would be
working for the dedication. City Mgr. Berlin replied that the sculpture
will not be here, but a modified water feature will be improvised. He
advised that Plastino would contact the Mayor regarding signs on the
closing hour at the Landfill. Mayor Vevera pointed out that the new
School Board is not interested in a meeting of the Board 8 Council re
funding for school -crossing guards. It had been decided that staff
members from the two agencies would meet with a 'unique hazards'
committee. Neuhauser called attention to the hole in the roof in the City
Clerk's office and resulting problems. Berlin stated that the roof would
not be permanently repaired until the summer of 1980, when heating and air
conditioning might be installed. Additional space would have to be leased
to move the office. An updated on the Heating, Ventilation, Air-
conditioning study will be provided soon by the Public Works Dept. Berlin
reported. that the Electrical Board had met on Friday, morning after the
ordinance had been amended, and would have recommendations for Council
soon.

City Attorney Hayek presented an Ordinance
Amending the Electrical Code to amend the
requirement that a person has to have an Iowa City

license, by deleting the words 'Iowa City', and
recommended its adoption. Chairman of the
Electrical Board Jim Hynes presented amendments.
Boardmember Ferrell Turner commented on cooperation
with the staff. Dir. Kucharzak will clarify
procedures re preparation of minutes. Moved by

requiring that ordinances must be considered and

to the meeting at which it is to be finally passed

INFORMAL COUNCIL DISCUSSION: October 7, 1979, 1:30 P.M. in the Conference
Room at the Civic Center. Mayor Robert Vevera presiding.
COUNCILMEMBERS PRESENT: Balmer, Roberts, Erdahl, Vevera, Perret, Neuhauser,
deProsse. Absent: None.

APPLICATIONS TO PLANNING AND ZONING COMMISSION Boothroy present
Court Hill -Scott Blvd. Part VII Legal papers & pkat have been
revised. greement for ete' on basin distributed to Council. Lot
106 is detention basin, assigned to Lot 107. Item 4.b will be two
resolutions, if Ord. approving PAD is adopted.
PAD Ty'n Cae, Parts 1 & 2 Instead of item 4.c on agenda, Council will
need to set a pu is earing on October 23rd. Agenda as posted will
be reposted. Balmer expressed concern, agreed to by other Council -
members, as to how well Home Owner's Associations work. Boothroy
advised that in this PAD there are no common open spaces, each building
will maintain an area. This PAD complies with the treeplanting plan.
'Out Par' Park (B DI Areal Developer has asked for special consideration.
Lego opinion note re capacity of sewer lift station & recommendation
from Legal & Engr. Dept. that it is o.k. to tap into sewer. City Mgr.
Berlin will check to make sure BDI approves this plan, & uses.

Ryan & Scholten present recommending any litigation be discussed
in executive session. Stolfus noted that executive session could
be held after 10/2 regular meeting. Notice will be posted on the
bulletin board.
2. Stolfus requested addition of consideration of Class C Beer Permit
for Quik Trip on W. Benton, to the Consent Calendar.
3. Neuhauser requested that the matter concerning zoning on Beldon Ave.,
letter from City Atty. Hayek noted, letter from Sherinian noted.
City Mgr, will tell:Sherinian that under the Ordinances, the avenue
of appeal is thru the Board of Adjustment. No Council objections.
4. Regarding Melrose Avenue Sewer Extension project, Ryan memo noted.
Property owners to be notified of informal discussion scheduled for
next Monday, to discuss sidewalk & other objections.
5. Balmer called attention to the memo re Spruce St. water drainage
problem. Residents will be invited to informal discussion Monday.
6.Neuhauser commented on use of criteria from Nat. Traffic Manual
for installation of signs. Berlin noted that they should be used,
but other factors may be used by Council & City Manager to make
a decision. Traffic signals at several sites will be discussed
at Council's goals session.
7. Collection of small rock at edges of streets that were chip -sealed
was discussed.

8. Neuhasuer called attention to problem in North Dodge area
with barking dogs, and sewer connection assessment. Berlin will
check complaints. She also noted that the catch -basin at Highwood
& Lee Sts. needs to be cleaned, someone is stuffing newspaper in it.
9. Berlin questioned if any of the four Council incumbents were going to
attend the Council Candidates meeting on Oct. 3rd. None will attend.
10. Perret questioned why the cards to be distributed for comments on
bus service were not ready. Berlin explained that Mose wanted the
new system to be in operation for awhile. All complaints and
alternatives are being checked.
HUMAN SERVICES BUDGET FORMS 2090-2560
Johnson County Regional Planning Human Services Planner Pam Ramser
noted that no Council representatives had attended the last two funding
sessions with United Way. If a Council person who is scheduled has
problems in attending the session scheduled for, someone else should be
contacted to replace him/her. Ramser went thru the Budget Form, Funding Request
Summary Sheet (which will be sent to Council on a regular basis for all
the agencies). She also distributed Instruction Manual & Questionnaire for
Agencies. Berlin advised that scheduling could be improved so that each
agency would appear only when they are considering funding for a request.
Council on Aging is the only budget not submitted. Ramser was complimented
on the improvements made over last year's budget forms & requests.
SOUTH GILBERT ST. RELOCATION PROJECT STATUS REPORT 2560-2838
City Mgr. Berlin state t at a t o some progress has been made on
property acquistion, Staff is not ready to recommend proceeding with
the Res. Awarding the Contract to Metro Pavers, who have agreed to
sit on their bid. Other concerns re Country Kitchen (Braverman/Meardon)
were noted. Council noted their appreciation of what Metro Pavers is
doing, and agreed that if there are too many problems, Council could
decide that they would not continue with the project. An item will be
added to the agenda, to defer consideration to Oct. 2nd. and will be
so posted.on the bulletin board.
APPOINTMENTS TO THE BOARD OF ADJUSTMENT AND THE LIBRARY BOARD OF TRUSTEES 2838 -End
Council agreed to res vert se for.the oar of Justment, and a majority
agreed to appoint Carolyn Cavitt to the Library Board.
EXECUTIVE SESSION 3:30 P.M. Conference Room
Moved y eProsse, seconded by Roberts to adjourn to executive session to
discuss the summary of negotiation procedures of the pre -settlement
conditions for the City of Iowa City for fiscal year 1981 (Fire Dept.).
Affirmative roll call vote unanimous, 7/0, all Councilmembers present.
Staff present: Berlin, Stolfus, Helling, Brown. Brown presented the
proposal for the Fire Dept., and discussed the city's counter proposal.
