I have been in business on Dubuque St. since Sept. 13, 1929. That's just fifty years. Some how we have survived the process of urban renewal. Mostly due to our loyal patrons and the hopes that things will be better. The City is spending :55,000 for end of the block curbs with sloping ramps for the.- handicapped. They are also providing passenger pick up and loading areas for Clinton St. M&Ilr yet there has been no provision made for passenger delivery and pick up for Dubuque St. Plaza. We have paVrons in wheelchairs, walkers, crutches and canes or just the infirm, of which we have many. My own husband is handicapped and I employ a handicapped bookkeeper. I pay taxes on this building and got a =450).00 raise this year and feel that this access problem should and could be resolved with.out it costing the City a cent before bad weather. The following criteria were considered in our recommendation to allow a tap: I. An existing sanitary sewer main is located in the street right-of- way at the proposed site. 2. The City has had freezing problems with the sewer main along Industrial Park Road. The ejector pump and force main tap proposed by Southway Park will aid in keeping the sewer main from freezing. 3. The existing dry weather flow through the Fairmeadows lift station is 22% of the station's capacity. 4. Flows from basement footing tile can reach 79% of the lift station capacity during a five year storm and high ground water conditions. 5. The flow contribution from Southway Park is insignificant when considering the capacity problem that exists because of basement footing tile. 6. A septic tank system cannot be utilized because of soil and water conditions at the proposed site. 7. City of Iowa City, Iowa, docket #42130. It is my conclusion that allowing Mr. Merlin Hamm to tap into the presently constructed sewer system feeding into the Fairmeadows lift station will neither materially nor substantially affect the litigation now pending against the City. Thus, the City's interests in the lawsuit should not be adversely affected. It is my further conclusion that any subsequent development pro- posals should be dealt with on a case-by-case basis, and decisions made only on particular facts and circumstances. Analysis Mr. Hasan has requested permission to tap onto a presently existing sanitary sewer main running northerly and southerly on Industrial Park Road. The proposed plan anticipates development of Mr. Hamm's property, with construction of six buildings over a period of six years. In referring to the proposed LSNRD plan presented to the City staff, Mr. Haran explained that he is ready to proceed with Building "C", which will contain 5 toilet stools in leased offices and that he anticipates construction to proceed on a six- year plan. Buildings "D", "E", "F", "G" and "A" are to be dry - use facilities. However, construction of these last two buildings will not be carried out until the fourth or fifth year. Building "B" is an existing structure used for warehousing and contains 5 toilet stools. These stools were allowed to tie into the sewer system in 1978 without prior approval from the Planning, Engineering or Legal staffs. 1. Private Interest Mr. Hams is arguably a successor in interest to BDI, Inc., the latter of which was a party to an Agreement with the City of MICROFILMED BY JORM MICROLAB CEDAR RAPIDS -DES MOIIIES -2- Iowa City, Fairmeadows, Inc., Sheller Manufacturing Corporation, and Powers and Associates executed November 1, 1963. Bjornsen Investment, Inc. filed an action in Johnson County district court on November 1, 1973, claiming damages against the City totaling $436,650, for the City's alleged failure to provide Bjornsen with assured sewer capacity in the Fairmeadows lift station located on Highway 6 Bypass in east Iowa City. As alleged successor in interest to Fairmeadows' 165+ acres and its -anticipated needs, Bjornsen claims the City's failure constitutes a breach of the 1963 contract. Bjornsen acknowledges that BDI, Inc. was entitled to at least ,286 mgd or 200 gallons per minute flow of the pump station capacity. Review of the Bjarnsen file reveals that BDI and its successors are not, in fact, using their so-called allotted capacity based on water use, exclusive of infiltration. However, the 1963 Agreement only spoke of sanitary flow, not storm flow. As a successor in interest to BDI, Mr, Hamm may well be entitled by agreement to this proposed tie-in. In other words, Mr. Ham arguably has a private contractual right to the proposed tie-in to the sewer system feeding into Fairmeadows lift station, i 2. General Public Interest Cities are generally authorized to control and regulate con- nections with sewer systems as an exercise of their police power. Cities can even compel connection and assess costs when public health requires it. Vol'_ne 11, McQUILLIN, MUNICIPAL CORPORATIONS, 531.30, p. 225., i "Power to regulate and control sewers and drains carries with it as a necessary incident authority to compel, regu- late and control all indispensable, desirable or convenient connections subject, of course, to the observance of property rights." Id. Owners, however, are entitled to be informed of any rules or procedures used by the City in exercising such controls. As with any such regulation, the City's decisions will not be subject to challenge if reasonably related to a legitimateup rpose and ap- plied fairly to individual citizens j Protecting the public safety and health is just such a legitimate purpose. And based on Mr. Chuck Schmadeke's assess- ment (see memo dated September 17, 1979), the proposed 5 addi- tional stools would have a de minimus effect on the capacity of the Fairmeadows lift station. Indeedl Mr, Schmadeke points outthat the practical effect of the proposed. tie-in may well y Ij have a beneficial effect on the sanitary sewer main vis-a-vis freezing conditions. Under the facts and circumstances presented here, the pro- posed tie-in is reasonably related to protecting public health and safety, and the additional sanitary flew generated by 5 stools will have a de minimus impact on the overall capacity of the Fair - meadows lift station, As stated in an Iowa Supreme Court case entitled Bell v. Washington St. Iowa City, Iowa 52240 RE: Southway Park, Lot 3 BDI Industrial Park Dear Mayor and Council Members: I am today submitting an amended Preliminary and Final L.S.N.R.D. Plan for Lot 3 in the B.D.I. Industrial Park which lies along Industrial Park Road. I have built one warehouse type building on this lot so far and ultimately plan to build several more on the site. My original submittal included an LSNRD Plan (Preliminary and Final) for only the first building. This amended plan will show the development scheme for the entire lot. I am most anxious to have review and approval of the plan accelerated to every degree possible. 1 have borrowed a considerable amount of money to construct my second building and the daily interest on these funds is substantial. Until the plan is approved, I cannot obtain a building permit nor begin construction. In addition to the critical financing schedule, the longer we must wait to begin construction, the greater the chances for delays caused by bad weather. I have discussed the probable review schedule with the City Planning staff and they advised that the P and Z Commission would be able to consider this plan on 9/17 and approve it on 9/20 if no major problems arise. They also suggested that I request the Council to consider this for final approval at the October 2nd meeting. My duties at the Institute of Public Affairs include responsibility for our research library. This collection includes some 10,000 books, pamphlets, and magazines dealing with Iowa state and local government, official records, and the public administration process in general. I administer the cataloging, storage, and distribution of this material. In addition to my library duties I edit, design, and distribute our research and training publications. I also write articles about Institute activities, develop promotional programs, and organize conferences. This past April, I was the chairman of the annual used book sale conducted by the Friend's of the Iowa City Public Library. This project is the Friend's major fundraising event each year. This year's sale enlarged the Friend's treasury by more then $6,000 after expenses, compared to about $2,500 last year. I would also bring to the Library Board the experience of previous service on a board with similar duties and responsibilities. During the past three years I have been a board member of Student Publications Incorporated, the trustees of the Daily Iowan. SPI is a non-profit corporation which contracts with The University of Iowa to publish the newspaper. The board administers a budget of more then $600,000, hires a professional staff and the student editor, establishes policy, and represents constituent interests. I am proud to say that I am now serving as the chairman of this organization for the second time. During my tenure, the paper has erased a substantial debt, and is about to end its second successive year in the black after several deficit budgets. In addition, we have made cash purchases of over $50,000 in new equipment and maintained competitive salaries. Most new board members will need time to learn about current issues facing the library. However, I feel I am already well acquainted with many of these issues because of a research report which I wrote this spring. This study covered the powers and duties of the Library,Roard, the Library Director, and j discussed such recent concerns as the bond issue, new building plans, computer conversion, and user fees. I am a voracious intense user of library services for many yearsreader and have been an . That experience has sharpened my opinions of what constitutes excellent rather than just adequate library service to a community. I served on the library governing committee for three years at a small private college in southeastern Michigan. During this time I became well-informed as to the problems and prospects of operating a library of about 115,000 volumes. My current position as assistant director of the Iowa Mental Health Authority gives me a good deal of knowledge of the problems of operating a people -centered organization. My experience with libraries has been even more increased by rqy wife's having completed a master's degree in library science in 1976; she is currently completing her fourth year as a school librarian. KNOWLEDGE OF BOARD: I am aware that the library board serves as the major source o common ty nput into the operation of the library as well as having the responsibility to set policy and thus shape the direction of the library's growth and development. REASON FOR APPLYING: I am applying for a position on the library board because o a ong-term n Brest in the delivery of library services. This interest combined with what I believe to be a strong background should serve to provide the foundation for a capable and active board member. A copy of what was published and what was sent to the City Council is attached. The correction does not change the amendment in any way. The correction is made to the beginning balance and available resource amounts and, under directions from the State, agrees with the total expendi- ture amounts.
