His 'letter to you did not, indicate the church's financial interest in the 'proposal -submitted-by-.Knutson' Construction Company. _It is essential to indicate that the First Christian Church held the option to purchase the site'on_which the Knutson Construction Company' proposed to build. The assignment to the Knutson Construction -Company was based upon several factors, one being that the First Christian Church (or a nonprofit corporation of its choice) would retain :the -option tomanagesthe-units. Robert Welsh First Christian Church 217 Iowa Avenue Iowa City, Iowa 52240 Dear Rev. Welsh: Mr. Nate Ruben, Director of Department of Housing and Urban Development, Federal Housing Administration, Des Moines office, has referred your letter dated -January 9, 1975 to this Authority for reply. First, -I would like to reiterate Mr. Ruben's statements concerning the intent of the Section 23 Housing Assistance Payments Program. The HUD Handbook 7431.1: clearly and -- distinctly provides the policies and procedures to be followed from application time through_ operations to completion of construction. It delineates specific responsi- bilities for specific_ entities. Its clear intent is to place the responsibility for determining the site, design and construction quality, -rents, --capability and responsi- - bility-of-developer/builder/owners of any proposed project into the hands of the Local Housing Authority (LHA). The Handbook also provides the LHA with the,authority to fulfill. this responsibility. In essence, the intent is to give to the Local Housing Authority not just a_housing project, but the opportunity to determine that locality's future in federally assisted housing The Iowa City Housing Authority` has accepted this responsibility and has diligently -followed- the procedures outlined to the best of their knowledge. Rev. Robert Welsh February 10, 1975 Page 2 Second, nowhere in your letter did you indicate that the Knutson proposal did not meet the requirements of the public solicitation, i.e., the units proposed to be con- structed were not air conditioned. <I believe this is a fact worthy of mentioning.- After the -official closing" date for 'submission of proposals, the Knutson company did affirm in writing that the _rental structure as -sub- mitted was based on non -air conditioned units but ,that this solicitation requirementwouldbe met and the rental structure would be reviewed. Therefore, we are of the opinion that - it_can be reasonably assumed that the Knutson Construction Company's proposal would not have had the lowest rent once this omission was considered.- To add airconditioning equipment and provide the energy to operate this system surely would have some effect on the rental structure of the project. - Furthermore, other items submitted concerning administrative, operating, maintenance and tax costs appeared to be so low as to prompt the staff to question the financial' feasibility of the submission. Knutson, again after'- the -closing date, _ stated in writing that these factors would be reviewed and necessary adjustments made. These factors would have an effect on .the rental structure of the project and serve to reaffirm the position that the proposed rent -for the Knutson project would probably not have been lower than the other submissions. Finally, the reasons stated in Mr. Kraft's letter of December 23, 1974 are valid. - The following information is provided concerning each of the three reasons contained in the letter to substantiate this position a. "Its location in the central area... The Housing Authority is also the City Council and in this capacity is responsible for the planned and _orderly growth, expansion, and development of the city. That the selected proposal is consistent with the city's plans is most assuredly a positive factor. That other proposals were not consistent or_complement.--y with existing plans are- .negative factors. The prohibition of site pre -selection was well known to the authority before advertising for proposals. There are sites within the preferred area that would have been consistent with existing plans (for example`, within the R-18 renewal area). Rev. Robert Welsh February 10, 1975 -Page -3 - b. "The developer proposes to construct...." The current housing situation in the city is of some concern to the authority. Virtually anything that can bproperly located to the `availability of the number of sound, p_ --p Y_ -- dwelling units in Iowa City should be encouraged.' That the ins a'total.of_'100 units is quite selected proposal conta important. Further, that,the developer did propose 100 units is consistent with -the--:public solicitation. "The structure or complex may contain more than the 62 units to be assisted." That an economic mix of residents will be' theendresult is a positive factor and'wi11 negate the labeling of the structure as "The Housing for the Low Income Elderly" C. "This project appeared to be more financially feasible..." Several items supporting this opinion have been presented above. The Authority could=not in good faith accept or recommend a proposal that appeared to befinancially infeasible. Construction costs in this area are well known totheKnutson firm in that they are currently active in construction in this area. That their proposal contained such a low estimated construction cost was cause;for.doubting that the firm could construct the building for_the`amount included in their proposal The Authority, in its desire to provide suitable housing, did not wishto enter into an agreement with a -firm only to find.at a later date that the firm could not build the structure, for the.proposed costs. If this were to Occur, the IRA, and the citizens of -Iowa city would then lose this 62 -unit allocation. In response to the final two comments in your letter, the following responses are presented: a. Section A -2c of the checklist. The old Capitol proposal was rated adequate in relationship.to other pro- - posals,-and the Knutson proposal was rated superior; however, because of the serious doubt concerning other factors in this proposal as previously mentioned, a.superior rating in this category was not sufficient.
