MINUTES OF A REGULAR COUNCIL MEETING MARCH 18, 1975 7:30 P. M. The Iowa City City Council met in regular session on the 18th day of March, 1975 at 7:30 P.M.-_in the Council Chambers at the Civic Center. Present: Brandt, Czarnecki, Davidsen, deProsse, Neuhauser. Absent: none. Mayor Czarnecki presiding. The Mayor noted the meeting was being recorded by KXIC Radio Station, and that portions to be broadcast later were at the discretion of the radio station and in no way controlled by the City or the Council. It was moved by deProsse-and-seconded by Davidsen that the minutes read thus far constitute a full reading of the minutes for March 4, 1975 Regular Council Meeting, and that Council approve them subject to correction. Motion carried. Mayor Czarnecki proclaimed the week of March 16th thru March 22nd as City High Week. It was moved by Neuhauser and seconded by deProsse that • the minutes of the meetings of Airport Commission, 2/20/75 and Riverfront Commission, 3/6/75 be received and filed. Motion carried. Mayor Czarnecki announced that this was the time set for the public hearing on the amended Final Planned Area Develop- ment Plan of Lot 24 of MacBride Addition, Part 1, requested by E. Norman Bailey. City Attorney Hayek advised that his office is representing the developer, who was present. There being no others_ present, the Mayor declared the hearing closed. The Mayor announced that this was the time set for the public hearing to rezone the east 40 feet of lot 3 in block 44, from R3B to C2. There being. no interested persons to speak for or against the rezoning, the Mayor declared the hearing closed. City Attorney Hayek informed Council that the Counsel- for Jerry Lanser, regarding the Iowa City Electrical Boaxd's denial of licensing and/or certification wants to defer the hearing. It was moved by Davidsen and seconded by deProsse that the item be deferred`-indefinitely and the City Manager and City Attorney write them a letter setting _a reasonable time limit. Page`2 Council Minutes March 18, 1975 Mayor Czarnecki called attention to Congressman Ed Mezvinsky's bill to Amend Urban Mass Transit Act, concerning eligibility for operating expenditures. He also.noted-that at the March 26th, 4:00 P.M. meeting of the Boards and Commissions, instead of reviewing activities of past year, they will change the format and prepare an agenda listing particular topics for discussion. Councilman Brandt asked the City Attorney for a report on the Attorney General's ruling concerning purchasing of meals. Thetlayor asked if all Regional Planning Evaluations from Council members had been turned in, and announced the By-law Committee meetings would be on Mondays at 4:00 P.M. in the Davis Bldg. and that all were invited. Councilwoman deProsse noted the Ralston Creek Co-ordinating Committee meeting would be March 26th at 8:00 P.M. in the Civic Center. Mayor Czarnecki discussed scheduling of items for informal meetings, adding Urban Renewal and Washington Street along with the Tenant Landlord ordinance to Monday's agenda. He also reminded Council of Friday's meetings with traininq • _ consultants of the National Training Development Service. The Mayor announced the Legislative Committee of himself, Neuhauser and Davidsen will meet at 12:30 A.M. Friday. Councilwoman Davidsen advised that districting on forthcoming elections should be started and asked if Council should name a committee. 'Bill Neppl, Administrative Aide, stated that a preliminary report will be ready in April. Councilwoman deProsse reminded the City Attorney to prepare an OrdinanceonCity Council Salary. Mayor Czarnecki also requested the City Attorney opinion on questions raised by Parks and Recreation Commission members concerning discussions in executive session and the process for public input. Councilwoman deProsse questioned if anything had been done to the microphone and sound system. City Manager Berlin replied - that the lobby speaker had been fixed and alternatives had been suggested to Council on microphones., Mayor Czarnecki commented that Council will try any alternatives. Page 3 Council Minutes;- • March 18, 1975 Mayor Czarnecki questioned the action taken for the Rock Island Railroad request and advised he had sent three more letters to persons as suggested by a Railroad representa- tive. -- It was epresentative.-It`was moved by deProsse and seconded by Neuhauser that the rules be suspended and the first -reading of the Ordinance Amending the Municipal Code by Repealing Section 7.02.5 and substituting in lieu thereof a -New Section on indecent exposure be given by title only. _-Upon -roll . call Brandt,, Czarnecki, Davidsen, deProsse, Neuhauser voted 'aye'. Motion carried and first reading given by title only. It was moved by Brandt and seconded by-deProsse to adopt the Resolution Authorizing Filing of Application with the Environmental Protection Agency, United States of America, for a Grant Under the Water Pollution Control Act. Upon roll call Czarnecki, Davidsen, deProsse, Neuhauser, Brandt voted 'aye'. Motion carried. It was moved by Neuhauser and seconded by Davidsen that the letter from Eleanor Gerow and Mike Jacobsen, Mark IV • Community Service Center, 2530-2-C, Bartelt Road, regarding the possibility of the City sponsoring a recreation program at Mark IV this summer be received and filed and referred to the City Manager and Parks and Recreation Commission. Motion carried. Councilwoman Neuhauser suggested the use of West 'High for a playground. Mayor Czarnecki reported on a Summer Youth Program meeting attended by Ira Bolnick. He.advised the Neighbor- hood Program was being discontinued. It was moved by deProsse and seconded by Neuhauser that the letter from Mr. and Mrs. Charles Schauberger, Bon -Aire Mobile Home Lodge, regarding bus service be received and filed. Motion carried. It was moved by Brandt and seconded by Neuhauser that the letter from Johnson County Board of Supervisors, Court House, regarding condition of Melrose Avenue from West High westerly to the City limits be received and filed and referred -- to the City Manager for report back to Council. Motion carried. Director of Public Works, Dick Plastino advised that the minimum cost for 2 inch overlay would be $76,000 from West High to the City limits. • Page 4 Council Minutes March 18, 1975 It was moved by Neuhauser and seconded by Davidsen that - the letter from Della A. It was moved by deProsse and seconded by Neuhauser to adopt the Resolution Approving Class C Beer Permit Application for Krause-Gentle Oil Corporation, 1104 South Gilbert St. Upon roll call Davidsen, deProsse, _Neuhauser, _Brandt, Czarnecki voted 'aye'. Motion carried. It was moved by Davidsen and seconded by Neuhauser to adopt the _Resolution Refunding Class C Beer Permit for Sav-Mor Gas, 1104 S. Gilbert. Upon roll call Davidsen, deProsse, Brandt, Czarnecki, Neuhauser voted 'aye'. Motion carried. It was moved by Brandt and seconded by Davidsen that the disbursements in the amount of $843,735.19 be approved subject to audit. Motion.carried. The Mayor announced the, basketball game between the • - Minnesota Vikings and Iowa.City.players on March 26th at West High, sponsored by the University of Iowa School of Social Workers Student Association and asked 'citizen support as proceeds will benefit community recreation programs.
