1st day of April, 1975 at 7:30 P.M. in the Council Chambers at
the Civic Center.
Present: Brandt, Czarnecki, Davidsen, deProsse, Neuhauser.
Absent: none. "Mayor Czarnecki presiding. The Mayor noted the
meeting was being recorded by KXIC Radio Station, and that
portions to be broadcast later were at the discretion of the
radio station and in no way controlled by the City or the
Council.
Ic was moved by deProsse and seconded by Neuhauser that
the minutes read thus far constitute a full,- reading of the
minutes for Marcie 18, 1975 Regular Council Meeting, and that
Council approve them subject to correction. Motion carried.
It was moved by Neuhauser and seconded by Davidsen that
the minutes of the meetings of Park and Recreation Comm., 3/19/75;
Riverfront Comm., 3/20/75 and Library Board, 2/27/75 be received
and filed. motion carried.
Chairwoman Fox was present to answer questions about Parks
and Recreation Commission minutes. Councilwoman Neuhauser re-
quested that the Mayor urge a representative oftheRiverfront
Commission attend Council meetings when their minutes are on the
agenda. Mayor Czarnecki announced two vacancies on the Housing
Comm. for three year terms beginning on May est, and two vacancies
on the Planning and Zoning Commission for 5 year terns beginning
on May 1st. He advised he would be asking for a description of
duties from each Board and Commission.
The Mayor commented that -the deadline for the Iowa City Arts
Council City Spirit Grant was April 15th, and he had explained
this to Parks and Recreation Chairperson Fox, so it could be
discussed at the Parks and Recreation meeting of April 9th.
He also noted that Council should discuss the vacancy on the
Johnson Co. Regional Planning Comm., due to the Madsen term
expiring. Council decided to discuss this at the April 14th mtg.
City Manager Neal Berlin advised that there would be an
agenda for the Monday and Tuesday National Training and Development
Service sessions. Mayor Czarnecki announced the Saturday, April 5th
meeting with the Iowa Legislators at the Library, with discussion
of bills of interest to the City. He also announced that the
Council had a conflict .rith the April 8th Iowa League of
Municipalities meeting, so no one from Council would be attending._
Concerning the memo on rnosqutto spraying, Council decided that
Lyle Fisher could come rind talk to the Council about this.

In answer to the question if the Staff would be attending
the Soil Conservation Commission meeting on Friday,. the City
Manager advised that they were planning to attend.- Councilwoman
deProsse announced the April 9th meeting of the Ralston Creek
Coordinating Committee in the Conference Room. After discussion,
it was decided to send the Soil Conservation Commission meeting
memo to Roxanne Haldeman, so that someone from Ralston Creek
Coordinating Committee could attend also. Councilwoman Davidsen
announced that the Rules Committee was planning to meet to
discuss bylaws for Boards and Commissions.
Councilwoman Davidsen also requested that a review of the
-Recycling Project be scheduled for informal discussion and
noted receipt of the memo updating the status of the project.
Mayor Czarnecki called attention to the International
Fair on Saturday, April 5th at the Mall, announcing the three
one-hour stage shows put on by the international students at
the University, displaying music and dances from various countries
and cultures. He noted that, official representatives of some
of the consulates would be coming to Iowa.City for the day and
thanked the City Manager for the City's cooperation in supplying
• the tables and chairs.
City Attorney John Hayek reported on the memo from Director
of Public Works to the City Manager concerning a title objection
in connection with escrow not deposited for sidewalk and an
east -west street (Virginia Avenue) off Prairie du Chien Road
adjacent to Lot 2, Giblin's Third Addition, property owned by
Jack Klaus. He asked that the Mayor be authorized to execute
a release from the contract, noting that a future street could
be put in and assessed in the normal way. It was moved by Brandt
and seconded by Davidsen to authorize execution of the release
by the Mayor. Motion carried.
The City Attorney also discussed his memo presented to the
Council on Council Election Districts and Implementation of the
City Charter. lie advised that the map filed by the Charter
Committee did not have any official status with respect to
Council Districts. He _explained the process necessary for
Council to establish the three districts. After discussion, it
was moved by Brandt and seconded by Davidsen that the City
Attorney and the City Manager be instructed to divide the City
into three equal districts and come back to Council with
recommendations. The observation was made that it could be
tried first with using 25 precincts and if this was not feasible,
alternatives could be tried. Director of Community Development
Dennis graft explained the population shifts in the present
• precincts. The vote was taken on the motion, all voting 'aye'.

It was moved by Neuhauser and seconded by Davidsen that
the rules be suspended and the third reading of the Ordinance
Amending the Municipal Code by Repealing Section 7.02.5 and
Substituting a New Section on Indecent Exposure be given by
title only. Upon roll call Brandt, Czarnecki, Davidsen,
deProsse, Neuhauser voted 'aye'. Motion carried and third
reading given by title only. It was moved by Brandt and
seconded by deProsse to adopt the Ordinance. Upon roll call
Czarnecki, Davidsen, deProsse, Neuhauser, Brandtvoted'aye'.
Motion carried.
It was moved by Brandt and seconded by Neuhauser that
the rules be suspended and the second and third readings of
the Ordinance Amending Final Planned Area Development Plan of
Lot 24, MacBride Addition, Part 1, requested by E. Norman Bailey
be given by title only. Upon roll call Davidsen, deProsse,
Neuhauser, Brandt, Czarnecki voted 'aye'. Motion carried and
second and third readings given by title only. It was moved
by Neuhauser and seconded by deProsse to adopt the Ordinance.
Upon roll call Neuhauser, Brandt, Czarnecki, Davidsen, deProsse
voted 'aye'. Motion carried. It was moved by Davidsen and
seconded by-Brandt-to adopt the Resolution Accepting Preliminary
Plat-MacBride Addition, Part 1, Large Scale Residential Develop-
ment. Upon roll call Neuhauser, Brandt, Czarnecki, Davidsen,
deProsse voted 'aye'. Motion carried. It was moved by Brandt
and seconded by deProsse to adopt the Resolution Accepting -
Final Plat - MacBride Addition, Part 1, Large Scale Residential
Development. Upon roll call Brandt, Czarnecki, Davidsen, deProsse,
Neuhauser voted 'aye'. Motion carried.
It was moved by Brandt and seconded by Neuhauser that the
- rules be suspended and the second reading of the Ordinance to
Rezone the East 40 feet of Lot 3 in Block 44 from R3B to CB,
located south of Iowa Ave. in Civic Center Parking Lot, be given
by title only. Upon roll call Czarnecki, Davidsen, deProsse,
Neuhauser, Brandt voted 'aye'. Motion carried.
It was moved by Brandt and seconded by Davidsen that the
rules be suspended and the first reading of the Ordinance Amending
the Definition of Conciliation Board with Human Relations Commission
Ordinance No. 2593 be given by title only. Upon roll call
Davidsen, deProsse, Neuhauser, Brandt, Czarnecki voted 'aye'.
Motion carried and first reading given by title only.
It was moved by Brandt and seconded by deProsse to adopt
the Resolution Approving the Final Plat of Oakwoods Addition,
Part 7, located west of Helen Lemme School and North of Washington
Street. Upon roll call deProsse, Neuhauser, Brandt, Czarnecki,

It was moved by Brandt and seconded by Neuhauser that
the application from Gordon Russell for construction on Highway
Right-of-way to the Iowa State Highway Commission be approved.
Motion carried.
It was moved by Brandt and seconded by deProsse to adopt
the Resolution Approving Contract Amendment for the Urban
Renewal Demolition and Site Clearance Contract No. 4, authorizing
demolition of parcel 93/3 and 92/8. Upon roll call Neuhauser,
Brandt, Czarnecki, Davidsen, deProsse voted 'aye'. Motion
carried.
It was moved by Brandt and seconded -by-deProsse -to-adopt_
the Resolution Establishing a Four Ton Load Limit on Rohret
Road and Mormon Trek until the Director of Public Works
makes a determination that the load limits are no longer re-
quired, but for a period of not to exceed 60 days. Upon roll
call Brandt, Czarnecki, Davidsen, deProsse, Neuhauser voted
'aye'. Motion carried.
It was moved by Brandt and seconded by Davidsen to adopt
theResolution Prohibiting Parking on the 11orth Side of Kimball
Ave. from Prairie du Chien to a point 50feetwest. Upon
• roll call Czarnecki, Davidsen; deProsse,; Neuhauser, Brandt
voted 'aye'. Motion carried.
It was moved by Brandt and seconded by Davidsen to adopt
the Resolution Allowing Parking on the North Side of Page Street
from Dodge to Webster to allow parking for the park. Upon roll
call Davidsen, deProsse, Neuhauser, Brandt, Czarnecki voted
aye'. Motion carried.
It was moved by Brandt and seconded by Davidsen to adopt
the following resolutions:
Resolution Refunding Cigarette Permit for Great Atlantic
and Pacific Tea Co., 901 Hollywood Blvd.
Resolution Refunding Beer Permit for Great Atlantic & Pacific
