Mr. Kraft also related that the survey to estabiishl the
basis for a request to HUD for a revised Fair Market Pent schedule

3.- Public discussion.
Mr. Ball, requested discussion related to the expected/predicted
acute 'housing; short age' that may be'experenced with the influx of
University of -Iowa -students for the Fall semester registration. He
suggested pursuing installation oftemporaryhousing for a;specified
nimiber of _years with funding from.privatesources. IN. Retish felt
University Housing should also take this plan under advisement.
Sheets moved, seconded by Retish, that the City check
feasi3ility of temporary housing on vacant Urban Renewal lots by
requesting' legalopinion, financial review and technical analysis:

Discussion continued in relation to further possible action to.

3..- .Coordinator's report:
Mr. Seydel`reported on; disposition of Project 22-2, Elderly--
Housing - New Construction. Conversion to Section 8 -has been
requested as recommended by. the; Commission on July 2 1975: The
project is in jeopardy at this tire due to financial -feasibility
related to the occupancy rate projected by FHA in the non -subsidized
portion of the project. The feasible alternative is -construction of
- -only 62 subsidized units as 'proposed by old Capital. < The - City Council
concurred inpursuingthis-alternative on July 29, 1975 and -a formal
request has been submitted by Old;.Capitol Associates to the City'.
Sevdell-indicated a resolution by the Council would be required prior
ng the change

to -the change and introduced a motion, seconded by Sheets, that:

west of their existing establishment from a CH Highway Commercial Zone to

ANALYSIS: the Planning and Zoning Commission
from Mr. Carl J. Goetz, Attorney
for J. M. Swank Co. Inc.
explicitly defines the nature of the business operation presently in
-existence and the principal points upon which the subject request for
rezoning is based. As shown on the attached site plan, the Swank Company
is located adjacent to Fleetway Stores Inc., Farm Fleet 'iCenter -on the west,
Gordon Food, Products Corporation, manufacturers of "Krunchy Dip", on the
north, and undeveloped land zoned CH on the west and C2 on the south. "
A wholesale establishment is a use which is permitted only in the M1 and
N12 Zones.- For this reason, it isessentialto the applicant that the 1.4
• acre undeveloped area to the west be rezoned to an M1 Zone to permit the
normal expansion of the present facility.
It is interesting to note that according to the City's Comprehensive Plan,
prepared by Harland Bartholomew and Associates in 1961, only a small area
within southeast Iowa City and south of Highway 6;Bypass--was zoned CH.;
That area which is located east of Sand Road and_south__of. Highway 6;Bypass
is completely undeveloped with the exception of a small parcel at the
southeast corner of the 'intersection 'of the aforementioned 'streets Which was
later.rezoned M1. Later, -_a vast area located east and south of the subject
area was rezoned C2: The -staff would now question the validity and the
justification of the CH zoning within the area mentioned, since the area zoned
C2'has -replaced the land needs for what commercial development was originally
anticipated,"and.whether=the CH -area -would not be better developed for
-industrial use in conformity with' - the Mlzoning completely -surrounding it.
Regardless, the expansion of the Ml Zone into the CH Zone, as.requested by
the applicant, would have no adverse: effect upon; adjoining land uses or
uses characteristic of the CH Zone that might locate within the area.
Approval of the rezoning application to_ permit -the normal'.expansion of the
business operation, therefore, would not be contrary to standard zoning
procedures." However, in numerous previous occasions, the staff had
indicated the problems inherent with; an Ml Zone._

Any building that is in violation of these area regulations
may be repaired and remodeled -but -not reconstructed o-
structurally;altered.
The above proposed revisions to the Zoning Code are believed to
incorporate the provisions intended,by-Harland:-Bartholomew and
Associates, authors of the "adopted"_Comprehensive '-Plan of the
City,- in that the same or similar wording is used as in the report
on "Land Use and -Zoning New, -:-sections which amplify the -author's
intent -include the definitions -"conversion" "
and "structural "alteration". As reviousl ,, non -conforming use",
P y.stated, the new
definition of a "non -conforming use" would: better define the
intent as implied by theword"permitted" in Section 8.10.21D. In
-other words, a use is non -conforming if itisa-use which is not
permitted inthezone in which it is located, -not -because 'it
doesn't meet -the_.height,-yard and area regultions. Sections
8.10.50 and D_were later introduced since in°the original
recommended zoning regulations, it 'merely stated r"use of premises
and -all -buildings -in the city shall be in accordance with the
minimum; standards hereinafter established".,zAs-proposed, the
words "or as otherwise provided in -this Chapteradded:to both
sections will; serve: to eliminate any apparent conflict with other
• sections of the Zoning Code. Th_e new _Section 8`10.21B -gives
clarity to the present language although it perhapsrepresentsa different connotation than originally -intended. Reference was
initially made to "a use of -the sameor of a.higher-classifi-
cation (explains thereasonfor-T words"same classification"
in the existing
"Code) which would imply that -a non -conforming
use may -be converted to another -non -conforming use of the _same
zone in which the -non -conforming use is allowed.- That is to say,
the proposed revision would not allow a non -conforming use to
be_converted-to any other use except a use allowed in the zone
in which `it -,is located. 'Should -it be=the policy of the City to
not allow conversion from one non -conforming -use to another, but
to-allow`only the conversion from anon-conforming'_use to a
conforming use? It is, nevertheless,,essential that thewords"higher =classification" be deleted, since as in the case of the
proposed industrial zones, certain uses in higher zones will not
be`allowed in -lower zones.
In summation, what are the -general effects of the proposed amend-
ments?- -Dr.-McCormick -would be allowed to convert his single
family dwelling to a'-multifamil dwelling, g, neither of which is
a,non-conforming use in the R3A Zone. However, he could not make
any structural alterations to the `building _since -it is in non-
compliance-with.the-area regulations. The -local -grocery store
located in an R2 Zone could continue to operate as la g ery
11 • store, but should itdiscontinue'-to be a grocery store, it.must
be ;converted to a duplex. A single family dwell i.nq whl.ch Con_
forms to the zoning regulations and is located in an R3B Zone
could be converted to and structurally -altered for a`multifamily
dwelling if done in compliance with all zoning; regulations:-
