Present:Brandt, Czarnecki, Davidsen deProsse, Neuhauser. Absent: none. ° Mayor Czarnecki, presiding. It was moved by deProsse and seconded by Davidsen to con- sider the amount read thus far to be a full reading and to approve the minutes of the Official Actions of the Council meet- ing of October 21, 1975, subject to correction. Motion carried, unanimously. Mayor Czarnecki proclaimed the week of November 10-16 as Youth Appreciation Week It was moved by Brandt and seconded by Davidsen that the - minutes of the meetings of Planning and -Zoning; Commission, 10/23/75; Library Board of Trustees, ;10/16/75; and Human Rela- tions Commission, 10/20/75,- be`received 'and files. Motion carried, unanimously. It was noted that the recommendations by the Planning and Zoning` Commission -to approve revision of the; preliminary -and final plat ofUniversityLake Apartments'and''Approve 'B.D.I. First Addition, preliminary and final plat __(with' contingencies) were acted upon at the October 28th meeting. It was moved by Neuhauser and seconded by deProsse that the recommendations by the Human Relations Commission--to<en courage Council to include representatives of special popula- tions, including.Johnson County Committee for the Handicapped, in discussions with Old Capitol` Associates relating to Urban Renewal Projects, and that these same.groups-be included in dis- cussions before the Council relating to any application that the City may make for leased housing or other housing programs, be referred to the Housing Commission and Design Review Commit- tee to include in their considerations. Motion carried, unani- mously. Public Hearing was held on the Ordinance to Amend the Sub- ` division Code by establishing 'the 'angle of intersection between the side lines of lots and straight street lines and by repeal- ing Section 9.50.5A.4j of the -Subdivision -Code. -No-interested persons appeared for discussion; public hearing closed. Official Actions of Council Page 2 November. 4, 1975 Public Hearing was -held -on -an Ordinance to Amend the Zon ing;Code by establishing provisions for non -conforming uses and by repealing Sections _8.10.3.56,-8.10.5C, 8. 0:5D, 8.10.21B, and 8.10.24C of said chapter by eliminating several existing con - flicts'in wording, and allowing a building occupied by a non- conforming use to be remodeled and/or converted toanother non- conforming use or conforming use though the-, building may be in ight, yard, non-compliance with the heand.area regulations of the Code. Motion carried, unanimously. Council discussed appointments to the Regional Planning Commission and to Citizens Advisory, Committee. After discus- cion, it was the consensus of the Council to advertise for both (30 -day notices). It was decided a meeting on the Comprehensive Plan dis- cussion will be held on November 24th. City Manager Berlin -asked -Council consideration -of -Housing and Community Development Act committee request of adding six members to replace those who have resigned, before budget dis cussions. After discussion of the request, and ,timeframe re- - lated to budget considerations, it wasthe.consensus of the Council_to,schedule discussion at an informal meeting soon. It was moved by Brandt and: seconded by deProsse to adopt Resolution No. 75 -396, -recorded in Resolution Book 33, page - and.Ordering Preparation of Plat and 133, Accepting the _Work Schedule of Assessments for the 1974 Sidewalk Program on por tions of --Benton St.-, Dartmouth -St., First Ave., Mormon Trek Blvd.', Park- Road, and Washington St.Roll call: Ayes: Brandt, Czarnecki, Davidsen, deProsse, Neuhauser. Nays: none. Reso- lution adopted, 5/0. It was moved by Brandt and seconded by deProsse to adopt - Resolution No. 75-397 recorded in Resolution Book 33, pages 134 and 135, Adopting and Levying Final Schedule of Assess- ments and Providing for the Payment Thereof for the 1974 Side walk Assessment Program. Roll call Ayes: Czarnecki, David- sen, deProsse, Neuhauser. Nays: none. -'Resolution adopted, 5/0. It was moved by deProsse and seconded:by Brandt that the letters from David Smithers,'regarding the; Madison Street closing, be received -and -filed and.made part of the public hearing. Motion carried, unanimously.
