HomeMy WebLinkAbout1975-11-04 Bd Comm minutes• A motion was made by Hines, seconded by Cain, to recommend to the City Council' approval,'of-S-7521, revision of the preliminary and final plat,of University: Lake Apartments, with the recommendation that: (1) a six-foot bicycle path and/or walk be provided partially at City expense; and (2) the City Council seek advice from the Engineering Division concerning snow removal in the subject area. The motion carried unanimously, _6-0. ---------------- Commissioner Cain suggested that the following`be_included as a discussion item at the next informalPlanning and Zoning Commission meeting, November 4, 1975: 'Consideration of an amendment to Chapter 9.51 of the City-Code, which would allow minor modifications of LSRD.plans to be made without resubmittal of the plans for approval`by the PP,Z Commission and the City Council S-7522. B.D.I. First Addition, preliminary plat (vic. corner; of Highway-6 Bypass and Heinz Road). Submitted by Business Development, Inc. -- Iowa `City Chamber of Commerce. Date filed: 10/21/75. 45-day limitation: 12/5/75. Mr. Jim Shive, engineer, stated that the following two options were available -for providing sanitary sewer service to Lot 1:` (1) tie on to the sanitary sewer lines of the H. P. Smith Paper Company to the west, or (2) connect to • the sewer lines between Lots 3 and 4 to the east. He, stated-that-an-easement had been provided if option N2 was chosen (connect to the sewer lines between Lots 3-and 4): Don Schmeiser--Senior' Planner, suggested that both options should be shown on the preliminary plat. A motion was made by Madsen, seconded by Cain, to recommend to the. City Council approval of 5-7522,' B.D.I. First Addition, preliminary plat, with the stipulation that the following two options of providing sanitary sewer service.be shown on the preliminary plat: (1) tie on to the sanitary sewer. -lines of the H. Mr. Schmeiser explained that there was some question as to whether or not the City. Council could legally` approve the subject.request without a statement from an attorney stating that the property is-:free of liens and encumbrances. He also stated that the Staff's recommendation was to require that an agree ment mutually acceptable to'the City and the applicant providing for the installation of sanitary sewers when they are needed be submitted in lieu rovisions-for of the standard p`the installation of sanitary sewers. Since B.D.I., a non-profit organization, sells land on the condition that the ements necessary for:the'issuance of a building purchaser shall meet all requir permit, the cost of the sanitary sewer could be passed on to the lot purchaser • by the agreement. -4 1. - 7 - A motion was made by Blum, seconded by Jakobsen to recommend to, the City -Council approval of S -7522A, B.D.I., First -Addition, final plat, with the following contingencies: a satisfactory legal document be submitted relative to liens and encumbrances of the subject property, and (2) an agreement be instituted concerning installation and cost of a sanitary sewer system. The motion carried 'unanimously, 6-0. Commissioners noted that the City Council should be thoroughly counseled by the City's Legal Staff relative.to the property liens of B.D.I. S-7523. Nagle Mini -Warehouse Large Scale Non -Residential Development (LSNRD) submitted by George Nagle. Date filed: 10/21/75. 45 -day limitation: 12/5/75. Mr. Shive stated that the owner -was aware of his responsibility for putting in curbs to provide for adequate drainage but because the grading plan had not yet been completed, he was not certain where the curbs would be placed A lack of sanitary sewer service was of special concern to Commissioner- -Madsenbecause of personal hygiene and safety.nee,ds. He felt some -assurance should be made that would provide a sanitary sewer system. Mr. Shive stated that the City does not require such a system to be provided for warehouses, but stated that they have provided for.the location that would accommodate a sanitary sewer system when and if it is required. Commissioners noted that the P&Z Commission may make a recommendation regarding a sanitary sewer system regardless of whether or not it is a requirement of the City Code. Stating that she felt there had not been adequate time to review the proposed LSNRD preliminary and final -plat, Commissioner Cain expressed dissatisfaction - with the haste involved in consideration of the plat and warned against setting'a precedent because of following such procedures. -Commissioner Madsen concurred and stated that he felt it would give a poor impression to rush into consideration of the proposal on the basis of granting a personal favor. Mr. Shive urged the Commission to take action only on that portion of the submitted LSNRD plat that was shaded. He stated that if the owner wants to add another building in the future,,he would be compelled to obtain a building permit and, therefore, comply with all City Code requirements. Eggers Judy Kelley Mary Burton Jeanette Carter Susan McGuire SUMARY OF DISCUSSION " President Farber called the meeting to order at 7:40 P.M. Ms. Eggers presented a partially completed 20 minute slide show and asked for criticism and comments. It had been; preparedby former library science students Mary Kitticson and 'Kathy ;Kjau with the help ofthe Iowa City Public' Library; staff members. Its purpose`is primarily informational - about the library and its services. It was the consensus of Board members _present that it wasn't suited for use in the current period., One which outlined specific building-inadequacies was felt to be needed. A possible meeting with forner-Library Board members was discussed. It was ` informally decided -to=consider a meeting November 6 with-all-Board members in the; period of the library addition invited. It was: felt that each should be contacted personally before sending formal letters of invitation. The Johnson Co.`Regional-Planning Commission's report Public Office Space: Needs, Priorities, Alternatives was discussed briefly & their suggested sites for a new library, building examined. The final period was spent in hearing an outline of possible items for discussion at future informal meetings. Areas outlined included 1) rela- ' `tionship with other libraries and educational institutions; 2) -relation- ship with other jurisdictions; 3) library extension services; 4) prob- lems`of the newer media; 5)` possible role (s) for the library in the com- munity; 6) the public r� !}4 -3- The Housing Section was presented. There was some discussion -regarding theissue • of:age and the issue of marital status as they relate to housing. Each category was added for discussion purposes with the age protection limited to people over 18 years of age. A third category.in those protected of "people with children" was discussed as a, possible category. More datawasneeded before a decision - - could be made onr.the housing provision.: Credit transactions were discussed with a question of mental versus physical disability being raised. The public hearing provision was discussed further with"the cost in adding.a public hearing_provision weighted against the benefits obtained by such a provision.'` The staff report is attached to these minutes. Felicia Mullen of the Iowa Civil Rights Commission reported on a new 'practice `by -_ the Commission entitled "Predetermination Settlement" which streamlines the ; cumbersome administrative process for some persons. A'special meeting; date of 10 November was established to distribute further ordinance provision materials and to consider complaints. At 10:35 p.m. a poll of -all members present indicated unanimous agreement -to go into executive session to consider complaints.
