The Iowa City City Council met in Regular Session on the 18th day-of November, 1975, at 7:30 P.M. in the CouncilChambers at the: Civic Center. Present:_ Brandt,' Czarnecki, Davidsen, Neuhauser. Absent: deProsse. Mayor Czarnecki presiding. It was moved by Brandt and seconded by Neuhauser to consider the amount read thus far to be.a full'_ reading` and to`approve_the minutes of the Official Actions of Council meeting of November _41 1975, subject to correction. .-Motion carried, unanimously. John 'Har er appeared on behalf of Citizens for a Better Iowa City Community Betterment Program presenting a-plaque awarding Iowa City Fifth Place for communities of:over 10,000 persons in L__ Community Awards Competa.ti.orl and -a oheck -in the amount of- $50.00. He recommended use of the money for Arts Council and earmarked for downtown public arts projects and the project book to be on file at the Library.- It was moved by Brandt and-seconded by Davidsen that the recommendation be approved. Motion carried, deProsse absent.. The Mayor noted the Council's appreciation of ,their efforts. It was moved by Brandt and seconded by Neuhauser that the minutes of themeetingsof Riverfront Commission, 10/30/75; and Planning -and_Zoning Commission, 11/7/75, be-received and filed. - Motion carried, deProsse absent. It was moved by Brandtand seconded by Davidsen to agprove the Mayor's appointment of C B Thayer to Parks and Recreation Commis- sion to fill Sarah Fox's unexpired term,,; expiring January 1, 1976. Motion carried, deProsse absent. The Mayor announced the vacancy on the Riverfront Commission would be filled next Tuesday. He inquired on, the -status `of the application for the Mass Transit Grant.. City Manager Berlin com- mented that nothing had been received as of this time. He also- inquired lso inquired about a-report-on Elderly Housing. The City Manager called attention to Seydel's report on all housing applications. Councilwoman Davidsen reported on a conference held in Ames for Policy Makers on Mass Transit. Councilwoman Neuhauser commented they were given a-preview of the State'•s multi-modal transportation plan in which the amount allotted for---Mass Transit is around $2,000,000 and that the Council ;should lobby the State Legislature for more funds.__ Councilwoman Neuhauser questioned whether the Women's Restaurant Project (Grace &'Rubies) is in fact a bona fide club an inquire i the Human Relations Commission and the City Attorney should look into Page 2 • • Council Activities November 18, 1975 this since there -is a question of discrimination. .Candy; Morgan, Human-RelationS Director, noted this item was discussed at the -'Human Relations Commission meeting, and it has been referred to Staff. It was moved by Brandt and seconded by Neuhauser-to approve 'the amendment. ,Motion carried, deProsse absent.- it was moved by Brandt <andseconded<-by. Davidsen to -adopt the -Resolution 'No. 75-409 recorded in Resolution Book 33, ,page 149, Authorizingthe Amendment to Negotiation Agree- ment. Roll call: _Ayes: Brandt, ,Czarnecki, Davidsen, Neuhauser. Nays: 'none. Absent: deProsse. - Motion carried, resolution adopted.` City Manager ,Berlin -called Council's attention to two requests approved by the Engineering Department from the Iowa State Hiahwav Commission for Iowa-Ilhnoas Gas and Electric for highway crossings for -utilities, one being an.overhead wire crossing at Sheller -Globe and the other is on -Highway l R -O -W S.W. between Orchard_Street'and Hudson Street, and asked for Council's approval at this time. it was moved by Brandt and seconded -by Neuhauser that the requests be granted. Motion carried, 4/0, deProsse absent. Mr. Berlincommentedon the Provisions in the Ordinance that limits height and width of buildings bein moved on a City street He noted discussion had been held with Iowa -Illinois and the Legal Department and they both recommended neither -limit be increased and that the Ordinance not be amended. After -discussion of alternatives, City Manager Ber11an noted an ordinance amending would be prepared. Assistant Citv`Attorney Bowlin reported on the case of Baker vs.--City-recently decided in District C'o_urt in which the Judge _ issued an injunction against the use of the Denver Boot. The City Legal Department requested authority from Council to appeal this decision to the Supreme Court. It was moved by, Brandt and seconded by. Davidsen to so authorize. Motion carried; 3/1, = Czarnecki voting deProsse absent. Attorney Bowlin requested executive session for discussionoflitigation in the case of Larew/Tauber and Tauber/City at the close /nD� of this session. It was moved by Brandt and seconded by Neuhauser that the City Manager be authorized .to roceed with the Com re- r hensive Plan as out ine in the Staff report, Motion: carriedt- Czarnecki voting "no", deProsse absent. Mayor Czarnecki 3 1, , commented he did not approve this planning process and gave his , reasons. -Robert Welsh, 2526 Mayfield Road,appeared offering sugges- tions. -Dennis Kraft,-Director ugges- tions. Dennis'Kraft,-Director of Community Development commented he would report next week on staffing and funding. It was moved by Neuhauser and seconded by Davidsen that the proposed Ordinance No. 75-2789, Amending the :_Municipal Code by Establishing the Angle of Intersection between the side lines of --lots an straig t street lines and by repealing Section 9.50.5A.4 of the Subdivision Code,be considered and given second vote for passage. Motion' adopted, 4/0. Roll call vote for adoption: Ayes: Czarnecki, Davidsen, Neuhauser, Brandt Nays; ,none. Absent:< deProsse. It was moved by Neuhauser and seconded by Davidsen that the proposed Ordinance No. 75-2788, Amending Chapter -8.10 of the Muni- cipal Code by-establishing_provisions for non-conforming'uses and b _ 7�q repealing sections 8.10.3._56,` 8.10.5C,°8.10.5D, 8.10,21B and 8.10. Of said Chapter,be considered and given second vote for passage. Motion adopted, 4/0 Roll call vote for adoption Ayes: - Davidsen,; Neuhauser, Brandt, Czarnecki. Nays: none. Absent; deProsse.
