The cost of publishing the following proceedings and claims is $ Cumulative cost to date during this calendar year for said publication is $ The Iowa City City Council met in Regular Session on the 18th day of November, 1975, at 7:30 P.M. in the Council Chambers at the Civic Center. Present: Brandt, Czarnecki, Davidsen, Neuhauser. Absent: deProsse. Mayor Czarnecki presiding. It was moved by Brandt and seconded by Neuhauser to con Sider -the amount read thus far to be,a full reading and, to approve the minutes of the official Actions of Council meet- ing of November 4, 1975, subject to correction. Motion"car Tied, unanimously. John Harper appeared on behalf of Citizens for a Better Iowa City Community Betterment Program, presenting a plaque awarding Iowa City Fifth Place for „Communities over 10,000 persons in the Community-Awards-Competition and..a check in the amount of $50.00. He recommended use of the money for Arts Council and earmarked for downtown public arts projects ; and the project book to be on file at the Library. It was moved by Brandt and seconded by Davidsen that the,recommen- dation be approved. Motion carried, -deProsse _absent. The Mayor noted the Council's appreciation of their efforts. It was moved by Brandt and seconded by Neuhauser that the minutes of the meetings of Riverfront_.Commission, 10/30/75, and Planning and Zoning Commission, 11/7/75, be received and filed.- Motion carried, deProsse absent. - It was moved by Brandt and seconded by Davidsen to approve the Mayor's appointment of C. B. Thayer to Parks and Recrea- tion Commission to fillSarah' Fox's unexpired term, expiring January 1, 1976. Motion carried, deProsse absent. CouncilwomanNeuhauserquestioned whether the Women's Restaurant Project (Grace & Rubies) is in fact a bona fide - -club and inquired if the Human Relations' Commission and the City Attorney should look into this since there `is a--question' of discrimination. It was moved by.Neuhauser and seconded by Davidsen that the matter of,liquor licenses for_private clubs be referred to the Human Relations Commission and City_:.. _- Attorney.for report back.-Motion carried, 4/0, deProsse absent: Page 2 Official Actions of Council November 18, 1975 City Manager Berlin reported on a Resolution Amending the Negotiations Agreement with the Iowa City Police Patrolmen's Association and the City by extending the length of time for the ground rules, and asked Council's.adoption'.at this time. It was moved by Brandt and seconded;:by;.Neuhauser to approve the amendment. Motion carried, deProsse absent. It was moved by Brandt--and-seconded ;by Davidsen-to adopt the Resolution No. 75-409, recorded inResolutionBook 33, page 149, Author- izing the uthorizing-the Amendment to Negotiation Agreement. Roll call: Ayes: Brandt, Czarnecki, Davidsen, Neuhauser. Nays: :none. Absent: deProsse. Motion carried, -resolution adopted. City Manager Berlin called Council's attention totwo re- quests approved by the Engineering Department from the -Iowa State Highway Commission for Iowa -Illinois Gas and Electric for highway crossings for utilities,one being an overhead wire crossing at Sheller -Globe and the other is on Highway l R -O -W S.W. between Orchard Street and Hudson Street, and asked for Council's approval at this time. It was moved by Brandt and seconded by Neuhauser that the requests be, granted. Motion carried, 4/0, deProsse absent. Assistant City Attorney Bowlin reported on the case of Baker vs. City ,recently decided in District Court in which the Judge issued an injunction against the use of the Denver Boot. The City Legal Department requested authority from Council to appeal this decision to the SupremeCourt.- It was moved by Brandt and seconded by Davidsen to -so authorize. Motion carried, __._3/1, Czarnecki voting "no", deProsse absent. It was moved by Brandt -and seconded by Neuhauser that the City Manager be authorized to proceed with the Comprehensive Plan as outlined in the Staff report.: Motion carried, 3/1, Czarnecki voting "no", deProsse absent. _'Mayor Czarnecki com- mented he did not approve this planning process and gave his reasons. It was moved by Neuhauser and seconded by Davidsen.that the proposed Ordinance No. 75-2789, Amending the Municipal Code by Establishing the Angle of Intersection between the "side -lines .,-of __lots and straight street lines and `by:repealing Section 9.50.5A.4j of the Subdivision Code, be 'considered and given second vote for passage. "Motion adopted, 4/0. Roll call vote for adoption: Ayes: Czarnecki, Davidsen, Neuhauser, Brandt. Nays:. -none. 'Absent: deProsse It was moved -by Neuhauser and seconded by Davidsen that the proposed Ordinance No. 75-2788, Amending Chapter 8.10 of the Municipal Code by establishing provisions for non -conform- ing uses and by repealing sections 8.10.3.56, 8.10.5C, 8.10.5D, 8.10.21B, and 8.10.24C of said Chapter,, be considered and givers second vote for passage. Motion adopted, 4/0. Roll; call vote' for adoption: Ayes: Davidsen, Neuhauser, Brandt, Czarnecki. Nays: none. It was moved by Davidsen and seconded by Neuhauser to adopt Resolution No. 75-410, recorded in Resolution Book 33, page 150, Authorizing Execution of Contract Regarding Agreement to Sell House Located at 330 South Capitol to Bill McDannald. -Roll call: Ayes: Neuhauser, Brandt, Czarnecki,'Davisen. Nays:. none. ' Absent: deProsse. Resolution adopted, 4/0_ It was moved by Neuhauser and seconded by Brandt to defer the Resolution Authorizing the Mayor. to Enter into Contract with Powers -Willis & Associates for the 'Ralston Creek Watershed Manage- ment Plan for one week. It was moved by Brandt and seconded by Neuhauser to adopt Resolution No. 75-411, recorded in Resolution' Book 33, page; 151, Establishing Stop Signs at the ,Intersection -of-Johnson and Bloomington Requiring TrafficonJohnson Street to Stop for - Bloomington Street.
