' FP.Oht: City 1•lanzger R.c Public Library Personnel Rules and Regulations i•lanual Sime '+'ee<5 ago, the stair was asked for information regarding differences, if any, that existed between the Public Library rules and regulations and the City's personnel rules and regulations. j1 In previous years, the Library Board has established its own classification I and pay plan for library employees separate from the City's_ classification and pay plan. With the negotiated contractfor'Local 183 of-AFSCME , the City and the Library Board, the pay plan and classifications have been brought under one classification and pay plan scheme. The library rules and regulations now indi- cate that a pay plan ;will -be adopted by the -,Library Board and the 'legal authority;: is vested in the board. However, the library director has indicated that•the board does intend to continue to cooperate with the City in_fuiat tur� The City Council may wish to communicate with -the Library Board on this matter IT there is any._uncertainty-as to the benefit of continued negotiations. •Generally the content of -the -two manuals are the same except that in most instances the Library Board replaces the City_Council and the Library Director replaces the City Manager and/or Personnel Director. { Thefollowingare language and content differences identified:in the library 11 rules and regulations manual: 1-. Introduction. The statement is made inthesecond paragraph of the library manual that these rules and, regulations supercede any and all conflictinc; statements of the City of Toua:City's personnel policy. The rest of-th sentence isthesame as the City', s. e 2. Responsibilit% for Administration._ In the library manual, the Civil Service Commission and the City's personnel director and City Manager will render such assistance to the Board as required to carry out the library's personnel program. Also contained in this section of the library's.manual`is language which states -that -the Board of Trustees shall adopt the official classification f1 plan and -annual establish the rate of pay for -al I positions in the classifi ca tion. r Position Classification Plan_. The subsection "Forms of r' Classi zcation Determinations", is deleted from the Library Board's manual. There are four areas under the forms of classification determinations. They are no change, lateral reclassification, upward reclassification`, and doi•;maard reclassification • Also deletef, fron the Library Board manual is Section F of the_ Citi j p .: manua lentitled 'Interin•etation of Class Specifications" eiowith Section I of - the City manual entitled 'rassificatin Periodic Chuck" T Memo: City Council • -2- Septoer 24, 1975 4. -Pay-Plan. Under the subsection entitled "Administration of the Pay Plan", `the Library;Board.manual has an additional subsection entitled "Sunday, _ = hours and Compensation". This= -subsection states that employees required to work on Sundays when the library is open `(October l - May, 30) will receive _ six hours credit for; each four -.hour Sunday 'shift worked. Library employees have received -this time and a half pay benefit for Sunday.viork since 1969. The library feels "because of -the number of evening and Saturday -hours in the regular schedules of Tibrary.employees, the 4 hour seasonal Sunday shift -is felt:to be an extra burden which deserves -the added incentive of extra pay, while working on'3 minor holidays is not". In the future,, this provision could have a significant impact upon the City. The recomendation of the factfinder in November of 1974 was—_"(t)—that the d Union proposethat this-issue.not; be, incorporated into the agreement but that the Library Board's policy on extra credit for -Sunday. -work be contin- ued for the term, of this agreement with the Understanding that the Union and the Library Board mutually explore trays to, move toward uniformity with ' general city policy on'Sunday -work. -- Under "Definition of Overtime; ;5 found in the City manual, subsections (a) and (b) under 5 have been deleted from the Library's, manual. 'Subsection (a) deals with -the official --City pay plan and subsection (b) deals with salary ranges based on performance.—The subsection entitled "The Incumbents in the Excepted Positions" found on„page 9_of.- the 'City manual- has.been de- leted frog the Library manual. The library provides:a revised wording for ` those provisions which appears essentially the -same -in content. • On -page 10 "Additional of City's manual number 9, Compensation% language dealing with special; uniforms has been deleted from the Library manual. 5. Employment and Promotions. In the Library manual, under subsection H "Separation Because of Curtailment of Work or Lack of Funds -(Lay=off)” an additional subsection, F, has been added which states that nothing in this section shall be used as -a method of circumventing' the City-'s`equal-oppor- tunity and affirmative action policies as adopted by the Board of Trustees. 6. Leave and Related Personnel Practices. Under section A, "Vacations", the Library -Board manual; has the additional classification of professional librarian'. for accumulations of vacation, seven plus hours per;pay;period and 172hoursper year. The City does not provide additional vacation time for professional' employees. 7. Employee Conduct and Relations. Under section A entitled "Management - Employee Cooperation the section entitled "procedure" found in the City manual has been deleted from the Library `Board's -manual. This is found on page, ;24,of the City's Personnel Rules and Regulations manual. In the Library Board's manual under the subsection "Poli tical Activity i:ot Affected", number _6 has:been added -which 'states "working for candidates other than for an Iowa City municipal office". - - Memo: City Council • -3- Sepber 24. 1975 _ Section G'which deals :•,ith board and commission travel and expense is - • deleted from the Library Board's manual. " In section H, "Disciplinary Procedures", the Library Board manual deletes .-. the 19 listed examples of cause -for _empioyee reprimand, salary increase :•rithholdings, suspension, etc. Under this section the Library Board manual has .language which states that in 'thecaseof dismissal, the Board of Trustees ,is given by law( the power to'remove 'the librarian, assistants or employees by a vote of t,. -Io -thirds of such board for lmisdemeanor, incompetency, -_ or inattentiontothe duties of such employement. This language is found io'Chapter -378.10 of the Iowa Code, 1973,.and,•nill be contained in the munici- pal code after July 1, 1975. In section K, the Library Board manual entitles this section "Problem Drinking" where the City manual entitles it -"Recovery and Rehabilitation Program for i•iuni ci pa l `` Employees" 8. 'Employee Development. The City manual entitles this section "Training Programs". The Library. Board manual has an additional number 2 which is entitled "Atten- dance'at Professional Meetings" 9. Holidays. City policy provides no holiday pay for permanent part-time employees '. unless they are regularly scheduled to work on the holiday. Permanent part- time employees in`the "Library may take pro -rated holiday.hours whether they are scheduled to work on the holiday -or not: -- It is important that the personnel policy and fringe benefits of the Library • be as consistent as possible with those of the City so that problems during negoti- ation and in implementation are minimized.
