The Iowa City City Council met in regular session on the 12th day of March at 7:30 P.M. in the Council Chambers at the Civic Center. Members present: Brandt, Czarnecki, Davidsen, White. Absent: deProsse. Mayor Czarnecki presiding. The meeting was recorded by KXIC Radio, portions to be broadcast later are at the discretion of the radio station and in no way con- trolled by the City or the Council. It was moved by Davidsen and seconded by White to consider the amount read to be a full reading and to approve the minutes of the regular Council meeting of February 26, 1974 subject to correction. Motion carried. It was moved by White and seconded by Brandt that the 7-:-1 3/6/74 and Housing Commission, 2/20/74 be received and filed. _ Motion carried. Concerning the recommendation from the River- front Commission that the consultant be instructed that as a first priority, consideration be given to preservation and improvement of the Iowa River Corridor as an open space and green area, it was noted that the objectives mentioned will be conveyed by the City Manager to the consultant. It was moved by Brandt and seconded by Davidsen that the recommendation of the Parks and Recreation Commission that those areas of the West Landfill, not now being actively used for landfill oper- ations be made available for recreation uses, including recre- ational vehicles, and that access for these uses be developed as part of the 1974 Development Activities be received and filed and referred to the City Manager for report back. Motion carried. It was moved by Davidsen and seconded by White that the Parks and Recreation Commission be informed that concerning the statement in their minutes, "The City Council does not want the Commission to be involved in the selection of a consultant for the Ralston Creek Project", they were to be involved in the selection of a consultant, input thru the City Manager. Motion carried. It was moved by White and seconded by Brandt to adopt the Resolution Approving Class C Beer Permit Application for Buck's Trading Post, 2120 S. Riverside Drive. Upon roll call Brandt, Czarnecki, Davidsen, White voted 'aye'. Motion carried. It was moved by Brandt and seconded by White that the letter from Harold Hughes, U.S. Senator, concerning Senate File 1541, regarding revenue sharing be received and filed. Motion carried. It was moved by Brandt and seconded by Davidsen that the letter from Robert Howard Benno, 413 E. Jefferson, concernin . Motion carried. Ballard, President, Pennsylvania IIorti- cultural Society, concerning their "10,000 Trees" Bicentennial project be received and filed and referred to the Mayor, Project Green and the Citv Manager for report back to Council. It was moved by Brandt and seconded by Davidsen that the tter from Mary Neuhauser, Riverfront Commission, regarding a .verfront Commission recommendation for the objective of a verfront Plan be received and filed. City Attorney John Ijavek gave a brief report on the contents of the contract with Old Capitol Associates for the urban renewal project_ which includes ; the sale of 11.5 acres of urban renewal property to Old Capitol Associates, 2) agreement of redeveloper for development of property and 3) agreement on City's part for public improve- ments. The City Manager explained the exchanges of property and air rights, and effects of the exchanges; and noted street closures, some to be reviewed and some to be closed, listed in Page 3 • Council Minutes March 12, 1974 Schedule E, are subject to compliance with necessary legal requirements. He recommended that the Mayor sign the contract subject to the filing of amended proposal and offer. Mayor Czarnecki stated that in his opinion, citizens are voting on the Old Capitol Associates Redevelopment proposal at the March 28th referendum. Rev. Robert Welsh appeared presenting a letter from the Board of the First Christian Church request- ing deletion of closing of Dubuque between Iowa and Jefferson,<-�. d d d d b y Item 11, Shcedule E. It was moved by Bran t an secon e y White that the letter be received and filed. Motion carried. It was explained why this closing was a part of the contract. Councilman Brandt commented on the impact of the project to the City and University and requested that the citizens vote on this important issue. It was moved by Brandt and seconded by White to adopt the Resolution Accepting Old Capitol Associ- ates Redevelopment Proposal and Authorizing Execution of the Contract. Upon roll call Czarnecki, Davidsen, White, Brandt voted 'aye'. Motion carried, deProsse absent. 4/0. Rev. Welsh acknowledged the work done by the Council and staff, noting the contract reflects the basic concerns of the citizens. Council- man Brandt expressed his appreciation for Rev. Welsh's interest and support of urban renewal. Dick Fedderson appeared stating gratitude to the Council for their action, judgement,consistancy and sincere interest in making downtown Iowa City a better place_ for all people. _ �K a? E seconded by Davidsen to defer the Grievance and Appeal Procedures" 1 na tiousinc7 Program for one week. / C� City Manager Wells reported that as certified by Wayne Evenson, Conductor, at the March 7th Union Election, 96% of those employees of the City who were eligible voted, with 56% endorsing AFSCME Union to represent them. It was moved by Brandt and seconded by White ro receive and file the certification of election results, and to instruct the City Manager to begin negotiations with the newly elected representatives. Motion The Mayor called a five minute recess. Mayor Czarnecki stated that the Council had received the memo from Attorney Hayek concerning mandatory park land dedi- cations. City Attorney Hayek reported on the results of his study stating his opinion that the City does have the power to require mandatory dedication or fees -in -lieu of dedication if certain standards are adhered to; 1) the park required must be included in our comprehensive or general plan, 2) the sub- division exaction must be considered reasonable, with regard to the subdivision in question, 3) the requirements must be at- tributed to the specific needs of the subdivision in question, 4) the advantage gained from the requirement must be used to the direct benefit of the people in that subdivision. He stated that there would be a significant amount of study and planning by the Department of Community Development before this could be enacted. It was moved by Brandt and seconded by Davidsen that the mandatory dedication of park land be referred to the City Manager for report back to Council as to procedural steps to be taken to enact regulations in this regard. Motion carried. After complimenting the legal department for the thorough work done, it was moved by Brandt and seconded by White that a copy of the memo be sent to the Planning and Zoning and Parks and Rec- reation Commissions. Motion carried. Mayor Czarnecki announced that this was the time set for the public hearing on an Ordinance Amending Chapter 8.10 of the Municipal Code of Iowa City, which adds a Central Service_ Business zone. Richard Wollmershauser, Department of C0nty Development, explained the previous action including a public hearing in October, 1973, and advised that parking provisions had since been added, and the list of CB Zone uses was delineated. The Mayor then declared the public hearing closed. It was moved by Brandt and seconded by Davidsen that the Mayor of Iowa City be instructed to contact the Mayor of University Heights to discuss the possibility of a joint merger. Page 7 Council Minutes March 12, 1974 Councilman White reminded the Council of the Legislative session Saturday morning at 9:30 including a discussion of the status of the Department of Transportation Bill, Land Use Bill and the Collective Bargaining Bill. It was moved by White and seconded by Brandt that the correspondence from the City P.ttorne concerning the Marijuana Ordinance be referred to the Regional_ Planning Commission.. Motion carried. It was moved by White and seconded by Davidsen that a copy be sent to Rod Miller who precipitated the discussion. Motion carried. Mayor Czarnecki announced receipt of the Solid Waste_. managemE. Mayor Czarnecki noted that the proposal from the Social Services on Dav Care would be discussed later. The Mayor announced that he had received suggestions regarding recreational multi -uses for the proposed ramp in the Urban Renewal Project. It was moved by Davidsen and seconded by Brandt to refer those suggestions to the City Manager for consideration and report to the Council. Motion carried. Mayor Czarnecki noted that he had contacted individuals in Cedar Rapids regarding the new manpower special revenue sharing, but r that the Mayor of Cedar Rapids was opposed to combining manpower programs. It'was moved by Brandt and seconded by White that the Mayor contact the Governor's office and communicate the interest of the City to participate in manpower programs. Motion carried. The Mayor advised that Iowa city has a reservation of $40,000 coming to them from the Youth Conservation Program, but that it requires $14,000 local match. It was moved by White and seconded by Davidsen that the Council commend West High School Basketball Team for an undefeated regular season, and compliment Mr. Jake Bush for his selection as Coach of,,,,,'c .,, the Year for the Mississippi Valley Conference. Motion carried. 0 City Manager Wells reported to the Council that the application for Regional Crime Commission Funds for the Police Department Rape Project has been approved which will increase the manaower in the policy department by one, and asked that <17% Council authorize the addition. It was moved by White and seconded by Davidsen that said authorization be given. Motion carried. The City Manager also reported concerning sidewalk installation on Washington Street, with 1900 lineal feet of walk needed between First Avenue and Westminister, the cost would be $11,500, with $550 as the City share. It was moved by Brandt and seconded by Davidsen that the memo regarding the cost of the sidewalk on Washington Street be made part of the 1974 Sidewalk Program. Motion carried, White voting 'no', deProsse absent, 3/1. City Attorney Hayek commented on other items on which he had submitted written reports: West Branch Road vacation, % C SEATS, and the Zoning Moratorium.- It was the consensus of ` the Council to ask the City Manager and City Attorney to explore provisions of our Ordinances to regulate the bus program on city streets.
