WHEREAS, the City of Iowa City,-lowa,has entered into a
- contract with the United States of America, said contract date6
September 2. 1970, for the purposes -of executing an urban renewal
project known as City -University Project I, Iowa R-14; and
WHEREAS, it is now necessary, for various reasons, to amend
said contract; -
NOW THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. The propos11 ed first Amendatory Contract attached hereto
and made apart`hereof, amending 'Loan and Capital Grant Contract,
-Iowa R-14, dated September 2, -_1970, --by and between the City of
Iowa `City, "Iowa, -(hereinafter called the'"Local -Public Agency"),
and _the__United States , of America (herein ,_called the "goverru,ment") , _
is hereby in all respects -approved;,
2. The Mayor -is -hereby authorized and directed to'execu�e
the amendatory contract in two counterparts on behalf of them vocal

(herein called the "Local Public Agency" and the United States
of America (herein-called the "Government") acting by and
through the Secretary of Housing and Urban Development (herein
called the "Secretary").

Capital) Grant Contract No. 'IOWA-R-14(LG)-dated--September Z, 1970
(herein called the "Existing Contract"), and the Parties now

mises, and representations contained herein and in the Existing

7 Project CapitalGrant, --,;The Government will also make

the "_Project Capital Grant") in an amount equal to the least
of the
followings
(a)
The amount by ---which (three-fourths) of the Net Project
Cost of this Project, 'together with the total of (i) two-
thirds of the aggregate net project costs of other projects
of the Local Public Agency (or of any other local public
agency -in the same -municipality) .on- which ; contracts for

grants have been made under Title I on a two-thirds

capital grant basis, (ii) three-fourths of the aggregate
net -;project costs'of other projects of the Local Public
Agency (or of any other `local public agency; in the same
municipality) on which contracts for capital grants have

location`'and property acquisition costs payable as provided
by Section 8(c) of this Contract and by any equivalent pro-

provided for, have been -paid, -or finally determined by the
Secretary to be payable, with respect to such other projects;

8 Relocation and Property Acquisition Costs
(a)
Assurances

The .grant recipient has filed with the Secretaryassurances
with respect to the Uniform Relocation Assistance and Real
-Property
Acquisit-ion Policies Act. of 1970 (hereinafter re-

ferred to as.the "Uniform Relocation Act") ;which the Secre-
tary has found to be satisfactory regarding the displacement
of= persons _and/or-:acquisition,of--real'-property in relation to
this project or program occurring on -or after _January 21 1971.
(b)
Payments and Assistance
Subject to the budgetary limitations of this Contract the
,grant recipient agrees to make relocation payments and
payments -for -eligible expenses incidental to transfer of
title and condemnation;' litigation, and to -provide reloca-
tion-assistance,to or on behalf of eligible recipients in
-
connection-withthe projector,program. Suchpaymentsshall
be made --and such assistance shall be providedinaccordance
-- -
with and to -the full extent permitted -by applicable regula-
tions or other requirements=of the Secretary -including, -with
respect to displacement or'properIty'acquisition occurring on

Federal Funding
Notwithstanding any other provision of this Contract and
notwithstanding'any.provis,ions governing funding in the
regulations of the Secretary implementing_thetUniform Re -
Gov
location Act which may be inconsistent herewith, the ern--
ment shall (i) fully fund as part of.the-project or program
capital grant, the total -of -all payments properly
-amount
made by - the -:grant recipient-pursuant;;to part(b) of this
Section, and (ii) fund the costs of, the grant recipient for
relocation 'assistance -properly -provided pursuant to part(b)
of this Section `in the same manner as regular project or
program costs.
