Item No. 5 A PUBLIC HEARING ON THE RESOLUTION OF NECESSITY AND THE PLANS AND
SPECIFICATIONS FOR THE 1974 ASPHALT RESURFACING PROGRAM.
A. CONSIDER RESOLUTION OF NECESSITY.
B. CONSIDER RESOLUTION APPROVING PLANS AND SPECIFICATIONS.
Comment: The above resolutions are necessary to initiate the 1974 Asphalt
Resurfacing Program. Under this project the following streets
are to be resurfaced:
a. Iowa Avenue - Madison Street to Riverside Drive
b. Kimball Road - Whiting Ave. to North Governor St.
C. Jefferson Street - Dubuque St. to Gilbert St.
d. Washington Street - Van Buren St. to Muscatine Ave.
e. Market Street - Dodge St. to Dubuque St.
f. Oakland Avenue - Sheridan Ave. to Court St.
g. Melrose Avenue - Rock Island Railroad bridge to
Byington Rd.
h. Dodge Street - North Governor St. to Burlington St.
It is estimated that this project will cost approximately $273,000
with the Highway commission reimbursing the City for approximately
$74,000 of that amount.

Item No. 6 - PUBLIC HEARING TO REZONE A TRACT OF LAND FROM R3 TO R3A. Z-7409.
Comment: On June 13, 1974, the Planning_and_Zoning-Commission by a 4-2
vote recommended that a 13,400 square foot tract of land owned by
Ms. Vivian M. Smith and located immediately east of the southerly _ \�
extension of Olive Court in University Heights be rezoned from an
R3 Zone to an R3A Zone. In a recent_Pistr.ict...Court..decisi.on, the
�OCourt ruled the property zoned R3A to eliminate the "nonconforming"
status of the property.c

ESTABLISHING CERTAIN REQUIREMENTS IN THE CB, CBS AND ORP
ZONES.
Comment: Amendments have recently been made to the Zoning Code adopting
regulations for the CB, CBS and ORP Zones and adopting parking

and side yard requirements. The latter two amendments deleted
sections of the former two, therefore, a subsequent amendment
is proposed for the purpose of clarifying this discrepancy_

Comment: The Planning and Zoning commission on .lune 13, 1974, recommended
by a 6-0 vote approval of an ordinance establishing requirements
for private, public and commercial parking facilities in the CB
Zone. With the exception of parking spaces for a hotel or motel,
the proposed ordinance provides for the approval by the Council
of all proposed parking facilities in the CB Zone.

Item No_ 11 - CONSIDER ORDINANCE TO REZONE A TRACT OF LAND FROM AN RIA ZONE TO
AN R3A ZONE. (THIRD READING)
Comment: After recent litigation, the Court issued a mandate requiring the
City to rezone a 7.05 acre tract of land located north and south
of Haywood Drive and west of Laura Drive and owned by Amerex Cor-
poration to a zone which would permit the construction of 108
apartment units. The Planning and Zoning Commission on May 9, 1974,
recom,7tended by a 2-1 vote and one abstention rezoning said tract
to an R3A Zone_ Public hearing was held June 18, 1974.

to rezone a 5.9 acre tract of land located north of Highway 6
By -Pass and between H. P. Smith Company and H. J. Heinz company
from an R1A Zone to an M1 Zone. The Planning and Zoning commission
on May 23, 1974, recommended by a 5-0 vote approval of the appli-
cation. Public Hearing was held June 25, 1974.

CONSIDER ORDINANCE TO VACATE AN EASEMENT FOR PUBLIC HIGHWAY PUR-
POSES ALONG WOOLF AVENUE. (SECOND READING)
The Veterans Administration has requested that the City vacate
an easement for public highway purposes located along the south-
east leg of the "Y" intersection of Woolf Avenue with Newton Road
in order to construct a parking facility over said easement. The
Planning and Zoning Commission on May 23, 1974, recommended by a
5-2 vote vacation of the easement and relocation of a public side-
walk within said easement by the Veterans Administration.
Public Hearing was held July 2, 1974.

MENT OF ZONES.ON LAND ANNEXED SINCE. 1962. (FIRST READING)
Comment: In a recent court case, the court ruled that a public hearing
must be held to establish zoning classifications on land annexed
since 1962. On May 23, 1974, the Planning and Zoning Commission
by a 7-0 vote recommended the establishment of zoning on said
annexed lands as set forth on the existing zoning map with the
exception of the following parcels as enumerated in the Staff
Report dated May 9, 1974. Public Hearing was held July 9, 1974.

AWARDING CONTRACT FOR THE
CIVIC CENTER PARKING
FACILITY PROJECT.
The following is a tabulation of the bidders:
Burger Construction Co.
Iowa City, Iowa $ 82,378.95
Wolf Construction Co.
Iowa City, Iowa $ 83,133.85
As can be seen, the bid submitted by the Burger Construction Company
was the lowest of the two bidders submitting bids on this project.
The Engineer's Estimate for this project was $65,000. This bid is
approximately 26% over the Engineer's Estimate. The City Manager
and staff recommend rejection c.f rhe bids received. The staff will
be prepared to discuss this project at the City Council meeting.

Action:
This resolution accepts the work done by Boyd & Runanelhart Tlumbing
and Heating, Inc. of Iowa City, Iowa, on the sanite=y sewer in
Court Hill -Scott Boulevard Addition, Part III, which commences at
the south line of Ravencrest Drive and continues north on Ravencrest
Drive for a distance of 540 feet: as well as commencing at an
existing manhole in the center. of Washington Street on the east line
of Oakwoods, Part II, and continuing easterly on Washington Street
240 feet. These sewers have been constructed in accordance with
the City's specifications.

GENERAL OBLIGATION BONDS.
Comment:
Action:
This is a resolution directing the levy of tax for the: payment of
General Obligation Bonds. On July 11, 1974 bids were received for
the sale of $400,000 in General Obligation Bonds. The best bid
was made by Continental Illinois National Bank of Chicago, and
First National Bank of Iowa City at a net interest cost of $74,053
or 5.696%. This resolution will authorize the levy of taxes for
the payment of this debt.
