MEMBERS ABSENT: Retish. CITY STAFF PRESENT: Seydel, Bowlin, Hillis. Is GUESTS PRESENT: C Jim Mullendore. RECOMMENDATIONS TO CITY COUNCIL: None. REQUESTS TO THE CITY MANAGER FOR INFORMATION OR STAFF ASSISTANCE: None LIST OF MATTERS PENDING COMMISSION -COUNCIL DISPOSITION: None SUMMARY OF DISCUSSION.AND FORMAL ACTIONS TAKEN: 1. Branson called the meeting to order. Bosserman moved that the minutes of the September 4, 1974 meeting be approved as written. McLaughlin seconded the motion. Motion passed unanimously. • • 2. Public Discussion. Sheets presented a bibliography of reading materials on housing which was compiled by Alecia Claypool. The bibliography will be reproduced and given to the commission members. 3. Coordinators. Report. Five new applications have been received since the last meeting. Seydel recommended approval of four of the applications. The other requires a letter to the applicant, who was previously in the program and left a $176.00 damage bill. Seydel cannot accept the application until this is paid. Seydel reported that even if the applicant pays the bill he will recommend the applicationnot be approved because of past experience in the program and because of the trouble she has caused where she is now living. Seydel reported seven leases are available. He has just rented a three bedroom unit and he is negotiating on one other unit. There is still nothing available. His largest demand is. for one and two bedroom units. ® Seydel went through some of the information provided for the members which included guidelines and leases used in other Programs and the..present fair market rents published by HUD. 4. Old Business. Seydel has talked with the regional office and the new housing is still'. on hold. The new rules and regulations will be published on October 1, for public comment. Seydel summarized.some of the things to think about concerning the new housing and community development bill: 1. The money has not been appropriated. 2. After the money is appropriated it has to be released. 3. No mandatory spending is provided for. In regard to our 62 units, there is a legal problem at the national level. The 62 units were to be funded from Section 23 funds. Section 23 expires December 31, 1974 and there is no carry over clause to carry the money over to Section 8 in the bill we are now working with. Branson informed the commission members of the City Council's special input session on September 25. 17J 11 5. New Business. The discussion of better understanding and communication between the members and the public was begun by Branson. She stated that Retish was one of the members who was very concerned about this topic but he was unable to attend the meeting. She talked with Retish and he agreed that the other members should go ahead with the discussion. Retish did not relate to her any items he wished to have discussed. Branson stated that she felt better about the commission now than she has during the past year that she has been on the commission. Branson feels. the commission needs to develop a more humanized attitude in dealing with the public. Branson feels the commission has to develop an approach of compassion and understanding and has a responsibility to deal with peoples problems no matter how small the complaint. White stated that he feels people should feel free to contact any commission member at any time without jeopardizing their position. White feels the commission has the responsibility of community service and he is disappointed that the commission has not been able to get things ,done. White emphasized that people should -b6 free to express themselves. He is very concerned about anything.developing in low rent housing. For example, Ottumwa has 300 units and Iowa City has none. White feels that the City Council ought to take an active interest in getting housing for Iowa City and follow through on it. Ottumwa only has a population of 29,000 and they have 300 units. Iowa City has been authorized 62 units and nothing is happening. We should have an established Housing Authority that gets things done. White stated he is not hesitant to express himself because nothing is happening. White feels the council members should attend Housing Commission meetings since the commission is now involved in a project vital to the community. White also feels that the council should communicate with the commission so that one person is not saying one thing and another person saying something different. If the commission gives out information it should be as accurate as possible. Branson stated she -thinks its better to say that you don't know than to make a commitment that you don't have the power to make. Seydel stated that the present Low Rent Housing Authority was set up in August.1968, but there actually was a housing authority before that. At that time the council had the option of deciding whether they wanted to retain all the power or pass on all the power. The council wanted to retain all the power at that time. seyd.el suggested that the commission might want to find Out if--the council,still feels the same way about retaining the Power. Seydel summarized Ottumwa's setup which has the Housing Authority and the Housing Commission as the same body. Burlington and Keokuk are set up the same as Iowa City. Seydel stated that it doesn't make much difference who has the powerrthis body must be aggressive and have City Council backing so that it isn't necessary to go back to the drawing board or do A study every time something changes. We haven't reached the point in Iowa City where someone says we're going to have elderly housing lets now get it done. Someone has to have the fortitude to make the decision. We have restudied programs for five years and ended up with nothing. Sheets stated she thinks it is advantageous to have the commission and the authority the same because better communication is possible.. Branson stated that she doesn't think the council has much regard for,the commission when they go ahead and do things without consulting the commission. For example, Mayor Czarnecki talked to the Daily Iowan and said that student housing will receive consideration-from the new housing and community development bill. Branson stated that maybe students will get something out of the new bill and maybe they won't but this hasn't been decided yet and because of this statement people will be expecting the commission to do something about student housing. Another example is the study being made by the law school regarding the tenant landlord ordinance. The council went ahead on.their own with this. Branson feels there needs to be some communication between the council and the commission. Branson stated that the council has the power and the authority to do these things. She does not mind the council having this authority but the Housing Commission has felt powerless under these conditions and she feels that it would be appropriate for the council to tell the commission what they are doing. Bosserman stated she has never felt the Housing commission accomplished anything. She asked if anyone felt things would be different if the commission had never met. Branson stated she thinks the commission has been influential in the acceptance of ideas in the community. Bosserman stated that she never felt she had influenced anything, that the council is the only one with impact. Branson stated that she would like to see some housing built. Seydel summarized the structure as we have it now. First there is the City Council, then the City Manager, Department of 11 Ll Community Development and the Housing Division. This is his chain of command. The Housing Division is charged with providing secretarial service for the Housing Commission. The commission can go directly to the City Council. Sevdel is mostly involved with administration of the present program. As far as getting new programs the commissioners should know the bills and know what's available. Seydel suggested the City might want to go into ownership: Public agency ownership is in the new bill. Under Section 202 the City could apply for a direct loan from the U.S. Treasury or the City could sell its own bonds. Branson stated that one of the commission members thought Seydel should provide them with a library of reading materials. It was generally agreed that this was not Seydel's responsibility and that the members should educate themselves. Branson stated that one of the things she is most commonly critized for is taking the landlords point of view. Branson does not feel that she takes the landlords side.more often than the tenants side. Bosserman stated that she is criticized most often by the landlords. They think the commission is indiscriminately using their tax dollar. McLaughlin stated she was concerned about the attitude at the public meeting at the Senior Citizens Center. Branson was impressed with the number -of people who called her before the public meeting to express their views. Fountain stated he was glad to hear how the tenants felt. Sheets motioned and McLaughlin seconded the motion that the Mayor be invited to the next commission meeting. Motion passed unanimously. Branson reminded the members of the September 25, special input session and suggested that all the members attend. It was agreed that the council members would be invited to go on the site visit to Burlington's housing. 6. Bosserman moved and White seconded the motion that the meeting be adjourned. To approve the voluntary annexation request made by Gordon'Russell for a tract of land east of Highway 218 and west and south of the old landfill. 2. That the tract of land east of Highway 218 and west and south of the old landfill previously recommended for annexation be zoned as follows: the westerly 300 feet of the tract be zoned Ml, with the remainder of the tract zoned M2. 3. To approve S-7414, Washington Park Addition, Part 9, Preliminary Plat, leaving the right-of-way for Green Mountain Drive as 60 feet. 4. To adopt the following resolution: Because of the evident and urgent need to determine and establish development policy; Because of the development and redevelopment problems that have been enunciated in the R3A Area Study that relate to a broader and more comprehensive approach to desired solutions; The Planning and Zoning Commission recognizes that there is a serious need for a new Comprehensive Plan. Therefore, the Planning and Zoning Commission recommends to the City Council that the preparation of a new Comprehensive Plan be of the highest priority, and that the City Council direct the City Manager and Staff to proceed in the pre- paration of a new Comprehensive Plan and to take other appropriate.actions-that are necessary to support the expeditious preparation of anew Comprehensive Plan. 5. That a program be established to define and identify buildings, and neighborhoods of historic or architectural significance and that provisions be incorporated into the City Code to protect and preserve these sites once they are identified. s- NFORMATION=`OR STAFF'•ASSISTANCE: To ask the: City _Attorney ,for _:an explanation of the extent of Jurisdiction by the City over the Valley View of River Heights First Addition. SUMMARY OF DISCUSSION AND FORMAL ACTIONS TAKEN: Chairman Madsen called the meeting to order and asked if there were any corrections or additions to the minutes of the September 12, 1974 minutes. Ms. Cain suggested that the words "to not recommend" on page 1, second paragraph, and on page 3, fourth paragraph, be changed to read "not to recommend". Dr. Ogesen suggested that the third recommendation on page 1 and the sixth paragraph on page 4 be changed to read: "... the ten feet of the Capitol Street right-of-way .". A motion to approve the minutes as corrected was made by Dr. Ogesen and seconded by Ms. Cain. The motion carried unanimously. A-7401. Voluntary annexation request made by Gordon Russell for tract of land east of Highway 218 and west and south of old landfill (see location map). Date filed: 8/16/74. 45 -day limitation: 9/30/74. A motion was made by Dr. Ogesen and seconded by Ms. Cain to recommend to the City Council approval of the voluntary annexation request made by Gordon Russell for a tract of land east of Highway 218 and west and south of the old landfill. Mr. Jay Honohan, attorney representing Mr. Gordon Russell, spoke in favor of the annexation and indicated that the proposed property would seem a desirable location for a car crusher operation because of its obscurity from public view and because it would not result in any adverse effects upon adjoining property owners. Ms. Larew questioned why the petitioner was asking the City for annexation and rezoning instead of requesting the County for rezoning. Mr. Honohan anticipated that rezoning would old for Mr. Honohan stated that his client is not anticipating a need for water or sewer for approximately the next five years but when the need would exist, it would be at Mr. Gordon's expense. It would be expected, he said, that there would be a tapping fee if at some future time it would be necessary to tap onto the trunk sewer line in southeast Iowa City. Ms. Cain indicated that she had some reservations about the existing provisions of Ml and M2 zones and noted that problems have previously been encountered with the mixture of uses permitted in M1 and M2 zones. She stated that she would prefer to defer a decision on the annexation and rezoning request until the City Staff has had an opportunity to consider a revision of the M1 and M2 zoning provisions. A vote taken on the motion to recommend approval of the voluntary annexation carried 4-1 with Ms. Cain dissenting. Z-7418. Request made for M2 zoning in conjunction with annexation request. Date filed: 8/16/74. 45 -day limitation: 9/30/74. It was moved by Dr. Ogesen and seconded by Mr. Henry to recommend to the City Council that the tract of land east of Highway 218 and west and south of the old landfill previously recommended for annexation be zoned as follows: the westerly 300 feet of the tract be zoned Ml, with the remainder of the tract zoned M2. Ms. Mary Neuhauser, Chairman of the Iowa City Riverfront Commission, indicated that the Riverfront Commission recently passed a motion to endorse the September 26, 1974 Staff Report if appropriate screening were provided between the operation and adjacent properties. Chairman Madsen stated that while adequate screening in the Ml zone is of great interest to the Commission, screening by itself is not a condition of zoning. Noting that a lake resulting from the sand and gravel operations, which is of particular interest to the Commission for recreational purposes, is outside the City limits, Ms. Cain said the City would be unable to screen against County land. If the lake is ever annexed and rezoned to residential use, however, the City could require screening within six months after the development had started. A vote taken on the above motion carried 4-1 with Ms. Cain dissenting. Chairman Madsen asked if there would be a problem with the location of the sanitary sewer. Don Schmeiser, Associate Planner, stated that the location of.sanitary sewers located along rear property lines presents a problem with access to manholes when a line is plugged. Chairman Madsen stated that the Commission would be interested in receiving a recommendation from the Department of Public Works and/or the Planning Division in regard to the location of sanitary sewers. A motion was made by Ms. Cain and seconded by Dr. Ogesen to recommend to the City Council approval of 5-7414, Washington Park Addition, _Part 91 Preliminary Plat, leaving the right-of- way for Green Mountain Drive as 60 feet. The motion carried unanimously. 5-7415. Valley View of River Heights, First Addition, Johnson County, Iowa. Located on north edge of River Heights area. Preliminary and final .plat. County referral. Date filed: 9/3/74. 45 -day limitation: 10/18/74. Mr. Bill Tucker, attorney representing Valley View of River Heights, First Addition, spoke in favor of the proposed sub- division and.explained that there is some question as to the extent of jurisdiction by the City over this plat. A motion to ask the City Attorney for an explanation of the extent of jurisdiction by the City over Valley View of River Heights, First Addition, was made by Mr. Henry and seconded by Dr. Ogesen. Ms. Elisabeth Foxley, architectural historian for the State Historic Preservation Program of ,Iowa, told the Commissioners that her off ice'would�be willing to help identify buildings and neighborhoods worthy of preservation. The motion carried unanimously. Commissioners voted to initiate consideration of rezoning the following areas. (It was pointed out that the following motions do.not commit the P&Z Commfission to rezoning, but to consideration_of rezoning.) It was moved by Dr. Ogesen, seconded by Ms. Larew, to initiate considerationof rezoningfrom R3A to R2 the thirteen (13) lots in the Kauffman and Summit 11ill Additions located along and adjacent to the intersection of South Summit Street and East Court Street south of Burlington Street. It was moved by Dr. Ogesen, seconded by Mr. Henry, to initiate consideration of rezoning from R3A'to R3 all lots on both sides of Governor Street from Burlington Street to Bowery Street and one (1) lot east and one (1) lot west of northern corner lots at Governor and Bowery Streets except corner lots on southwest and southeast corners of Burlington and Governor Streets. It was moved by Ms. Cain, -seconded by Dr. Ogesen, to initiate consideration of rezoning from R3A to R3 all lots on both sides of Governor Street from Bowery Street to CRI&P RR and including the following described parcels: the two (2) lots east and west of the southeast and southwest corner lots respectively at Bowery and Governor Streets. It was moved by Ms. Larew, seconded by Ms. Cain, to initiate consideration of rezoning from R3A to R3 all lots on both sides of Dodge Street from Burlington'Street to CRI&P RR except lots fronting on Burlington Street. Each of the above motions carried unanimously. Z-7417. Amendment of Zoning Code to apply high-rise provisions to CBS Zone. Council referral: 8/8/74. Deferred by Planning and Zoning: 8/22/74`-- 9/12/74. Chairman Madsen indicated that the amendment of the Zoning Code to apply high-rise provisions to the CBS Zone will be considered at the next P&Z meeting, October 10, 1974. Don Schmeiser indicated that..the City Council had requested a joint P&Z meeting to be: held October 8, 1974 at 4:00 p.m. for the purpose of discussing the rezoning of the Streb-National By -Products' property to a PC Zone. The general areaof the nei'g.bo..rhood hasz_ beendeveloping ing along the lines of Ml and M2 uses with -the-exce tion of the.'Johnson Mobile Home Court and two or three residential uses which :existed prior`to-their annexation by the City in 1965. The site has a very adequate'4=land .highway; facility to the west, and a railroad line is located,,west,,of the sitealso. Although not presently served by water and `sewe facilities (it is outside the City), these would be available upon' annexation at *the - cosV.-of the developer. (The proposed use does not require water and-sewer, at this:time.) The critical question now:under: consideration-is the proposed use, that of a car-crushing operation. The Petitioner has from the beginning explained to the City staff and commissions that -the intended use was the car-crushing operation. This is the "sole reason for the _M2 request since this is the only zoning classification which would allow this use. No other uses, except the uses the land-is presently being used for,>are contemplated. We also recognize that the car-crushing operation is regarded as a junk yard (although we might feel otherwise). Kraft, Acting City Manager Comments on Draft Environmental Impact Statement for V.A. Ramp The EIS generally displayed a lack of adequate referencing or footnoting. In the review of this statement, the Council found it necessary to research other re- ports in an attempt to develop.supporting information for the statement. The City Council also questioned whether the VA would have a greater need for parking facili- ties beyond the year 1980. If there would be an increased need beyond this year, it is requested that this information be included in the Environmental Impact State- ment. The statement also did not provide adequate discussion for the percentage of the VA work force which actually has access to mass transit by virtue of residence in the Iowa City metropolitan area. It is recognized that some of these people would be working on shifts when transit would not be available; however, the state- ment generally failed to address this point. Additional information is desired on this subject. The statement also did not adequately treat the use of alternative means of transportation other than the private automobile. The statement also did not pro- vide adequate differentiation between employee parking needs and visitor or patient parking needs. It is recognized that a very high percentage of patients using the hospital and visitors are from outside of the Iowa City metropolitan area; however this is not the case of VA employees. From information presented in the draft EIS, it is indicated that approximately 77% of the work force has access to mass transit. In order to more adequately ana- lyze this particular statistic, it is necessary to determine the breakdown by shifts of the number of employees working at the VA facility. There is also a need to correlate this with the hours of transit operation of the various systems. The third paragraph on page 3 of the Environmental Impact Statement (EIS) describes the area served by the Iowa City VA station; however the statement fails to mention how many persons are from the various parts of this service area. This deficiency should be addressed by the EIS.` In the first paragraph on page 4 of the EIS there is a discussion of the necessity for the construction of a new boiler plant and a modification to the existing physical plant in order to provide for central air conditioning and to pro- vide a simple chilling structure. The EIS fails to mention whether the aforemen- tioned facilities are movable. This should be done. In the first paragraph on page 7 of the EIS the minimization of adverse environ- mental impacts are discussed.' It is stated that these will relate primarily to planning and aesthetic considerations which will minimize the visual impact of the structure and which will enhance the "perceived aesthetics." The statement should more fully express what the proposed design will do in order to minimize the adverse In the second paragraph on page 8 of the Statement, there is also a discussion relative to measures which could be taken in order to eliminate the discharge of particulate matter in the storm drainage system, and subsequently into the Iowa River. This statement indicates that measures which could be taken would include the provisions for appropriate French drains and sediment traps within the drainage system. Will these actually be installed, or is this merely a possibility which may or may not come into fruition? A direct response to this question should be provided. In the last section on page 8 of the statement, there is some mention made of the alternatives to the proposed action which were considered. It would seem more appropriate that this list directly relate to all of the alternatives which are found starting on page 95 of the Hansen, Lind, & Meyer report on the proposed ramp. Starting on page 8 of the statement, there is some discussion of eleven factors which were analyzed relative to the construction of this facility. There is some question as to whether the factors were weighed equally although it appears this is not the case. If they were not this should be specifically mentioned and incorporated in this section which begins on page 8 of the statement. The Hansen, Lind, & Meyer report on this facility indicates that site 6 was chosen as the most feasible location for the proposed ramp because it was more accessible to visitors. In other places in this report, it indicates that this site is more desirable because of favorable location relative to use by employees. There seems to be some discrepancy here whether the ramp is proposed to be constructed primarily for visitors and patients or for _employees. If.it is for the employees the utilization of mass transit should figure in here and should have some impact on the necessity for con- structing an employee facility of this size at this particular location. In Exhibit A of the EIA a summary of parking needs is presented. This exhibit includes parking requirements for three different out-patient levels (60,000; 80,000; and 95,500 out-patients). The EIS presents no backup material relative to how these numbers were determined. This information should be provided. It is also desirable that the EIS make some mention of the impact of this proposed ramp on the traffic circulation system in the vicinity of the west campus of the Uni- versity. In the last paragraph on page 7 of the EIS, there is a statement that "adequate parking will also reduce the number of "hunters" looking for parking spaces around this facility." Backup information is needed here to determine the extent of this problem. No factual data is presented to substantiate this position. On page 95 of the Hansen, Lind, & Meyer report the graphic indicates that sites 5 and 6 are favored to best provide for visitor parking; however, the accompanying narrative appears to make this point invalid. It would appear as though either site 5 or site 6 would likely become employee parking in the future. The EIS also gives no assurance of coordination with the activities of the Uni- versity of Iowa in this area, specifically as relates to the creation of a pedestrian - oriented campus. Documented statements from the University of Iowa relative to their future construction plans should also be included as a part of this statement.
