PROGRAM.
THE SPECIAL POPULATIONS INVOLVEMENT
WHEREAS, there exsits a need within the City of Iowa City, Iowa for a
community based recreation program for handicapped individuals, and
WHEREAS, the Special Populations Involvement Program is a tentative pro-
gram addition to the current recreational services provided by the City of Iowa
City, Iowa, intended Lo provide recreation services to a segment of the popula-
tion of Iowa City, Iowa, that currently are not receiving such services.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA, that
it endorses the Special Populations Involvement Program in its efforts to
provide recreational services to the handicapped citizens of the City of Iowa
City, Iowa.

WHEREAS, the Ordinances of the City of Iowa City, Iowa,
provide that the City Council may establish or remove stop
signs at designated intersections in Iowa City, Iowa, by Resolu-
tion, after determination that it is in the public interest
to establish or remove said stop signs, and
WHEREAS, the City Council of Iowa City, Iowa, has deter-
mined that it is in the public interest to establish stop signs
at the following intersections:
Four-way stop sign at the intersection of Dubuque Street and
Burlington Street until such time as the traffic signals are
installed under the Burlington St. Project.
WHEREAS, the City Council of Iowa City, Iowa, has deter-
mined that it is in the public interest to remove stop signs
at the following intersections:
none
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF IOWA CITY, IOWA, as follows:
A) That stop signs are hereby established at the following
intersections:

B) That stop signs are hereby removed at the following
intersections:

C) That the City Manager is hereby authorized and directed

cels will be released as they become available. The entire contract is intended to '
be completed by 180 calendar days after the first Notice to Proceed is issued.

AGREEMENT

referred to as the City and Powers -Willis and Associates

Consultant.
NOW THEREFORE, it is hereby agreed by and between the parties hereto
that the City does hereby retain and employ the said Consultant to act for
and represent it in all engineering matters involved in the terms of this
Agreement. Such contract of employment to be subject to the following terms
and conditions and stipulations, to -wit:
1) Consultant shall not commit any of the following employment
practices and agrees to prohibit the following practices in any subcontracts.
a) To discharge from employment or refuse to hire any individual
because of his race, color, religion or national origin.
b) To discriminate against any individual in terms, conditions
or privileges of employment because of his race, color, religion or
national origin.
2) The Consultant shall assist in the preparation of notice to
contractors and shall provide assistance in the preparation of plans and
specifications for prospective bidders, if any construction be the end
product of this Agreement. It is further agreed that the end product of
this Agreement shall be determined at the time of signing of this Agreement
and entered hereon. The endproductof this Agreement is agreed to be and
include, to -wit:
a. Run a base traverse loop or loops as follows:
1. Willow Creek --approximately 5 miles of traverse marked by
approximately 30 permanent monuments.
2. Ralston Creek --approximately 14 miles of traverse marked by
approximately 60 permanent monuments.
b. Permanent monuments will be set within the existing street right-of-way,
and will consist of a 5/8" iron rod set in concrete.
c. Base traverses will begin and terminate at existing points on the State
Plane Coordinate System.
d. Closures of the base traverses will be not less than 1/10,000.
e. The traverses will be adjusted and coordinates computed for each traverse
point. Coordinates will be based on the State Plane Coordinate System.
f. Approximately 18 horizontal control points in the Willow Creek area and
approximately 49 horizontal control points in the Ralston Creek area
will be tied into the base traverse, at a closure to be not less than
1/3000.
g. Coordinates will be computed for each horizontal photo control point.
h. Elevations for approximately 68 vertical control points in the Willow
Creek area and approximately 21 vertical control points will be obtained.
i. Elevations will be based upon the U.S.G.S. datum.
J. All work will be under the direction of a Registered Land Surveyor.
Said description to be referred to hereafter as, "The Project".

5) Should the City abandon the Project before the Consultant shall complete
the work contemplated by this Agreement, said Consultant shall -be paid on the -
basis of direct hourly rates as herein attached for the various classes of
personnel actively engaged_on the, project for all work completed and for all
work and services performed up to the time of termination. It is further agreed
that upon 30 days notice, either party may terminate this Agreement, but such
termination does not indicate or release either party from any rights or legal
actions they may have as a result of such termination.
6) This Agreement and each and every portion thereof shall be binding upon
the successors and the assigns-of.the parties hereto. Provided, however, that
no assignment shall be made without the written consent of all parties to.said
Agreement.
7) It is understood and agreed that the employment of the Consultant by
the City for the.purposes of said Project shall be exclusive, but the Consultant
shall have the right to employ such assistants as may be required for the
performance of the Project. Said Consultant shall be responsible for the
compensation, insurance and all clerical detail involved in their employment.
8) The Consultant, upon request of the City, hereby agrees to furnish a .
resident project representative in order to provide more extensive representation
at the Project site during the construction phase. Upon completion of any
construction, said Consultant shall furnish said City with a complete set of
plans showing the final construction as recorded by the Consultant's resident
project representative. Said plans shall be mylar sepia and shall become the
property of the City. Should the City perform the resident engineering, the
Consultant shall furnish the original tracings as aforementioned except the City
will make the necessary changes to reflect the project as constructed.
Through the more continuous on-site observations of the work in progress
and field checks of materials and equipment by the Resident Project Representative
(if one is to be furnished) the Consultant will endeavor to provide further
protection for the City against defects and deficiencies in the work, but the
furnishing of such resident project representation shall not make the Consultant
responsible for the Contractor's failure to perform the construction work in
accordance with the Contract Documents.
b) Keeping a daily record or log of the contractor's activities
throughout construction of the Project, including notations on the nature
and cost of any extra work. Any extra work will be authorized by the City
Engineer prior to commencing the work.
c) Supervision of inspectors, proportioning engineers and other
technical personnel.
d) Revision of contract drawings to show location and nature of
improvements as actually constructed.
e) Reviewing and checking all
equipment and materials tested.

said Project.
10) Consultant further agrees to furnish the City with a list of all
employment positions expected to be required to perform resident engineering
pursuant to this Agreement including the hourly rate of pay budgeted for
such employment.
11) It is agreed by the City that all records and files pertaining to
information needed for said Project will be made available by said City upon
request of the Consultant. The City further agrees to furnish all reasonable
assistance in the use of these records and files.
12) It is further agreed that no party to this Agreement will be required,
nor will perform -contrary to any State, Federal or County law or any of the
Ordinances of the City of Iowa City, Iowa.
13) It is further agreed that in the event of any disagreement as to the
meaning or scope of this Agreement that cannot be worked out to the mutual
satisfaction of both parties.concerned, the disagreement shall be referred to
a three member Arbitration Panel with one member selected by the City, one
selected by the Consultant and`the third to be selected by the two Arbiters.
Each party will be finally and fully bound by the decision of the Arbitration
Panel and said panel shall have full authority to allocate the costs of such
arbitration between the parties. Nothing herein shall be construed as
preventing subsequent appeal to a Court of law from the decision of the
Arbiters but such costs and expenses of said appeal shall be borne by the
appealing party.
14) The Consultant shall assist and where reasonably required by the
attorney for the City or the Manager of the City, be present for any
preparation of, letting or analysis of contracts dealing with said Project.
Any requirements made by the above named representatives of the City shall
be given with reasonable time to appraise the Consultant so that he may
attend. Such requests shall be made in writing to the Consultant.
15) Said Consultant shall exercise general services in the administration
of all construction contemplated by the Project.
16) The Consultant agrees to furnish, upon termination of this Agreement
and upon demand by ,the City, copies of all basic survey notes and sketches,
charts, computations and any other data prepared or obtained by the Consultant
pursuant to this Agreement, without the cost and without.restriction or
limitation as to their use.
17) Consultant agrees to furnish all plans of engineering with the seal of
a professional engineer affixed thereto where such seal is required by law.
19) Should any section of this contract be found to be invalid it is
agreed that all other sections shall remain in full force and effect as
though severable from the part invalid.
20) The City agrees that should said City require any changes in the
basic project as described herein, after the plans and specifications have been
approved by the City, the City will pay said Consultant on the basis of direct
hourly rates as herein attached for the various classes of personnel actively
engaged on the project'. Said changes, after said final approval being described
in a written Agreement signed by all parties or their representatives that are
parties to this Agreement. Said Agreement as to changes shall definitely and
distinctly refer to this Agreement and incorporate same by a reference therein.
It is understood that "changes" is defined to mean a basic change in the description
or intent of the Project as hereinbefore described.
21) The City further agrees that should said City extend the completion
date beyond the date specified'herein,'the Consultant shall be entitled to
receive his actual costs incurred beyond such limit.
22) Actual cost for the purpose of this contract shall be defined as
materials cost, plus actual payroll cost, social security and retirement deduction.
Said Consultant shall, upon demand, furnish receipts therefore or certified copies
thereof.
23) All traveling expense incurred while specifically dealing with this
Project by the Consultant shall be paid by the City at actual cost. Said
Consultant shall, upon demand, furnish receipts therefore or certified copies
thereof.
24) The City hereby agrees to pay for the services stipulated herein on the
basis of the following fees
For field surveys, setting monuments and making required computations,
a fee based upon 2.0 times the direct personnel payroll expense, which
is in accordance with the schedule attached.
All other expenses will be based upon the actual cost incurred by the
engineer.
The total fees for the work as described shall not exceed $7,750.

on several occasions over the last 12 years,,I am quite sympathetic
to the concerns of many other citizens about this problem.
I do feel, -it is important to' point out at this time that there
is no simple solution to the Ralston Creek 'problem. Some people seem
to feel that some dredging of the channel:in a.limited way will solve
the problem. This overlooks, in my opinion, the magnitude of the creek
problem. If you will examine the only detailed report on this aspect
of the creek solution, the Ireport done by the Corp of Engineers in
1966, you will see that to` control thezflooding by improving the channel,
the Corp of Engineers ,predicts the need fora 40 foot wide channel
on the main channel at the bottom of.the creek. This would mean an
even wider channel at the top of -the creek. They also suggest 20 to 30
feet widths on the north and south forks.
Such an improvement;,,if the.corp'.s figures are correct, would
mean that it would `be'necessary-`for the City'to acquire a substantial
amount of real estate frori`,private property.owners along the creek,
a solution that I am not sure many people along the creek realize
may be necessary or:are willing to agree to

Said approval shall be subject to any conditions or restrictions hereafter

BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA, that the applications
be granted and the cigarette bond now on file in the office of the City Clerk be
and the same are hereby approved, and the City Clerk be and he is hereby directed
