Ralston 'Creek -problem
Dear Mayor Czarnecki & Council Members:
Due to certain conflicts, I am unable to attend your meeting on
the above. As you,know,jam personally quite concerned about the
Ralston Creek problem and since I expect it will be discussed, I am
writing this letter.
As a homeowner wh-. has personally cleaned up after the problem
on several occasions over,the last 12 years, I am quite sympathetic
to the concerns of many other citizens about this problem.
I do feel it -is impo . rtant to point out at this time that there
is no simple solution to the Ralston Creek problem. Some people seem
to feel that some dredging of the channel in a limited way will solve
the problem. This'.overlooks in my-opInion, the magnitude of the creek
problem. If you will examine the only detailed report on this aspect
of the creek solution, the report done by the Corp of Engineers in
1966, you will see,thatto control the flooding by improving the channel,
the Corp of Engineers predicts1the need for a 40 foot wide channel
on the main channel at the bottom of the creek. This would mean an
even wider
channel -at thetop of :the creek. They also suggest 20 to 30
feet widths on -the north.and south forks.
Suchan improvement, if the corp's figures are correct, would
mean that it would be'necessaryjor the City to acquire a substantial
amount of real-estate from private property owners along the creek,
A solution thatI am not sure many people along the creek realize
may be necessary or are..willing to agree to.

Further, the`Corp,has accurately.stated_that bridges and culverts
belonging_to the City and.. to the;Rock,Island,Railroad;will also have to
be widened. There:is data on file ins the City's, Public Works Department
on the flood of;,
July 17,-1972, to,'support'this conclusion, and it has
long been recognized by the.Public Works Department and City administration.
The Corp,`s estimate of the' _,cos t of the.project was $3,200,000 plus
in 1966. This--did'-not include'work•needed in what was then designated as
the R-18:-Urban`Renewal Project area. 'Based ,upon rising costs, I am
certain that this 'figure .must be increased at least 25% or more if it was
to be done at this;
-time.
I submit this letteronly in an effort to point out to the Council
that: -
1. -Thereis no inexpensive short range answer to
this problem.
2. That the final solution whatever it may be
will involve_a'great deal of.money.-
3: >'That hopefully the Council will agree with
me that there are many things,'that need to
beexplored and. done.
I would submits however, that there needs to be considerable attention
given to,this'problem byvthe Council and the'-staff and that as I have stated
before, I feel_that the Council:has not given the problem the consideration
it has deserved',in.the past

We should like to urge the Council. members to try to obtain whatever federal
funds maybeavailable to t$e City of. Iowa City from the Rousing and Community
Development Act of 1974 and to apply a large portion of those .funds to the
improvement and expansion of the city's highly inadequate sewer system.
The installation.and .Mai nte-pance of a sewage system is one of the largest and
most basic services that'a governmental unit provides all of its citizens and
therefore it should have'=top""pr,iorty when :funds from any source are allocated
and apportioned.
There is no dispute between the Council and the citizens that Iov,ra. City's
sewer systems, presently at inadequate; thit has been for. many years, and that
_
it presents a health hazard to the community because of its extensive sewage
backups into homes and businesses and because of the pumping and. overflow of
sewage into yards and public streets.
For years the citizens have been told that',the main problem ha.s been the lack
of funds -for ar comprehensive -server •project. -Ohe Housing and Community Devel—
opment Act of 1974 might, solve that:'problem for us if we will intelligently
and diligently apply for the funds it offers.
nonetheless, while vie await a reply<:from'the federal government, we should use
whatever available local and -.state funds vie have -to improve and maintain the
sewer system properly iriCorder -to reduce the health problems that might occur
in the community as a result.of its.ma"Ifunction.

Dear City Council Members:
The Housing Commission is looking forward to the
development of'62 units of low rent housing for the
elderly that has been funded by the present Section 23
Housing Assistance Payments Program for new construction.
These 62 units barely touch the surface in terms
Of the need for low cost housing. There are cities of
comparable populations that have 200 or 300 units in
operation.
The Housing Commission recommends that the Housing
Authority (City Council) establish the following priorities
for future housing assistance plans or programs.
1. Elderly to include disabled and handicapped.
2. Low income non -elderly families excluding those
whose head of household or spouse are full time
students.
3. Others to include student families.
The Housing and Community Development Act of 1974 (HCD)
requires applicants for grants to provide a three year
community development plan. A part of this plan is the
community's plans for providing housing assistance. To
fullfill the need and follow the priorities noted above
the Housing Commission recommends that as soon as possible
after the HCD 1974 is funded and implemented the Housing
Authority apply for an additional allocation for 100 - 120
units for the elderly. A portion of these units to be
congregate units. This to be followed by 80 - 100 units
for non -elderly. This group to be re -habilitated units
with some provision for home ownership. These recommendations
are minimum numbers for planning purposes.
The HCD 1974 provides an excellent opportunity for each
community to decide for themselves which things should have
highest priority. We believe a decent safe and sanitary
dwelling for all residents of the city should receive first
Priority in the community development plan.
To prepare ourselves and better understand housing
developments, members of the Housing Commission have visited
several cities and viewed their actions in meeting housing
problems.
Cedar Rapids - Geneva Towers, 119 units for elderly.
Non-profit sponsored.
Hawthorne Hills, 202 units for elderly and
non -elderly. 221 D3 financing and non-profit
sponsored. The city administers 220 units
Section 23 leased housing and there are
others in the city.
Ottumwa - Population 29,000, 300 units conventional
Public housing in operation five years.
Burlington - Population 33,000, 201 units conventional
Public housing in operation four years.
These are pointed out as specific examples of communities
that have taken positive action. The programs under which they
built their units are no longer in existance. They did not
succeed by sitting back and re -studying the problem.
The continuing increase in cost of housing, food and other
necessities of life is most crunching on the low income elderly,
handicapped and disabled. The Housing Commission urges all the
residents of this fine city to join with us in meeting our
responsibilities to see that this group is provided with housing
within their financial needs.
In closing it is pointed out that both Burlington and
Ottumwa have established Low Rent Housing Agencies (Housing
Commissions) which act as the Housing Authority. Here in
Iowa City the Housing Commission only makes recommendations.
Regardless ofwho is the Authority we need housing assistance
in Iowa City now. We ask the City Council and all the residents

Dear Customer:
We filed amended electric and gas rate schedules with the
Iowa State Commerce Commission in conjunction with the proceedings
of Docket u-483 on September 20, 1974. These new rates are
designed to produce approximately 3.0 percent (or $1,625,000)
of additional annual gas revenue and 7.8 percent (or $3,660,000)
of additional annual electric revenue. We have asked the Commission
to permit us to put the new rates into effect on October 31,
1974.
The amount of the proposed increase depends upon the type
of service (residential, commercial or industrial) and the amount
of electricity and gas you use. On the average, the rates we
have filed would increase the price for residential customers
using electricity by about $1.48 per month, or ab$Ot38 , per month,
and for residential customers using gas by
or 2 percent. The electric increase applicable to most commercial
and industrial customers would be about 8 percent, and the gas
increase from about 2 percent to 3 percent.
The Company's costs of providing electric and gas service
have continued to rise under increasing pressures of inflation,
increasingly demanding environmental standards, and continuing
gas supply problems. It is necessary for us to seek increased
revenues through higher rates to reversethe

earnings to enable us to meet the heavy
ted with providing for present and future service requirements of
our customers.
If you have any questions or want additional information about
the proposed increase, please contact our business office (telephone
338-9781) and we will be happy to help you.
We expect the Iowa State Commerce Commission to hold a
public hearing to consider our request. You may file with the Commis-
sion (Valley Bank Building, Des Moines, Iowa 50319) written objection
to our proposed increases and may request that a public hearing
be held to determine if they should be allowed.
We regret having to increase our rates but believe our electric
and gas service will still be among your best bargains.

Dear Mr. Kraft:
The city council recently asked the Johnson County Commission on Environmental
Quality to compare the proposed Open Burning ordinance proposed by the Commission
with similar legislation incorporated in the fire code.
At the meeting of 25 September the commission discussed the matter and
concluded that the following points of difference are both pertinent and
significant:
(1) The applicable section of the fire code relies on citizen complaint
for enforcement. The proposed ordinance makes it the duty of the regular law
enforcement agency, the police. The commission feels very ntrongly that law
1±nforcement nhould not depr;nd on a comflict aituation betwenn citizenn.
(2) The proposed ordinance from C.E.Q. allows for periods when burning
could be permitted, at the discretion of the city council. It is foreseen
that this might be of advantage in the fall leaf raking period for example, if
fuel for hauling is in short supply.
(3) The inclusion of the regulations on open burning in the fire code
seems to C.E.Q. to be an unlikely place for the average citizen to look for
such regulations. C.E.Q.recommends that the regulations be made a part of
the regular city code and included in the appropriate index.

Thank you for your letter supporting S. 386, the Minish-Williams
Emergency Mass Transit Act.
The bill is back in Conference Committee after having been re-
committed to the House of Representatives. The Conference Committee
will meet later this week or early next week.
I share your support for well funded mass transit legislation and
hope that the Committee will report out a good substantial bill. Unfortun-
ately, in this session of Congress, the Senate will not have the opportunity
to support a comprehensive mass transit bill, more inclusive than
this emergency provision. But funds are urgently needed for the
maintainence and development of mass transit as provided in S. 386.
I am concerned about the future of mass transit legislation because
of Administration opposition. This opposition is strongly mirrored in
the House vote for S. 386. The House opposes such a large part of the
appropriation going to New York City, wanting to spread more of the
funds across the nation, and opposes such a large figure for the total
appropriation in the bill.
I hope that the Congress can act on this mass transit provision
before the end of the session and is able to pass the Conference Committee
bill until more comprehensive legislation can be drafted.

Dear Mayor Czarnecki:
The President asked me to respond to your letter concerning mass
transit legislation now pending before the Congress. Yesterday
evening the President met with a delegation of Mayors, business
and labor leaders, headed by Mayors Alioto, Beame and Daley, on
this subject.
At that meeting, the President again strongly reaffirmed his support
for immediate Congressional action on a long-term, comprehensive
transportation bill which would include limited operating assistance.
This type of legislation was submitted to the Congress in February
by the Administration, and in the President's September 13th Message
to Congress of "must do" bills this session, it was included as a
high priority item.
The House has passed a long-term bill which contains funding levels
at the upper limit of what would be acceptable to the Administration -
$11 billion over six years. There have been companion bills filed in
the Senate since June, but so far, there has been no Senate action.
The President stressed to the Mayors that he could not support a
stop -gap short-term bill primarily for operating subsidies, such as
the Williams-Minish Bill (S.386). Instead, the President refused to
accept any excuses that Congress could not act now on the long-term
bill and promised that he would work with the Mayors for immediate
passage of the long-term transit bill which our nation's cities so
desperately need.
To this end, the President has agreed to meet with a delegation of
Mayors and key Senators next week in an effort to get this needed
legislation.
We remain convinced that if the Senate acts promptly on a long-range
bill, a compromise is possible between the House and Senate and an
acceptable bill can result, which the President would be able to sign.

transit legislation this year.

From information received from our representative at Council meet-
ings, there seems to be quite a bit of misunderstanding relative to
stickers for conventioneers. Our proposal, which was deemed accept-
able by Ray Wells, is as follows:
1. That stickers be good only on the day or days stamped.
2. That we would pay the City 104t per sticker for all
stickers issued, whether used or not.
3. That stickers would be good in any parking area, in-
cluding on street meters.
This is a common practice in all cities we know of, where conventions
are held and is done primarily as a public relations gesture to make
the convention people feel they are being treated in a first class
manner by the City.
It appears to us that the City will be more than adequately compen-
sated for parking spaces used under this system.

Hot Mix Resurfacing of Summit Street
Attached is a Memo from George Bonnett to Ray Wells with
an explanation of our criteria for resurfacing streets.
At the time of the survey, Summit Street from Kirkwood
to Burlington was designated as a "B".street; however, recent
observation of this street indicates it should be reclassified
as an "A" since it is presently disintegrating under warm
weather traffic and will present a_particular maintenance
problem this winter. .I am recommending we resurface Summit
Street to the extent of the funds available, which would allow
us to,resurface from Burlington to Bowery and from the railroad
bridge on south ,to Kirkwood.
I had originally anticipated that approximately $30;000 -
would be available for hot mix resur acing; however, final
cost accounting reveals that $eTIMO will be available. This °pO
will be the approximate cost of the above mentioned resurfacing
on Summit Street and this explains why we are not doing the
entire street._
I might mention that Burlington from Summit to Muscatine
was categorized as a,type "D" street which suggests the street
is structurally sound, although it is rough to ride.
The suggestion was also made at the last Council meeting
that Linn Street be resurfaced and I would have to agree with
this recommendation, but in light of the limited funds available
this fall, I would suggest that it be deferred until the
resurfacing program begins next Spring. '

Resurfacing Selection Procedure
The purpose of this Memorandum is to provide information
for response to a citizen inquiry concerning our procedure
for selecting streets to be.included in the resurfacing
program. The following procedure was followed:
1. All citizen complaints concerning rough roads
have been placed into a file during the latter
part of 1973 and the early part of 1974.
2. The Street Superintendent prepared a list of all
streets which he felt were in need of resurfacing.
3. The two lists were combined and placed according
to their functional classification of arterial,
collector and residential.
4. Each street was inspected by the Acting Director
of`Public.Works along with the Assistant to the
City Engineer. During this inspection the street
was assigned a letter designation as follows:
A - Street surface will in all probability
become unserviceable during the winter of
1974/1975
B - Street in need of repair, however, will
in all probability remain serviceable
with heavy -maintenance during the winter
of 1974/1975
C - Street surface rough and.in need of surface
repair, however, structurally adequate to
last through the winter of 1974/1975
D - Street surface'in need of repair, however,
in all probability adequate to last through
the winter of 1979/1976.
5. A cost estimate was then made and checked against
the available monegs from the Road Use Tax Fund.

7. A recommendation was prepared as to what streets were
to be resurfaced to fall inside the confines of the
financial perameters. The City Manager, Acting Director
of Public Works and the Assistant to the City Engineer
then drove each of the streets included in this program.
8. After approval of the City Manager, plans and specifications
were prepared for Council approval.

BICYCLE TRAILS AND PEDESTRIAN WALKWAYS
Under the Federal Highway Act of 1973, a federal grant program
has been initiated whereby the acquisition and development of bicycle
trails and pedestrian walkways could be funded 70 percent by federal
monies.
The essential criterion is that any proposed bike trail or
pedestrian walkway be located in logical contact with a federally -
funded primary, secondary, or urban system road. In the case of
primary roads, any bike trails or walkway projects must be completed
within existing rights-of-way. However, in the case of the other
two categories, trails may be developed outside of the normal rights-
of-way. The reasoning is that_ the proposed trails excompass bicycle
or pedestrian traffic that would normally utilize federally -funded
secondary or urban system roads..,
The Iowa Conservation Commission is the reviewing authority
for these projects.
This is a very new program and one in which there will un-
doubtedly be some holdups.in;implementing. If you are aware of

On October 22, 1974 at 10:30 a.m. at the Des Moines Area Community

PROPOSED RULE CHANGES FOR LANDFILLS

Area counties and communities have probably received a Notice
of Public Hearing from the Iowa Solid Waste Disposal Commission.
On October 22, 1974 at 10:30 a.m. at the Des Moines Area Community
College Building 24, Ankeny, Iowa, regarding revision of Sanitary
Disposal Project Rules.
The proposed rules suggest the following changes:
I. An annual permit will be required.
2. Local Governments and private industries will be re-
sponsible for closing of all non -permitted landfills.

Guarantees of on
site equipment availability will be
required.

Two attendants are
required
to be on duty.
8. Additional measures are required for storage of solid
waste arriving during closing hours.
9. And a permit system for composting operations will be
required.
HOUSING AND COMMUNITY DEVELOPMENT
The Housing and Community Development Act of 1974 has been
signed into law. It is a comprehensive act which changes many of
the old HUD Programs. The areas covered by the Act are:
Community Development (Title I)
Assisted Housing (Title II)
Mortgage Credit Assistance (Title III)
Comprehensive Planning (Title IV)
Rural Housing (Title V)
Mobile Home Construction and Safety Standards (Title VI)
Consumer Home Mortgage Assistance (Title VII): and
Miscellaneous (Title VIII)
HUD is now drafting and publishing the guidelines which will
put this law to work. Funds for some of the program titles will
become available on January 1, 1975.
More information on this program will be published in the
Newsletter as it becomes available.

This letter will serve as authorization for the Bicentennial
Flag Presentation, sponsored by the Johnson County American Revolu-
tion Bicentennial Society, to be held Sunday,_October 20, 1974.
As per your, application and communication with the City's Director
of Community Relations,`you will be barricading a portion of Clinton
Street between Court and Harrison Stroets during the ceremonies,
leaving adequate access to the Johnson County Courthouse for emer-
gency vehicles and to the Post Office.
You indicate in your description of this event that a hot air
balloon will be stationed on Clinton Street between the barricades.
It should be brought to your attention that the balloonist must have
a permit in order to land within the City limits other than on
Airport property and to fly above the City limits. Howaver, if the
balloon will be brought in by truck and not launched from the Clinton
street site there will be no permit required.
If we can be of further assistance, please feel free to contact
my office.

Re: Budget Discussion
Among the items to be discussed at the Council work session of
October 7 should be the operation of the transit system and the
financial consequences of;the continued deficit in this activity.
In preparing for such a discussion the attached schedules were
developed to give a*financial perspective of the system to date.
After reveiwing this data it would be my recommendation that
we once again put forward to the Council a proposal for an increase
in the fare structure to `twenty-five (25) cents effective January 1,
1975. In making this recommendation the following points have been
considered:
1. Costs for the operation of the system continue to
advance faster than our ability to manage adequate
funding without impairing the financial support of
other activities in the Transportation Program.
As the schedules indicate, it will take $55,861 in
property tax in 1974 to make up the deficit from
operations when only $26,993 is available. This problem
will increase during ,the first 6 months of 1975
because the tax .levy is fixed, and will put increased
pressure on . available balances. An increase in
revenue'production would eliminate this particular
situation for the short run and would begin to reduce
the fund balance deficit that now exists.
2. The Council has plannedan additional expansion of the
system and has applied for federal aid to assist with
such expansion. For equipment acquisition alone,
the local share of the capital cost will be at least
$65,000 which so far has not been identified. In
addition, future operating deficits are predictable to
a degree that an additional tax levy over 30 mills will
be required in.fiscal year 1976 to support the level
of service anticipated. It would seem desirable to
require fare paying passengers to take a greater
equity position in supporting future operations.
3. In considering the effects of a fare increase we have
concluded that no decrease in, ridership below the
1,500,000 rides anticipated for 1974 would take place.
At 25¢, an additional $150,000 could be generated on
an annual basis under this assumption. When balanced
against the current and anticipated cost of operation;
and the present rate of inflation, this increase
does not seem out of line'. It should be pointed out
that the cost per passenger has increased from 27�
in 1972 to a projected 36� for the first six months of
1975 without a corresponding increase in the 1971
ratio of passenger revenue to costs. Maintanance
of the same ratio would indicate a fare of 24�.
To lessen the burden of this increase and those of fixed
income it would be our suggestion that consideration be given to
providing free rides to persons over 65 between the hours of
10:00 AM and 2:30 PM. I'm sure the Chamber will continue the
Ride 'N' Shop program at;the higher rate thereby providing additional
support to those dependent on the bus for shopping purposes.
Other means can be considered and we could explore them with Steve
if appropriate.

Longer range proposal: not necessarily delayed until
receipt of funds under Title I
It is proposed that the City of Iowa City in its three year o9mmunity
development plan proposed under Title I of the Housing and ComMunity Develgp-
ment Act of 1974, include a three year study and experimentation related to the
means and effectiveness of involving the citizens of the City in hose policy
issues of city administration which affect tie citizenry most directly. Special
emphasis shall be upon involving citizens of low and moderate income categories.
It should include but not be limited to:
a. An analysis of present practices:

and management personnel, with particular reference to the weight of
technical expertise and consumer participation in the choice of policy.
