HomeMy WebLinkAbout1973-11-27 Ordinance• 16° ORDINANCE NO. 73-2695 AN ORDINANCE AMENDING THE MUNICIPAL CODE OF IOWA CITY, IOWA, BY ESTABLISHING A COMPUTERIZED UTILITY BILLING "SYSTEM; REPEALING SECTION 3.18.2; REPEALING SECTION 3.18.6; AND REPEALING SECTION 3.18.7; REGULATING THE CLASSIFICATION OF WATER SERVICE USERS; AND -PROVIDING FOR APPLICATION FOR SERVICE AND ENFORCEMENT FOR VIOLATIONS. BE IN ENACTED BY• THE CITY- COUNCIL OF; IOWA CITY IOWA, SECTION I PURPOSE. This purpose of this Ordinance is to establish a computerized utility billing system, repeal Sec- tion 3.18.2, ection-3.18.2, repeal Section 3.18.6, repeal Section 3.18.7, and regulate the classification of water service users and to provide penalties for delinquent charges and services for the health, safety and welfare of the citizens of Iowa City, Iowa. SECTION II AMENDMENT. The Municipal Code of Iowa City, Iowa, is hereby amended by repealing Section 3.18.2, Section 3.18.6 and Section 3.18.7 and enacting the following in lieu thereof. A. Classification of water service. water service shall be divided by user type; residential, commercial/ retail, industrial, governmental/institutional. The Director of Public Works shall determine the alloca- tion for each consumer based on such criteria as rate of consumption, water use, size of meter, etc. Meters on residential service shall be read -quarterly. --Meter readings for other users shall be determined by the Director of Finance. Charges for services shall be - billed monthly based upon estimated and actual readings.. All charges are due and payable when rendered and become delinquent 15 days thereafter. B. Application for Service and enforcement. Application for water service must be made by the property, owner, or -- -- the authorized agent of the owniar, to the Department of Finance stating the location to which water is to be Ordinance No. 73-2695 furnished. Aftergivingreasonable notice, the Department of Finance may discontinue service to any consumer who has failed to pay for water supplied and who has not contested the payment in good faith. Service will not be restored until the property owner, or his authorized agent, has completed payment for all delinquent charges and services. SECTION III REPEALER.- Sections 3.18.2. 3.18.6 and 3.18.7 of the Code of Iowa City, Iowa, and all Ordinances or parts of Ordinances in conflict with theprovisionsof this Ordinance are hereby repealed. SECTION IV SAVINGS CLAUSE. In the event any section,- provision or part of this Ordinance shall be adjudged by an court of competent jurisdiction to be invalid or unconstitutional, such adjudication shall not affect the validity of this Ordinance as a whole or any section, provision or part thereof not adjudged, invalid or unconstitutional. - SECTION V EFFECTIVE DATE. This Ordinance shall be in effect after its final passage, approval and publication as required by law.
