ORDINANCE NO.
ORDINANCE AMENDING THE PLANNED DEVELOPMENT HOUSING OVERLAY (OPDH-5) PLAN
FOR THE PENINSULA NEIGHBORHOOD BY AMENDING THE PENINSULA NEIGHBORHOOD CODE.
WHEREAS, by Ordinance No. 01-3958 the city adopted a Conditional Zoning Agreement and
Preliminary Sensitive Areas Development Plan for the Peninsula Neighborhood; and
WHEREAS, the Sensitive Areas Development Plan included the Peninsula Neighborhood code which
specifies building placement requirements for the Peninsula Neighborhood; and
WHEREAS, The developer has requested amendments to the Planned Development Housing
Overlay (OPDH) Plan for the Peninsula Neighborhood to designate revised locations for Single-Family
houses, Rowhouses, Townhouses, Live Work Buildings and Small Apartment Buildings and to clarify the
language in the Peninsula Development Code, to allow for an increase in height for single family homes,
Live Work units and Small Apartment Buildings, to allow for the location of parking spaces along alleys
and to specify how parking requirements shall be calculated for Neighborhood Commercial uses.
WHEREAS, the Planning and Zoning Commission has reviewed the revised Peninsula Neighborhood
code and Planned Development Housing Oveday Plan and has recommended approval
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF iOWA CITY,

SECTION II ADOPTION OF REVISED DEVFI OPMENT CODE. The revi zed Peninsula Neighborhood
code is hereby adopted as a component of the Planned Development Housing Overlay (OPDH) Plan by this
reference, and the terms and requirements therefore are given full force and eff~ ~ct as if fully set forth herein.
SECTION III VARIATIONS. The following variations from the requirerr ents of the RS-5 zone and
chapter 14-6, Zoning, are approved, as further detailed in the revised Per insula Neighborhood Code,
adopted by reference as a component of this ordinance and attached hereto:
a) A modification of height limits of the RS-5 zone to allow a maximurr height of 35 feet for single-
family houses, townhouses and row houses; 40 feet for Live Work Buildings, 48 feet for Small Apartment
Buildings as detailed in the revised Peninsula Neighborhood Code.

b) A modification to allow the waiver of Section 14-6N~1B(2)(g) restricting the number of parking
spaces that may back onto an alley, if the site plan demonstrates to the satisfaction of the Building Official
that parking spaces are configured so as not to impede traffic on the alley.
c) A modification to specify that off-street parking spaces for Neighborhood Commercial uses are
not required for the first 1500 square feet of floor area as detailed in the revised Peninsula Neighborhood
Code.
SECTION IV ZONING MAP. The Building Inspector is hereby authorized and directed to change the
zoning map of the City of Iowa City, Iowa, to conform to this amendment upon the final passage, approval
and publication of this Ordinance as provided by law.
SECTION V. CERTIFICATION AND RECORDING. The City Clerk is hereby authorized and directed to
certify a copy of this ordinance, a copy of the Preliminary OPDH Plan, and a copy of the Peninsula
Development Code, and record the same in the Office of the County Recorder, Johnson County, Iowa, at the
Owner's expense, upon the final passage, approval and publication of this ordinance, as provided by law.

SECTION VII SEVERABILITY If any section, provision or part of the Ordinance shall be adjudged to be
invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any
section, provision or part thereof not adjudged invalid or unconstitutional.

Re: Peninsula Code Definitions
At the February 3 informal meeting the Council requested clarification of the definition of back
yard. The current definition may be confusing because in the Peninsula Code we do not have
side yards as defined in the zoning ordinance. All open space on a lot, other than the front
yard, is considered the back yard.
To clarify the code, staff recommends that the following definition for back yard:
BACK YARD All unbuilt portions of the lot except for the FRONT YARD.

The following definitions are additions or substitutions to the current list of definitions in the City of Iowa
City Zoning Ordinance for use with this Code. Certain terms in the Code are used in very specific ways,
often excluding some of the meanings of common usage. Wherever a word is printed in SMALL CAPITAL
LEITERS, it is being used as defined herein.
ACCESSORY UNIT
A dwelling unit on a single-family lot incidental to the primary residence and no greater than 650 square feet
in size. (Note: This definition differs from the Definition of "Accessory Apartments" in Chapter 6, Article
B Zoning Dgfinitions of the City Zoning Ordinance).
ALLEY
The open public Right of Way at the rear of lots that provides access to vehicle parking spaces (e.g.,
garages), utility meters and garbage bins. The ALLEY Right of Way is generally 25 feet. (Note: This
definition differs from the Definition of "Alley" in ChaRter 6, Article B Zoning Definitions of the City
Zoning Ordinance. See also COMMON DRIVE.

BUILDABLE AREA
The area of the lot within which buildings will sit. The BUILDABLE AREA sets the limits of the building
footprint now and in the future -- additions must be within the BUILDABLE AREA. This provides for future
growth in a manner consistent with the Peninsula Neighborhood's Quality of Life goals. The BUILDABLE
AREA is illustrated in and set by the BUILDING PLACEMENT STANDARDS. (Note: This definition differs from
the Definition qf "Buildab/e Area" in Chapter 6, Article B Zoning Definitions of the City Zoning
Ordinance).
BUILDING PLACEMENT STANDARDS
The BUILDING PLACEMENT STANDARDS (BPS) establish the basic parameters governing building
construction. This includes the envelope for building placement (in 3 dimensions) and certain
required/permitted building elements, such as porches, balconies and fences.
Civic GREEN, SQUARE
PUBLIC SPACES located within the NEIGHBORHOOD, as designated on the REGULATING PLAN. The CIVIC
GREEN is a primarily unpaved, formally configured, small public lawn or park. The SQUARE may be paved,
appropriate to a more highly trafficked area. Both shall have not less than 60% of their tract perimeter
fronting Rights of Ways and shall be surrounded by canopy STREET FREES. Their tract dimensions shall be
no thinner than a 1:4 ratio, with a minimum tract dimension of 25 feet. Situated at prominent locations
within the NEIGHBORHOOD and often dedicated to important events or citizens, civic GREENS and SQUARES
may contain play equipment but shall not include ball fields and courts.

AN ORDINANCE VACATING PORTIONS OF MADISON STREET, DAVENPORT STREET, AND
BLOOMINGTON STREET RIGHTS-OF-WAY,
WHEREAS, the City of Iowa City has reached an agreement with the University of Iowa to convey the
old Iowa City Water Plant to the University of iowa, including adjacent rights-of-way; and
WHEREAS, portions of Madison Street, Davenport Street, and Bloomington Street rights-of-way,
encompassing approximately 3.62 acres, will no longer be required for City access once the old Iowa City
Water Plant is closed; and
WHEREAS, all other property abutting these rights-of-way is University of Iowa property, and the rights-
of-way do not provide access to any private property; and
WHEREAS, necessary utility easements, well sites, a water storage facility and easements for
emergency vehicle access will be created; and
WHEREAS, there is no City interest in continuing to incur maintenance costs and liability for these
rights-of-way with a closure of the old Iowa City Water Plant.

ORDINANCE NO.
AN ORDINANCE AMENDING TITLE t, "ADMINISTRATION", CHAPTER 5,
"MAYOR AND CITY COUNCIL", SECTION 3, "COMPENSATION" TO ALLOW
CITY COUNCIL MEMBERS TO PARTICIPATE IN THE CITY'S GROUP
HEALTH INSURANCE PLAN AT THEIR OWN EXPENSE.
WHEREAS, the City Council desires to provide members of the City Council with the ability
to participate in the City's group health insurance plan at a council member's own expense and
at no cost to the City; and
WHEREAS, pursuant to state code, compensation of council members must be established
by ordinance; and
WHEREAS, participation in the City's group health insurance plan is a form of
compensation; and
WHEREAS, pursuant to state code a change in compensation becomes effective for all
council members at the beginning of the term of the council members elected at the election
next following the change in compensation.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA:
SECTION I. AMENDMENT. Title 1, "Administration", Chapter 5, "Mayor and City Council",
Section 3, "Compensation", of the City Code is hereby amended by adding a new subsection "D"
as follows:
D. Health Insurance shall be available to a council member on such terms and conditions as
health insurance is available to city employees, except that a city council member's participation in
the city's group health insurance plan shall be at the council member's own expense and at no
cost to the City.
SECTION I1. REPEALER. All ordinances and parts of ordinances in conflict with the provi-
sions of this Ordinance are hereby repealed.

Subject: Health insurance
Today's {2/5/03) Press-Citizen reported that some
Council members wanted us (i.e., the City) to pay for
their health insurance. This would imply an employee
status that does not apply te you. You were elected to
serve as overseers on your own volition; you were not
hired to perform employee duties necessary to Iowa
City municipal operation.
I appreciate your efforts en behalf of the citizenry,
but humbly suggest that you keep your role in
perspective. Get a job with the City if you want the
City to pay for your health insurance. (I see nothing
wrong with major cities providing health insurance to
full-time mayors - if they do.}
