Comment: This project includes repair of flood damaged infrastructure under the Burlington Street (westbound) Bridge and the US Hwy 6 Bridge. The project will include installation of stone revetment to protect the bridge abutment, replacement of retaining wall, replacement of wood guard fence and debris cleanup and seeding. CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON JUNE 16, 2009 ON PLANS, SPECIFICATIONS, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE RIVERSIDE DRIVE FLOOD REPAIR PROJECT [ER-3715(638)--8R-52], DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project includes repair of flood damaged infrastructure along Riverside Drive. The project will include flushing of storm sewer facilities and pavement repair along N. Riverside Drive between Hwy 6 and Park Road. The estimated construction cost is $34,892 and will be funded with $27,914 in Federal Funds and the remainder in Road Use tax proceeds. oq- /9~ 3. CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON JUNE 16, 2009 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE CITY OF IOWA CITY /SHERATON HOTEL PEDESTRIAN WALKWAY IMPROVEMENT JOINT PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: The project will involve improving the exterior pedestrian access easement located at 210 South Dubuque Street, west and south of the Sheraton hotel building. The work includes demolition of the existing walkway and features, and installation of new concrete paving, new and additional lighting, architectural and landscaping elements, and way-finding signage. The goal of the joint project is to improve the safety and aesthetics of the walkway in exchange for the hotel being allowed to lock off the interior walkway upon its completion. The estimated cost is $249,500 and the funding for this project is split 50/50 between the Sheridan Hotel and the City. The City share will be paid from TIF increment revenues in the City University 1 district. f) Resolutions. ~9 ~ 141 1. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST TO A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA CITY AND U.S. BANK, IOWA CITY, IOWA FOR PROPERTY LOCATED AT 1034 CONKLIN LANE, IOWA CITY, IOWA. Comment: U.S. Bank has requested that the City approve a Subordination Agreement for property at 1034 Conklin Lane. On September 8, 1995, the owners of the property received funding from the City of Iowa City through the Housing Rehabilitation Program. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE PARTIAL RELEASE OF LIEN REGARDING A MORTGAGE FOR THE PROPERTY LOCATED AT 2527 WHISPERING PRAIRIE AVENUE, IOWA CITY, IOWA. Comment: The Iowa Valley Habitat for Humanity owns the property located at 2527 Whispering Prairie Avenue and received assistance though the City of Iowa City's HOME Investment Partnership Funds. The HOME assistance is secured by a mortgage on this property and four (5) other lots. Habitat is conveying this property to a family. Because the family has executed a mortgage in favor of the City to secure the HOME assistance, the City can release this particular lot. g) Correspondence. 1. Comment: At its May 21, 2009 meeting, by a vote of 5-0 (Busard &Plahutnik absent), the Planning and Zoning Commission recommended approval of this ordinance. Staff recommended approval in a report dated May 15. Approval will add a Business Services land use category, modify the street width standards for institutional uses in residential zones, and clarify applicable regulations to and allow minor modifications to site development standards in the Public Zone. Approval will establisl the Northside Historic Preservation District and require that the Historic Preservation Commission review demolition permits and building permits tha affect the exterior of buildings within the district. Protest petitions representinc over 20% of the property within the proposed district have been submitted therefore, a super majority (6 out of 7 voting in favor) is necessary to pass thi; ordinance. Correspondence included in Council packet. ~ em^c ~ Action: N~~ ~i June 2, 2009 City of Iowa City Page 6 ~ R_ .4„~,4.~ c) CONSIDER AN ORDINANCE AMENDING TITLE 14, ZONING, ESTABLISHING DEFINITIONS AND A USE CLASSIFICATION PROCEDURE FOR DRINKING ESTABLISHMENTS AND ALCOHOL SALES- ORIENTED RETAIL USES AND ESTABLISHING MINIMUM SPACING REQUIREMENTS FOR DRINKING ESTABLISHMENTS THROUGHOUT THE CITY AND FOR ALCOHOL-SALES ORIENTED RETAIL USES IN THE CENTRAL BUSINESS SERVICE (CB-2), CENTRAL BUSINESS SUPPORT (CB-5), AND CENTRAL BUSINESS (CB-10) ZONES. (PASS AND ADOPT) Comment: At its April 16 meeting by a vote of 6-0 (Pluhutnik absent), the Planning and Zoning Commission recommended approval. Staff recommended approval in a report dated March 5. Approval will establish a minimum separation requirement between bars in all commercial zones that allow these uses and a minimum separation requirement in the Central Business Zones between retail establishments, such as liquor stores, that receive a significant amount (25% or more) of their gross income from the sale of alcohol and alcoholic beverages. Action: O~ .. 193 d) CONSIDER A RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT OF SCOTT - SIX INDUSTRIAL PARK , 2ND ADDITION, A RESUBDIVISION OF A PART OF LOT 36, SCOTT-SIX INDUSTRIAL PARK, IOWA CITY, IOWA. (SUB09-00001) Comment: At its May 7, 2009 meeting, by a vote of 6-0 (Freerks absent), the Planning and Zoning Commission recommended approval subject to approval of legal papers and construction drawings.. Staff recommended approval in a report dated May 7, 2009. It is anticipated that legal papers and construction drawings will be approved prior to the June 2 City Council meeting. APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE 2009 PCC PAVEMENT PATCHING PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project involves repairing sanitary sewer manhole castings in the street pavement at 25 locations and replacing arterial street pavement at 9 locations throughout Iowa City. This project includes patching only and does not include diamond grinding for smoothness. The estimate of construction cost is $240,000 and will be funded with Road Use tax proceeds and Wastewater revenues. a) PUBLIC HEARING Action: ~~' a oq- I ~'Q- b) CONSIDER A RESOLUTION Action: ITEM 7. APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE OLD HIGHWAY 218 RESURFACING PROJECT [ESL-3715(643)--7S-52], ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project will resurface Old Highway 218 from Highway 1 and 6 south to Mormon Trek Boulevard. The project includes milling the existing asphalt surface and placing a new asphalt surface the entire width and length of the project. This project does not include diamond grinding for smoothness. The estimated construction cost is $750,000 and will be funded with $650,000 in Federal funds (stimulus) and the remainder with Road Use tax proceeds. a) PUBLIC HEARING Action: 09~- (QS b) CONSIDER A RESOLUTION Action: June 2, 2009 City of Iowa City Page 8 ITEM 8. AMENDING TITLE 3, FINANCES TAXATION AND FEES, CHAPTER 4, SCHEDULE OF FEES, RATES, CHARGES, BONDS, FINES, AND PENALTIES, SECTION 8, PARKING VIOLATIONS, TO AMEND PARKING FEES, RATES, AND FINES. Comment: This ordinance includes increases in parking meter and monthly parking permit rates, as well as parking citation fines. These changes would be effective July 1, 2009. The increases in parking citation fines and parking meter rates are a component of the proposed plan to minimize congestion in downtown Iowa City, The increase in monthly parking permit rates would result in a rate similar to the rate charged by the University of Iowa for covered parking facilities. a) PUBLIC HEARING Action: b) CONSIDER AN ORDINANCE (FIRST CONSIDERATION) Action: ITEM 9. CONSIDER AN ORDINANCE AMENDING ENTITLED "DISORDERLY CONDUCT" TO BEHAVIOR IN THE DESCRIPTION OF CONSIDERATION) r TITLE 8, CHAPTER 5, SECTION 1,~ INCLUDE FIGHTING OR VIOLENT DISORDERLY CONDUCT. (FIRST Comment: The current Iowa City ordinance prohibiting disorderly .conduct does not include a prohibition on engaging in fighting or violent behavior. This proposed ordinance amendment adds such behavior to the description of disorderly conduct, thereby making such behavior a simple misdemeanor under the local code. By adopting this amendment, the City's ordinance will more closely mirror the state's regulation of disorderly conduct. Staff memorandum included in Council's packet. CONSIDER AN ORDINANCE AMENDING TITLE 9, MOTOR VEHICLES AND TRAFFIC, CHAPTER 9, TOWING AND IMPOUNDMENT PROCEDURES, SECTION 4, IMPOUNDMENT FOR ACCUMULATED PARKING VIOLATIONS, SUBSECTION A: DETERMINATION OF TOWING AND IMPOUNDMENT, TO COUNT RAMP CHARGES AND VEHICLE UNLOCK FEES TOWARD THE $50 "TOW THRESHOLD AMOUNT", AND TO ELIMINATE THE REFERENCE TO AT LEAST FIVE (5) PARKING TICKETS; AND TITLE 9, MOTOR VEHICLES AND TRAFFIC, CHAPTER 1: DEFINITIONS, ADMINISTRATION AND ENFORCEMENT OF TRAFFIC PROVISIONS, SECTION 1: DEFINITIONS, TO INCLUDE DEFINITIONS OF "RAMP CHARGES" AND "VEHICLE UNLOCK FEE." (FIRST CONSIDERATION) Comment: Currently City Code allows for the towing and impoundment of a vehicle after it has accumulated (5) or more parking tickets or $50 or more in accumulated parking violations, but does not currently count ramp charges or vehicle unlock fees toward the tow threshold which means that a vehicle can not be towed no matter how much is owed in ramp charges or vehicle unlock fees. This ordinance will define "Ramp Charges" and "Vehicle Unlock Fee" and provide the ability to collect from those that owe the City more than $50 in these vehicle related charges. CONSIDER AN ORDINANCE AMENDING TITLE 9, MOTOR VEHICLES AND TRAFFIC, CHAPTER 4, PARKING REGULATIONS, SECTION 6, PARKING IN ALLEYS: SUBSECTION B, ALLEYS IN COMMERCIAL DISTRICTS: PARAGRAPH 2, TO LIMIT PARKING IN AN ALLEY TO TEN (10) MINUTES. (FIRST CONSIDERATION) Comment: Currently City Code allows fora (10) minute parking time limit in alleys for vehicles, unless they are there to "load or unload goods, wares and merchandise for any business establishment abutting the alley" and this has in effect lead to the abuse of these parking privileges by vehicles remaining in the alleys far longer than necessary to accomplish their loading or unloading. Staff recommends that all parking in alleys be limited to (10) minutes. Action: June 2, 2009 City of Iowa City Page 10 ITEM 12. CONSIDER AN ORDINANCE .AMENDING TITLE 9, MOTOR VEHICLES AND TRAFFIC, CHAPTER 4, PARKING REGULATIONS, SECTION 1, PARKING PROHIBITED IN SPECIFIED PLACES, SUBSECTION A, PARAGRAPH 6, AND TITLE 9, MOTOR VEHICLES AND TRAFFIC, CHAPTER 4, PARKING REGULATIONS, SECTION 7: VEHICLES ON PARKING AREA, SUBSECTION B: STANDARDS, PARAGRAPH 3, SUBPARAGRAPH C, TO CHANGE THE PARKING RESTRICTION FROM WITHIN FIVE FEET (5') OF A FIRE HYDRANT TO THE FIVE FEET (5') OF CURB SPACE IN FRONT OF THE FIRE HYDRANT. (FIRST CONSIDERATION) Comment: Currently City Code prohibits parking "within five feet (5') of a fire hydrant" allowing the adjacent curb space to be entirely blocked by a legally parked vehicle if the fire hydrant is at least five feet (5') from the curb and inhibiting the fire department in its access to such a hydrant with no legal remedy to force vehicles to be removed as needed. The Fire Department requests and recommends this amendment to prohibit vehicles from parking in front of fire hydrants. Action: ~; ~ ~~ ~~ ~ S ~ /~ ITEM 13. CONSIDER AN ORDINANCE AMENDING TITLE 9, MOTOR VEHICLES AND TRAFFIC, CHAPTER 5, PARKING METER ZONES AND PARKING LOTS, SECTION 6, PENALTIES; PARKING TICKETS: BY ADDING SUBSECTION D, RETURNED CHECKS:, TO ALLOW FOR THE RECOUPMENT OF FINANCIAL PENALTIES AND ADMINISTRATIVE COSTS UPON THE RETURN OF ANY CHECK OR AUTOMATIC BANK DEBIT. (FIRST CONSIDERATION) Comment: The City currently incurs financial penalties and administrative costs upon the City's deposit of non-sufficient-fund checks or automatic bank debits in payment for parking fees, charges, fines, and penalties. The City charges a fee (currently $15.00) for all returned checks or automatic bank debits for water service, but not for parking costs. Staff recommends that the same fees be charged for any checks or debit payments of parking fees, fines, charges or penalties which are returned for any reason to the City from the financial institution from which it is written to establish a level of recovery uniform with the City Water Division. CONSIDER AN ORDINANCE AMENDING TITLE 9, MOTOR VEHICLES AND TRAFFIC, CHAPTER 9, TOWING AND IMPOUNDMENT PROCEDURES, SECTION 1, TOWING AND IMPOUNDMENT OF ABANDONED VEHICLES; NOTICES, SUBSECTION A, TOWING AND IMPOUNDMENT AUTHORIZED:, TO AMEND THE NOTICE REQUIREMENT FROM SEVENTY-TWO (72) HOURS TO TWENTY-FOUR (24) HOURS BEFORE TOWING VEHICLES FROM CITY-OWNED PARKING RAMPS. (FIRST CONSIDERATION) Comment: City Parking staff have encountered an increasing number of vehicles being stored long-term in City-owned ramps, preventing others from using the spaces for short- term parking, as intended. Current City Code prohibits parking in a City-owned or operated lot or ramp for more than 24 hours, however it also requires notice to the vehicle owner of at least 72 hours before towing. Staff recommends that the notice be changed, so that a vehicle that has been parked illegally in excess of 24 hours may be towed and impounded after a 24 hour notice which would allow increased availability of parking in ramps. Action: ITEM 15. CONSIDER AN ORDINANCE AMENDING TITLE 9, MOTOR VEHICLES AND TRAFFIC, CHAPTER 9, TOWING AND IMPOUNDMENT PROCEDURES, SECTION 4, IMPOUNDMENT FOR ACCUMULATED PARKING VIOLATIONS:, SUBSECTION B, NOTICE OF TOWING AND IMPOUNDMENT; HEARING:, TO ELIMINATE THE REQUIREMENT THAT THE VEHICLE BE IN VIOLATION OF PARKING REGULATIONS AT THE TIME OF TOWING OR IMPOUNDMENT AND STREAMLINE NOTICE PROVISIONS. (FIRST CONSIDERATION) Comment: Currently City Code requires that in order for a vehicle to be towed and impounded, the vehicle must be in violation of Iowa City parking regulations at the time of towing. Staff recommends that a vehicle with an accumulation of (5) parking tickets or $50 in outstanding parking fines be allowed to be towed if found on a public street or in a public parking lot even if not in violation of any parking regulations at the time. Staff also recommends that the Notice of towing procedures be on every ticket thereby eliminating the requirement of mailing a separate notice. Action: ITEM 16. CONSIDER A RESOLUTION AUTHORIZING THE CITY MANAGER TO SIGN FARM off- ~ cl (P LEASES AND SECURITY AGREEMENTS FOR ANY AND ALL AGRICULTURAL LAND OWNED BY THE CITY OF IOWA CITY, IOWA. Comment: This resolution authorizes the City Manager, or designee, to negotiate, execute, renew and manage farm leases and security agreements for agricultural land the City may now own or later acquire, upon approval by the City Attorney's Office. Comment: This is a one-year agreement which includes a 3.05% across-the-board wage increase and additional $5 per month contribution by each employee toward their family health insurance premium, and minor increases in annual payments for holidays and longevity.
