HomeMy WebLinkAbout2009-06-16 Correspondence4c(1) Liquor License Renewal Agreement between the City of Iowa City Police Department and Los Cocos, Inc. WHEREAS, the Iowa City Police Department, based on the present history of operation of Los Cocos, and without changes to that operation, cannot recommend approval of the liquor license renewal application made by Los Cocos; and WHEREAS, those concerns include the following Iowa City Police Department (hereinafter "ICPD") response statistics related to the operation of Los Cocos for the 11 month period ending June 1, 2009: • Calls-for-service = 210; • Officers dispatched = 396; • Officer-hours =over 208; • Arrests = 74 (there were 3 additional "Warrant Arrests"); • Fight in Progress = 24; WHEREAS, these statistics represent a disproportionately high need for police response to Los Cocos when compared to other bars, especially bars of their capacity; and WHEREAS, the response made necessary by the operation of Los Cocos during this period has had an associated cost in ICPD staff time of approximately $8,500; and WHEREAS, the level of cooperation the ICPD has received from Los Cocos staff has been inconsistent; WHEREAS, the hosting of after-hours parties at the bar, often running until 5:00 a.m., has resulted in fights and other problem behaviors through that time; and WHEREAS, the ICPD has made repeated arrests of the same individuals at Los Cocos, indicating that problem patrons are not being excluded from the bar; and WHEREAS, numerous meetings with Los Cocos management have failed to address these problems; and WHEREAS, the ICPD wishes for Los Cocos to have one last opportunity to earn a positive recommendation from the ICPD for renewal of their liquor license. NOW THEREFORE, as a condition for the recommended approval of a six (6) month license renewal, Los Cocos, Inc. agrees to withdraw their application for a twelve (12) month license, and re-file for a six (6) month license, as well as the following conditions: a. Los Cocos owners and staff shall commit no violations of state or local law, rule or regulation b. Specific adherence to the Iowa City Fire Code, including specifically code provisions establishing occupancy limits c. The premises will be staffed with an adequate number of appropriately trained personnel, as approved by the ICPD, at all times to check ID, keep a count of patrons for occupancy limits, prevent overservice issues, and monitor the parking lot and other outdoor premises of the bar d. Los Cocos owners shall meet monthly with the ICPD to discuss concerns and progress. The ICPD shall provide a copy of the calls for service log to the owners at these meetings. e. Los Cocos shall prepare and implement an action plan, in consultation with the ICPD intended to achieve an immediate reduction of fight, disturbance, assault, weapons, intoxication, littering, and narcotics calls. The action plan shall include, at a minimum: 1) Staff /Security shirts to identify employees of the establishment. 2) Evidence of proactive and visible management for the entire property (1921 Keokuk St) to include the interior of the premises as well as the parking lot and outdoor premises. 3) Open communication between the establishment and ICPD f. Los Cocos will not host any after hours events, and will have the interior of their premises cleared of all patrons by 2:00 a.m. each night, and their parking lot and outdoor premises cleared of all patrons, and their vehicles, by 2:30 a.m. each night. g. Los Cocos will eject patrons causing problems in the bar, and ban them for a minimum of six months from the date of occurrence, on penalty of trespass charges. Los Cocos will keep a list of said individuals (to include date of ban and name of employee delivering the ban), and update that list with ICPD within 72 hours of each name addition. Los Cocos may, and is in fact encouraged to, expel problem patrons without the involvement of ICPD. ICPD will assist in such matters when requested. h. Los Cocos shall acknowledge by its signature below that safety and the reporting of criminal activity is paramount. Los Cocos shall actively and affirmatively call in these crimes to the ICPD as its employees become aware of the incidents. Heather German Owner, Los Cocos, Inc. I sent an E Mail a couple of weeks ago regarging panhandlers. I have not heard anything regarding this. I don't know what happened to the E Mail. We were driving home from work today, and I saw three panhandlers. I can't imagine what a visitor to our city would think. Can you imagine the first impression a visitor from another state or country would think? Beggers on our street corners? I am just at a loss to figure out why our City allows them. Panhandling is illegal anywhere in Iowa City when it is done in an "aggressive" manner or in a manner that will "impair orderly movement of pedestrian or vehicular traffic or otherwise create unreasonable health and safety concerns." In addition, in April of 2008 the City Council amended the ordinance to specifically prohibit panhandling in certain places downtown such as within 10 feet of a building entrance or within 20 feet of an ATM machine, and to prohibit persons, with certain exceptions, from sitting or lying on sidewalks in the downtown area and within 10 feet of a building in the City Plaza. These ordinances can be found at Sections 8-5-2 and 8-5-10 of the City Code. With respect to panhandling on the street medians, under the existing ordinance a panhandler may stand on the median but may not impede the flow of vehicle traffic or create an unreasonable safety concern, such as by walking among the cars on the street. In the Spring of 2007 the City Council, on a vote of 4 to 3, voted against an ordinance that would have prohibited persons from standing on any part of the streets or sidewalks and soliciting from the occupant of a vehicle operating on the street. Consideration of panhandling ordinances requires a balancing of a number of different interests. The Council had a significant amount of discussion when these ordinances were proposed in 2007 and 2008. After being displaced by the Flood of `08, the animal center continues to serve the community well, but is limited by its inconvenient location and small size. A larger facility would allow the animal center would to provide the animals with more green space. It would also enable the center to accommodate tours, educational events and mentoring partnerships with volunteers and youth. A larger animal center would not only benefit animals and the citizens of Iowa City, but the citizens of the surrounding communities as well. As I understand, FEMA will cover the cost of the old center. However, for the city to have an adequate facility, the animal center will need more money than FEMA provides. I believe Iowa City should require the outside communities, such as University Heights, Coralville and North Liberty, to pay more money to the animal center for continued use of the facility. I strongly urge the City Council to consider my idea. Anew, enlarged facility would greatly contribute to the future education of our youth and greatly enrich the community as a whole. The devastatuig flood of 2008 proved to be detrimental to the inhabitants of the shelter. The animals were forced to relocate to a temporary site, the 4H fairgrounds and later required to move again due to the Johnson County fair. I am aware that there are a vast amount of other buildings and flood impacted property that needs to be repaired or rebuilt, but the animal shelter needs to have something done soon. Many animals were required to be transported to other neighboring animal shelters to be cared for because currently the Iowa City animal shelter cannot provide sufl-icient care an ample amount of animals. A new permanent animal shelter must be built soon, away from any river danger and bigger than the previous animal shelter on Kirkwood Ave. The previous animal shelter was having over crowding issues and was on the verge of needed a bigger facility. It is essential for the new animal shelter to be built away from any river or potential site of natural disaster. The new animal shelter should also be accessible to citizens but also not in an overwhelmingly developed area for the animal's sake. Although money right now is an issue in itself, the new animal shelter should be built with improved building design and usability as well as increased capacity for the increasing need of residences for the homeless animals. It is best to address the problems of the animal shelter for the long-term benefits rather than a temporary fix, which is why the building of a new shelter that is bigger and improved from the previous is the best choice. There are various ways in which the animal shelter issue can be solved. The animal shelter can mimic the size of the Cedar Rapids animal shelter and replicate the location of the Washington facility. The Iowa City animal shelter is currently awaiting a reply from FEMA for aid money in rebuilding a new shelter. The shelter is also receiving donations from smaller non- profitorganizations for temporary care, many of which are animal shelters themselves. Although the shelter is getting a lot of help from outside sources, it needs your help as well. All the expenses of building the shelter might not be covered in what has been accumulated already and a location for the new shelter is yet to be decided. Money gathered from the increased sales tax could greatly help in rebuilding the shelter, and this money would be well spent for this cause. The other issue is the location of the new animal shelter. The new animal shelter needs to be built away from densely developed areas yet easily reached to citizens and one place to start is nowhere near a river. Knowing the police department has a say in the location with animal problems and the economic department will also have input if the new shelter will be build on city land, the opinions of heads of these departments need to be taken into consideration. The new animal shelter as an important issue and is not one that should be left to the side and dealt with in another couple of years. The new one cent sales tax raise is going to aid flood repairs for buildings that were damaged by the flooding. One building in particular, the Iowa City Animal Shelter, should be rebuilt however, in a new location than it was prior to the flood. There are many other buildings such as the Iowa City Water Plant that need to be repaired but right now the water is fine. Many animals were displaced during the flood and the present location and uuilding where the animal shelter was transferred to isn't sufficient enough to take care of the animals. This issue is very important to me. As the City Council's job of solving problems, I am hoping that the City Council could solve this problem by voting to have the animal shelter be one of the first buildings assisted via the new sales tax. The sales tax increase will bring in 9 million dollars to Iowa City. The Iowa City Animal shelter would take up an estimated 1.9 million dollars of it but it would be well worth it. If passed by a simple majority of four to three then the job of rebuilding the animal shelter could be given to one of the head of departments, most likely the Parks and Recreation department. The Press Citizen says that officials have been looking at Iowa City-owned locations or perhaps even privately owned locations. The most popular idea is for the animal shelter to be rebuilt at a park. Preferably at the Sand Lake Recreation Area where there is much more space to take care of the animals. There are many other buildings that also need to be repaired but the Iowa City Animal Shelter has been needing more space for a long time now. The animals need a bigger place to roam around and more space to live in. Right now at the current location on sand road hundreds of animals are crammed into 2 buildings. The animals would greatly appreciate it if they could move around and be free. In my AP Government class, my teacher, Ms.leanine Redlinger, has assigned a civics project to learn more and better understand Iowa City's local government. In this project we are to use our knowledge of government to make a difference and become involved in an issue that is important to us and the Iowa City community. The problem that I see in Iowa City as most pressing is the number of underage drinkers in the community. I feel that more should be done to improve the health and safety not only of those drinking, but those individuals that are exposed to underage drinking. I believe that one way to tackle this issue is to increase police enforcement in the Iowa City downtown area on nights and weekend, especially Friday and Saturday nights. I believe that more police enforcement downtown would discourage minors to drink as well as decrease public intoxication. However, in order for the police force to be able to improve downtown conditions, a budget increase for public safety is needed to supplement the pay of the police officers. I believe that even with hard economic times and a tight budget, this is important to the lives of teenagers in Iowa City. 1 also believe that this action, though a minor one, is a starting point in confronting this issue in Iowa City. I chose to look into the alcohol consumption in our community and the violence related to this mass amount of alcohol being consumed. After learning of what you have done concerning this issue I must applaud you. The idea to no longer allow the condensed alcohol scene of downtown is a great idea. In addition I agree with making the penalty of 19 year-old kids trying to drink in bars harsher is a great idea as well. However as a concerned member of our community I believe that further measures must be taken to create the most secure community for our citizens to live in. My main concerns that I believe should be heard consist of harsher penalties on drunk drivers, changing the 19 year-olds allowed in bars law and lastly stricter penalties for bars that serve alcohol to underage minors. By implementing these measures, I believe we can drastically lower alcohol consumption and in return lower the amount of alcohol related crime in our city. That means when working at the Robert A. Lee recreation center, 5.6 percent of the hourly income is already paid back to the city before the city has even paid it to the lifeguard. Most guards are either in high school or are attending the University of Iowa or Kirkwood Community College. Being a guard is supposed to help get through school or help to not rely on parents' pockets so much, as well as teach responsibility. Having to pay full price for parking is a five percent decrease in income, but only for those workers at the rec center pool. Mercer pool and City park guards do not have to pay to park so are in effect being paid more based on the location of their building. The difference between the other downtown employees and the lifeguards is that the other employees are mostly full-time employees and therefore are eligible for the city employee- parking permit that many of the downtown employees have. Lifeguards on the other hand pay full price parking even though they are the ones who have an hourly wage and don't get paid as much overall. The proposal to raise the parking fees downtown would also not help the situation; it would raise the five percent loss to an 8.3 percent loss per hour. There are several possible solutions to this problem. There are enough parking places in both the rec center parking lot or even the Chauncey Swan garage to have three to five lifeguard parking places setup. The parking enforcers could also be given the guarding schedule and license plate numbers so they would know if the people parked in the spots were even lifeguards or if they were supposed to be working. Numbered stickers could be given to guards working at the rec for a reduced parking price so they would still pay some but not such a high percentage of their wage. Hang tags could be given to guards working at the rec center, the parking enforcement officers could be given a list with the numbers of the employees hang tags and a schedule so they would know if the correct people were working. It is true that the city will lose money by granting lifeguards the privilege of not paying for parking or getting a discount on parking. I called the Parking division several times to find out how much money the ramps and meters make. I was going to use this figure to approximate the amount the city would lose, but since I was unable to find out the necessary number I was unable to produce an approximation of the amount the city would lose, it is certain on the other hand that the loss to the city would be very small compared to the loss for the lifeguards. Please take the time to consider other possibilities not listed for I am sure there is a better, more fair way to handle the issue of employees parking than is being used right now. There are several issues that you need to take into consideration in this matter; 1) You do not have to park in the recreation center lot while at work, there are several alternatives, parking on the street where there are no meters, taking the bus into work, since you are a student it is considerably cheaper than parking, and taking shifts that are after enforceable meter hours. 2) There are no other part-time temporary workers that are afforded free parking, If we were to provide free parking to our temporary employees that number could range anywhere from 100-200 individuals, which would relate to a substantial loss of revenue to the city and take away a substantial amount of parking for the use of citizens of Iowa City. We have to consider all temporary employees in a request such as this. 3) Full time employees are not awarded the luxury of free parking either; we must pay for our privilege of using the parking lot if we wish. If we choose not to use this lot we are forced to consider the same alternatives as I mentioned earlier. I cannot answer for the Parking Division about open space such as you suggest, you will have to take that up with Chris O'Brien, Director of Transportation Services, however I do know that both lots are full and have a substantial waiting list on them for persons to obtain permits, Chris can answer specific number questions for you. If you would like to pursue parking for lifeguards and other temporary employee parking, I would be happy to work with you on that, however it will not be provided to you free of charge. Please let me know if you would like to consider some alternatives such as you suggested. However please keep in mind that the Parks and Recreation Department does not have jurisdiction over the parking lots in the city or behind the recreation center, the Parking Division does, they are the folks that would put the requirements forth to follow on any proposal, followed by City Council approval. Last year in 2008 the flood damaged and destroyed thirty nine houses in Iowa City. As of now Habitat for Humanity has only three construction sites this summer to help rebuild after the flooding. This means that the city must rebuild thirty six of these houses. Allowing Habitat for Humanity to build more houses would save the city a great deal of money. Habitat for Humanity is primarily made up of a volunteer work force. It costs almost nothing to mobilize a construction crew for their builds. Habitat for Humanity also receives its building materials thorough donations. If Habitat for Humanity is running short on materials, the organization is able to buy them for very low prices. The city does not have to pay for materials or a workforce for these builds. Construction of these houses cost the city almost nothing. Iowa City has received 8.6 million dollars in Fema funds and 1.2 million dollars in CDBG funds. The U.S. Department of Housing and Urban Development allows a maximum of 15% of CDBG funds to go to non-profit organizations. I recommend that 15% of the CDBG funds be used for Habitat for Humanity and other needed non-profit organizations. $180,000 would go to Habitat and other non- profit organizations while $1,020,000 would go to the city. Additional funds from FEMA would be needed. I would ask that adequate funds from FEMA be given to Habitat for Humanity so that as many housing projects as possible be done by Habitat. The only limiting factor is the number of volunteers Habitat currently has. The CDBG funding as well as FEMA funding would allow for more houses to be put up under this organization. I think this would be the best strategy for Iowa City. The construction of houses under Habitat for Humanity would save the city a lot of money. More attention could given to rebuilding our roads, public buildings, and businesses. We are currently facing the worst economic crisis since the great depression and a$er the flood, our businesses have faced a great loss. It is now very important that we rebuild our businesses to bring back Iowa City's economy. It is vital that we do this quickly and thoroughly. Under this plan it is possible. By allowing Habitat for Humanity to rebuild lost houses, the city saves money, and allows more focus to put on rebuilding our city's businesses. Not only would this plan save the city money now, but it would save the city money in the long run. This plan supports the construction of new homes for almost no cost to the city as well as the growth of business. Allowing Habitat for Humanity to build many of the houses would allow for our attention to be shifted towards investing in our businesses. This is the first step in getting out of our recession. Rebuilding after the flood as well as rebuilding our businesses should be our first priority. More unnecessary tax and spending! The parents either stand, sit on their (generally very wide) fannies, or bring the ubitiquous folding chairs! After all you're only there for about 1.5 hours on about 8 Saturdays a season. Parents can't tough it out by standing or remember to bring their own chairs? This is another example of a want, not a need. This will cost both cash for buying the bleachers and city staff time and salaries to install them. It would seem that this could be an easy budget cut item. How about it City Council? You must cut the budget somewhere. If you just must spend money foolishly I would think community fireworks - for all the people, including property owners, students, kids, tourists, illegals etc....would be a better "investment" than bleachers at the soccer fields. After all -not that many poor, homeless, or illegal people can afford to pay the $90 per year for their kids to be in a soccer league. So it will only benefit a few.....not all in the community. With the influx of new residents it's obvious that we need to expand these two departments. With the current economic conditions, it is even more difficult to bring these two departments to the needed levels. These two areas should have top priority. It is time to look at monies given to the airport, Englert Theater, public art and other charitable donations. Do not cut programs that involve senior citizens or cutting back hours that might give kids a place to go like the recreation centers. The tax payer can no longer keep paying salaries for the public sector at the current rate. Every year the public sector employees automatically receive their raise. This is not a given in the private sector. As a city government you must determine a sustainable and healthy wage for our employees but at the same time not breaking the financial backs of the tax payers. Salaries should be cut or frozen at the administration level. When a union employee receives a raise that should not mean anon-union employee automatically receives one. Just because the city receives money for Section Eight housing does it mean we spend it all? Iowa City - Johnson County already has one of the lowest unemployment rates in the state. We do not have enough jobs to support the people that move to our City. With the UIHC laying off people it tightens up the market even more. All of this puts a tremendous amount of strain on our social services. How can we continue to support the people that come into our town under this plan? In view of Greg Roth's experience in south side Iowa City when he was confronted by a mob of youth (everybody knows their ethnic identity by now; do you?) and related in his commentary that was printed in the Press Citizen in June 1 2009 I feel compelled to reintroduce a letter that was sent by physical mail as well as by email to you dated 3/09 addressed to the Press Citizen administration in which I reiterate my warnings that the social integrity and security of this town was defaulting as the result of illogical and detrimental to our community social policies. This letter is long and would be send attached as a MWord file. Eliminating 50% of subsidized housing, restricting construction of low income housing including those built by private organizations who seem to have no limits, hiring at least ten more police officers to counter the results of your actions, and eliminating unnecessary positions like the Equity Director of the Iowa City School District and other like positions in the City's staff as well as the city manager position. (but not within the Central Business District) We plan to pursue some level of LEED certification and will be a very sustainable project. Please forward this the City Manager as well. Our project will put between $5 and 8,000,000 on the property tax rolls so hopefully you will spark some interest and help from your appropriate departments. What we will bring to the table is local ownership, a quality project and increase in revenue for the city- what we'd like to see is some help from the City to identify land/locations we can pursue.
