ORDINANCE NO.
AN ORDINANCE REZONING 1.6 ACRES FROM COMMUNITY COMMERCIAL (CC-2) TO PUBLIC (P) FOR
PROPERTY LOCATED AT 1828 LOWER MUSCATINE ROAD.
WHEREAS, Section 14-61-1 of the Iowa City zoning ordinance requires that land owned by a government entity
shall be zoned P, Public; and
WHEREAS, the City of Iowa City has initiated the rezoning of 1828 Lower Muscatine Road, owned by Kirkwood
Community College, from CC-2, Community Commercial to P, Public; and
WHEREAS, the new zoning classification is consistent with the zoning classifications of properties owned by the
Federal government, the State, the County, the City, and all political subdivisions thereof.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA:

SECTIQN III CERTIFICATION AND RFCORDING. The City Clerk is hereby authorized and directed to certify a
copy of this ordinance which shall be recorded at the office of the county recorder of Johnson County, Iowa, upon final
passage and publication as provided by law.

are hereby repealed.
SECTION V SEVERABILITY. If any section, provision or part of the Ordinance shall be adjudged to be invalid or

part thereof not adjudged invalid or unconstitutional.
SECTION VI. EFFECTIVE DATE. This Ordinance shall be in effect after its final passage, approval and

ORDINANCE AMENDING THE PLANNED DEVELOPMENT HOUSING OVERLAY (OPDH-5) PLAN
FOR THE PENINSULA NEIGHBORHOOD BY AMENDING THE PENINSULA NEIGHBORHOOD CODE.
WHEREAS, by Ordinance No. 01-3958 the city adopted a Conditional Zoning Agreement and
Preliminary Sensitive Areas Development Plan for the Peninsula Neighborhood; and
WHEREAS, the Sensitive Areas Development Plan included the Peninsula Neighborhood code which
specifies building placement requirements for the Peninsula Neighborhood; and
WHEREAS, The developer has requested amendments to the Planned Development Housing
Overlay (OPDH) Plan for the Peninsula Neighborhood to designate revised locations for Single-Family
houses, Rowhouses, Townhouses, Live Work Buildings and Small Apadment Buildings and to clarify the
language in the Peninsula Development Code, to allow for an increase in height for single family homes,
Live Work units and Small Apartment Buildings, to allow for the location of parking spaces along alleys
and to specify how parking requirements shall be calculated for Neighborhood Commercial uses.
WHEREAS, the Planning and Zoning Commission has reviewed the revised Peninsula Neighborhood
code and Planned Development Housing Overlay Plan and has recommended approval
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,

SECTION 11 ADOPTION OF REVISED DEVFI OPMENT CODE. The revised Peninsula Neighborhood
code is hereby adopted as a component of the Planned Development Housing Overlay (OPDH) Plan by this
reference, and the terms and requirements therefore are given full force and effect as if fully set forth herein.
SECTION III VARIATIONS The following variations from the requirements of the RS-5 zone and
chapter 14-6, Zoning, are approved, as further detailed in the revised Peninsula Neighborhood Code,
adopted by reference as a component of this ordinance and attached hereto:
a) A modification of height limits of the RS-5 zone to allow a maximum height of 35 feet for single-
family houses, townhouses and row houses; 40 feet for Live Work Buildings, 48 feet for Small Apartment
Buildings as detailed in the revised Peninsula Neighborhood Code.

b) A modification to allow the waiver of Section 14-6N-1B(2)(g) restricting the number of parking
spaces that may back onto an alley, if the site plan demonstrates to the satisfaction of the Building Official
that parking spaces are configured so as not to impede traffic on the alley.
c) A modification to specify that off-street parking spaces for Neighborhood Commercial uses are
not required for the first 1500 square feet of floor area as detailed in the revised Peninsula Neighborhood
Code.
SECTION IV. ZONING MAP. The Building Inspector is hereby authorized and directed to change the
zoning map of the City of Iowa City, Iowa, to conform to this amendment upon the final passage, approval
and publication of this Ordinance as provided by law.
SECTION V CERTIFICATION AND RECORDING. The City Clerk is hereby authorized and directed to
certify a copy of this ordinance, a copy of the Preliminary OPDH Plan, and a copy of the Peninsula
Development Code, and record the same in the Office of the County Recorder, Johnson County, Iowa, at the
Owner's expense, upon the final passage, approval and publication of this ordinance, as provided by law.

Ordinance are hereby repealed.

AN ORDINANCE VACATING THE NORTHERNMOST 60 FEET OF THE DEAD-END ALLEY ALONG
THE WEST PROPERTY LINE OF 405 SOUTH SUMMIT STREET.
WHEREAS, the northernmost 60 feet of the alley between South Governor Street and South Summit
Street, adjacent to the west property line of 405 South Summit Street, is not used for pedestrian or
vehicular traffic circulation; and
WHEREAS, there are no utilities in the right-of-way proposed to be vacated; and
WHEREAS, the area proposed to be vacated does not provide access to any drives or driveways, is
partially unpaved, and is not being used by the general public.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA:
SECTION I. VACATION. Subject to the disposition and conveyance of the right-of-way being

AN ORDINANCE AMENDING TITLE 1, "ADMINISTRATION," CHAPTER 9,
"CITY ELECTIONS," SECTION 2(A), "DEFINITIONS," OF THE CITY CODE TO
AMEND THE DEFINITION OF "CANDIDATE'S COMMITTEE" TO BE
CONSISTENT WITH THE RECENTLY AMENDED DEFINITION OF
"CANDIDATE'S COMMITTEE" IN THE CAMPAIGN FINANCE CHAPTER OF
THE STATE CODE THAT INCREASES THE LEVEL OF CONTRIBUTIONS
WHICH REQUIRE THE ESTABLISHMENT OF A COMMITTEE AND THE
ATTENDANT REPORTING REQUIREMENTS FROM $500 TO $750.
WHEREAS, effective April 2002, the campaign finance provisions of the State Code
(Chapter 56) were amended to increase the contributions which require the establishment of a
Candidate's Committee from $500 to $750; and
WHEREAS, the definition of "Candidate's Committee" in the City Code mirrors the previous
definition in state code and is included in the City ordinance merely because Iowa City prohibits
a candidate or a "candidate's committee" from accepting contributions in excess of $100; and
WHEREAS, Iowa City does not have its own enforcement mechanism for the $100
limitation, relying on self-enforcement and the State campaign's finance reporting requirements.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA:
SECTION I. AMENDMENT. Title 1, Chapter 9, Section 2, subparagraph A, entitled
"Definitions" is hereby amended by deleting the definition of "Candidate's Committee" and
substituting the following definition in lieu thereof:
CANDIDATE'S COMMITTEE: The Committee designated by the Candidate to receive
contributions as defined in Chapter 56 of the State Code of Iowa.
SECTION II. REPEALER. All ordinances and parts of ordinances in conflict with the provi-
sions of this Ordinance are hereby repealed.
SECTION III. SEVERABILITY. If any section, provision or part of the Ordinance shall be

ORDINANCE NO.
ORDINANCE AMENDING TITLE 3, "CITY FINANCES, TAXATION AND FEES," CHAPTER 4,
"SCHEDULE OF FEES, RATES, CHARGES, BONDS, FINES AND PENALTIES" OF THE
CITY CODE, TO DECREASE WATER SERVICE CHARGES AND FEES IN IOWA CITY,
IOWA.
WHEREAS, pursuant to Chapter 384, Code of Iowa (1999), the City of Iowa City is authorized to establish
and provide for the collection of rates to pay for the City's utility systems, including the City's water supply and
treatment system; and
WHEREAS, water rates were increased in 2000 to generate adequate revenues to pay the estimated costs
of operation, maintenance, necessary expansion and debt service for the City's potable water supply and
treatment system; and
WHEREAS, the bid for construction of a new water supply and treatment facility and distribution system was
less than projected; and
WHEREAS, present water rates will result in unnecessarily large reserves and can safely be reduced without
harming the financial condition of the City of Iowa City Water Division, both short and long term; and
WHEREAS, the Iowa City City Council proposes to decrease water user fees by 5% for billings on or after
July 1, 2003 to adequately finance the City's water supply and treatment facility and distribution system.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA:
SECTION I. AMENDMENT. Title 3, Chapter 4, Section 3, entitled "Potable Water Use and Service," of the
City Code is hereby amended by:

ORDINANCE NO. 03-4064
AN ORDINANCE AMENDING TITLE 1, "ADMINISTRATION", CHAPTER 5,
"MAYOR AND CITY COUNCIL", SECTION 3, "COMPENSATION" TO ALLOW
CITY COUNCIL MEMBERS TO PARTICIPATE IN THE CITY'S GROUP
HEALTH INSURANCE PLAN AT THEIR OWN EXPENSE.
WHEREAS, the City Council desires to provide members of the City Council with the ability
to participate in the City's group health insurance plan at a council member's own expense and
at no cost to the City; and
WHEREAS, pursuant to state code, compensation of council members must be established
by ordinance; and
WHEREAS, participation in the City's group health insurance plan is a form of
compensation; and
WHEREAS, pursuant to state code a change in compensation becomes effective for all
council members at the beginning of the term of the council members elected at the election
next following the change in compensation.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA:
SECTION I. AMENDMENT. Title 1, "Administration", Chapter 5, "Mayor and City Council",
Section 3, "Compensation", of the City Code is hereby amended by adding a new subsection "D"
as follows:
D. Health Insurance shall be available to a council member on such terms and conditions as
health insurance is available to city employees, except that a city council member's participation in
the city's group health insurance plan shall be at the council member's own expense and at no
cost to the City.
SECTION II. REPEALER. All ordinances and parts of ordinances in conflict with the provi-
sions of this Ordinance are hereby repealed.
SECTION III. SEVERABILITY. If any section, provision or part of the Ordinance shall be
adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the
Ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconsti-
tutional.
SECTION IV. EFFECTIVE DATE. This Ordinance shall take effect on January 1, 2004.
