Comment: This action is being taken to promote vehicle turnover and to free up parking spaces for customer use. A May 2009 study found that a majority of vehicles parked on-street do not move throughout the day and are parked long term. I am writing to you today to wholeheartedly endorse and support this recommendation. Over the past 19 years I have had the opportunity to work very closely with Terry, both as President of the IC P&R Foundation as well as during my 18 year tenure on the P&R Commission. Together we worked on a wide variety of projects, too numerous to mention here. I am sure that you are all aware of the tremendous growth of our Parks, programs, trails and recreation facilities under Terry's guidance. What I will mention however, is that over the course of my career and the many boards and committees that I have served on, Terry's selfless dedication to his job as well as his profession is unmatched. During my tenure on the P&R Commission, several `naming opportunities' were brought before our commission for discussion; all were given the proper amount of dialogue and scrutiny before a .thoughtful decision was made. Now I will say that the Parks Dept. did find some time to power wash the pad. It didnt come up very well at all. I did call the Parks and Rec Dept. I talked to Mike. I asked him about the possibility of cleaning this up? He became argumenative. Telling me he had other priorities. He was not nice at all. If the Parks and Rec Dept cannot delegate or find time in about a year to paint over graffiti. They arent working very hard. Three men standing around and one man digging. Im sure I dont need to remind you that the city has its own ordinance about grafitti?! May the Park and Rec Dept needs to be notified of such ordinance. Your message has been forwarded to Council members as part of the consent agenda for the June 30 regular Council meeting. I can provide some information that I hope will be helpful. I am advised that our Parks Division staff had painted over graffiti on the shelter posts and the small storage shed twice within the past year. It appears to them that the graffiti you have observed was done sometime this past spring or early this summer. Some of the wording is the same as what was painted over. We regularly find that the same person or persons apparently return to recreate graffiti after it has been removed. Staff recently pressure washed the floor as well and that has not been retagged thus far. Further, picnic tables that had been painted with vulgar wording have been removed and replaced. Finally, I've been advised that the posts and storage shed were painted over again on June 17th in response to a complaint received on that date. Thanks for making your concerns known. On May 21, 2009 Senate file 340 was signed into law by Governor Culver and is set to go into effect July 1, 2009. Senate file 340 is the new sex offender law. It was written by the Iowa department of public safety and backed by the Sheriffs association amongst many other law agencies. It redefines loitering and residence. Loitering means remaining in a place or circulating around a place under circumstances that would warrant a reasonable person to believe that the purpose or effect of the behavior is to enable a sex offender to become familiar with a location where a potential victim may be found, or to satisfy an unlawful sexual desire, or to locate, lure, or harass a potential victim. Residence means each dwelling or other place where a sex offender resides, sleeps, or habitually lives, or will reside, sleep, or habitually live, including a shelter or group home. If a sex offender does not reside, sleep, or habitually live in a fixed place, "residence" means a description of the locations where the offender is stationed regularly, including any mobile or transitory living quarters. "Residence" shall be construed to refer to the places where a sex offender resides, sleeps, habitually lives, or is stationed with regularity, regardless of whether the offender declares or characterizes such place as the residence of the offender. These changes are significant because of something that has not been built yet. Shelter house's proposed new site at 429 Southgate sits within the 300 ft. "Exclusionary Zone" around HACAP daycare with 85 children and Hilltop Mobile Home Park where 80-100 children are and board school busses. This is a problem because during the day the shelter is an open walk in center where anyone in need can get assistance, do laundry, get mail and eat. One of my neighbors received a letter in regards to when and if sex offenders could be there. Also the shelter has given us a release form that parents are to sign when they stay at the shelter. Both make it clear that the shelter cannot and will not be able to keep all registered sex offenders out of what will be within the 300 foot "Exclusionary Zone" With the law the way it has been up until July, Ms. Canganelli and Ms. Persson have stated that the law didn't apply to the shelter as they didn't knowingly allow registered sex offenders to sleep there. As of July sleeping won't be the issue. The 300 feet "Exclusionary Zone" extends from HACAP and the School bus stop to the East 82 feet into the property adjacent to the East of 429 Southgate, south to where Waterfront drive dead ends, North to the North end of 1947 Southgate and West ;~ way to Gilbert Street. 1 With this law taking effect July 1, why hasn't the city done anything about this conflict? Are you planning to defy the new state law? Also would like to point out that in recent history there is recorded evidence in the police record of registered sex offenders useing the shelter durring day use. for example: Peter Mendoza, arrested 5/25/2009 for starting a fire at 332 S. Linn st. Report number 926977. The reason for this being linked to the shelter house is in the details of the report, "David Ward called shelter house to say a subject by the name of Peter Mareno is setting fires. Why would David Ward have called the shelter not the police if it were not for the fact that they were clients of shelter house. Peter Mendoza is also a registered sex offender. Peter is his alias. His real name is Ernest Espinosa Garcia and is on the sex offender registry in California. Another example is John Koch. His address given is 331 N. Gilbert, shelter house, and I am sure he isn't allowed to sleep there but must get meals and mail there and he is on the Wisconsin Sex offender Registry and was arrested Aug.12, 2008 for public intox. Another example is Demetrius Lee. In one arrest report, there are 2, he gives his address as 331 N. Gilbert and another as "no address given". He has been arrested for criminal trespass as well as attempted burglary and criminal mischief but he is also on the Georgia Sex offender Registry. These were just recent and easy ones to find. The City is aware of Senate File 340, and the changes it will bring to the Iowa Sex Offender Registry statute, Iowa Code Chapter 692A, on July 1, 2009. Our office has been working with the Library and the Parks and Recreation department to prepare for the changes the new law will bring. For clarity, let me first note that the two thousand foot (2,000') residency requirement under the new statute refers only to registered sex offenders who have been convicted of an "aggravated offense against a minor." Iowa Code Section 692A.101(2); 692A.114(2). This new language limits the applicability of this provision to a small portion of registered sex offenders. We believe Shelter House would qualify as a "residence" under 692A.101(24), so registered sex offenders who have been convicted of an aggravated offense against a minor may not reside there. No other sex offenders would be prevented by this statute from residing there. Of course, Shelter House could choose to impose their own restrictions, but the City of Iowa City may not. Iowa Code Section 692A.127 prohibits a City from passing its owli residency requirements or exclusion zones. You are correct that the newly created Iowa Code Section 692A.113(1)(d) creates an exclusion zone of three hundred feet (300') around child care facilities, among other locations; in which sex offenders who have been convicted of a sex offense against a minor may not loiter. Two distinctions are important: 1. This provision applies only to sex offenders who have been convicted of a sex offense against a minor, not all sex offenders; and 2. The so-called "exclusion zones" are not precisely titled, as they do not exclude sex offenders, but instead merely prohibit sex offenders who have been convicted of a sex offense against a-minor from "...remaining in a place or circulating around a place under circumstances that would warrant a reasonable person to believe that the purpose or effect of the behavior is to enable a sex offender to become familiar with a location where a potential victim may be found, or to satisfy an unlawful sexual desire, or to locate, lure, or harass a potential victim." See the definition of "loitering" under Iowa Code Section 692A.101(17). It is our opinion that nothing in this statute would prevent sex offenders who have been convicted of a sex offense against a minor from utilizing the services of Shelter House, as long as they do not erigage in "loitering" as defined above. I am not aware of any exclusionary zones that apply to the homes of children, or school bus stops, so their presence is of no legal effect under the statute. Perhaps the most important point of this discussion is that the burden is on the sex offender to comply with the law. While law enforcement agencies are under a duty to enforce this law, like any other law, neither non-profits nor private businesses are obligated to check for compliance with the law. Of course, they may choose to do so, if they feel it is in the best interest of their patrons, or the general public. For these reasons, the Iowa City Ptablic Library and the Iowa City June 19, 2009 Page 2 Parks and Recreation departments will be taking affirmative steps to ensure that sex offenders who have been convicted of a sex offense against a minor do not offend the provisions of the statute. Shelter House has already publicly indicated that their Board will be modifying the present policy you noted from their 2005 letter to be consistent with the 2009 changes in the sex offender statute. Those policies are controlled by the Shelter House Board alone, and not by the City of Iowa City. Regardless of their policy decisions, it is our opinion that the new Shelter House can be constructed and operated in full compliance with the new law, just as other businesses, agencies, and non-profits in "exclusion zones." You have asked why the City hasn't done anything about what you describe as a "conflict." From the City's perspective, the Shelter House provides no more conflict than any other business, agency, or non-profit operating within an "exclusion zone." Under 692A.127, the City has no power to impose additional restrictions there, or anywhere else. Sex offenders who have been convicted of a sex offense against a minor must not loiter there. Registered sex offenders who have been convicted of an aggravated offense against a minor may not reside there. The Iowa City Police will enforce the law at Shelter House, just as they will enforce it in every other exclusion zone. Sincerely, Eric R. While I agree that the 2000 foot residency restriction that exists still is for the most serious of offences. That was neither the part of the law I was refemng to or concerned about. I acknowledge that the shelter does not knowingly allow sex offenders to sleep at the shelter because they screen. The part that we questioned, which is also reflected in your interpretation of Iowa Code 692.A.101(17). The entirety of the new shelter facility would fall within the new 300 foot "exclusionary zone" and so how can they screen people as they have already entered 300 ft. of the daycare as well if you reference 692A.104 "Loiter" means remaining in a place or circulating around a place under circumstances that would warrant a reasonable person to believe that the purpose or effect of the behavior is to enable a sex offender to become familiar with a location where a potential victim maybe found, or to satisfy an unlawful sexual desire, or to locate, lure, or harass a potential victim. We believe that includes school bus stops that serve more than just our location. There are at least 3 separate places where children gather within this area to get on the school bus and get off to return home. We believe that is reflected in 692A.129 "Loiter on or within three hundred feet of the premises of any place intended primarily for the use of minors including but not limited to a playground available to the public, a children's play area available to the public, recreational or sport=related activity area when in use by a minor, a swimming or wading pool available to the public when in use by a minor, or a beach available to the public when in use by a minor. We feel that for the shelter to be effective in its services as well as to effectively be able to screen it people, yet be responsible to the new law, they cannot build within the 300 ft. exclusionary zone. For example: If a person on the registry comes in for day services, which is currently allowed at the shelter, they are "becoming familiar with a location where potential victims can be found" Iowa code section 692A.104. So even if they do not stay, even if the person is responsible fro their own reporting and actions this is not responsible on the part of the shelter house to introduce the person to the neighborhood by allowing their day usage within the 300 ft. exclusionary zone of the daycare and school bus stops. For example section 692A.106 of the Iowa Code "Residence" means each dwelling or other place where a sex offender resides, sleeps, or habitually lives, or will reside, sleep, or habitually live, including a shelter or group home. If a sex offender does not reside, sleep, or habitually live in a fixed place, "residence" means a description of the locations where the offender is stationed regularly, including any mobile or transitory living quarters. "Residence" shall be construed to refer to the places where a sex offender resides, sleeps, habitually lives, or is stationed with regularity, regardless of whether the offender declares or characterizes such place as the residence of the offender. Specifically I would like to point out "stationed with regularity, regardless of whether the offender declares or characterizes such a place as the residence of the offender." All these issues could be a moot point if the new shelter were not to fall within the 300 ft. exclusionary zone. We do not wish to change the services provided at the shelter house. We wish to see them successful and expand. We do not see how this can happen within the limits of the new law at this location. The City of Iowa City owns a property that would comply. In the airport development that would provide the shelter with bus service, access to jobs, (new wall mart) the lot size is priced similar to the lot price they have and it is double the size of the existing proposed location. Better school districting for the children of shelter house. With this site being a larger lot this would also provide them with an ability to expand at will of their services and they would not have to face the public scrutiny as they have in the past 4 years. I live in Wisconsin but have deceased relatives in Oakland. I like to come at least a couple of times during the warm months to decorate the graves. All of the tombstones have permanent vases mounted at least a foot above the ground level, and were quite expensive to purchase - at least $250 for each pair of vases at the time, many years ago. After leaving a few artificial flowers in the vases I was surprised to come back two months later and find them gone. I was informed that I am not allowed to place anything in the permanent granite vases except fresh flowers. I was amazed to hear of this policy. I have never heard of another cemetery with this kind of restriction. Igo past Memory Gardens and St. Joseph's Cemeteries and they are always decorated at al] times of the year, but I go to Oakland and it seems so grim and barren of decorations. Now I know why -they only accept fresh flowers and throw away any artificial ones -even those well protected in granite vases high above ground level. I called Memory Gardens and St. Joseph's and neither cemetery has the kind of restriction in place at Oakland. I've called my local cemeteries in Madison and likewise there are no similar restrictions. They even seem amused at my question -wondering what problem there could possibly be with placing artificial flowers in a permanent granite vase well above ground level I don't know why tombstone companies even sell vases to those customers for Oakland Cemetery since people won't be able to use them. Especially for out of town visitors, it seems useless to leave fresh flowers for decorations when they will be withered within a day or so. I was informed that the reason for the restriction against artificial flowers was that they are a hazard to crews using string trimmers. I think this is a stretch! An artificial flower in a granite vase a foot above ground level should not be a hazard to a well trained crew. I only wish the crews would be a bit more careful as I spend a lot of time cleaning off the grass clippings from the tombstone each time I come. It appears they don't use the trimmers properly and allow the clippings to fly all over -but that's not the reason I am writing to you today. I urge you to take another look at these overly strict grave decoration restrictions and make them more reasonable. I can understand the need for maintenance and safety, but let's balance that with more reasonable allowances for your customers who are attempting to leave some kind of remembrance for their deceased relatives. This correspondence will become a public record. June 16, 2009 meeting. I do not personally live or walk on any of the sidewalks in the areas that were specifically mentioned in this particular meeting. I choose to walk and or ride a bike as my main form of transportation. I could write many complaints about sidewalk maintenance and clearing. I do write complaints, but usually it must be repeated or very bad before I do so. Homeowners need to clear their walks. I personally would advocate more stringent enforcement of the ordinances. If a homeowner needs to be out of town it should be their responsibility to arrange for maintenance of their property. we all need to be more conscious of burning fossil fuels and exercising our bodies. Walking and using the sidewalks should be encouraged. Nothing can be more hazardous than a poorly maintained public walkway. If I fall and injure myself on someone's sidewalk it is not only an inconvenience but also endangers my ability to remain gainfully employed. Crutches in the snow and ice are NOT fun. Iowa City is fortunate to have a very good public library and recreation center as well as the senior center. The first two are resources for the whole community. The senior center is exclusively for those over fifty. Providing programs and opportunities to socialize for these older Iowa Citians helps to keep this population physically and mentally fit, living on their own, and thus contributes to the well being and peace of mind of their families. This is a huge contribution to the whole community as well. Why is the Center a place of such possibilities for older residents? The Old Post Office is a beautiful building but it is the members of the staff who have created a wealth of programming options, have organized volunteers to run or assist in running programs, and have made the atmosphere as welcoming as it is. My own experience is just one case history of many. I have lived in Iowa City for almost 40 years. I have been retired for the past 14 and have been increasingly active at the senior center. I exercise there, in classes and in the two exercise machine rooms. I am learning tai chi. I am one of the charter members of the women's pool (billiards) group and struggle weekly -with pleasure - to improve my game. I have taken literature classes with Ray Heffner and Ken Gavrell, drawing with Jim Ochs, and I started and continue to lead the Reading Aloud group in exploring the delights of reading poetry. I had solo exhibitions of my photographs twice, in 1995 and 2006. The first presentation about my book, The View from 70, after it was published, was at the Center. I am grateful for all these opportunities. Public sector programs are provided at Scanlon Gyn, Mercer Park, Iowa City, Coralville, North Liberty, UI Recreation Centers and Tiffin Exercise. Pricing varies even between two city departments; Collin Kersetter teaches Chair Fitness and Zumba classes at both Scanlon Gym and The Senior Center. At Scanlon the fee is ;4 per class, there is NO membership fee and no liability waiver required for adults. At the Senior Center that same class is $5 per class in addition to the membership fee and liability waiver, plus parking. ICJCSC has remodeled to make exercise equipment and space available. There is no trainer or supervisor on site and these rooms are automatically locked and opened only with membership access cards. Liability issues are "addressed" by having registrants sign a waiver which is not required of adults at the Iowa City Recreation facilities. Sports of interest to seniors at recreation centers include bowling, bocce ball, pickleball, horseshoe and tennis. Not locally available to seniors are Senior Slowpitch Softball League and training programs for Senior Olympics. Personal Note: As an experienced professional in adult education classes and a former fitness class participant 1 am concerned that many of the fitness classes at the Senior Center on all levels are offered for 3, 4 or 5 class meetings. 1 don't know how you can learn Yoga or Balanced Fitness in three class meetings. We know it takes longer for senior bodies #o limber up, adapt to new postures and exercises. Many of these topics are covered regularly by Elder Services. COIOAl1AlJIViTY ILVNOLVEMENT It appears that the community is invited to sponsor events or attend concerts, art walks and dances open to the public but there is little evidence of seniors becoming involved in the community under the aegis of ICJCSC. The premier senior volunteer group, Retired Senior Volunteer Program is a part of Elder Services,lnc. RSVP announced at the annual appreciation breakfast last week that they had 645 volunteers at 43 community "stations" contributing 31,250 hours of service last year. RSVP links seniors to community needs in schools, law enforcement, courts, care centers, Meals on Wheels and others. Their volunteers enjoy serving the community in intergenerational experiences. Still countless other seniors are involved in church , political end service groups such as NAMBI, Habitat for Humanity. An AARP project celebrating Senior Month In May of 2006 documented 62 events, classes and activities across the county, partnered with 118 businesses with 231 volunteers, generated 3,285 pounds of food for the Crisis Center plus 5395 in donations and 54440 in ticket sales for a senior volunteer show at the Englert to Iowa City Hospice. The 2008 ICJCSC Annual Report, p.10 lists 445 volunteers with 34,300 hours of service, comparable to RSVP in numbers yet we are confused as to what these volunteers provided and where. Also puuling is an entry, " 8,002 visits for Volunteer Programs:' To their credit, the ICJCSC attempted to collect non-perishable food for the Crisis Center but it was getting stolen so the effort was dropped. HARP and Johnson County Task Force on Aging focus on bringing seniors Into the larger community to hear about issues and become advocates for appropriate physical, social and political reforms. AARP fosters community services such as tax assistance and safe driving, legislative action and education. Note: HARP lost its shared office space (625 sq. feet) at the ICJSCS because it did not keep it staffed 30 hrs. a week as stipulated in a 1980 contract. The office has been used for storage and a dressing room for the custodian for over a year. AARP has recently been holding its monthly meetings at several libraries and community centers in the county. I couldn't match his numbers with those listed in the Summer Guide. He mentioned 31 "Special Events" while the Guide lists Boomer Bash, 4 Friday afternoon movies, Silver Swing Band at the Jazz Fest, not at the Center, an SSRO program and a Voices of Experience program. He cites 30 performance groups, the Guide lists Drill and Dance Team, New Horizon Band, New Horizon Orchestra, SSRO and Voices of Experience. He cites a "busy summer with TO different classes" The Guide shows 48 different classes„ 8 groups and clubs which meet at the Center, 5 special events and 5 performances, and we don't know how many of them will "make". (Example, a voice instructor was scheduled to teach last year, reported only one student registered yet his class was scheduled in later Guides and a room blocked out for his use.) 1 trust Jay can prepare and post a list if the Guide is not an accurate accounting. The ICJCSC administration must keep clear and meaningful data to allow the council to evaluate its cost-effectiveness. There is no air conditioning and it is unbearably hot and humid inside. The extreme temperature poses a risk for employees, volunteers, the public, and the animals housed there. I am aware the Director of Animal Services has made requests for air conditioning, and it is my understanding that such an expense has to go through a process of approval. I am very concerned that the process is taking too long and people are are risk as well as animals. While I know our shelter staff and volunteers do everything they can to make shelter animals comfortable, there is nothing they can do about the heat. There are fans all around the building at an attempt to help (which pose yet another risk with extension cords everywhere) but they do nothing but push hot air around. The animals are already stressed enough as it is, being abandoned and homeless, their immune systems and stamina are not like our family pets. With the high humidity, the floors stay wet all day from the regular required morning cleaning, this poses yet another (slipping) risk and also harbors bacteria and viruses. I know the location is only temporary, and A/C is expensive, but something needs to be done- and quickly. I implore you to please take action to help these animals and reduce the risk before the animals at the Iowa City Animal Center die or people get sick or injured. Cement Pavement recycling facility to be located east of and adjacent to Sharpless Auction at the intersection of I-80 and Herbert Hoover Highway. The Johnson County Zoning Code requires review by the City for all conditional use permits for property within the Fringe Area. In a memo dated June 18, City Staff noted that because the proposed site for the temporary use is outside of the Iowa City growth boundary, it is unlikely to have negative impacts on existing or planned development within Iowa City. The proposed site, which is in close proximity to the Interstate, will minimize the potential traffic issues related to transporting paving materials to and from the road construction site. At its June 18 meeting, The Iowa City Planning and Zoning Commission recommended by a vote of 5-0 (Busard abstained, Eastham absent) that the City Council recommend approval of this conditional use permit subject to a sunset clause for removal of the recycling facility and all associated equipment and materials. The City Council concurs with the Commission's recommendation and recommends that the conditional use permit requested by Peterson Contactors, Inc., be approved, subject to a date for removal of the recycling facility and all associated equipment and materials no later than 6 months after completion of the Interstate reconstruction project. Peterson Contractors, Inc. has submitted an application to the Johnson County Zoning Commission and the Board of Supervisors for a conditional use permit to allow a temporary Portland Cement Pavement and Asphaltic Cement Pavement recycling site to be located on Lot 3 Sharpless Division. The 12.74-acre property is located east of and adjacent to Sharpless Auction at the intersection of I-80 and Herbert Hoover Highway, outside of the City's growth boundary but within Fringe Area B of the Fringe Area Policy Agreement. The Johnson County Zoning Ordinance requires that cities be allowed to review conditional use permits within their extraterritorial jurisdiction. Conditional use permits in Johnson County require a 4/5 majority vote of the Board of Supervisors to approve if the use is opposed by a vote of the City Council. In June 2009, the Iowa Department of Transportation will remove and replace pavement along Interstate 80, from the Iowa River Bridge east to Highway One. The proposed temporary recycling facility will provide service for the planned upgrading of a portion of Interstate 80. Once removed, pavement will be hauled to the recycling site, crushed, and then hauled back to the Interstate 80 to be used as sub-base material for the new roadbed. Recycling pavement is a common practice in road reconstruction and may conserve energy and resources, and eliminates the need for disposal. The applicant has indicated that the improvements for I-80 will take 2 to 3 years to complete. , There are no buildings on the proposed site, which is vacant and has been filled with excess soils over the last 5 to 10 years. Access to the recycling site will be along the existing driveway at the northeast corner of Lot 2 of Sharpless Subdivision. According to the application letter, there will be no requirements for a well or wastewater system. Portable restrooms will be provided to the employees.
