CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON oq _ a.3a- JULY 28, 2009 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE IOWA CITY POLICE STORAGE PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: The project will involve the remodeling of the lower level of the North Water Treatment Facility into secure storage and an office and restroom space for the Police Department. The work includes general building construction, and mechanical, and electrical work. The estimated construction cost is $271,500 and will be funded by General Obligation bond proceeds. d) Resolutions. O ~ 3 3 1. Comment: The project has been completed in substantial accordance with the plans and specifications. The Engineer's Report and Performance and Payment bonds are on file with the City Clerk. CONSIDER A RESOLUTION APPROVING THE ACCEPTANCE OF THE DEDICATION OF A 0.09 ACRE PARCEL OF LAND ON AUDITOR'S PARCELS 2004120, ALONG SOUTH GILBERT STREET IN IOWA CITY, JOHNSON COUNTY, IOWA, AS PUBLIC RIGHT-OF- WAY. Comment: This right-of-way is being dedicated to clean up title to certain right-of-way currently being used as right-of-way. This dedication is occurring at this point because the owners of the adjacent property desire to adjust the boundary line between Auditor's Parcels 2004121 and 2004120. PLANNING AND ZONING MATTERS. a) CONSIDER AN ORDINANCE AMENDING TITLE 14, ZONING, ADDING A BUSINESS SERVICES LAND USE CATEGORY, MODIFYING THE STREET WIDTH STANDARDS FOR INSTITUTIONAL USES IN RESIDENTIAL ZONES, AND CLARIFYING APPLICABLE REGULATIONS TO AND ALLOW MINOR MODIFICATIONS TO SITE DEVELOPMENT STANDARDS IN THE PUBLIC ZONE. (PASS AND ADOPT) Comment: At its May 21, 2009 meeting, by a vote of 5-0 (Busard & Plahutnik absent), the Planning and Zoning Commission recommended approval of this ordinance. Staff recommended approval in a report dated May 15. Approval will add a Business Services land use category, modify the street width standards for institutional uses in residential zones, and clarify applicable regulations to and allow minor modifications to site development standards in the Public Zone. July 6, 2009 City of Iowa City Page ITEM 5. CONSIDER AN ORDINANCE AMENDING TITLE 6 "PUBLIC HEALTH AND SAFETY" TO AMEND THE RESTRICTED GARBAGE DUMPSTER PICK-UP HOURS _ Oq -'~l~ ~J S~ AFTER 10 P.M. AND BEFORE 7 A.M. (SECOND CONSIDERATION) Comment: This ordinance amends the Noise Control section of the City Code to change the start time for the emptying of dumpsters from 6:00 a.m. to 7:00 a.m. in areas where such activity would create a noise disturbance within or near residentially zoned areas. This change is in response to a number of complaints from residents. All other restrictions remain unchanged. A letter was sent to local haulers seeking input on the proposed change. One objection was received, noting that this change may impede the morning schedule for their work. Staff recommends expedited action. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A LICENSE AGREEMENT FOR TEMPORARY USE OF PUBLIC p~r c13~p RIGHT-OF-WAY BETWEEN THE CITY OF IOWA CITY, LANDOWNER WILLIAM AND JOAN GILPIN REVOCABLE TRUST, AND TENANT 2-TONE, INC., D/B/A BLUE BIRD DINER, FOR A SIDEWALK CAFE. Comment: William and Joan Gilpin, as landowner, and 2-Tone, Inc., d/b/a as Blue Bird Diner, seek a license agreement for temporary use of public right-of-way at 330 E. Market Street, Iowa City, Iowa for a sidewalk cafe. City staff and Design Review have reviewed the plans and specifications and required submittals and recommend approval of said Action: ITEM 7. CONSIDER A RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE TRANSPORTATION SERVICES DEPARTMENT AND THE AFSCME PAY PLAN BY y~ ,. X37 DELETING ONE FULL-TIME MAINTENANCE WORKER II -TRANSIT BUILDING MAINTENANCE POSITION AND DELETING THREE FULL-TIME MAINTENANCE WORKER II -PARKING SYSTEMS -DAYS POSITIONS AND ADDING FOUR FULL-TIME MAINTENANCE WORKER II - TRANSPORTATION SERVICES POSITIONS. Comment: In the Fall of 2008, the maintenance operations within the Parking and Transit Divisions merged when the department was reorganized and the name was changed to the Transportation Services Department. As a result of the reorganization, the MWII -Transit Building Maintenance position is performing the same duties as the MWII -Parking Systems -Days position. Staff recommends deleting the 1.0 FTE Transit Building Maintenance (AFSCME Grade 4) and the 3.0 FTE MWII-Parking Systems -Day (AFSCME Grade 5) and adding 4.0 FTE MWII-Transportation Services (AFSCME Grade 5). CONSIDER RESOLUTION ESTABLISHING A REVISED SCHEDULE OF RATES r ~~g AND CHARGES FOR INTERMENTS, LOT SALES AND OTHER SERVICES IN OAKLAND CEMETERY. Comment: Cemetery rates and charges were last reviewed in 2001. Department staff recommend that additional fee charges are in order after discussion with area funeral directors. Recommended fee schedule is in line with appropriate charges and is competitive compared to costs charged by other area cemeteries. In lieu of FY 10 budget discussions these new fees are being proposed. Staff memorandum included in Council packet. Action: llJr~~ ITEM 9. CONSIDER A RESOLUTION ADOPTING REGULATIONS FOR OAKLAND a9 ~ ~3q CEMETERY REGARDING THE RIGHTS OF LOT OWNERS, MAINTENANCE PRACTICES AND RULES FOR VISITORS. Comment: Regulations for Oakland Cemetery were last adopted in 2001. A few of these regulations have been changed to support the revised schedule of rates and charges for interments, lots sales, and other services in Oakland Cemetery. See staff memorandum included with item above. Action: ITEM 10. ANNOUNCEMENT OF VACANCIES. Applicants MUST reside in Iowa City and be 18 years of age unless specific qualifications are stated. [Staff will not publish additional notices after a period of six publications; but will continue to advertise vacancies with postings and on the Council agenda.
