Notice is hereby given that a public hearing will
be held at which the Council will consider:
An ordinance rezoning property located
at 2525 Highlander Place from Highway
Commercial (CH -1) to CH -1 with a
Historic District Overlay (OHD/CH-1).
(REZ20-0014)
Copies of the proposed ordinance are on file for
public examination in the office of the City Clerk,
City Hall, Iowa City, Iowa, which is currently closed
to the public because of the coronavirus. Copies
are available by telephoning the City Clerk at
319/356-5043 or emailing kellie-fruehlinqaiowa-
city.orq.
The public hearing will be held at 7:00 p.m. on
February 16, 2021, in Emma J. Harvat Hall of the
Iowa City City Hall, 410 E. Washington Street,
Iowa City. If City Hall remains closed to the
public, the meeting will be an electronic meeting
using the Zoom Meetings Platform. For

Whereas, the applicant, Highlander Hotel, LLC, has requested a rezoning of property located
at 2525 Highlander Place from Highway Commercial (CH -1) to Highway Commercial with a
Historic District Overlay (OHD/CH-1); and
Whereas, this structure was originally constructed in 1967 and is significant to Iowa City's
history; and
Whereas, this structure is associated with architecture significant to the mid -west and Iowa; and
Whereas, the Comprehensive Plan encourages the preservation of historic buildings to
encourage the retention and expansion of existing businesses; and
Whereas, Goal 1 of the Historic Preservation component of the Comprehensive Plan calls
for identification of resources significant to Iowa City's past with the objective of designating
individual buildings as landmarks; and
Whereas, the Historic Preservation Commission has reviewed the proposed Historic
Landmark designation, has found that it meets the criteria for landmark designation in its
significance to Iowa City history, integrity of location and design, association with events that have
a significant contribution to the broad patterns of history, and embodies distinctive characteristics
of the period and has recommended approval; and
Whereas, the Planning and Zoning Commission has reviewed the proposed Historic
Landmark designation rezoning, has found that it meets the Comprehensive Plan goals of
improving the economic and environmental health of the community through efficient use of
resources, and encouraging the retention and expansion of existing businesses;
Now, therefore, be it ordained by the City Council of the City of Iowa City, Iowa:
Section I. Historic Landmark Approval. Property described below is hereby reclassified to
Highway Commercial with a Historic District Overlay (OHD/CH-1) zone:
Lot 24, Highlander Development Second Addition, Iowa City, Iowa, according to the plat thereof
recorded in Book 38, Page 155, Plat Records of Johnson County, Iowa.
Section II. Zoning Map. The Building Inspector is hereby authorized and directed to change
the zoning map of the City of Iowa City, Iowa, to conform to this amendment upon the final
passage, approval and publication of this ordinance by law.
Section III. Certification And Recording. Upon passage and approval of the Ordinance, the
City Clerk is hereby authorized and directed to certify a copy of this ordinance and to record the
same, at the office of the County Recorder of Johnson County, Iowa, at the owner's expense, all
as provided by law.

Section IV. Repealer. All ordinances and parts of ordinances in conflict with the provisions of
this Ordinance are hereby repealed.
Section V. Severability. If any section, provision or part of the Ordinance shall be adjudged to
be invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a
whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
Section VI. Effective Date. This Ordinance shall be in effect after its final passage, approval
and publication, as provided by law.

Findings
• Wood siding is partially present and lacks moisture barrier.
• Holes in the wood from insulation and are observed to have insect
damage and decay
• Lack of trim details are not present on windows or doors
• Evidence of moisture damage is present in the house
Staff response
• Siding is in "good" condition and could reasonably be retained
• The moisture content is low, at 6-7% indicating no moisture issues
• The wooden siding can be scraped and sanded to remove lead
based paint and repainted
• Retaining the material is consistent with previous decisions and
follows ICHPP and the Secretary of Interior's Standards for
Preservation
Good condition?
• The issue is deeper than just the condition of the wood. The house a system is fundamentally
different now than it was in 1924. The walls have clearly been insulated, the original trim has been
removed and the wood is now a swiss cheese amalgamation of insulation access points and nail
penetrations from the aluminum siding. The challenge of properly repairing this system is
immense and likely technically infeasible. The removal of the original trims (likely because they
failed) causes a challenge to properly flash and ensure water tightness around the penetrations
and openings which will ultimately lead to water infiltration into the wall and insulation and a
long term mold issue. Additionally, according to Building Science Corporation (BSC) article
BSI -023 "adding insulation to walls or increasing insulation levels in walls causes paint to
fail"
• The existing wood siding at 1113 East Court is applied tight to the wood sheathing,requiring an
absolutely flawless repair and water sealing of all of the exposed wood in order to function as the
drain plane. However, as the articles above illustrate, this will only be a temporary solution as the
paint is destined to fail with the inevitable movement of the wood through seasonal expansion and
contraction creating a long term maintenance issue in the best case and a house wide mold
and health hazard in the worst [case].

• Was measured on the surface of siding in the driest part of the year at
a temperature of -15° C 16°F
• Measured with an instrument that staff admitted is unreliable in
freezing conditions on a day when it was below zero
• Moisture meter calibration to wood species?

Obvious signs of moisture damage to underlying sheathing were
ignored
Cold winter temperatures can have an adverse effect on some moisture meters during the winter. Usually, though,
the impact of cold temperatures on a moisture meter's readings are minimal—unless those[temperatures are in the;
[freezing zone; This is because high or low temperatures can affect the electrical conductivity of a material—which
affects the accuracy of the moisture reading.

"Bristow explained Sanborn maps and other evidence say this house was originally clad in
asbestos siding. No one knows what is underneath the existing synthetic siding and
insulation. if they find asbestos shingle siding in good condition, they may keep it. She said
nothing would require that they remove it. If the original siding was completely removed
or found to be in poor condition, staff recommends new cement board shingle siding
to capture the original intent.
Bristow reiterated that this project has a Targe scope: Removal of the garage, construction
of a new garage, a house addition, and window and siding replacement. Staff
recommends approval."

"Bristow said one project where all of the original siding was approved
to be removed was a house that was insulated without a vapor
barrier being able to be installed. She referred to the Bob Yapp article.
Bristow said moisture from the interior of the house migrates into the wall
and condensates in the wall cavity. The insulation holds that moisture
and does not dry out.
Bristow said that this issue was obvious on the house at 424 Clark Street
because it was possible to see that the siding was failing and could no
longer hold paint. Because of the deteriorated siding, the owner was
approved to replace it with cement board."

Substituting wood siding is allowed "if the substitute material retains the appearance and function
of the original wood. The substitute material must be durable, accept paint and be approved by the
Historic Preservation Commission. In many applications, fiber cement board with a smooth
finish is an approved wood substitute"
The Secretary of the Interior's Standards for Rehabilitation
The Standards (Department of Interior regulations, 36 CFR 67) pertain to historic buildings of all
materials, construction types, sizes, and occupancy and encompass the exterior and the interior,
related landscape features and the building's site and environment as well as attached, adjacent,
or related new construction. The Standards are to be applied to specific rehabilitation projects in a
reasonable manner, taking into consideration economic and technical feasibility.

"Bristow showed the front of the house and said that the demolition would involve all of the porch
structure."...
"Bristow added that it is very, very dark on the porch. She said that part of the applicants' interest with the front
porch work is to increase the amount of Tight that comes in through the front. Bristow said that to do that, the
applicants would remove the astragal and put it up at the point where the beam rests or the columns and remove
one part of the arch, creating a flat beam on tapered columns. She showed an example of that. Bristow said staff
feels that if the balustrade could remain and the material was sound, the panelized balustrade is again another
aspect of the history of the house. She said that at the same time, the applicants would like to get more Tight in,
and that would help make the area darker. Bristow showed some photographs of the porch, which show that
it is fairly dark and that it seems to have a really Tow beam across the front.
"Agran said the phrase "false history" is used in terms of deciding which elements of the history of this house staff
is determining to be "false history" or real history. He said it strikes him as strange that staff would say that we
should hold on to certain elements from a certain era of this house but would allow the removal of other
things."
"Agran said he has no problem with spindles but was just curious about what it means if the Commission makes
this exception. He said that the exception is based not on the integrity of the material but the whim of the
owner. Agran said he wanted to understand the rationale."
Summary
• Staff has made assumptions about the feasibility and reliability of the
wood that are contradicted by licensed professionals
• Staff has made a decision based on evidence that they admit is faulty
and unreliable
• Staff has recommend methods of lead removal that are dangerous,
violate EPA regulations, and would lead to civil penalties were we to
follow them
• Staff has refused to address the underlying issue of a lack of a moisture
barrier
• Cost up to this point: $2,000. 34 months since the first inquiry.
• We are simply trying to protect our family from any health hazards posed
by either lead paint or mold/pests; protect the integrity of the structure for
future generations; and to prevent unnecessary costs of not installing the
siding the correct way the first time

TO ALL TAXPAYERS OF THE CITY OF IOWA CITY,
IOWA, AND TO OTHER INTERESTED PERSONS:
Public notice is hereby given that the City Council of
the City of Iowa City, Iowa, will conduct a public hearing on
the Project Manual, including the plans, specifications,
contract, and estimated cost for the construction of the
Collector Well Nos. 3 and 4 Rehabilitation project in said
city at 7 P.M. on the 16th day of February, 2021, said
meeting to be held in the Emma J. Harvat Hall in the City
Hall, 410 East Washington Street in said city, or if said
meeting is cancelled, at the next meeting of the City
Council thereafter as posted by the City Clerk. If City Hall
is closed to the public due to the health and safety
concerns from COVID-19, the council meeting will be an
electronic meeting using the Zoom Meetings. For

This project includes dewatering Collector Well Nos. 3
and 4, rehabilitating Collector Well Nos. 3 and 4 (three
laterals each), and repairing or replacing associated
pumping equipment.
Said Project Manual and estimated cost are now on file
in the office of the City Clerk in the City Hall in Iowa City,

The City Council will conduct a public hearing on the proposed Fiscal Year City property tax levy as follows:
