7. Resolutions and Motions
7.a. June 2021 Disbursements
Motion to approve disbursements in the amount of$10,014,614.19
for the period of June 1 through June 30, 2021 , as recommended
by the Finance Director subject to audit. Disbursements are
published and permanently retained in the City Clerk's office in
accordance with State Code.
7.b. Alcohol Agreement- Farm to Table
q1 Resolution approving an agreement with the Downtown District to
allow the sale, consumption, and possession of beer and wine
during the Farm to Table Dinner on a City street.
Comment This resolution allows the Downtown District to sell beer and wine during the
Farm to Table Dinner on Aug. 19 on an area on N.Linn St.The agreement,which is
attached to the resolution, is substantially the same as past years,and Exhibit A shows
the exact location.
7.c. Alcohol agreement-Arts Fest
Resolution approving an agreement with Summer of the Arts, Inc.
to allow the sale, consumption, and possession of beer and wine
on City streets during the Iowa Arts Festival.
Comment:The City Code allows private entities to sell and their customers to
consume and possess alcohol on public right-of-way.This resolution approves
an agreement with Summer of the Arts, Inc.to be able to sell beer and wine in a
demarcated area on Iowa Ave.during Arts Fest on Aug. 13-15.The agreement
is substantially similar to previous ones.
7.d. Listing Agreement-Industrial Campus
Resolution authorizing the City Manager to sign a one-year
extension of the listing agreement with Lepic-Kroeger Realtors for
the Iowa City Industrial Campus.
Comment:The lowa City Industrial Campus is a City-owned industrial use site on 420th
Street. In 2015 the City Council approved a one-year listing agreement with Lepic
Kroeger, Realtors to sell the lots.The agreement has since been extended each year,
and this resolution extends it again until July 15,2022.

7.e. Bulk Sale of Bus Passes
Resolution authorizing the City Manager to sign an agreement
with Tailwind Iowa City, LLC for the bulk sale of bus passes.
Comment:Tailwind Iowa City, LLC(Tailwind")owns a multi-family residence
with approx.900 tenants at 2401 Highway 6 known as The Quarters.Tailwind's
tenants indude many University of Iowa and Kirkwood students.Tailwind
desires to discontinue its private bus service, and this resolution approves a 3-
year agreement for the purchase of 900 annual bus passes.
7.f. Ryerson's Woods-REAP grant
Resolution authorizing the City Manager to submit a Resource
Enhancement and Protection (REAP) grant application for
Ryerson's Woods Park and to sign a grant agreement if awarded.
Comment The Iowa Dept.of Natural Resources administers Resource
Enhancement and Protection(REAP)grants for development and enhancement
of land for outdoor recreation.The grant process requires City Council approval of
a grant submission,and City staff would like to apply for a$200,000 grant for
woodlands restoration at Ryerson's Woods Park.
_ 7.g. Energy Efficiency TIF Grant Agreement: ALPLA

" -O - Resolution approving agreement between ALPLA, Inc., and
the City of Iowa City.
Comment In August of 2020,the City amended the Scott Six Urban Renewal Plan to
indude an economic development grant program funded by the tax increment in the
area,to assist in energy efficiency improvements by companies in the urban renewal
area.ALPLA, Inc.has applied for an energy efficient chiller and upgrade to LED of all
interior and exterior lighting.
7.h. City Park Adventure Playground

Playground Project.
Comment The project has been completed by All American Concrete of West
Liberty, Iowa, in substantial in accordance with the plans and specifications.The
Engineer's Report and Performance and Payment bonds are on file with the
City Clerk.

7.m. Nevada Avenue Sanitary Sewer Replacement Construction

NevadaAvenue Sanitary Sewer Replacement Construction Project
and setting a new date for receipt of bids for the rebidding of Nevada
Avenue Sanitary Sewer Replacement Construction Project, directing
City Clerk to post notice to bidders, and fixing time and place for
receipt of bids.
Comment: Bids for this project were received on Thursday,July 8,2021 and the
following bids were received:

The bid received exceeds the amount available in the project fund. Public Works and
Engineering recommend rejecting the bid and rebidding the project. Funding is

7.o. Biennial Bridge Inspection and Master Plan 2021
" l(-' Resolution approving, authorizing and directing the Mayor to
execute and the City Clerk to attest Amendment No. 1 to the May
18, 2021 agreement by and between the City of Iowa City and
Calhoun-Burns and Associates, Inc. to provide engineering
consultant services for the Biennial Bridge Inspection and Master
Plan 2021 Project.
Comment The City entered into an Agreement with Calhoun-Bums and
Associates to perform field inspections and prepare the documentation for the
Biennial Bridge Inspection and Master Plan 2021 Project. It has been
determined that a more detailed Element Level Inspection is required for the
Burlington Street and Iowa Avenue Bridges that require use of a snooper truck.
Amendment No. 1 has been negotiated and the total amount of the Agreement
and Amendment is$60,200 which exceeds the City Manager's approval
authority.
7.p. Workers' Compensation
! Resolution authorizing the City of Iowa City to apply for
membership in the Iowa Municipalities Workers'
Compensation Association (IMWCA).
Comment: In the Spring of 2021,the City's insurance broker sent out requests for
proposals for workers'compensation insurance for the City.After reviewing proposals
from the existing excess carrier and IMWCA,the City derided to select IMWCA as the
City's worker compensation carrier effective 6/26/21.This resolution,as required by
IMWCA,authorizes the City of Iowa City to apply for membership in the Iowa
Municipalities Workers'Compensation Association(IMWCA),a Chapter 28E
association,and authorizes and directs the City Manager to execute the documents
necessary for the City of Iowa City to become a member of the Association.
7.q. Acceptance of ROW Dedication
2l - 21 2. Resolution accepting the dedication of right-of-way adjacent to
McComas Homestead, Johnson County, Iowa.
Comment:This right-of-way is being dedicated to dean up title to the American Legion
Road right-of-way in conjunction with a county subdivision.

7.r. FY22 Legacy Aid to Agencies Allocation Revision
2-� 3 Resolution to revise human services Legacy Aid to Agencies
funding allocations for Fiscal Year 2022, July 1, 2021 - June 30,
2022.
Comment The FY22 Legacy Aid to Agencies allocations were approved by Council
May 4,2021. Due to an increase in Community Development Block Grant funds
available for public services,and the 3%increase in the Aid to Agencies budget
approved by Council,additional funds are available for a prorated increase to Legacy
Agencies allocations.
7.s. Housing Trust Fund Contribution

-2-)4 Resolution authorizing the City Manager to sign a Memorandum of
Understanding with the Housing Trust Fund of Johnson County for
the contribution and use of$500,000 for affordable housing.
Comment This resolution provides the Housing Trust Fund of Johnson County with
$500,000 for affordable housing.The MOU attached to the resolution requires that
funds serve households under 80%of the Area Median Income,units must be located
within corporate limits of Iowa City,and projects must comply with the Affordable
Housing Location Model. Eight percent of the allocation($40,000)may be used for
administrative expenses.
7.t. Forensic Analysis Agrccment
— '` �' Resolution authorizing the Mayor to sign and City Clerk to attest a
Chapter 28E agreement with Johnson County and University of
Iowa for a joint forensic analysis team ("J-FACT").
Comment:The Police Dept., Sheriffs Office,and the University Dept.of Public Safety
have taken steps in their respective agencies to invest in specialized training and
equipment for digital and cyber evidence examination and collection.This resolution
approves an agreement among these three entities to join their capabilities and
resources while sharing skills,equipment,knowledge,and revenue.The Board of
Supervisors approved it on June 8.

(-- ,14-06 Comment The Punning and Zoning Commission recommended approval of VAC20-
�k-�5 0003 by a vote of 7-0.The applicant intends to purchase the adjoining lots and
redevelop all assembled properties.The subject right-of-way will not be necessary for
City or public use after the adjacent properties redevelop.Conveyance shall be
contingent upon the retention of an access easement, private utility easement,and
sanitary sewer easement for so long as the adjacent properties are occupied,
and a new sanitary sewer has been built in a location accepted by the City.The
applicant desires to purchase the right-of-way for fair market value.
8.b. Sale of 322 Douglass Ct.
2J Co Resolution setting a public hearing for August 17, 2021, on a
proposal to convey a single-family home located at 322 Douglass
Court.
Comment The UniverCity Partnership Program encourages homeownership and
reinvestment in designated neighborhoods surrounding the University.The City
purchases rental units in the designated neighborhoods,rehabilitates them,and sells
them to eligible buyers.The City renovated 322 Douglass Court and wishes to convey
the single-family home for$134,000.
8.c. Muscatine Avenue Pedestrian Crossing
21 - -L1 -7 Resolution setting a public hearing on August 17, 2021 on project
manual and estimate of cost for the construction of the Muscatine
Avenue Pedestrian Crossing Project, directing City Clerk to publish
notice of said hearing, and directing the City Engineer to place said
project manual on file for public inspection.
Comment:This project indudes installation of an accessible mid-block crosswalk with
pedestrian refuge areas on Muscatine Avenue between Wade Street and Williams
Street,and construction of pedestrian circulation areas for the installation of new bus
shelters.The bus stops will implement electrically-conductive concrete pavement.The
estimated construction cost is$88,000 and will be funded by Muscatine Ave
Pedestrian/Transit Amenities account#T3065.

8.d. Second Avenue Bridge over South Branch of Ralston Creek
- 1 Resolution setting a public hearing on August 17, 2021 on project
manual and estimate of cost for the construction of the Second
Avenue Bridge over South Branch of Ralston Creek Project,

the City Engineer to place said project manual on file for public
inspection.
Comment This project indudes the replacement of the Second Avenue Bridge over the
south branch of Ralston Creek and streambank stabilization,sidewalk,water main,and

Comment At its May 6,2021 meeting,by a vote of 6-1 (Marlin in the negative),the
Planning and Zoning Commission recommended approval of this rezoning subject to
conditions related to woodland management,trail connections,traffic calming,right-of-
way trees,and platting.This rezoning was considered by the Commission three times
due to concerns about its compatibility with the neighborhood and consistency with the
comprehensive plan's concept for a single-loaded street in this area.The Commission
recommends approval of this version of the plan,which is responsive to the concerns

Ordinance Amending Tile 5, Entitled "Business and License
Regulations,"Chapter 2, Entitled 'Taxicabs,"to allow for flexibility in the
requirements for pedicab lettering. (First Consideration)
Comment Taxicabs that are motor vehides and pedicabs have some of the same Code
requirements.A recent applicant for a pedicab license raised a question with the lettering
requirement,which is the same as for motor vehicles. Because pedicabs are smaller than
motor vehides and vary in design,the lettering requirements for pedicabs should be
flexible.

Comment: Iowa Code section 453A.22(2)provides that,after a hearing,a civil penalty shall be

providing tobacco to a minor.This hearing is the time designated for the Council to consider
