6.a. Rohret South Truck Sanitary Sewer
I `I Resolution approving, authorizing and directing the Mayor to
execute and the City Clerk to attest an Agreement by and
between the City of Iowa City and Strand Associates, Inc. to
provide engineering consultant services for the Rohret South
Trunk Sanitary Sewer Project.
Comment This item will approve an agreement with Strand Associates, Inc.to provide
preliminary design,final design,preparation of a project manual for bidding,permitting,
bidding assistance,and constructions services for the Rohret South Trunk Sanitary
Sewer Construction Project The project proposes to extend the sanitary bunk sewer
from the Willow Creek Interceptor to the west side of US Highway 218 to serve future
City growth.The negotiated fee is not to exceed$375,000 and will be funded by the
Rohret South Sewer Project,Account#V3155.
6.b. Landfill Gas Collection System Expansion
" Resolution awarding contract and authorizing the Mayor to sign
and the City Clerk to attest a contract for construction of the
Landfill Gas Collection System Expansion Project.
Comment Bids for this project were received on Tuesday,January 25,2022 and
the following bids were received:

Public Works and Engineering recommends awarding the contract to Landfill Drilling and
Piping of Sun Prairie,Wisconsin. Funding is available in the Landfill Gas
Infrastructure Expansion account#L3343.

6.c. Benton Street Rehabilitation
z - z 1 Resolution rejecting all bids received on January 19, 2022 for the
Benton Street Rehabilitation Project [STP-U-3715(669)-70-52].
Comment Bids for this project were received by the Iowa Department of
Transportation on Wednesday, January 19, 2022 and the following bid was
received:
Boomerang Corp. Anamosa, IA $ 4,518,620.00
Engineer's Estimate $ 3,200,000.00
The bid received exceeds the estimated cost by more than 41%. Public Works and
Engineering recommends that Council reject the bid and re-bid the project at a future
date. Funding is available in the Benton Street Rehabilitation Project account#S3947.
7. Setting Public Hearings
7.a. Maximum Property Tax Levy
ZZ—ZZ Resolution setting a public hearing on setting the maximum
property tax levy for certain levies for the proposed budget ending
June 30, 2023.
Comment Cities are required to hold a public hearing to set a maximum property tax
levy for certain levies.
7.b. Chadek Green, Whispering Meadows & Court Hill Parks
Improvements
ZZ — Z j Resolution setting a public hearing on February 15, 2022 on project
manual and estimate of cost for the construction of the Chadek
Green, Whispering Meadows & Court Hill Parks Improvements
Project, directing City Clerk to publish notice of said hearing, and
directing the City Engineer to place said project manual on file for
public inspection.
Comment This agenda item begins the bidding process for the construction of the
Chadek Green,Whispering Meadows&Court Hill Parks Improvements Project
Improvements include new playgrounds,a restroom,water hydrants and an accessible
parking bt Shelters will be bid as alternate bid items.The estimated cost of construction is
$820,000 and will be funded by the Chadek Grccn Park Playground and Shelter account
#R4350,the Whispering Meadows Park Ecological Restoration&Park Improvements
account#R4357,and the Court Hill Park Shelter&Playground Replacement account
#R4368.

9. Planning and Zoning Matters
If a majority of the Council is inclined not to concur with the Planning and
Zoning Commission recommendation a consult with the Planning and

Ordinance rezoning approximately 0.13 acres of property located
at 421 E. Market Street from Commercial Office (CO-1)to Mixed
Use(MU). (RF721-0010)
Comment At its January 5 meeting, by a vote of 5-0(Nolte and Padron absent),the
Planning and Zoning Commission recommended approval of this rezoning.Approval will
allow for future redevelopment of the property under the Mixed Use zoning designation,
which will allow for single-family residential and two-family(duplex)residential uses in
addition to general and medicaUdental office uses.

10. Iowa City Public Works Material Storage Bins
Resolution approving project manual and estimate of cost for the
construction of the Iowa City Public Works Material Storage Bins
Project, establishing amount of bid security to accompany each bid,
directing City Clerk to post notice to bidders, and fixing time and place
for receipt of bids.
Comment:The Iowa City Public Works Material Storage Bins Project indudes the base bid of
one 1,600 SF covered storage area to allow for the improved storage of sand/salt mixture and
other materials.The project consists of selective demolition,pavement rework,electrical site
lighting to assist with 24/7 operations,improved drainage and new storm sewer.An alternate for
an additional 1,600 SF is included in the final plans.The estimated cost of construction is
$400,000 and funds are available in the Sand/Salt Storage Bunkers account#P395.

members.At the Oct 19 work session,Council directed staff to draft an ordinance increasing the

13. Farmer's Market- Insurance
Ordinance amending Title 10 of the City Code, entitled "Use of Public
Ways and Property," Chapter 11, entitled "Farmer's Market,"to require all
vendors to carry insurance. (Second Consideration)
Comment:The City Code currently requires only grilling vendors to carry liability insurance.This
ordinance will require all vendors to carry insurance to ensure a level of protection for both the
vendors and customers in case of potential daims due to the actions of a vendor.The insurance
requirement is consistent with vendor requirements of other farmer martkets held in municipalities

14. Downtown SSMID Amendment
2) - f� 7 5- Ordinance amending Title 3, "Finance, Taxation and Fees", Chapter 7,
"Iowa City Downtown Self-Supported Municipal Improvement District",
Section 4 "Operation Fund"of the City Code to conform to amendments
in Iowa Code Chapter 386 regarding multi-residential properties. (Second
Consideration)
Comment:Since adopting the Downtown SSMID ordinance in 2015,properties dassffied as
multi-residential for property tax purposes have been assessed and have paid the SSMID tax
vy.
Pursuant to state code,the SSMID tax has not been levied against property assessed as
residential property. Recent state code changes redassified mutti-residential properties as
residential,but gave the City the authority to continue levying the SSMID tax against such
properties.This amendment is appropriate to track the state code changes,thus preserving the
status quo.Staff is requesting xpedited action. '�"

15. Assessment Schedule
22 - Resolution adopting an assessment schedule of unpaid mowing, dean-up
of property, snow removal, sidewalk repair, and stop box repair charges
and directing the Clerk to certify the same to the Johnson County
e Treasurer for collection in the same manner as property taxes.
Comment The City has the authority under Iowa Code§364.13B to assess the nuisance
abatement costs in the same manner as a property tax.This resolution allows the City Cleric to
certify to the Johnson County Treasurer the abatement cost to be assessed against the property.
This assessment is being pursued only after the City took many steps to resolve the matter.The
City notified the property owners to abate the nuisance(for example,to remove snow from the
sidewalk)and after the owner did not take action to abate the nuisance,the City abated the
nuisance and billed the owner.After being billed at least twice,these owners still have not paid the
abatement costs.The City has sent a letter to the owner giving them notice that this resolution would
be on the agenda,a copy of which is attached to the resolution.No interest will be charged if the
owner pays within 30 days of the first required publication.Attached as an exhibit to the resolution is
a list of the properties that will be assessed and the amount that will be assessed.
