CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR
APRIL 22, 2003 ON PLANS, SPECIFICATIONS, FORM OF
CONTRACT AND ESTIMATE OF COST FOR THE CONSTRUCTION
OF THE OAKLAND CEMETERY DEEDED BODY MEMORIAL SITE,
DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING,
AND DIRECTING THE PARKS AND RECREATION DIRECTOR TO
PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION.
Comment: This is a cooperative project, jointly funded with The
University of Iowa. Beginning in 1966, the university has conducted an
annual memorial program in Oakland Cemetery to honor those who
donated their bodies to science. The old site for the deeded body
cremains is nearly out of space. The new site will be located in an
unused portion of the cemetery, and will consist of a small gazebo,
accessible walkways, parking spaces for persons with disabilities,
landscaping, an ash interment tank and a series of memorial stones.

APRIL 22 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT AND
ESTIMATE OF COST FOR THE CONSTRUCTION OF THE
WATERWORKS PARK TRAILHEAD PARKING PROJECT,
DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID
HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID
PLANS ON FILE FOR PUBLIC INSPECTION.
Comment: This project will construct a parking lot off of Dubuque Street,
near the Iowa River, and will connect to existing trails along Dubuque
Street and inside Waterworks Park.
CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR
APRIL 22 ON AMENDING THE FY2003 OPERATING BUDGET.
Comment: This resolution sets a public hearing for April 22, 2003, to
amend the FY2003 budget. Information will be available to the public on
April 11.

ON APRIL 22 FOR THE UPDATE OF THE
SECTION 8 ADMINISTRATIVE PLAN FOR IOWA CITY
HOUSING AUTHORITY SECTION 8 PROGRAM.
Comment: The Resolution sets the date for a Public Hearing which is a
requirement before the adoption of the updated Section 8 Administrative
Plan can occur. The Section 8 Administrative Plan is being amended to
include various program updates including preference for Section 8
assistance at MECCA. The Administrative Plan is a HUD required
administrative document which is used in the operations of the Section 8
program.

APRIL 22 REGARDING THE PROPOSED FY04 ANNUAL ACTION
PLAN, INCLUDING THE COMMUNITY DEVELOPMENT BLOCK
GRANT (CDBG) AND HOME INVESTMENT PARTNERSHIP
PROGRAM (HOME) BUDGETS. THE FY04 ANNUAL
ACTION PLAN IS A SUB-PART OF IOWA CITY'S 2001-2006
CONSOLIDATED PLAN (CITY STEPS), AS AMENDED.
Comment: At their March 20, 2003 meeting, the Housing and
Community Development Commission made recommendations to the
City Council for FY04 CDBG and HOME funding. A public hearing on the
proposed CDBG\HOME allocations and Annual Action Plan is required
by the U.S. Department of Housing and Urban Development (HUD).
Friday, April 4, the Project Resource Book and the Annual Action Plan
will be available for review in the Planning & Community Development
Department and the Iowa City Public Library.

CONSIDER A RESOLUTION OF INTENT TO APPROVE A PURCHASE
AGREEMENT BETWEEN THE CITY OF IOWA CITY AND 1 TOWER
PLACE LLC FOR CONDOMINIUM UNIT I-D IN TOWER PLACE AND
PARKING AND TO DISPOSE OF UNIT 1-D IN ACCORDANCE
HEREWITH, AND SETrlNG A PUBLIC HEARING FOR APRIL 22,
2003.
Comment: The Tower Place and Parking facility includes commercial
space which has been marketed for sale to the general public. The City
has negotiated a purchase agreement with I Tower Place LLC which
requires City Council approval. This resolution declares City Council's
intent to approve of the contract and sets public hearing for April 22,
2003.

Comment: This project has been completed in substantial accordance

Comment: Hills Bank and Trust, Coralville, Iowa has requested that the
City approve a Subordination Agreement for 2230 Hickory Coud to
refinance a mortgage. On December 17, 1999, the owner of the
property received a loan from the City of Iowa City's Downpayment
Assistance Program for the amount of $3,000. The property is appraised
for $124,000 which provides enough equity to cover the City's second
lien position.

AN ORDINANCE CONDITIONALLY CHANGING THE ZONING

Comment: At its February 6 meeting, by a vote of 6-0 (Chait absent), the
Planning and Zoning Commission recommended approval subject to
conditions regarding the design of any new structure. Staff recommended
approval in a report dated January 16. Applicant previously requested
expedited consideration. Properly owners of more than 20% of the properly
within 200 feet of 130 North Dubuque Street have filed protests of this

CONSIDER AN ORDINANCE AMENDING CITY CODE TITLE 14,
CHAPTER 6, ENTITLED "ZONING," ARTICLE B, ENTITLED "ZONING
DEFINITIONS," AND ARTICLE M, ENTITLED "ACCESSORY USES AND
BUILDINGS," SECTION 1, ENTITLED "PERMITTED ACCESSORY USES
AND BUILDINGS." (SECOND CONSIDERATION)
Comment: At its February 6 meeting, by a vote of 6-0 (Chait absent), the
Planning and Zoning Commission recommended approval of the proposed
amendments to Title 14. The amendments will add certain facility
requirements for childcare homes based on the number of children in care.
In addition, it will increase the maximum number of children allowed in
certain childcare homes from 11 to 16. These changes reflect recent
changes made by the State of Iowa with regard to childcare homes and will
provide consistency between State and City regulations. Staff
recommended approval in a memorandum dated January 30, 2003.

THE IOWA CITY HOUSING AUTHORiTY'S ANNUAL PLAN (FISCAL YEAR
2003).
Comment: The Department of Housing and Urban Development (HUD) under
the Quality Housing and Work Responsibility Act of 1998 ("QHWRA"), requires
the Iowa City Housing Authority to update its Annual Plan annually. The Iowa
City Housing Authority's Annual Plan has been updated with no significant
changes. The plan was only updated to reflect the Housing Authority's
immediate operations, program participants, and programs and services for the
upcoming fiscal year. Efforts were made to invite the public to review the plan
and make comments. As required by HUD, public notice was published 45
days prior to the public hearing. In addition, the Housing Authority invited its
residents to be involved in the process, a Resident Advisory Board was formed
and two meetings were held. Also, the Housing and Community Development
Commission was informed and given copies of the updated plan. The updated
Annual Plan and comments received can be obtained from Iowa City Housing
Authority.

proceeds.

Comment: This project involves repair and preventative maintenance work to
the Capitol Street, Dubuque Street and Chauncey Swan parking ramps;
including the replacement of leaky expansion joints and control joint, the repair
of broken precast double-tee weld plates and spalled concrete, and the
application of a waterproofing membrane. The project is anticipated to be
completed during the months of May-August 2003. The estimated construction
cost is $302,500 and will be funded with Parking Improvement Reserve money.

Comment: City Code currently allows mobile vending carts on City Plaza only.
When Iowa Avenue was renovated, locations for the purpose of mobile vending
were accommodated in the plan. Staff recommends mobile vending activity
also be allowed on the nodh side of the 100-300 blocks of Iowa Avenue.
Current administrative policy includes 5 carts on City Plaza with a
recommended addition of 2 on Iowa Avenue. Staff previously requested
expedited consideration to allow vendors to proceed with purchase of carts.

TO BE CONSISTENT WITH THE RECENTLY AMENDED DEFINITION OF
"CANDIDATE'S COMMITTEE" IN THE CAMPAIGN FINANCE CHAPTER OF
THE STATE CODE THAT INCREASES THE LEVEL OF CONTRIBUTIONS
WHICH REQUIRE THE ESTABLISHMENT OF A COMMITrEE AND THE
ATTENDANT REPORTING REQUIREMENTS FROM $500 TO $750. (PASS
AND ADOPT)
Comment: Effective April 2002, the campaign finance provisions of the state
code (Chapter 56) were amended to increase the contributions which require
the establishment of a candidate's committee from $500 to $750. The definition
is included in the City ordinance merely because Iowa City prohibits a candidate
or a "candidate's committee" from accepting contributions in excess of $100.
The ordinance change will not affect Iowa City's limitation on campaign
contributions. Iowa City does not have its own enforcement mechanism for the
$100 limitation, relying on self-enforcement and, the state's campaign finance
reporting requirements. Due to the state code amendment, a committee and
reports will not be required until a candidate has received $750 in contributions
as opposed to $500. Staff requests expedited consideration to allow codification
prior to distribution of candidate materials.
