NOTICE OF PUBLIC HEARING
Notice is hereby given that a public hearing will be
held by the City Council of Iowa City, Iowa, at
which time the Council will consider:
An ordinance amending Title 14, Zoning of
the Iowa City Code to clarify code language
related to historic preservation. (REZ22-
0009)
Said public hearing will be held at 6:00 p.m.on the
12th of July 2022, in Emma J. Harvat Hall at City
Hall, 410 E. Washington St., in said city, or if said
meeting is cancelled, at the next meeting of the
City Council thereafter as posted by the City Clerk.
Copies of proposed ordinances and resolutions
are on file for public examination in the office of the
City Clerk, City Hall, Iowa City, Iowa. Persons
wishing to make their views known for Council
consideration are encouraged to appear at the
above-mentioned time and place. Copies may
also be made available by telephoning the City

Ordinance amending Title 14, Zoning of the lowa'City Code to clarify
code language related to historic preservation. (REZ22-0009)
Whereas, the City of Iowa City aims to make its Zoning Code as clear as possible; and
Whereas, clarification is required that special exceptions for historic properties in
residential and commercial zones applies to properties in Historic District Overlay zones,
which includes Local Historic Landmarks; and
Whereas, Local Historic Landmarks, Local Historic Districts, and Local Conservation
Districts are designated through rezoning ordinances and therefore do not need to be
individually listed in the Zoning Code; and
Whereas, the abbreviation for Conservation District Overlay (OCD) zones is not listed in
the Zoning Code; and
Whereas, the mailing procedures for Historic Preservation Commission public notices
require clarification; and
Whereas, Historic Preservation Commission procedures should only require submittal of
applications to the State Historic Preservation Office that the State Historic Preservation
Office will review; and
Whereas, the State Historic Preservation Office completed a review of these changes on
April 22, 2022 and noted no concerns with the changes; and
Whereas, the Historic Preservation Commission recommended approval of these
changes at their meeting on June 9, 2022; and
Whereas, the Planning and Zoning Commission recommended approval of these
changes at their meeting on June 15, 2022; and
Whereas, it is in the City's best interest to adopt this ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF IOWA CITY, IOWA:
Section 1. Title 14 of the Iowa City Code is hereby amended by deleting the strikethrough
text, adding the underlined text, and renumbering the subsequent paragraphs accordingly:
Amend 14-2A-7B, Historic Preservation Exceptions, as follows
B. Historic Preservation Exceptions:
1. The Bboard of Aadjustment may grant a special exception to waive or modify any
dimensional or site development standards listed in this article or in chapter 5 of this title or
any approval criteria listed in chapter 4, article B of this title that would prevent use or
occupancy of a property located in a Historic District Overlay (OHDIde'
or registered on the national register of historic places. In addition to
the general special exception approval criteria set forth it chapter.4, article BM this title, the
following approval criteria must be met:
a. The modification or waiver will help preserve the historic, aesthetic, or cultural
attributes of the property;
b. The applicant must obtain a certificate of appropriateness from the Hhistoric
Ppreservation Coommission.
2. The Bboard of Aadjustment may grant a special exception to allow a property
located in a Historic District Overlay (OHD) or
registered on the national register of historic places to be adapted and reused as a
community service use, specialized educational facility, or hospitality oriented retail use. In
addition to the general special exception approval criteria listed in chapter 4, article B of this
title, the applicant must also meet the following criteria in order for the Bboard to grant this
exception:
a. The exception is necessary to preserve the historic, aesthetic, or cultural attributes
of the property.
b. The applicant must obtain a certificate of appropriateness from the Hhistoric
Ppreservation Csommission.
Amend 14-2B-8A, Historic Preservation Exceptions, as follows
A. Historic Preservation Exceptions:
1. The Bboard of Aadjustment may grant a special exception to waive or modify any
dimensional or site development standards listed in this article or in chapter 5 of this title or
any approval criteria listed in chapter 4, article B of this title that would prevent use or

Amend 14-3B-2A, Purpose, as follows
A. Purpose: The conservation district overlay (OCD) zone is used to designate
conservation districts. The purpose of this overlay zone is to:
1. Conserve the unique characteristics of older neighborhoods and resources, including
their architectural, historical and aesthetic qualities;
2. Provide for design review of new construction or alteration of existing resources to
assure compatibility with the existing character of older neighborhoods and preserve the
historic integrity of the resource;
3. Encourage the retention, rehabilitation and appropriate maintenance of existing
buildings, structures and sites in older neighborhoods;
4. Stabilize property values and encourage reinvestment in older neighborhoods; and
5. Protect the environmental setting of historic landmarks and historic districts through
the designation of conservation districts adjacent to historic landmarks and historic districts.

Amend 14-8E-1C, Historic Preservation Commission Public Hearing, as follows
C. Historic Preservation Commission Public Hearing:
1. Upon receipt of an application for historic landmark designation or following initiation
of a proposal to designate a historic or conservation district, the historic preservation
commission will hold a public hearing on the proposal.
2. The historic preservation commission will give notice of the time, date, place and
subject matter of such public hearing_atleas eve► (ter prior to the hearir ach
. Such
notice shall be sent by ordinary mail, not less than seven (7) days before the date the
hearing is held, to the owner of record of each property or property interest at the
owner's last known address as shown in the records of the Iowa City Assessor not
more than fourteen (14) days prior to the date of mailing. A change in ownership of
any such property which is not reflected in the records of the Iowa City Assessor
during the period those records are searched as above provided shall not affect the
validity of the notice . An affidavit of mailing will be filed with the city clerk setting forth the
date that notice was mailed and the names and addresses of all property owners notified
pursuant to this subsection. .�
3. Following the public hearing, the historic preservation commission will consider'
motion recommending approval of the proposed district or historic landmark.
4. Upon approval of the motion, the historic preservation commission will submit an
application to rezone the proposed area to historic district overlay or conservation district
overlay, whichever is applicable. For properties proposed as local historic landmarks, an
application for a historic district overlay rezoning must be submitted.
Amend 14-8E-1 D, State Historic Preservation Office Review, as follows
D. State Historic Preservation Office Review: Following the public hearing before the
historic preservation commission, any the proposal regarding a local historic district will
be submitted to the state historic preservation office (SHPO)for review and
recommendations. The city will make any recommendations made by the state historic
preservation office available to the public for viewing during normal business hours at a city
government place of public access. Any proposals regarding conservation districts
and/or local historic landmarks need not be submitted to SHPO.
Amend 14-8E-1 E, Planning And Zoning Commission Review, as follows
5. If the planning and zoning commission alters the area of the proposed district as
approved by the historic preservation commission, the planning and zoning commission
must submit a description of the altered proposed area or the petition describing the area to
the state historic preservation office where required and the historic preservation
commission for review and recommendations concerning the altered proposed district.
Section II. Repealer. All ordinances and parts of ordinances in conflict with the provision of
this Ordinance are hereby repealed.
Section III. Severability. If any section, provision or part of the Ordinance shall be adjudged
to be invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance
as a whole or any section, provision or part thereof no adjudged invalid or unconstitutional.
Section IV. Effective Date. This Ordinance shall be in effect after its final passage, approval,
and publication, as provided by law.

Ordinance amending Title 14, Zoning Code to clarify language related
to historic preservation. (First Consideration)
Background
The proposed ordinance would result in the following minor amendments
related to Historic Preservation in the Zoning Code by:
Clarify Historic Preservation Exception Applicability
Remove List of Local Landmarks, Historic Districts, and Conservation
Districts
Add Abbreviation for Conservation Overlay Zones (OCD)
Clarify Historic Preservation Commission Procedures
Amendments reviewed by the State's CLG Coordinator who had no concerns.
Historic Preservation Commission recommended approval at their June 9
meeting.
Clarify Historic Preservation Exception
Applicability
(14 -2A -7B, 14 -2B -8A, and 14 -2C -11A)
Summary of Change
The BOA may grant a special exception to waive or modify certain standards
or adaptively reuse a building designated as an Iowa City landmark or
registered in the National Register of Historic Places
Includes requirements related to dimensions, site development, approval criteria, and certain
uses
Requires a Certificate of Appropriateness from HPC
Clarifies that the BOA can grant special exceptions to properties in a Local
Historic District
Justification
Provides clearer language, i.e. properties zoned OHD include Local Historic
Districts and Local Historic Landmarks
Consistent with staff's current interpretation of this provision
Remove List of Local Landmarks, Historic
Districts, and Conservation Districts
(14 -3B -1D and 14 -3B -2D)
Summary of Change
The zoning code includes a list of Local Historic Districts and Landmarks, in
addition to Local Conservation Districts
The proposed amendment would remove the listing from the zoning code
Justification
Staff uses several methods to track historic properties:
Rezoning ordinances passed by City Council (primary)
Administrative lists available to the public (secondary)
Separately codified lists in the Zoning Code
However, the codified lists in the Zoning Code are irregularly updated and
are redundant with the rezoning ordinances passed by Council
Relying on ordinances and staff's list is more accurate and efficient
Add Abbreviation to Conservation
Overlay Zones (14-3B-2)
Summary of Change
The OCD abbreviation used for Conservation District Overlays zones is not in
the Zoning Code
The proposed amendment adds OCD into the code
Justification
Specifying that the OCD abbreviation is used for Conservation District
Overlay zones connects the designation on the zoning map with the zone it
represents
Clarify Historic Preservation
Commission Procedures (14-8E-1)
Summary of Change
Public notice must be mailed for any HPC public hearings following an application
to designate a Local Historic Landmark or Local Historic or Conservation district;
current mailing requirements have been a source of confusion and complaint
Code requires that proposed Local Historic Districts and Landmarks, and Local
Conservation Districts, must be submitted to SHPO, even if they will not review it
The proposed amendment makes two changes:
Public notice mailing procedures are modified to delineate exactly how the list of property owners will
be generated and mailed
Submittal requirements to SHPO are modified so that the only proposals required to be sent to SHPO
shall be for projects on which SHPO will provide comment
Justification
More clearly codifies staff mailing procedures
Helps streamline SHPO submittals by aligning City policy with State policy
and prevents unnecessary work/dead-time
