CONSIDER A RESOLUTION SETTING PUBLIC HEARING FOR ~~t- a4~ _ AUGUST 18, 2009, ON A PROPOSAL TO CONVEY A SINGLE FAMILY HOME LOCATED AT 842 LONGFELLOW COURT. Comment: The Iowa City Housing Authority, under its Affordable Dream Home Program, proposes to sell 842 Longfellow Court. The amount of the sale will be $156,500. The family is currently in the HCV program and enrolled in the Family Self-Sufficiency (FSS) program, and meets income eligibility criteria. The family will make a $500 down payment and has received a written commitment for a mortgage from a local bank in the amount of $108,500. The City will provide a second mortgage for $38,000 and a third mortgage through the Down Payment Assistance Program for the remaining $10,000. CONSIDER A RESOLUTION SETTING PUBLIC HEARING FOR AUGUST 18, 2009, ON A PROPOSAL TO CONVEY A SINGLE FAMILY HOME LOCATED AT 840 LONGFELLOW PLACE. Comment: The Iowa City Housing Authority, under its Affordable Dream Home Program, proposes to sell 840 Longfellow Place. The amount of the sale will be $152,000. The family is not currently assisted through the Housing Authority, but meets income eligibility criteria. The wife works at the University of Iowa Hospitals and Clinics. The husband is an Iraqi War Veteran currently attending college. The family will make a $500 down payment and has received a written commitment for a mortgage from a local bank in the amount of $104,000. The City will provide a second mortgage for $38,000 and a third mortgage through the Down Payment Assistance Program for the remaining $10,000. This sale will provide the opportunity for aloes-income family to obtain ownership of their own home. ~q~ a-9"3 3. CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON AUGUST 18, 2009 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE FY09 LANDFILL GRADING PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project will include the excavation and grading work for constructing an additional cell on the west half of the landfill. This new cell will be constructed in accordance with all federal and state regulations. The estimated construction cost is $2,900,000 and will be funded with Landfill revenues. 4. CONSIDER A RESOLUTION AUTHORIZING MAILING AND °q ~ ~'~ PUBLICATION OF NOTICE OF INTENT TO COMMENCE PUBLIC IMPROVEMENT PROJECT TO CONSTRUCT THE SYCAMORE STREET FROM LANGENBERG AVENUE TO DEFOREST AVENUE IMPROVEMENT PROJECT AND TO ACQUIRE PROPERTY FOR THE PROJECT; AND SETTING DATE OF PUBLIC HEARING ON SEPTEMBER 15, 2009. Comment: The City of Iowa City must acquire right-of-way, fee title, permanent easements and temporary construction easements to construct the Sycamore Street from Langenberg Avenue to Deforest Avenue Improvements Project. State law requires the City to give notice to agricultural property owners whose properties may be affected. This notice will notify all potentially affected property owners of their opportunity to present their views on the project and proposed acquisition of property rights at the public hearing. This notice protects the City's right to condemn if necessary. This project involves improvements including reconstruction of Sycamore Street from Langenberg Avenue to Burns Avenue, pavement repair from Burns Avenue to US Hwy 6, and installation of a new traffic system at the intersection of Hwy 6 and Sycamore Street. SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF PHASE ONE-TRAIL DEVELOPMENT OF THE SAND LAKE RECREATION AREA, DIRECTING THE CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project is the first phase of construction for this park area and will include the trail development around the park, including a North access point and parking area into the park from McCollister Ave. and enhance the South parking access area that currently exists. The estimated construction budget for this project is $500,000 and will be funded by general obligation bonds. f) Resolutions. ~~ , ~~~ 1. CONSIDER A RESOLUTION APPROVING THE ACCEPTANCE OF THE DEDICATION OF A 0.54 ACRE PARCEL OF LAND ADJACENT TO AUDITOR'S PARCELS 2009048, AT THE INTERSECTION OF LOWER MUSCATINE ROAD AND SYCAMORE STREET IN IOWA CITY, JOHNSON COUNTY, IOWA, AS PUBLIC RIGHT-OF-WAY. Comment: City Council recently authorized the acquisition of 1807 Lower Muscatine Road to facilitate construction of the Lower Muscatine Road Reconstruction Project on the condition that the owner dedicate the necessary right-of-way to the City. This Resolution contemplates acceptance of that dedication. ~,~ _ a~j 2. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST TO A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA CITY AND UNIVERSITY OF IOWA COMMUNITY CREDIT UNION, IOWA CITY, IOWA FOR PROPERTY LOCATED AT 3 DUNUGGAN COURT, IOWA CITY, IOWA. Comment: University of Iowa Community Credit Union has requested that the City approve a Subordination Agreement for property at 3 Dunuggan Court. On December 28, 2007 the owners of the property received funding from the City of Iowa City through the Housing Rehabilitation Program. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA CITY AND MIDWESTONE, IOWA CITY, IOWA FOR PROPERTY LOCATED AT 1562 DICKENSON LANE, IOWA CITY, IOWA. Comment: MidWestOne Bank has requested that the City approve a Subordination Agreement for property at 1562 Dickenson Lane. On February 27, 1998 the owner of the property received a loan from the City of Iowa City's HOME Investment Partnership Funds. Comment: The owner of the property located in Johnson County, Iowa received assistance through the City of Iowa City's Community Development Block Grant (CDBG) funds. Comment: The owner of the property located at 221 E. Washington Street received assistance through the City of Iowa City's Community Development Block Grant (CDBG) funds. Comment: The owner of the property located at 2205 J Street received assistance through the City of Iowa City's Housing Rehabilitation Program. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST TO A SUBORDINATION AGREEMENT WITH US BANK FOR EIGHT MORTGAGES WITH THE HOUSING FELLOWSHIP. Comment: The City assisted The Housing Fellowship with FY96, FY97, FY98, FY99, and FY00 HOME and CDBG funds to support affordable housing and has eight mortgages on fifty (50) properties securing the loans. The Housing Fellowship is refinancing all private debt on these properties, and its lender, US Bank, is requesting that the City subordinate the eight mortgages to its lien. There is sufficient equity to secure the City's interests. A copy of the subordination agreement is available for review in the City Clerk's office. g) Correspondence. 1. (REZ09-00003) Comment: It is anticipated that the Planning and Zoning Commission will make a recommendation at its August 6 meeting. (FIRST CONSIDERATION) Comment: AM Management on behalf of the owner and applicant has requested a two year extension of the planned development overlay (OPD) rezoning and sensitive areas development plan that is associated with the preliminary plat of Whispering Meadows Subdivision, Part 4. Similar to preliminary plats, preliminary OPD plans expire after two years unless extended. (SU609-00004) Comment: At its July 16 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval. Staff recommended approval in a report dated July 16. Approval will allow the development of Stone Bridge Estates Part 6-9, a 102-lot, 36.32-acre residential subdivision located north of Court Street, south of Lower West Branch Road, and west of Taft Avenue. Action: ~~O ITEM 6. APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE IOWA CITY POLICE STORAGE PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: The project will involve the remodeling of the lower level of the North Water Treatment Facility into secure storage and an office and restroom space for the Police Department. The work includes general building construction, and mechanical, and electrical work. AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST AN EXTENSION OF A LEASE WITH MERSCHMAN SEEDS, INC. FOR AN ACCESSWAY FROM MORMON TREK BOULEVARD TO THE AIRPORT. Comment: On February 22, 2008, the City of Iowa City and the Iowa City Airport Commission agreed to lease to Merschman Seeds, Inc. a strip of land to use for an accessway from Mormon Trek Blvd. to the centerline of the southern end of runway 18/36 at the Iowa City Airport for the period of March 1, 2008 to February 28, 2010. Merschman Seeds, Inc. would like to extend the lease by an additional two years, which triggers the necessity of a public hearing. Comment: In accordance with City Code sections 4-2-3 and 4-2-4 staff is recommending the denial of the renewal application for the above mentioned establishment for reasons identified in the memorandum from the Police Department. The memo from the Police Chief providing information on the violations and recommendation for denial is included in the Council Packet along with copies of correspondence sent to the applicant /owner from the City Clerk's office. a) HEARING Action: ~,~i O~./1/ b) CONSIDER A MOTION TO DENY IN ACCORDANCE WITH STAFF RECOMMENDATION Action: ITEM 10. CONSIDER AN ORDINANCE AMENDING CITY CODE TITLE 1, ENTITLED "ADMINISTRATION," CHAPTER 5, ENTITLED "MAYOR AND CITY COUNCIL," TO FREEZE THE COMPENSATION FOR CITY COUNCIL MEMBERS AND REPEAL THE REVIEW POLICY ESTABLISHED BY ORDINANCE 97-3804. (FIRST CONSIDERATION) Comment: City Council directed staff to prepare an ordinance after discussion at their June 29 work session that freezes Council and Mayor salaries at the present level; and repeals the review and automatic adjustment in each regular election year in accordance with previously adopted ordinance 97-3804. Action: ITEM 11. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY oq, a5q CLERK TO ATTEST AN AMENDMENT TO THE AGREEMENT WITH THE JOINT EMERGENCY COMMUNICATION CENTER OF JOHNSON COUNTY AND MIKE SULLIVAN. Comment: JECC and the City entered into a contract of employment with Mike Sullivan for the purpose of employing him as Executive Director of JECC effective February 23, 2009. Pursuant to the contract, Sullivan is employed as a City employee for the first six months of his employment, for administrative purposes. JECC now wishes to extend the Executive Director's term of employment under said contract until March 31, 2010, to provide additional time and assistance to get information technology systems in place in order to enable the hiring of additional personnel. This resolution authorizes a contract of employment for the Associate Director until March 31, 2010. Comment: It has been requested by several Citizens of Iowa City for the park known as the "Sand Lake Recreation Area" to be renamed the "Terry Trueblood Recreation Area" in honor of the positive impact he has made to the citizens of Iowa City and his significant contributions to the development of parks and recreational facilities and programs. Comment: Anon-profit is being established to provide an organization that recognizes the significance and opportunity of Iowa City having been designated a UNESCO City of Literature. The organization will promote reading, support writers and literary education, develop collaborations, create opportunities for public engagement in literary activities, and facilitate dissemination and appreciation of literature, including projects benefiting people in need. The Bylaws of the ICUCOL call for Iowa City to appoint three directors who shall be City Councilors, City Manager, or Library Director. The University of Iowa may also appoint three directors, and Coralville, North Liberty and Johnson County one each. The presidents of the Iowa City Area Chamber of Commerce and of the Iowa City/Coralville Area Convention and Visitors Bureau are ex- officio directors.
