Approval of FY2023 Amended Interfund Transfers -'- Resolution Amending FY2023 Interfund Transfers. October 3, 2022 Comment Iowa Administrative Code requires that the City Council adopt all interfund transfers by resolution. Iowa City City Council Agenda Page 3 6.b. Lobbying Services Agreement - Resolution approving and authorizing the Mayor to execute and the City Clerk to attest an agreement by and between the City of Iowa City and Carney & Appleby, PLC to provide Lobbying Services. Comment On August 2, 2022, the Purchasing Division issued a request for proposal to provide lobbying services for the City of Iowa City. Three (3) proposals were received, evaluated, and scored by staff who determined that the proposal submitted by Carney & Appleby, P.L.C. best met the needs of the City. The initial term of this contract is for three (3) years with the option to renew for three (3) additional one (1) year periods. The City expects to spend $100,000 for the initial term of the contract Funds for this purchase are available in the consultant line item 10210100 432060, in the operating budget for the City Manager's Department This resolution authorizes the award of the contract and authorizes the City Manager to effectuate future renewals. 6.c. Acceptance of Outlot Dedication Resolution accepting the dedication of Outlots A and B, Galway Hills Subdivision, Part Ten, Johnson County, Iowa. Comment Pursuant to the subdivider's agreement for Galway Hills Subdivision, Part Ten, the developer agreed to dedicate to the City Outlots A and B in satisfaction of its neighborhood open space requirements. At that time, the City agreed to accept such dedication upon the occurrence of certain conditions defined in the subdivider's agreement. The conditions have been satisfied and thus it is appropriate for the City to accept ownership and maintenance thereof for public open space. 6.d. Accepting Tobacco Penalty and Waiver of Right to Hearing. Kum & Go LC (Store #3502) Resolution accepting payment of $300.00 civil penalty and waiver of right to hearing form Kum & Go LC (Store #3502). Comment This Resolution accepts a waiver of right to hearing and a payment of a $300.00 civil penalty by Kum & Go LC (Store #3502). The civil penalty is required by Iowa Code Section 453A.22(2) due to a first instance of an employee selling or providing tobacco to a minor within a two-year period. 6.e. Updating Sidewalk Snow Removal Policy d,a J Z ` Resolution adopting a sidewalk snow removal policy and rescinding October 3, 2022 Resolution No. 08-326. Comment Iowa City's snow removal policy was last updated in 2008. The policy is being updated to reflect a change in the posting requirement, the addition of a courtesy electronic notification, and to reflect the department merger and name change. Mercer Park Ball Fields and Courts Resolution approving, authorizing and directing the Mayor to execute and the City Clerk to attest an Agreement by and between the City of Iowa City and Hitchcock Design Inc. (dba Hitchcock Design Group) to provide engineering consultant services for the Mercer Park Ball Fields and Courts Project. Comment: This agreement authorizes Hitchcock Design Inc. (dba Hitchcock Design Group), to provide consultant services induding the design of improved walkways, field drainage, fencing, ball field improvements, tennis/pickieball court improvements, site furniture, shelters, plantings, and restoration. The total cost of the services is $171,200 and will be funded by Mercer Park Ball Diamond Improvements account #R4374 and Tennis Court Renovations account#R4391. 6.g. Prairie Hill Resolution accepting the work for the water main, and certain sidewalk public improvements for Prairie Hill, and dedaring public improvements open for public access and use. Comment This item will accept the public improvements for Prairie Hill, generally located west of Miller Avenue between Benton Street and Hwy 1. 6.h. 2022 Sanitary Sewer Manhole and Pipe Rehabilitation Construction Resolution awarding contract and authorizing the Mayor to sign and the City Clerk to attest a contract for construction of the 2022 Sanitary Sewer Manhole and Pipe Rehabilitation Construction Project. Comment Bids for this project were received on Thursday, September 22, 2022 and the following bids were received: October 3, 2022 Municipal Pipe Tool Co. SAK Construction, LLC Visu-Sewer, Inc. (RF722-0001). (Pass & Adopt) Comment The Planning and Zoning Commission recommended approval by a vote of 6- 0 (Nolte absent) subject to a condition that the owner shall contribute 50% of the cost of upgrading Camp Cardinal Rd to City standards. This contribution shall include 50% of the cost of construction of the traffic circle at the intersection of Deer Creek Rd and Camp Cardinal Rd. (Second Consideration) Comment An existing 35 mph speed zone currently extends from Buckingham Lane east to City Limits at Taft Avenue. With the 2nd phase of the American Legion Road Reconstruction Project nearing completion, and upon the basis of an engineering and traffic investigation and the design speed of the new road segment, the speed limit east of Buckingham Lane should be reduced from YVN GOV LAD -e. 35 mph to 25 mph.
