Parking Access Revenue Control System Resolution authorizing the procurement of a Parking Access Revenue Control System for the City of Iowa City. Comment This Resolution will approve the procurement of a replacement Parking Access Revenue Control System for the City of Iowa Citys parking facilities. The contract will be awarded to Amano McGann, Inc. for one (1) three-year term. This purchase will exceed the $150,000 spending authority of the City Manager, thereby requiring Council approval. The City expects to expend approximately $1,071,699.71 for the procurement of a Parking Access Revenue Control System for the City of Iowa City. 5.d. Willow Creek Trail Replacement Resolution authorizing the acquisition of property interests i-2- _ �-"� necessary for construction of the Willow Creek Trail Replacement Project. Comment The City of Iowa City must acquire right -of --way, fee title, permanent easements and/or temporary construction easements to construct the Willow Creek Trail Replacement Project. Landfill Cell FY23 Construction Resolution awarding contract and authorizing the Mayor to sign and the City Clerk to attest a contract for construction of the Landfill Cell FY23 Construction Project. Comment Bids for this projectwere received on Tuesday, November 29, 2022 and the following bids were received: Delong Construction Washington, IA $ 3,277,685.00 JB Holland Decorah, IA $ 3,486,706.00 Connolly Construction Peosta, IA $ 3,565,050.85 Boomerang Corp. Water Treatment Plant Chlorine, Feeder System Upgrade Resolution awarding contract and authorizing the Mayor to sign and the City Cleric to attest a contract for construction of the Water Treatment Plant Chlorine Feeder System Upgrade Project. 5.g. Comment Bids for this project were received on Tuesday, November 29, 2022 and the fallowing bids were received: WRH, Inc. South Amana, IA $ 239,800.00 Engineer's Estimate $192,000.00 Public Works and Engineering recommend awarding the project to WRH, Inc. of South Amana, Iowa. Funding is available through account #W3316 — Chlorine Feeder System Upgrade. McCollister Boulevard Extension Resolution approving the final contract price for the McCollister Boulevard Extension Project. Comment The final cost of this project was incorrectly included in the resolution and on the agenda accepting the project on October 18, 2022. This resolution corrects the final contract price to $3,991,299.72. Comment The project has been completed by Merit Construction Company of Cedar Rapids, Iowa, in substantial accordance with the plans and specifications. Project Estimated Cost $10,720,000.00 Project Bid Received: $10,978,700.00 • Project Actual Cost $11,362,340.60 6. Setting Public Hearings 6.a. Zoninq Code Amendment - Solar & Climate Action Ordinance Motion setting a public hearing for January 10, 2023 to consider an ordinance amending Title 14, Zoning Code to enhance land use regulations related to solar energy systems and further climate action goals. (RE722-0011) Comment: At its December 7 meeting, staff anticipates that the Planning and Zoning Commission will make a recommendation on REZ22-0011. The amendment would clarify how solar energy systems fit into the zoning code, remove potential barriers to solar energy systems, and incentivize solar energy, electrification, and higher energy conservation standards. Proposed regulations relating to Electric Vehicle readiness and charging stations were removed so staff can evaluate how to incorporate comments made by the Planning and Zoning Commission at their meeting on November 2, 2022. 6.b. Convey Sanitary Sewer Easement _ Resolution of intent to consider the proposed conveyance of a private sanitary sewer easement to Metro Pavers, Inc. adjacent to Lot 1, Metro Pavers,1 st Addition, and setting a public hearing thereon for January 10, 2023. Comment In order to facilitate development of a newly subdivided lot, the Clty has been asked to dedicate a private sanitary sewer easement to the adjacent properly owner fior its sanitary service line. This easement will allow connection to the public sanitary sewer system in the most efficient location and is in an area immediately west of the terminus of Southgate Ave. that is intended to be dedicated as right-of-way, at which time this easement would be terminated. This easement area is encumbered with other easements. For these reasons, Staff recommends oonveying this easement for $0. Discrimination against Section 8 Tenants Ordinance amending Title 2, entitled "Human Rights," Chapter 1, entitled "General Provisions," to eliminate the prohibition on landlords Se --e discriminating against Housing Choice Voucher (aka, Section 8) holders. �� -W GL- (First Consideration) Comment: The City Code prohibits landlords from refusing to lease to tenants who have Housing Chace Vouchers (aka, Section 8). As of Jan. 1, 2023, this provision is unenforceable due to a 2021 state law that preempts local governments from prohibiting landlords from refusing to lease a unit to a person with a voucher. The ordinance removes the City Code provision prohibiting landlords from discriminating against tenants with vouchers. Action: 70n -Re ce,-,\ , (-S -7/ In PT 9. Repeal of Rental Permit Cap Ordinance amending Title 17, entitled "Building and Housing," Chapter 5, entitled "Housing Code," to repeal the rental permit cap provision. (First Sem Consideration) Comment: In 2017, City Council established a rental permit cap to limit the percentage of rental permits for single-family and duplex homes in the central area of the City to stabilize those neighborhoods. In 2019, a new state law was adopted preempting local governments from imposing a rental permit cap on single-family or duplex homes. Although the rental cap provision has been unenforceable for three years, it was never repealed. This ordinance repeals the provision. Sidewalk Cafes -expand locations Ordinance amending Title 10, entitled "Public Ways and Property," Chapter 3, entitled "Commercial Use of Sidewalks," to allow sidewalk cafes outside of the downtown and Riverfront Crossings. (Second Consideration) Comment Sidewalk cafes are currently only allowed in the Central Business zones and the Riverfront Crossings District. Staff recommends establishments without liquor permits should be allowed to have a sidewalk cafe in zones outside of the Central Business zones and Riverfront Crossings District. The ordinance allows the City Manager to impose restrictions in addition to those in the City Code and Council JT adopted policy, such as fewer hours of operation. Staff requests expecRpd action. Sidewalk Cafes- Policy Changes 0 :a Resolution adopting a policy for use of public right -of --way and City Plaza for sidewalk cafes and rescinding Resolution No. 21-133. Comment: The City Code provides the basic framework for regulating sidewalk cafes, and the S details are set forth in a policy adopted by Council resolution. The proposed policy changes ��-�- indude seating "minor cafes" defined as small cafes without aloohol permits to which few requirements will be imposed. Staff is also proposing to eliminate most cafes from having to provide deposits as well as not approving any additional cafes in the elevated planters. Action:e -7 L AAK 12. ARPA UI Labor Center - Construction Apprenticeship Opportunity Program �Q Resolution authorizing the Mayor to sign a State and Local Fiscal Recovery Fund (SLFRF) grant agreement with the University of Iowa Labor Center to administer the Quality Pre -apprenticeship Program l (QPP). Comment: As part of the American Rescue Plan Act (ABPA), the City was awarded State and Local Fiscal Recovery Funds (SLFRF) dollars to respond to impact of the COMD-19 pandemic. This resolution authorizes a subrecipient grant agreement with the University of Iowa Labor Center for $435,239 to administer the Quality Pre -apprenticeship Program, creating a pathway for Iowa City residents to qualify for and secure careers in the building and construd ion trades. City staff will be responsible for coordinating implementation and execution of these Council goals over the next six years.
