CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING A MORTGAGE FOR THE PROPERTY LOCATED AT 1220 SOUTH FIRST AVENUE, IOWA CITY, IOWA. Comment: On August 31, 2006, the owner of 1220 South First Avenue executed a Second Mortgage in the amount of $33,750 to secure a loan from the City for said amount as part of the Tenant to Ownership Program. The owner of 1220 South First Avenue also executed a Resale Agreement with the City on August 31, 2006, for the property at 1220 South First Avenue. The owner sold the home to another income-eligible buyer. The loan was fully paid on July 31, 2009, and the owner has met all the obligations contained in the Resale Agreement. It is now the City's responsibility to release these liens. o~ ~ a-73 2. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RESALE AND OCCUPANCY AGREEMENT REGARDING THE PROPERTY LOCATED AT 1220 SOUTH FIRST AVENUE, IOWA CITY, IOWA. Comment: On July 31, 2009, the Iowa City Housing Authority, through its Affordable Dream Home Program, provided aincome-eligible family a $31,250 loan, which is secured by a second mortgage, to assist them in the purchase of the single-family home located at 1220 South First Avenue. In the event that the family sells the home within fifteen years, the Resale and Occupancy Agreement requires that the owners sell the property to an income-eligible family and that the City receive a percentage of the appreciated value of the property. FIRST AVENUE, IOWA CITY, IOWA. Comment: Hills Bank and Trust has requested that the City approve a Subordination Agreement for property at 1010 S. First Avenue. On August 9, 2007 the owners of the property received funding from the City of Iowa City's HOME Investment Partnership Funds. The property has enough equity to cover the City's lien position. 09- a75 4. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST TO A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA CITY AND HILLS BANK AND TRUST, HILLS, IOWA FOR PROPERTY LOCATED AT 37 COLWYN COURT, IOWA CITY, IOWA. Comment: The owners of the property located at 37 Colwyn Court received flood rehabilitation assistance through the state Jumpstart program on March 27, 2009. The subordination will not change the City's current position, which is second position and inferior to the owner's primary lender. ~ ~ a-7~ 5. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST TO A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA CITY AND DEERE HARVESTER CREDIT UNION, MOLINE, ILLINOIS FOR PROPERTY LOCATED AT 2221 A STREET, IOWA CITY, IOWA. Comment: The owners have a housing rehabilitation loan with the City which is secured by a mortgage. The owners are refinancing, and the lender is requesting that the City subordinate its mortgage to the new mortgage. Action: b) CONSIDER AN ORDINANCE APPROVING A TWO YEAR EXTENSION OF THE PRELIMINARY PLANNED DEVELOPMENT PLAN AND SENSITIVE p 9 ~ d--3 5 4 AREAS DEVELOPMENT PLAN (REZ06-00026) FOR APPROXIMATELY 34.86 ACRES OF LAND LOCATED SOUTH AND WEST OF WHISPERING MEADOWS DRIVE TO COINCIDE WITH APPROVAL OF A TWO YEAR EXTENSION OF THE PRELIMINARY PLAT OF WHISPERING MEADOWS SUBDIVISION, PART 4. (SECOND CONSIDERATION) Comment: AM Management on behalf of the owner and applicant has requested a two year extension of the planned development overlay (OPD) rezoning and sensitive areas development plan that is associated with the preliminary plat of Whispering Meadows Subdivision, Part 4. Similar to preliminary plats, preliminary OPD plans expire after two years unless extended. Comment: AM Management on behalf of the owner and applicant has requested a two year extension of the preliminary plat of Whispering Meadows Subdivision, Part 4, which was approved on August 21, 2007. Preliminary plats expire after two years unless an extension is approved by the City Council. Staff has reviewed the preliminary plat and finds that it remains in substantial compliance with City ordinances and recommends approval of the extension. (SUB09-00003) Comment: The preliminary plat was approved by the City Council on May 5, 2009. Staff recommends approval of the final plat subject to approval of legal papers and construction drawings. It is anticipated that legal papers and construction drawings will be approved prior to the August 18 City Council meeting. Approval will allow the development of Country Club Estates, Third Addition a 38-lot, 28.19-acre residential subdivision located north of Rohret Road on Lake Shore Drive. Action: ~ J a- e) CONSIDER A RESOLUTION APPROVING THE FINAL PLAT OF ST(~INE BRIDGE ESTATES, PART SIX, IOWA CITY, IOWA. (SU609-00005) Comment: The preliminary plat was approved by the City Council on July 28, 2009. Staff recommends approval of the final plat subject to approval of legal papers and construction drawings. It is anticipated that legal papers and construction drawings will be approved prior to the August 18 City Council meeting. Approval will allow the development of Stone Bridge Estates, Part Six, a 26-lot, 8.28-acre residential subdivision located north of Court Street on Arlington Drive and Colchester Drive. Comment: The Iowa City Housing Authority, under its Affordable Dream Home Program, proposes to sell 840 Longfellow Place. The amount of the sale will be $152,000. The family is not currently assisted through the Housing Authority, but meets income eligibility criteria. The wife works at the University of Iowa Hospitals and Clinics. The husband is an Iraqi War Veteran currently attending college. The family will make a $500 earnest money payment and has received a written commitment for a mortgage from a local bank in the amount of $104,000. The City will provide a second mortgage for $38,000 and a third mortgage through the Down Payment Assistance Program for the remaining $10,000. The family is currently in the HCV program and enrolled in the Family Self-Sufficiency (FSS) program, and meets income eligibility criteria. The family will make a $500 earnest money payment and has received a written commitment for a mortgage from a local bank in the amount of $108,500. The City will provide a second mortgage for $38,000 and a third mortgage through the Down Payment Assistance Program for the remaining $10,000. APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE FY09 LANDFILL GRADING PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project will include the excavation and grading work for constructing an additional cell on the west half of the landfill. This new cell will be constructed in accordance with all federal and state regulations. The estimated construction cost is $2,900,000 and will be funded with Landfill revenues. a) PUBLIC HEARING Action: Comment: This project is the first phase of construction for this park area and will include the trail development around the park, including a North access point and parking area into the park from McCollister Ave. and enhance the South parking access area that currently exists. CONSIDER AN ORDINANCE AMENDING CITY CODE TITLE 1, ENTITLED "ADMINISTRATION," CHAPTER 5, ENTITLED "MAYOR AND CITY COUNCIL," TO ~,q_ 43,5 FREEZE THE COMPENSATION FOR CITY COUNCIL MEMBERS AND REPEAL THE REVIEW POLICY ESTABLISHED BY ORDINANCE 97-3804. (SECOND CONSIDERATION) Comment: City Council directed staff to prepare an ordinance after discussion at their June 29 work session that freezes Council and Mayor salaries at the present level; and repeals the review and automatic adjustment in each regular election year in accordance with previously adopted ordinance 97-3804. CONSIDER A RESOLUTION ESTABLISHING ANNUAL PASS FEES FOR THE THORNBERRY OFF-LEASH DOG PARK AND RITA'S RANCH DOG PARK Comment: As required by the City Code, all Parks and Recreation fees must be approved by City Council resolution. Johnson County DogPAC and the City staff have proposed a revised annual fee schedule for use of the off-lease dog parks in Iowa City, and this fee schedule has been approved by the Iowa City Parks and Recreation Commission. The fee schedule proposes an annual pass fee of $25, with a reduction of $5 for spayed/neutered dogs; a bi-annual fee of $50 with aspay/neuter reduction of $10; and a tri-annual fee of $75 with a $15 spay/neuter reduction. The Commission also recommends there no longer be a reduction in fees offered for dogs that are microchipped, at the recommendation of Misha Goodman from the Iowa City Animal Services Division, who states that this reduction does not play a role in the dog owner's decision as to whether to microchip their dog. CONSIDER A RESOLUTION APPROVING FUNDING FOR CORRIDOR DRYWALL LLC FROM IOWA CITY'S COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) - ECONOMIC DEVELOPMENT FUND AND AUTHORIZING THE CITY MANAGER TO 09- 2-Sq _ ACT AS CHIEF ADMINISTRATIVE OFFICER AND SUBMIT ALL NECESSARY DOCUMENTATION TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT. Comment: On July 30 the City Council Economic Development Committee recommended $35,000 in funding for this project. The Council Economic Development Committee recommended that these funds be a loan at 1 % interest for a term of 7 years. Due to the owner's extensive experience in the drywall business, the owner's efforts in obtaining technical assistance to start and operate a new business and the owner's history of paying loan obligations, the committee recommended funding this business even though the loan will not be fully secured. The loan will be partially secured by a financing statement on all business assets. Said business will create three full time positions, of which 51 % will be held by or made available to low-to- moderate income persons. CONSIDER A RESOLUTION AUTHORIZING A CHANGE FROM CALENDAR PARKING TO ODD/EVEN DATE PARKING FOR STREETS WHICH CURRENTLY p(~, a,qa HAVE CALENDAR PARKING. Comment: This action would replace the alternate-side calendar parking restrictions with alternate-side odd/even date parking restrictions in an effort to align better with the snow emergency ordinance. During declared snow emergencies in the winter of 2008/2009, vehicle owners were asked to obey existing signage in areas with calendar parking rather than follow the odd/even date parking strategy, and this created confusion with residents unsure of which side of the street to park on. If approved, signs will be installed in advance of the winter season. Action: ITEM 13. Comment: The City of Iowa City must acquire right-of-way, fee title, permanent easements and/or temporary construction easements to construct the North Dodge Street Pedestrian Bridge over Interstate 80 Project. This project includes the construction of a pedestrian bridge and associated sidewalk and also the replacement of water main and sanitary sewer force main. Action: ITEM 16. oq-a91F CONSIDER A RESOLUTION CONCERNING MEDIACOM COMMUNICATIONS CORPORATION'S 2009 UPDATING OF RATES FOR BASIC CABLE SERVICES. Comment: The required forms have been submitted by Mediacom. Upon review it has been determined that the information therein supports Mediacom's proposed maximum permitted rate of 10.94 per month for basic cable service.
