Benton Street. (CPA23-0001) An ordinance conditionally rezoning approximately 0.78 acres of property 1C�b located at 1201 W. Benton Street from Low Density Single -Family Residential (RS-5) zone to Low Density Multi -Family Residential (RM-12) zone. (REZ23-0008) Said public hearing will be held at 6:00 p.m. on the 2nd of January, 2024, in Emma J. Harvat Hall at City Hall, 410 E. Washington St., in said city, or if said meeting is cancelled, at the next meeting of the City Council thereafter as posted by the City Clerk. Benton Street (CPA23-0001) Whereas, the Iowa City Comprehensive Plan serves as a land -use and planning policy guide by illustrating and describing the location and configuration of appropriate land uses throughout the City; by providing notification to the public regarding intended uses of land; and by illustrating the long-range growth area limit for the City; and Whereas, Christian Retirement Services Inc. (also known as Oaknoll Retirement Residence) has requested that the future land use designation for the property located at 1201 W. Benton Street be changed from Residential 2-8 Dwelling Units Per Acre to Residential 8-16 Dwelling Units Per Acre in the Comprehensive Plan, as shown in Appendix 1; and Whereas, Christian Retirement Services Inc. has requested that the future,,, land use designation for the property located at 1201 W. Benton Street be changed frgr Single- Family/Duplex Residential to Low Density Multi -Family Residential in the Southwest [strict Pffm, as shown in Appendix 2; and .k . Whereas, if circumstances change and/or additional information or factors come to light;— change to the Comprehensive Plan may be in the public interest; and -'- Whereas, circumstances have changed since the Southwest District Plan was jopted in 2002 (Resolution No. 02-346), including the near doubling of the population aged 65 ears and older and the expectation that this age group will continue to grow faster than the general population, such that identifying additional land to allow assisted group living uses is in the public interest; and Whereas, the proposed amendment is compatible with other policies and provisions of the Comprehensive Plan, including policies that support infill redevelopment opportunities in areas where services and infrastructure are already in place and promote housing design and features that allow people to age in place, such as universal design; and Whereas, the Southwest District Plan encourages the development of high quality multi- family housing in areas with good access to urban services, like the Benton Street arterial corridor, and encourages households of all types to live close to the University and downtown, including elderly populations; Whereas, the Planning and Zoning Commission reviewed this proposed amendment at its meeting on December 6, 2023 and determined that circumstances changed to the extent that an amendment to the Comprehensive Plan is warranted and in the public interest and the proposed amendment is compatible with other policies or provisions of the Comprehensive Plan. Now, therefore, be it resolved by the City Council of the City of Iowa City, Iowa, that: 1. The Comprehensive Plan future land use designation for approximately 0.78 acres of property located at 1201 W. Benton Street is amended from Residential 2-8 Dwelling Units per Acre to Residential 8-16 Dwelling Units per Acre, as illustrated and described in Appendix 1, attached hereto; and 2. The Southwest District Plan, a component of the Comprehensive Plan, future land use designation for approximately 0.78 acres of property located at 1201 W. Whereas, the owner, Christian Retirement Services, Inc., has requested a rezoning of property located at 1201 W. Benton Street from Low Density Single -Family Residential (RS-5) to Low Density Multi -Family Residential (RM-12); and Whereas, the Comprehensive Plan indicates that the subject area is appropriate for 8-16 Dwelling Units per Acre and encourages land use and housing policies specifics ensuring compatible infill development to the surrounding neighborhood, appropriate'infill.-Old redevelopment opportunities, and housing designs to allow people to age in place; ands Whereas, the Southwest District Plan identifies the subject area as appropriate for PvFr)lti-fa�i Residential and encourages development of high -quality multi -family housing that is cempatib)� with the surrounding development to meet the housing needs of a variety of households )clud'►ng' singles, young families, university students and elderly populations; and �a Whereas, the rezoning creates a public need to ensure the development of high quality multi- family housing that is compatible with the existing neighborhood character, mostly comprised of small scale single-family homes, through general compliance with the footprint and scale of the concept plan, a maximum height of one story, and approval of a landscaping plan by the City Forester that preserves as much of the existing mature landscaping as possible; and Whereas, the Planning and Zoning Commission has determined that, with reasonable conditions regarding general compliance with the development concept attached hereto, a maximum height of one story, and a landscaping plan that preserves the existing mature landscape, the requested zoning is consistent with the Comprehensive Plan. Whereas, Iowa Code §414.5 (2022) provides that the City of Iowa City may impose reasonable conditions on granting a rezoning request, over and above existing regulations, in order to satisfy public needs caused by the requested change; and Whereas, the owner, Christian Retirement Services, Inc., has agreed that the property shall be developed in accordance with the terms and conditions of the Conditional Zoning Agreement attached hereto to ensure appropriate development in this area of the city. Section III. Conditional Zoning Agreement. The mayor is hereby authorized and directed to sign, and the City Clerk attest, the Conditional Zoning Agreement between the property owner(s) and the City, following passage and approval of this Ordinance. Section IV. Certification And Recording. Upon passage and approval of the Ordinance, the City Clerk is hereby authorized and directed to certify a copy of this ordinance, and record the same in the Office of the County Recorder, Johnson County, Iowa, at the Owner's expense, upon the final passage, approval and publication of this ordinance, as provided by law. Section V. Repealer. All ordinances and parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. Section VI. Severability. If any section, provision or part of the Ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Section VII. Effective Date. This Ordinance shall be in effect after its final passage, approval and publication, as provided by law. (hereinafter referred to as "Owner"). Whereas, Owner is the legal title holder of approximately 0.78 acres of property located at 1201 W. Further, the parties acknowledge that Iowa Code §414.5 (2023) provides that the City of Iowa City may impose reasonable conditions on granting a rezoning request, over and above the existing regulations, in order to satisfy public needs caused by the requested change. 3. In consideration of the City's rezoning the subject property, Owner agrees that development of the subject property will conform to all requirements of the Zoning Code, as well as the following conditions: a. General compliance with the footprint and scale of the development concept attached hereto. b. The building shall not exceed one-story in height. c. Approval of landscaping plan by the City Forester that minimize removal of existing mature landscaping during construction. 4. The conditions contained herein are reasonable conditions to impose on the land under Iowa Code §414.5 (2023), and that said conditions satisfy public needs that are caused by the requested zoning change. 5. This Conditional Zoning Agreement shall be deemed to be a covenant running with the land and with title to the land, and shall remain in full force and effect as a covenant with title to the land, unless or until released of record by the City of Iowa City. The parties further acknowledge that this agreement shall inure to the benefit of and bind all successors, representatives, and assigns of the parties. In the event the subject property is transferred, sold, redeveloped, or subdivided, all development will conform with the terms of this Conditional Zoning Agreement. 6. Nothing in this Conditional Zoning Agreement shall be construed to relieve the Owner from complying with all other applicable local, state, and federal regulations. 7. This Conditional Zoning Agreement shall be incorporated by reference into the ordinance rezoning the subject property, and that upon adoption and publication of the ordinance, this agreement shall be recorded in the Johnson County Recorder's Office at the Applicant's expense. Circumstances have changed and/or additional information or factors have come to light such that the proposed amendment is in the public interest. 2. The proposed amendment will be compatible with other policies or provisions of the comprehensive plan, including any district plans or other amendments thereto. 1 .
