Consent Calendar - Resolutions and Motions 6.a December 2023 Disbursements Motion to approve disbursements in the amount of $18,807,194.94 for the period of December 1 through December 31, 2023, as recommended by the Finance Director subject to audit. Disbursements are published and permanently retained in the City Clerk's office in accordance with State Code. February 6, 2024 Iowa City City Council Agenda Page 2 6.b Oakland Cemetery Rules ,4- D, -D- Resolution adopting regulations governing the operation of Oakland Cemetery including lot owner rights, maintenance practices, and visitor rules and rescinding Resolution No. 17-65. Comment: The City Code requires Council to adopt regulations governing the operation of Oakland Cemetery by resolution. The primary substantive change is easing the restriction on requiring flush monuments on most lots. The title of the ownership right to the lot or niche is changed from "cemetery deed" to "Certificate of Interment," which is the term used in the Code of Iowa, and the owner's rights under a Certificate of Interment remain the same as for those who own a cemetery deed. 6.c Oakland Cemetery fees Resolution establishing a schedule of rates and charges for Oakland L4 -�>> Cemetery and rescinding Resolution No. 23-55. Comment: The City Code requires the fees and charges for services at Oakland Cemetery be established by Council resolution. The major changes are to have one fee for weekend interments and the fee for a lot for monument markers be the same as for a lot requiring a flush marker. 6.d Automated Refuse Truck Procurement Resolution authorizing the procurement of one (1) new automated refuse truck. Comment: This Resolution will approve the procurement of one (1) Freightliner/Labrie automated refuse truck for Solid Waste Operations. Sourcewell cooperative contract 091219 -LEG will be utilized for this procurement. Total purchase price is $297,054.20 which exceeds the $200,000.00 spending authority of the City Manager, and so requires Council approval. 6.e Scott Blvd Sidewalk Infill & Storm Sewer Improvements Project Resolution accepting the work for the Scott Blvd Sidewalk Infill and Storm D, Sewer Improvement Project. Comment: This project constructed approximately 1400 linear feet of sidewalk connecting Eastbrook Flats to Court Hill Trail along Scott Boulevard, and Rita's Ranch Dog Park to Eastbrook Street. 6.f 2023 Dual Extraction System Expansion Project Resolution accepting the work for the 2023 Dual Extraction System Expansion Project. Comment: Construction of the 2023 Dual Extraction System Expansion Project has been completed by Connolly Construction, Inc. of Peosta, Iowa. Project Estimated Cost: $115,000.00 Project Bid Received: $91,485.00 Project Actual Cost: $87,485.00 February 6, 2024 Iowa City City Council Agenda Page 3 6.g Consultant Services for the Asset Management Project Resolution approving, authorizing and directing the Mayor to execute and the City Clerk to attest Amendment No. 3 to the March 3rd, 2020 Consultant Agreement by and between the City of Iowa City and SAM, LLC (formerly Midland GIS Solutions, LLC.), of Maryville, MO to provide consultant services for the Asset Management Project. Comment: This agenda item authorizes an amendment to the Consultant Agreement for the Asset Management Project to include GPS mapping and GIS development for the City's storm sewer system. 6.h High Street and Southgate Avenue Sidewalk Infill Project a4 _�L_� Resolution authorizing the acquisition of property interests necessary for construction of the High Street and Southgate Avenue Sidewalk Infill Project. Comment: The High Street and Southgate Avenue Sidewalk Infill Project's design has been completed and it has been determined that a temporary construction easement is needed on 367 Southgate Avenue. 6.i Kirkwood Ave CRANDIC Railroad Crossing Project Resolution authorizing the acquisition of property interests necessary for construction of the Kirkwood Ave CRANDIC Railroad Crossing Project. Comment: Preliminary design for the Kirkwood Avenue CRANDIC Railroad Crossing Project has been completed and easements are needed for the construction of the upcoming Kirkwood Avenue CRANDIC Railroad Crossing Project. 6.j Final Plat - Brickyard Hollow Resolution Approving Final Plat of Brickyard Hollow Iowa City, Iowa. L44 (SUB23-0008) Comment: Staff recommends approval of the final plat subject to approval of the legal papers by the City Attorney's Office and construction documents by Public Works. It is anticipated that the legal papers and construction documents will be approved prior to the February 6 City Council meeting. Approval will result in the creation of nine residential lots and two outlots. 6.k Settlement Agreement Approval O Resolution approving the settlement of pending litigation. Comment: This item approves a settlement agreement negotiated by staff and the City's insurer to resolve litigation filed by a former employee against the City. The total settlement amount is $925,000. The total out-of-pocket cost to the City in this matter is $500,000, with the City's insurance provider paying all remaining costs. Consent Calendar - Setting Public Hearings 7.a Rezoning - 1810, 1816, and 1828 Lower Muscatine Rd Motion setting a public hearing for January 20, 2024 on an ordinance rezoning approximately 6.25 acres of land from Neighborhood Public Zone (P-1) to General Industrial (1-1) (REZ23-0010). Comment: On January 17, 2024 the Planning and Zoning Commission recommended approval of REZ23-0010 without conditions by a vote of 7- 0. Correspondence included in Council packet. 7.b Appeal of Historic Preservation Commission Decision Motion setting a public hearing for February 20, 2024 on an appeal to the City Council of the decision of the Historic Preservation Commission approving a Certificate of Appropriateness with conditions for an alternation project regarding the installation of a mini -split HVAC system at 811 E. College Street in the College Green Historic District. Comment: Laura Westemeyer appealed the decision of the Historic Preservation Commission approving a Certificate of Appropriateness for the installation of a mini -split HVAC system subject to the following conditions: 1) piping on the north wall of the building and each side of the front projecting bay is relocated, 2) all additional piping is painted to blend with the building behind, and 3) any damage to the brick building caused by the project is repaired with matching brick and mortar so that it is not visible. 7.c Amendment No. 1 to the Highway Commercial Urban Revitalization Plan Resolution setting a public hearing on a proposed Amendment No. 1 to the Highway Commercial Urban Revitalization Plan. Comment: Staff proposes that the Urban Revitalization Plan be amended to be consistent with state code regarding preapproval of improvement projects for which an owner intends to seek the partial tax exemption allowed pursuant to the Plan. Currently the Plan requires such preapproval, while the code merely makes it permissible. This amendment would not eliminate the requirement to obtain approval of the project and exemption after construction. 7.d Greater Iowa City Inc. Lease Resolution setting a public hearing for February 20, 2024 regarding the intent to 14 -'33 enter into Lease Amendment #2 with Greater Iowa City, Inc. to renew their lease for the Merge space within the Iowa City Public Library. Comment: The Iowa City Area Development Group, Inc., now doing business as Greater Iowa City, Inc., has occupied the Merge space within the Iowa City Public Library since beginning a short- term lease on October 1, 2015. That lease was extended for four years starting on March 1, 2016, and then extended for an additional four years in 2020. The lease is set to expire on February 29, 2024. The City wishes to extend that lease, under the same terms, through February 29, 2028, with an option to renew for an additional four years under mutually agreeable terms. February 6, 2024 Iowa City City Council Agenda Page 5 7.e Highway 6 East Water Main Replacement Project Resolution setting a public hearing on February 20, 2024 on project manual and estimate of cost for the construction of the Highway 6 East Water Main Replacement Project, directing City Clerk to publish notice of said hearing, and directing the City Engineer to place said project manual on file for public inspection. Comment: This project includes installation of 16" water main on the north side of Highway 6 East between Fairmeadows Boulevard and Industrial Park Road. The estimated construction cost is $ 880,000 available in the Hwy 6 (Fairmeadows to Industrial Park Rd) Water Main Replacement Account #W3320. 7.f Sale of 3351 Wintergreen Dr. _ Resolution setting public hearing for February 20, 2024, on a proposal to convey the property at 3351 Wintergreen Drive. Comment: City Council authorized the acquisition of 3351 Wintergreen Dr. for the purpose of abating the nuisance. After City staff was unable to acquire the property voluntarily, the City proceeded to condemnation. State law requires the City to convey the property to a buyer that will either rehabilitate the home or demolish it and construct a new house, and City staff has negotiated a purchase agreement with a buyer to rehab the house for the sale price of $206,000, subject to formal approval by City Council. Because Community Comment is for items not properly noticed on the agenda, Council cannot engage in discussion or debate due to open meetings laws. Only in- person comments will be allowed for Community Comment. Public comment for specific agenda items, which must be directly related to that agenda item, may be made in- person or remotely. Individuals will be provided 3 minutes to speak. The Community Comment period will end at 7:00 p.m. unless an extension is needed to meet a minimum 30 minutes of total time allocated for the Community Comment period. The Mayor reserves the right to reduce the 3 minute period based on the number of individuals desiring to speak. Planning & Zoning Matters 9.a Rezoning - Moss Ridge Rd. Ordinance conditionally rezoning approximately 61.72 acres of land located North , L44— 4q �LO of 1-80, West of N. Dodge Street, at the end of Moss Ridge Road from Research Development Park (RDP) zone, Interim Development Research Park (ID -RP) zone, and Highway Commercial with a Planned Development Overlay (OPD/CH-1) zone to Intensive Commercial (CI -1) zone (REZ23-0009). (Second Consideration) Comment: On December 20, 2023 the Planning and Zoning Commission recommended approval of REZ23-0009 by a vote of 6-0 (Craig absent) subject to the following conditions: prior to approval of a preliminary plat, completion of a traffic study; prior to issuance of a building permit, completion of all required improvements outlined in the traffic study subject to review by the City Engineer; prior to approval of a site plan, approval of a preliminary and final plat; and the water main is designed to extend and connect to the existing water main along I- 80 to create a looped system. Approval would allow the development of intensive commercial uses. Applicant is requesting expedited action.
