AIRPORT TERMINAL BUILDING FINAL Members Present: Judy Pfohl, Chris Lawrence, Hellecktra Orozco, Warren Bishop, Ryan Story Members Absent: Staff Present: Michael Tharp, Jennifer Schwickerath, Others Present: Carl Byers (via zoom), Minnetta Gardinier RECOMMENDATIONS TO COUNCIL: DETERMINE QUORUM A quorum was determined at 6:01 pm and Orozco called the meeting to order. APPROVAL OF MINUTES Lawrence moved to accept the minutes of November 15, 2023, seconded by Pfohl. Motion carried 5-0 PUBLIC COMMENT - None ITEMS FOR DISCUSSION / ACTION a. Unhoused encampments (Stevens Drive/Sturgis Ferry) — Tharp stated they had filed the eviction notices and that a court hearing was scheduled for Monday. Tharp noted that the last count had around 5 people remaining in the area. Orozco asked about the cleanup schedule to which Schwickerath responded. b, Airport Construction Projects: I. FAA grant projects 1. Runway 25 Threshold Relocation — Tharp stated they were working on some final paperwork and were not ready to accept it as complete. Lawrence asked about the lighting, and Tharp noted that all lights associated with the project were installed. a. Consider a resolution accepting project as complete deferred to next meeting 2. Runway 12130 Displaced Threshold/Relocation — Tharp stated this was waiting for the new year. 3. Terminal Area Study — Tharp noted they were finishing the revisions after the FAA review of the study draft. 4. Solar Power Project — Tharp stated that they.were working on the scope of services agreement with GMT and that they had 2 options Airport Commission December 14, 2023 Page 2of 4 for moving forward. One would have bids opening in May and other could speed up the process with a special meeting in February. Tharp stated that this would be a short meeting to set a public hearing for the next regular meeting in March. Members discussed the scheduling and chose by consensus to use the accelerated schedule. 5. FAA FY24 AIP Pre -Application- Tharp stated that they had submitted the draft to the FAA and the only comments they received were regarding the terminal building program and if the grant didn't come through they'd need to slide the project. Gardinier asked about the plans to replace the terminal building to which members responded. Gardinier asked if another location for the terminal had been considered. Tharp stated the plan called for the demolition of the existing building to be replaced by something in approximately the same area. Byers noted that if they got the money for the planning grant, then some of the subjects that were discussed could be further reviewed. Tharp stated that if the Commission agreed with the plan, he would submit it. Members agreed to submit the application by consensus. it. Iowa DOT grant projects 1. FY23 Program a. Terminal Building Improvements —Tharp stated they were waiting for the contractor to get their supplies. iii. Airport/Locally Funded Projects — none iv. Future Projects — none c. Airport "Operations" L Budget —Tharp stated that they had received the checkfrom the Community Foundation to pay for the art mural project. Tharp noted that this had brought their fund balance back into the positive. Tharp stated they still need a couple of good years with major surpluses to bring the fund balance up to a Comfortable level. ii. Management — 1. OPL Request for fencing installation —Tharp stated they received a request from OPL for some additional fencing around their facility. Tharp stated that request wouldn't impact the solar project or other activities at the airport. Tharp stated that if they were amenable to to the plan, he would create a contract amendment for the Commission to formally approve. Commission agreed to consider a resolution at the next meeting. 2. Strategic Plan End of Year Review —Tharp stated that for the plan having only been out there for 6 months, they've already done some pretty good things. Tharp stated that as far as community events, they hosted Summer of the Arts Movie Night, the Climate Fast movie, and had an open house for the art mural. Tharp stated that he had an invitation to talk with a university coffee club about the airport. Tharp then discussed the 2nd goal from the plan and stated that they had constructed the south taxilane extension for future hangars. The 31d goal is Continue to develop funding mechanisms for airport operations, improvements, and maintenance. Tharp Airport Commission December 14, 2023 Page 3of 4 noted that they recently updated the fuel flowage fees, and had the successful fundraising campaign for the art mural. Tharp noted the solar power project intended to reduce the airport's utility costs. Tharp stated the final goal was to `sustain strong communication and collaboration with the City Council, City Administration, and other City Departments'. Tharp noted they had presented the strategic plan to Council. The Public Art Advisory Committee had helped with the art mural project. Tharp also noted that Streets and Public Works were very involved in helping with the encampment cleanups. Lawrence stated his desire was for the Commission to fulfill the goal of attending Council meetings. Gardinier asked about a trail along Riverside drive and members discussed things they've done trying to advocate for the trail. 3. T-Hangar Improvements —Tharp stated he wanted to follow up on comments from Story last meeting and give Commission members a chance to brainstorm what ideas they might have in terms of making the hangars have a better value for the price tenants pay. Story said his comments revolved around access and usage of the hangars and doing additional work in regards to maintenance of the hangars especially on the north side. Lawrence asked about the tracking system that Tharp had set up and Tharp responded that it was working as planned. Members discussed increasing maintenance work and being more pro -active on maintenance items instead of reactive. Tharp noted that they could increase the communication as well and remind tenants that they should be reporting items that need attention. Pfohl suggested sending a letter to tenants and reminding them of the maintenance details. III. Events — Tharp stated that as the events for 2024 were scheduled the list would be repopulated d. FBO / Flight Training Reports I. Jet Air — Tharp noted that Wolford wasn't in attendance due to some sick family. Tharp stated he didn't have a lot of info from Matt. Orozco asked about when they were purchasing the broom, and Tharp responded that would be next summer with the next year's budget. e. Commission Members' Reports —none Staff Report — Tharp noted he would be out of the office the last week of December. SET NEXT REGULAR MEETING — Members set the next meeting for January 1111, 2024 at 6:OOpm. Story stated that he would not be able to attend the next meeting. [Smith joined the meeting 3:36] UNFINISHED/ONGOING BUSINESS: Climate Action Commission Page 2 of 4 Visioning indicators of success in built environment • Gardner provided an overview of the discussion to date, presenting a bullet list of indicators gathered and condensed from previous meetings as well as the text of the City Council's climate vision from the Strategic Plan. Gardner explained the goal is not for the Commission to create a competing vision from the Council's but to provide additional details that can be useful in guiding the City's climate efforts. • As to next steps, Gardner asked the Commission to review the list and make sure it accurately captured the discussion so far. Commissioners were also asked for the next meeting to consider which would be the priority items to measure and ways to do so. Gardner invited Commission members to consider this question broadly, both in terms of the comparative importance of the items and which might not be getting measured already or could be better measured. • Gardner also noted that the vision for residential areas might be a bit stronger as compared to the commercial and industrial areas and suggested it would be helpful to bring in a representative from a local industrial entity to share their perspective and efforts toward sustainable operations, similar to the presentations the Commission has heard from other City departments throughout this process. • Gade and Sillman expressed approval for the list of visioning indicators in the agenda packet. No omissions were noted. • Gardner noted that the minutes from each meeting are included in the information packet that goes to City Council for review and that the bullet list would be included as well. NEW BUSINESS: Whole Home Electrification / Housing Choice Voucher Grant Pilot • Gardner outlined the program that will launch in January. In return for grants to make electrification and energy efficiency upgrades, property owners will agree to accept Housing Choice Vouchers for five years. Gardner noted that Rewiring America staff were excited about the idea and asked to be kept apprised of the program, to share information with other communities. • Fraser expressed approval for the program and noted the importance of growing it. • Sturdevant asked if the program would target new participants or current landlords. Gardner noted that the Housing Authority has relationships with landlords who already accept Housing Choice Vouchers and this program is designed to reach both them and landlords who have not yet accepted these vouchers. • Sturdevant asked what type of properties would be eligible. Gardner responded that the program would be for single-family homes, as these properties are most likely to house families with children. • Gade asked about how landlords might apply. Gardner noted that Housing Authority has a framework for accepting applications. • Sillman asked what exactly participants get. Gardner listed the types of improvements eligible as outlined in the memo included in the agenda packet. Gardner explained the forgivable loan structure of the grant. • Eynon -Lynch expressed approval for the success benchmarks and asked about the timeline to secure funding to expand the project beyond the pilot. Gardner offered thoughts on the possibilities for making this a regional program, using federal grant funds from the Climate Pollution Reduction Grant program, as well as the possibility of continuing to draw on the balance of funds from the Emergency Levy. Climate Action Commission Page 3 of 4 Gade asked if there are plans to measure the direct impact on the tenants, in terms of energy efficiency or comfort. Fraser asked if it would be possible to collect information on the property's energy costs before and after improvements. Gardner explained some of the difficulties in collecting before -and -after data, as different families with different habits would occupy the properties, but suggested the Housing Authority might be able to offer ideas on measures used in their programs. Sillman noted that broadening this program regionally might be a way to reach beyond the usual Iowa City audience. Sturdevant asked whether the voucher was part of the $25,000 allocated per property. Gardner noted that Commission members can nominate others or themselves for the role, both approaches are allowed. Gade asked if the same chair and vice - chair can serve again. BOARD'S RESPONSIBILITY: Under the City Code of the City of Iowa City, the Board's responsibilities are as follows: 1. The Board forwards all complaints to the Police Chief, who completes an investigation. (Iowa City Code Section 8-8-7(A).) 2. When the Board receives the Police Chiefs report, the Board must select one or more of the following levels of review, in accordance with Iowa City Code Section 8-8-7(B)(1): a. On the record with no additional investigation. b. Interview /meet with complainant. c. Interview /meet with named officer(s) and other officers. d. Request additional investigation by the police chief, or request police assistance in the board's own investigation. e. Perform its own investigation with the authority to subpoena witnesses. f. Hire independent investigators. 3. In reviewing the Police Chiefs report, the Board must apply a "reasonable basis" standard of review. This means that the Board must give deference to the Police Chiefs report, because of the Police Chief's professional expertise. (Iowa City Code Section 8-8-7(13)(2)).) 4. According to Iowa City Code Section 8-8-7(B)(2), the Board can recommend that the Police Chief reverse or modify the Chiefs findings only if: a. The findings are not supported by substantial evidence; or b. The findings are unreasonable, arbitrary, or capricious; or c. The findings are contrary to a police department policy or practice, or any federal, state, or local law. FILE® JAN 112924 City Clerk Iowa City, Iowa 5. When the Board has completed its review of the Police Chiefs report, the Board issues a public report to the city council. The public report must include: (1) detailed findings of fact; and (2) a clearly articulated conclusion explaining why and the extent to which the complaint is either "sustained" or "not sustained ". (Iowa City Code Section 8-8-7(B)(3)).) 6. Even if the Board finds that the complaint is sustained, the Board has no authority to discipline the officer involved. BOARD'S PROCEDURE: The Complaint was initiated by the Complainant on June 22, 2023. As required by Section 8-8-5(B) of the City Code, the Complaint was referred to the Chief of Police for investigation The Chief's Report was filed with the City Clerk on September 26, 2023. As per Section 8-8-6(D) of the City Code, the Complainant was given the opportunity to respond to the Chief's report. The Board voted on December 12, 2023 to apply the following Level of Review to the Chiefs Report: On the record with no additional investigation, pursuant to Iowa City Code Section 8-8-7 (6)(1)(a). The Board met to consider the Report on December 12, 2023 and January 11, 2023. Prior to the December 12, 2023 meeting, the Board had the opportunity to review the complaint, the Police Chief's report, and to watch and listen to body worn camera and/or in -car camera footage showing the interaction between the officers and the complainant. FINDINGS OF FACT: The complainant reported his involvement in an accident two days after the event. He felt his interaction with the Iowa City Police Department had been unfair. He wanted his recent accident classified as a "Hate" crime. He reported that he had been to the emergency room. The police investigation included a report from the emergency room saying there had been no physical damage and that he had been released the same day on his own. There was no further medical care indicated. The complainant said that a black vehicle, which he was following, had suddenly slowed to make a turn. It happened so suddenly that he turned his moped into the curb and both he and his vehicle fell. He felt this was an intentional act to try and kill him. He said that he had similar interactions with this black vehicle. He also said that no action has been taken by the police as the officer taking the report found that his mother-in-law had been the driver. The police did check with the owners of several black vehicles, but none had issues of the kind the complainant had claimed. Chief Liston said that no police officer had a mother-in-law matching the description given by the complainant. The reporting requirements are not intended to be all-inclusive. A member may complete a report if he/she deems it necessary or as directed by a supervisor. 323.5.1 Criminal Activity: When a member responds to a call for service, or as a result of self - initiated activity becomes aware of any activity where a crime has occurred, the member shall document the incident regardless of whether a victim desires prosecution. Documentation may include a report or department approved alternative reporting method as described in this section. The Iowa City Police Department will respond to all vehicle crashes which occur within the corporate limits of Iowa City. Members of this department will comply with state reporting requirements . (See Iowa Code 321.266) In incidents that do not meet the state mandated reporting requirements, officers will respond and will fill out an "accident report" for submission to Iowa City Police Department records section. All accidents will be sufficiently investigated to determine the facts surrounding the accident- D. Hit and Run Crashes. Hit and run crashes will be investigated to the extent possible. Upon arrival at the scene the responding officer should broadcast any suspect vehicle or driver information as soon as possible. Iowa Code 321.266 1. BOARD'S RESPONSIBILITY: Under the City Code of the City of Iowa City, the Board's responsibilities are as follows: 1. The Board forwards all complaints to the Police Chief, who completes an investigation. (Iowa City Code Section 8-8-7(A).) 2. When the Board receives the Police Chiefs report, the Board must select one or more of the following levels of review, in accordance with Iowa City Code Section 8-8-7(B)(1): a. Subject was drinking alcohol and being disruptive during his stay at Mother's home. Mother feared bodily harm if the subject was to remain at her house. With the involvement of the mental health liaison, it was deemed necessary for subject to be placed elsewhere to be evaluated for mental state. COMPLAINANT'S ALLEGATION #1 — Violation of 300.3, Use of Force. Officers shall use only that amount of force that reasonably appears necessary given the facts and circumstances perceived by the officer at the time of the event to accomplish a legitimate law enforcement purpose. The application of any use of force compliance shall be discontinued once the officer determines that compliance has been achieved.
