Ordinance No. 24-4918
An ordinance conditionally rezoning approximately 0.78 acres of land located 1201 W. Benton Street from
Low Density Single -Family Residential (RS-5) to Low Density Multi -Family Residential (RM-12) (REZ23-
0008).
Whereas, the owner, Christian Retirement Services, Inc., has requested a rezoning of property located at 1201
W. Benton Street from Low Density Single -Family Residential (RS-5) to Low Density Multi -Family Residential (RM-
12); and
Whereas, the Comprehensive Plan indicates that the subject area is appropriate for 8-16 Dwelling Units
per Acre and encourages land use and housing policies specific to ensuring compatible infill development to the
surrounding neighborhood, appropriate infill and redevelopment opportunities, and housing designs to allow people
to age in place; and
Whereas, the Southwest District Plan identifies the subject area as appropriate for Multi -family Residential and
encourages development of high -quality multi -family housing that is compatible with the surrounding development
to meet the housing needs of a variety of households including singles, young families, university students and
elderly populations; and
Whereas, the rezoning creates a public need to ensure the development of high quality multi -family housing
that is compatible with the existing neighborhood character, mostly comprised of small scale single-family homes,
through general compliance with the footprint and scale of the concept plan, a maximum height of one story, and
approval of a landscaping plan by the City Forester that preserves as much of the existing mature landscaping as
possible; and
Whereas, the Planning and Zoning Commission has determined that, with reasonable conditions regarding
general compliance with the development concept attached hereto, a maximum height of one story, and a
landscaping plan that preserves the existing mature landscape, the requested zoning is consistent with the
Comprehensive Plan.
Whereas, Iowa Code §414.5 (2022) provides that the City of Iowa City may impose reasonable conditions
on granting a rezoning request, over and above existing regulations, in order to satisfy public needs caused by
the requested change; and
Whereas, the owner, Christian Retirement Services, Inc., has agreed that the property shall be developed
in accordance with the terms and conditions of the Conditional Zoning Agreement attached hereto to ensure
appropriate development in this area of the city.
Now, therefore, be it ordained by the City Council of the City of Iowa City, Iowa:
Section I Approval. Subject to the Conditional Zoning Agreement attached hereto and incorporated herein,
property described below is hereby reclassified to Low Density Mufti -Family Residential (RM-12):
LOTS 1 AND 2, BRYN MAWR HEIGHTS, PART 1, ACCORDING TO THE PLAT THEROF RECORDED IN BOOK 6,
PAGE 12, PLAT RECORDS OF JOHNSON COUNTY, IOWA.
DESCRIBED AREA CONTAINS 0.78 ACRES.
Section II. Zoning Maw The building official is hereby authorized and directed to change the zoning map of
the City of Iowa City, Iowa, to conform to this amendment upon the final passage, approval and publication of the
ordinance as approved by law.
Section III. Conditional Zoning Agreement. The mayor is hereby authorized and directed to sign, and the City
Clerk attest, the Conditional Zoning Agreement between the property owner(s) and the City, following passage and
approval of this Ordinance.
Section IV, Certification And Recording. Upon passage and approval of the Ordinance, the City Clerk is hereby
authorized and directed to certify a copy of this ordinance, and record the same in the Office of the County Recorder,
Johnson County, Iowa, at the Owner's expense, upon the final passage, approval and publication of this ordinance,
as provided by law.
Section V. Repealer. All ordinances and parts of ordinances in conflict with the provisions of this Ordinance are
hereby repealed.
Section VI. Severability. If any section, provision or part of the Ordinance shall be adjudged to be invalid or
unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any section, provision
or part thereof not adjudged invalid or unconstitutional.
Section VII, Effective Date. This Ordinance shall be in effect after its final passage, approval and publication,
as provided by law.

Conditional Zoning Agreement
This agreement Is made among the City of Iowa City, Iowa, a municipal corporation (hereinafter referred to as
"City') and Christian Retirement Services, Inc. (hereinafter referred to as "Owner").
Whereas, Owner is the legal title holder of approximately 0.78 acres of property located at 1201 W.
Benton Street legally described below; and
Whereas, Owner has requested the rezoning from Low Density Single -Family Residential (RS-5) to Low
Density Multi -Family Residential (RM-12); and
Whereas, the Comprehensive Plan indicates that the subject area is appropriate for 8-16 Dwelling
Units per Acre and the Southwest District Plan indicates that the subject area Is appropriate for Multi -family
Residential; and
Whereas, the rezoning creates a public need to ensure the development of high quality multi -family housing

Now, therefore, in consideration of the mutual promises contained herein, the parties agree as follows:
1. Christian Retirement Services, Inc. is the legal title holder of the property legally described as:
LOTS 1 AND 2, BRYN MAWR HEIGHTS, PART 1, ACCORDING TO THE PLAT THEROF RECORDED IN BOOK 6,
PAGE 12, PLAT RECORDS OF JOHNSON COUNTY, IOWA.
DESCRIBED AREA CONTAINS 0.78 ACRES.
2. Owner acknowledges that the City wishes to ensure conformance to the principles of the
Comprehensive Plan. Further, the parties acknowledge that Iowa Code §414.5 (2023) provides that
the City of Iowa City may impose reasonable conditions on granting a rezoning request, over and
above the existing regulations, in order to satisfy public needs caused by the requested change.
3. In consideration of the City's rezoning the subject property, Owner agrees that development of
the subject property will conform to all requirements of the Zoning Code, as well as the following
conditions:
a. General compliance with the footprint and scale of the development concept attached
hereto.
b. The building shall not exceed one-story in height.
C. Approval of landscaping plan by the City Forester that minimize removal of existing mature
landscaping during construction.
4. The conditions contained herein are reasonable conditions to impose on the land under Iowa Code
§414.5 (2023), and that said conditions satisfy public needs that are caused by the requested zoning
change.
5. This Conditional Zoning Agreement shall be deemed to be a covenant running with the land and with
title to the land, and shall remain in full force and effect as a covenant with title to the land, unless or
until released of record by the City of Iowa City. The parties further acknowledge that this agreement
shall inure to the benefit of and bind all successors, representatives, and assigns of the parties. In
the event the subject property is transferred, sold, redeveloped, or subdivided, all development will
conform with the terms of this Conditional Zoning Agreement.
6. Nothing in this Conditional Zoning Agreement shall be construed to relieve the Owner from complying
with all other applicable local, state, and federal regulations.This Conditional Zoning Agreement shall
be incorporated by reference into the ordinance rezoning the subject property, and that upon adoption
and publication of the ordinance, this agreement shall be recorded in the Johnson County Recorder's
Office at the Applicant's expense.

Ordinance No. 24-4919
Ordinance amending Title 14, Zoning to reduce the maximum allowable height in the Neighborhood Stabilization Residential (RNS-12) zone from thirty-
five (35) feet to twenty-seven (27) feet for single-family and duplex uses. (REZ23-0005)
Whereas, the Northside Neighborhood Association asked the City Council to consider amending the zoning code to reduce the maximum allowable
height in the RNS-12 zone from thirty-five (35) feet to twenty-seven (27) feet; and
Whereas, on June 6, 2023, City Council initiated the requested zoning code text amendment by directing City staff to consider and make a
recommendation on this request; and
Whereas, Staff researched the history of the RNS-12 zone and the existing height limit; and
Whereas, the City Council created the RNS-12 zone in 1993 with the purpose of stabilizing certain existing residential neighborhood by preserving the
predominately single-family residential character of these neighborhoods; and
Whereas, with the adoption of the RNS-12 zone, Council established the maximum building height at 35 feet, consistent with other single-family
residential zones; and
Whereas, since 1992, there have been 17 residential demolitions in the RNS-12 zone; and
Whereas, Staff found no evidence that the existing 35 feet height limit is an incentive for redevelopment and recommends denial of this zoning code
text amendment; and
Whereas, the Planning and Zoning Commission reviewed the zoning code amendments set forth below and recommends denial.
Now, therefore, be it ordained by the City Council of the City of Iowa City, Iowa:
Section I. Amendments. The Code of Ordinances of the City of Iowa City, Iowa is hereby amended as follows:

Section II. Repealer. All ordinances and parts of ordinances in conflict with the provision of this Ordinance are hereby repealed.
Section III. Severability. If any section, provision or part of the Ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall
not affect the validity of the Ordinance as a whole or any section, provision or part thereof no adjudged invalid or unconstitutional.

Ordinance rezoning property located at 302-316 E. Bloomington Street
from Central Business Service (CB-2) zone to CB-2 with a Historic District
Overlay (OHD/CB-2) zone. (REZ24-0001)
Whereas, the City of Iowa City Historic Preservation Commission requested a rezoning of
property located at 302-316 E. Bloomington Street from Central Business Service (CB-2) zone to
CB-2 with a Historic District Overlay (OHD/CB-2) zone to designate the property as an Iowa City
Historic Landmark; and
Whereas, this structure was originally constructed in 1875 and is significant for its role in
the ethnic and commercial history of Iowa City's Northside neighborhood and as a well-preserved
example of Italianate architecture; and
Whereas, the Comprehensive Plan encourages the preservation of historic buildings
through a Neighborhood Design Principle that aims to preserve historic resources and reinvest
in established neighborhoods; through a Land Use goal that aims to continue and protect the
community's historical, environmental, and aesthetic assets with a strategy to encourage
protection of natural areas and historic features; and through a Housing goal that aims to
preserve the integrity of existing neighborhoods and the historic nature of older neighborhoods
with a strategy that supports the Historic Preservation Commission's efforts to meet its goals;
and
Whereas, the Central District Plan encourages preservation of historic homes, resources and
neighborhoods, especially in areas close to the University by bestowing historic landmark status
on the area's most significant buildings and properties; and
Whereas, the Central District Plan identifies the Northside Marketplace as a historic
commercial neighborhood where there is a strong communal desire to maintain the historic
mainstreet character and includes a goal that aims to preserve and promote the unique aspects
of the Northside Marketplace; and
Whereas, Goal 1 of the Historic Preservation component of the Comprehensive Plan calls
for identification of resources significant to Iowa City's past with the objective of designating
individual buildings as landmarks; and
Whereas, the Historic Preservation Plan includes a section on the Gilbert -Linn Street Historic
District, which discusses the importance of various buildings including the Slezak Building -
National Hall; and
Whereas the Historic Preservation Commission has reviewed the proposed Historic
Landmark designation, has found that it meets the criteria for landmark designation in its
significance to Iowa City history, integrity of location and design, association with events that
have a significant contribution to the broad patterns of history, and embodies the distinctive
characteristics of a type, period, or method of construction; and
Whereas, the Planning and Zoning Commission has reviewed the proposed Historic
Landmark designation rezoning and has found that it is consistent with the Comprehensive Plan
goals of preserving historic resources.
Now, therefore, be it ordained by the City Council of the City of Iowa City, Iowa:
Section I. Historic Landmark Approval. Property described below is hereby reclassified to
Central Business Service with a Historic District Overlay (OHD/CB-2) zone:
Lot 5 and the West 50 feet of Lot 6 all in Block 57 in Iowa City, Iowa, according to the
recorded plat thereof.
Section II. Zoning Map. The building official is hereby authorized and directed to change the
zoning map of the City of Iowa City, Iowa, to conform to this amendment upon the final passage,
approval and publication of this ordinance by law.
Section III. Certification And Recording. Upon passage and approval of the Ordinance, the
City Clerk is hereby authorized and directed to certify a copy of this ordinance and to record the
same, at the office of the County Recorder of Johnson County, Iowa, at the owner's expense, all
as provided by law.
Section IV. Repealer. All ordinances and parts of ordinances in conflict with the provisions
of this Ordinance are hereby repealed.
Section V. Severability. If any section, provision or part of the Ordinance shall be adjudged to
be invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a
whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
Section VI. Effective Date. This Ordinance shall be in effect after its final passage, approval
and publication, as provided by law.

Ordinance amending Title 9,entitled
"Motor Vehicles and Traffic,"Chap-
ters 1 and Chapter 6 to require
drivers to yield right of way to bicy-
clists at crosswalks and to require
bicyclists riding on sidewalks to
obey pedestrian devices at signaled
intersections.
Whereas, the Governor recently
signed HF2568 requiring drivers to
yield the right of way to bicyclists in
cross walks and to clarify that a
bicycle is not a pedestrian in the
chapter governing motor vehicles
and rules of the road(Chapter 321 of
the Iowa Code) effective July 1,
2024;and
Whereas, the City Code should be
amended to be consistent with
HF2568;and
Whereas there is no provision in the
City Code that governs whether a
bicyclist riding on the sidewalk must
obey pedestrian traffic control
signals;and
Whereas, a bicyclist riding on the
sidewalk should be required to obey
pedestrian traffic control signals;
and
Whereas, it is in the City's interest
to adopt the ordinance.
Now, therefore, be it ordained by
the City Council of the City of Iowa
City,Iowa:
Section I.Amendments
1. Title 9, entitled "Motor Vehicles
and Traffic," Chapter 1, entitled
"Definitions, Administration and
Enforcement of Traffic Provisions,"
Section 1, entitled "Definitions," is
amended by adding the underscore

in place or in operation, the driver

crossing the roadway within any
marked crosswalk or within any
unmarked crosswalk at an intersec-
tion,except as otherwise provided in
this title.
3. Title 9, entitled "Motor Vehicles
and Traffic," Chapter 8, entitled
"Bicycles," Section 1, entitled
"Operation of Bicycles," Subsection
Al is amended by adding the under-
score text and deleting the strike
through text as follows:
All persons riding bicycles upon any
street or sidewalk within the City

nances and rules as to traffic lights
and highway and street stop signs

Section II. Repealer. All ordinances
and parts of ordinances in conflict
with the provision of this Ordinance
are hereby repealed.
Section III. Severability. If any
section, provision or part of the
Ordinance shall be adjudged to be
invalid or unconstitutional, such
adjudication shall not affect the
validity of the Ordinance as a whole
or any section, provision or part
thereof not adiudged invalid or
unconstitutional.
Section IV. Effective Dote. This
Ordinance shall be in effect after its
final passage,approval and publica-
tion,as provided by law.

Ordinance amending Title 3,entitled"Finances,Taxation and Fees,"Chapter 4,entitled"Schedule of Fees,Rates,Charges,Bonds,Fines and Penalties"
Whereas,pursuant to Chapter 384,Code of Iowa(2023),the City of Iowa City is authorized to establish and provide for the collection of rates to pay for the
City's utility systems,including the City's water supply and treatment system,wastewater treatment system,solid waste disposal services at the municipal
landfill,and parking system;and
Whereas,the City's financial policies dictate that the Water fund and the Wastewater fund shall be self-supporting;and
Whereas,the Iowa City Water Division and Wastewater Division previously approved various charges,deposits,and fees administratively;and
Whereas,the Iowa City City Council proposes to add water system charges for fire hydrant flow tests and locating private service lines,after the initial 30
minutes;and
Whereas,the Iowa City City Council proposes to add water system deposits for fire hydrant meters;and
Whereas,the Iowa City City Council proposes to add water system fees for taps,water meter,potable meter kit rental,fire hydrant meter connection and
disconnection,and fire hydrant meter water use;and
Whereas,the Iowa City City Council proposes to add wastewater system fees for testing and car wash loads;and
Whereas,the Iowa City City Council proposes these charges,deposits and fees be in effect on October 1,2024 to recover the City's cost of providing services.
Now,therefore,be it ordained by the City Council of the City of Iowa City,Iowa:

Ordinance Amending Title 3,Entitled"Finances,Taxation And Fees,"Chapter 4,Entitled"Schedule Of Fees,Rates,Charges,Bonds,
Fines,And Penalties,"Section 8 Entitled"Parking"to establish the rate for evening and weekend parking permits,to decrease
meter rates,and establish a tine for parking permit violations.
Whereas,the Iowa City City Council received public comment regarding recent increases in parking fees and now finds it
appropriate to establish the rate for evening and weekend parking permits,decrease meter rates,and establish a fine for parking
permit violations;and •
Whereas,the Iowa City City Council proposes to add a monthly and evening weekend permit to allow permit parking in designated
ramps and ICI set the tee at 75%of the monthly all day ramp permit fee;and
Whereas,the Iowa City City Council proposes to change the name of the existing monthly off hours permit for surface lots to
monthly evening and weekend permit to allow permit parking in designated surface lots and to set the fee at 75%of the monthly
all day surface lot permit fee;and
Whereas,the Iowa City City Council proposes to decrease the hourly meter fee from$3.00 per hour to$2.25 per hour in the core
of Downtown Iowa City;and
Whereas,the Iowa City City Council proposes setting die line for parking permit violations at$30.00 per violation;and
Whereas,it is in the best interest of the City to adopt this ordinance.
Now,therefore,be it resolved by the City Council of the City of Iowa City,Iowa:
Section I.Amendment.
1.Title 3,entitled"Finances,Taxation,and Fees,"Chapter 4,entitled"Schedule of Fees,Rates,Charges,Bonds,Fines,and
Penalties,"Section 8,entitled"Parking,"of the Iowa City Code is hereby amended by deleting it in its entirety and replacing
it as follows:

Ordinance No.24-4940
Ordinance amending Title 14,Zoning Code,to allow redemption centers in commercial and industrial
zones.(REZ24-0007).
Whereas,the Iowa's Beverage Containers Control Law was amended in June 2022 to allow stores to opt out of redeeming containers
if there is a redemption center nearby or if other criteria are met;and
Whereas,there is interest from a local business that operates a redemption center to expand services,improve collection processes,
and provide better access to the community;and
Whereas,the Comprehensive Plan includes a goal that aims to increase and diversify the property tax base by encouraging the retention
and expansion of existing businesses that are compatible with Iowa City's economy and a strategy focused on creating an attractive
economic environment with streamlined,business-friendly culture by making regulatory and permitting processes clear;and
Whereas,the Comprehensive Plan includes a goal that focuses on encouraging a healthy mix of independent,locally-owned businesses
and national businesses and a strategy focused on retaining and encouraging the growth of existing locally-owned businesses;and
Whereas,the Comprehensive Plan includes a goal to raise awareness and expand opportunities for waste reduction,energy efficiency,
stormwater management and other environmental issues;and
Whereas,the City Council adopted the Climate Action and Adaptation Plan in 2018 and declared a Climate Crisis in 2019;and established
a goal to reduce carbon emissions by 45%from 2010 levels by 2030;and
Whereas,the proposed amendments allow redemption centers to locate throughout the community in commercial and industrial zones;
and
Whereas,the Planning and Zoning Commission recommended approval of the Title 14 Zoning Code amendments at its meeting on
September 18,2024;and
Whereas,it is in the City's best interest to adopt this ordinance.
Now,therefore,be it ordained by the City Council of the City of Iowa City,Iowa:
Section I.Iowa City Code Title 14"Zoning Code"is hereby amended by deleting the strikethrough text,adding the underlined text,and
