Comment: On February 21, 2024, the Planning and Zoning Commission recommended approval of the conditional use permit application by a vote of 7- 0. Final approval of the application will come from the Johnson County Board of Adjustment. Approval of the conditional use permit will allow for a temporary concrete and asphalt recycling use located south of IWV Rd SW and west of Kansas Ave SW in unincorporated Johnson County. March 19, 2024 Iowa City City Council Agenda Page 3 7.b Conditional Use Permit - Telecommunications Tower Motion to approve submitting a letter of recommendation to the Johnson County Board of Adjustment for a Conditional Use Permit application for a telecommunications tower on land zoned County Agriculture (A) in unincorporated Johnson County not located in the City Fringe area. Comment: On February 21, 2024, the Planning and Zoning Commission recommended approval of the conditional use permit by a vote of 7-0. Final approval of the application will come from the Johnson County Board of Adjustment. Approval of the conditional use permit will allow a telecommunications tower located on property south of 355th St and east of Kansas Ave SW in unincorporated Johnson County. 7.c County Conditional Use Permits Resolution delegating review authority of County Conditional Use Permits. L4-`> Comment- The Johnson County Unified Development Ordinance (UDO) allows for City Council or a duly authorized representative to comment or waive comment on County Conditional Use Permits (CUP) when they are located within Iowa City's extraterritorial jurisdiction. To streamline the review and reduce the amount of staff time required for these reviews, staff recommends authorizing administrative review by the Director of Neighborhood and Development Services or designee. Where the Director or designee anticipates a substantial impact on the public, as determined in his or her sole discretion, he or she may request a full review by the Planning and Zoning Commission and City Council. 7.d Amend budgeted positions - Neighborhood Services Resolution amending budgeted positions in the Neighborhood Services Division of ------------ --- the Neighborhood and Development Services Department by reclassifying one full-time Associate Planner position to one full-time, Senior Community Development Planner position and amending the Administrative pay plan by adding the position Senior Community Development Planner to grade 29. Comment: Neighborhood Services is requesting reclassification of the 1.0 FTE Associate Planner position with a 1.0 FTE Senior Community Development Planner position to direct the operational, financial, and personnel activities of community development. 7.e Makeup Air Units Resolution authorizing the procurement of three (3) makeup air units. Comment: This Resolution will approve the procurement of Trane Indirect Gas Fired Makeup Air Units for the Wastewater Treatment Facility via Omnia Partners Cooperative Contract 3341. This purchase will exceed the $200,000 spending authority of the City Manager, thereby requiring Council approval. Over the course of this contract the City expects to expend approximately $245,305.72. March 19, 2024 Iowa City City Council Agenda Page 4 7.f ARPA Inclusive Economic Development The Dream Center Agreement _ Resolution authorizing the City Manager to sign a grant agreement with The Dream Center for Inclusive Economic Development funds. Comment: This resolution will approve the allocation of $2,900,000 of State and Local Fiscal Recovery Fund (SLFRF) funds to The Dream Center for facility acquisition, renovation, and Inclusive Economic Development programs. 7.g ARPA Inclusive Economic Development Wright House of Fashion Agreement Resolution authorizing the City Manager to sign a grant agreement with Wright House of Fashion for Inclusive Economic Development funds. Comment: This resolution will approve the allocation of $100,000 of State and Local Fiscal Recovery (SLRFR) funds to the Wright House of Fashion to provide training in arts education and design related careers, offer related business programming and workshops, and host an incubator space for early stage entrepreneurs. 7.11 ARPA Inclusive Economic Development Multicultural Development Center of Iowa Agreement aL+-LS Resolution authorizing the City Manager to sign a grant agreement with Multicultural Development Center of Iowa for Inclusive Economic Development funds. Comment: This resolution will approve the allocation of $600,000 of State and Local Fiscal Recovery (SLRFR) funds to the Multicultural Development Center of Iowa to hold business accelerator cohorts, provide business training and mentoring to small businesses, and distribute technical assistance grants. 7.i 28E Agreement - Dive Team Resolution authorizing the Mayor to sign and the City Clerk to attest a Chapter `4 - S 28E agreement for the joint provision of underwater search and recovery operations (aka, a dive team) and rescinding Resolution No. 23-301. Comment: The City along with the County, Coralville, and other local governments entered into an agreement in 2015 for the provision of underwater search and recovery services, aka a dive team. Johnson County Emergency Management Agency is proposing a new agreement to add University Heights, to remove North Liberty, and to modify diver qualifications. This resolution authorizes the City to sign the agreement. Council approved a similar agreement in November 2023, but prior to all governments signing off, North Liberty withdrew. The 2015 agreement remains in force until all parties sign the new agreement. March 19, 2024 Iowa City City Council Agenda Page 5 7.j 2024 Parks Improvements Project Resolution approving, authorizing and directing the Mayor to execute and the City & O Clerk to attest an Agreement by and between the City of Iowa City and Bolton and Menk, Inc. to provide engineering consultant services for the 2024 Parks Improvements Project. Comment: This item will approve an agreement with Bolton and Menk, Inc. of Cedar Rapids, Iowa to provide consultant services including design development, preparation of construction documents, bid phase services and limited construction administration services for the 2024 Parks Improvements Project. The project generally includes replacing aging playground equipment, construction of a new playground, and improved trail connections. The negotiated fee is not to exceed $139,000, available in the Brookland Park Playground Replacement and ADA Paths Project, Account #R4410, New Park near Shannon Drive and Andrea Court, Account #R4351, College Green Park Playground and Basketball Court Replacement, Account #R4385, and Calder Park Accessible Trail Entry and Connection to Monument Hills Subdivision, Account #R4206. 7.k Burlington Street Bridge Resolution approving, authorizing and directing the City Manager to execute and 4 the City Clerk to attest a correction to the agreement between the City of Iowa City and the Iowa Department of Transportation for acceptance of Bridge Investment Program (BIP) Funds for the Burlington Street Bridge Project. Comment: This item authorizes a correction to the Agreement for acceptance of Bridge Investment Program (BIP) funds from the Iowa Department of Transportation for the Burlington Street Bridge Project. The corrected agreement revises the reimbursement rate of eligible costs to 50% (from 80%) to correct an error in the previous agreement and match the terms of the grant award. These funds are expected to assist with the study, environmental review and preliminary design phases of the project. 7.1 Hwy 1 / Hwy 6 Intersection Improvements Study Project Resolution approving, authorizing and directing the Mayor to execute and the City Clerk to attest an Agreement by and between the City of Iowa City and Strand Associates, Inc. of Madison, Wisconsin to provide engineering consultant services for the Hwy 1 / Hwy 6 Intersection Improvements Study Project. Comment: This item will approve an agreement with Strand Associates, Inc. for the Hwy 1 / Hwy 6 Intersection Improvements Study Project, which includes a functional design level of analysis of the Hwy 1 / Hwy 6 / Riverside Drive intersection and the surrounding area. Consent Calendar - Setting Public Hearings 8.a Rezoning - 302-316 E Bloomington Street - Local Historic Landmark Motion setting a public hearing for April 2, 2024 to consider an ordinance rezoning property located at 302-316 E. Bloomington Street from Central Business Service (CB-2) zone to CB-2 with a Historic District Overlay (OHD/CB- 2) zone in order to designate the property as an Iowa City Historic Landmark. (REZ24-0001) Comment: At its meeting on February 8, the Historic Preservation Commission recommended approval of REZ24-0001 by a vote of 8-0. At its meeting on February 21, the Planning and Zoning Commission recommended approval of REZ24-0001 by a vote of 6-1 (Wade in the negative). The rezoning recognizes the property as an Iowa City Historic Landmark. Comment: The pre -levy resolution imposes a levy for the Fiscal Year beginning July 1, 2024 and ending June 30, 2025. This is included in the Fiscal Year 2025 Budget. This resolution satisfies the requirements for the resolution and levy as required by Iowa Code Chapter 76. When the Bonds are issued (the sizing of which may change as directed by the Council), the authorizing resolution will incorporate this levy based on the actual rates at the sale. The City purchased a duplex at 1311-1313 Sandusky Dr., —�� rehabilitated it, and converted it to a 2-unit condominium.
