Comment: This resolution provides final authorization for US Bank of St Paul, Minnesota to act as paying agent for the City of Iowa City in regard to the issuance of $10,140,000 General Obligation Bonds, series 2024. 6.b 2024 Bond Authorization Resolution Resolution Authorizing and Providing for the Issuance of$10,140,000 General Obligation Bonds, Series 2024, and Levying a Tax to Pay Said Bonds; Approval of the Tax Exemption Certificate and Continuing Disclosure Certificate. Comment: This resolution approves the tax exemption certificate, the continuing disclosure certificate and authorizes the issuance of the 2024 General Obligation Bonds. The resolution also amends the tax levy requirements needed for the repayment of the bonds. May 21, 2024 Iowa City City Council Agenda Page 3 2q- 12)2 6.c Cemetery Rules Resolution adopting regulations governing the operation of Oakland Cemetery including lot owner rights, maintenance practices, and visitor rules and rescinding Resolution No. 24-22. Comment: The City Code provides regulations governing the operation of Oakland Cemetery shall be established by resolution of the City Council. When Council updated the regulations in early 2024, no provisions addressed cremation monuments (a monument which is hollow to allow placement of an urn). This resolution amends the the regulations to add provisions for cremation monuments, and there are no other substantive changes. 2�1 13"3 6.d Cemetery Fees Resolution establishing a schedule of rates and charges for Oakland Cemetery and rescinding Resolution No. 24-23. Comment: The City Code provides rates and charges for services and burial spaces for Oakland Cemetery shall be established by resolution of the City Council. When Council updated the rates and charges in early 2024, rates for cremation monuments (a monument which is hollow to allow placement of an urn) were not included. This resolution amends the rate schedule to add a rate for cremation monuments, and there are no other changes to rates and charges. 2y 6.e Block Party & Oktoberfest alcohol agreement Resolution approving an agreement with the Downtown District to allow the sale and possession of beer and wine during the Block Party and Oktoberfest. Comment: The City Code allows private entities by agreement to sell and their customers to consume and possess alcohol on public right-of- way under limited circumstances. The Downtown District would like to be able to sell beer and wine in demarcated areas during the Block Party on June 22 and Oktoberfest on Sept. 28 and customers to possess beer and wine. This resolution approves the attached agreement, which is the same agreement as last year. The demarcated areas for the two events are shown on exhibits to the agreement. 6.f Riverside Festival Stage-alcohol agreement Resolution approving an agreement with Riverside Theatre to allow the sale of wine and beer under limited circumstances in City Park. Comment: The City Code allows non-profit entities by agreement to sell and their patrons to consume and possess alcohol in a city park and on public right-of-way. Riverside Theatre would like to be able to sell beer and wine during performances in June and July 2024 in a demarcated area in and around Riverside Festival Stage in City Park. This resolution approves an agreement which is the same as last year. May 21, 2024 Iowa City City Council Agenda Page 4 2y -I?�l, 6.g IRA Clean Energy Tax Credit Consulting Services Agreement Resolution authorizing the City Manager to sign an agreement with Eide Bailly LLP to provide consulting services for the Inflation Reduction Act Clean Energy Tax Credit. Comment: This resolution will approve an agreement with Eide Bailly LLP to provide consulting services for the Inflation Reduction Act Clean Energy Tax Credit related to the Wastewater Digester Gas Improvements Project. The total cost of the services are not to exceed $275,000, plus actual out- of-pocket expenses such as travel time, mileage, lodging and meals and funds are available in Account#V3184 - Wastewater Digester Gas Improvements. 2�4- 13-1 6.h Sycamore Woods - Parts One and Three Resolution accepting the work for the storm sewer, sanitary sewer, water main, paving, and certain sidewalk public improvements for Sycamore Woods — Parts One and Three, and declaring public improvements open for public access and use. Comment: This item will accept the sanitary sewer, storm sewer, water main and paving public improvements for Sycamore Woods — Parts One and Three, generally located east of the Sycamore Greenway and south of Whispering Meadow Drive. 24-13$ 6.i Hickory Hill Park Shelter and Restrooms Project Resolution accepting the work for the Hickory Hill Park Shelter and Restrooms Project. Comment: The Hickory Hill Park Shelter and Restrooms Project has been completed by Rogers Construction, Inc., of Iowa City, Iowa, in substantial accordance with the plans and specifications. Consent Calendar - Setting Public Hearings 7.a FY25 Utility Rates IN- )HO Resolution setting a public hearing for June 4, 2024 on an ordinance amending Title 3, entitled "Finance, Taxation and Fees," Chapter 4, entitled "Schedule of Fees, Rates, Charges, Bonds, Fines and Penalties" of the City Code to increase or change charges and fees. Comment: Title 3, Chapter 4 amendments includes changing the low income discount for water and wastewater users charges from 60 percent to 75 percent of the minimum monthly charge and for stormwater utility fee from 60 percent to 75 percent of the monthly charge and updating Section 5 "Solid Waste Disposal' to match the language in Section 3 "Potable Water Use and Service" on the 10 percent delinquency charge that was approved in October 2020. Comment: This project includes pavement repairs associated with water main breaks on various streets throughout Iowa City. (REZ24-0001) (Pass & Adopt) Comment: At its meeting on February 8, the Historic Preservation Commission recommended approval of REZ24-0001 by a vote of 8-0. At its meeting on February 21, the Planning and Zoning Commission recommended approval of REZ24-0001 by a vote of 6-1 (Wade in the negative). Comment: This agenda item approves the project manual & estimate of the cost for the construction of the Fire Station 1 Apparatus Bay Slab Reconstruction Project. The project includes replacing the front half of the slab with structural concrete, installing new floor drains and a code required sand/oil separator with connection to the sanitary system and associated exterior pavement replacement. (Pass &Adopt) Comment: Title 3, Chapter 4 amendments include a 3% increase in water users charges, a 5% increase in wastewater user charges, an increase in residential rtl. solid waste collection fees for curbside recycling fees by $1.00 per dwelling unit per month, an increase in the tipping fee charged at the landfill by $2.50 per ton, an increase in the hourly parking ramp fee by $1.00 per hour in the Court Street Transportation Center, Tower Place, Capital Street and Dubuque Street parking ramps, an increase in the hourly parking ramp fee by $1.25 per hour in the Chauncey Swan and Harrison Street ramps with the first hour free, an increase in the hourly parking meters from between $0.75 to $1.50 depending on the location and an increase in the fines for parking violations by varying amounts per violation in fiscal year 2025. ) Action: P3 A — SGL. ih1� f rmScm 1 ! 10.e Adjusting Park Hours Ordinance amending Title 10, entitled "Public Ways and Property," Chapter 9, entitled "Parks and Recreation Regulations," to adjust park closure hours. (First Consideration) Comment: Currently, all parks but Chauncy Swan, College Green, and Black Hawk Skt� Mini Park are closed from dusk to dawn. Under this ordinance Chauncey Swan and College Green would be closed from midnight to dawn to continue to allow use later into the evening. When parks are closed, persons may still pass through when using trails and sidewalks. Action: US �J 54 10.f Bicyclists in Crosswalks and Using Sidewalks Ordinance amending Title 9, entitled "Motor Vehicles and Traffic," Chapters 1 and Chapter 6 to require drivers to yield right of way to bicyclists at crosswalks and to require bicyclists riding on sidewalks to obey pedestrian devices at signaled intersections. (First Consideration) `JpAI V10" Comment: The Governor recently signed HF2568 requiring drivers to yield the vc right of way to bicyclists in cross walks, and this ordinance amends the City Code to be consistent with HF2568.
