6.b ICDD SSMID FY26 Preliminary Budget
Motion to accept the proposed FY26 preliminary budget for the Iowa City
Downtown District, as approved by the Iowa City Downtown District
Advisory Board.
Comment: Per the Operating Agreement between the Iowa City Downtown
District (ICDD) and the City of Iowa City, the ICDD Advisory Board must hold a
public meeting, consider approval of the preliminary proposed budget, and submit
it to City Council by December 1 each year.

Comment: Per the Operating Agreement between the South of 6 Business

completed by Woodruff Construction of Tiffin, Iowa, in substantial accordance with
the plans and specifications prepared by Shive Hattery, Inc., of Cedar Rapids,
Iowa. The Engineer's Report and performance, payment, and maintenance bond
are on file with the City Clerk.

6.g Tobacco civil penalty - Hy-Vee Fast & Fresh #1
Resolution accepting use of Iowa Code Section 453A.22(3) affirmative defense
to tobacco civil penalty by Hy-Vee Fast & Fresh #1.
Comment: This Resolution accepts the use of an affirmative defense to tobacco
civil penalty, described in Iowa Code Section 453A.22(3), from Hy-Vee Fast &
Fresh #1. Without the affirmative defense, Iowa Code Section 453A.22(2) would
provide that after a hearing, a civil penalty be assessed because an employee
of Hy-Vee Fast & Fresh #1 violated Iowa Code Section 453.2(1) by selling or
providing tobacco to a minor.

Resolution accepting payment of $ 300.00 civil penalty and waiver of right

Comment: This Resolution accepts a waiver of right to hearing and payment of a

providing tobacco to a minor within a two-year period.

Community Comment is for items not properly noticed on the agenda, Council cannot engage
in discussion or debate due to open meetings laws.
Only in-person comments will be allowed for Community Comment. Public comment for

person or remotely.
Individuals will be provided 3 minutes to speak. The Community Comment period will end at

9.a Zoning Code Amendment - Tobacco Sales Oriented Retail Uses
Ordinance amending Title 14, entitled "Zoning Code", to address tobacco
sales oriented retail uses. (REZ24-0006) (Second Consideration)
Comment: At its meeting on September 4, 2024, the Planning and Zoning
Commission recommended approval of REZ24-0006 by a vote of 5-1 (Wade in
the negative, Hensch absent). Following the Planning and Zoning Commission
meeting, paragraph 8 of the ordinance has been added as a technical fix to
account for the addition of 14-4E-5H in paragraph 7. Due to two prior substantive
changes by Council, the November 19th meeting will be treated as the second
reading.

the Bradford Drive Water Main Replacement Project, establishing amount of bid

y-e-- Comment: This project includes the replacement of existing 1950's 6-inch cast iron
water main with 8 -inch PVC pipe, on Bradford Drive from First Avenue to Arthur
Street, on Louise Street from Bradford Drive to Wayne Avenue, and on Wayne
Avenue from Wade Street to Arthur Street. The estimated construction cost is
$900,000 available in the Bradford Drive Water Main Replacement Project
Account #W3300.

Resolution approving project manual and estimate of cost for the construction of

Comment: This project generally includes construction of a joint utility trench,
removal and replacement of storm sewer, sanitary sewer, water main, and street
and sidewalk pavement, retaining walls, traffic signal systems and other related
work. The project is located on Court Street between Muscatine Avenue and
First Avenue. The estimated cost for this project is $9,600,000 and is available in
the Court Street Reconstruction account#S946.
