Consent Calendar - Resolutions and Motions 7.a October 2024 Disbursements Motion to approve disbursements in the amount of $13,203,568.22 for the period of October 1 through October 31, 2024, as recommended by the Finance Director subject to audit. Disbursements are published and permanently retained in the City Clerk's office in accordance with State Code. 7.b Personnel Policies Update Resolution rescinding the 2021 Personnel Policies and adopting L-) updated Personnel Policies. Comment: The City's Personnel Policies have been recently reviewed and updated by staff and are now being presented for adoption by the City Council. December 10, 2024 Iowa City City Council Agenda Page 3 7.c 28E Agreement -Tobacco Enforcement Resolution authorizing the City Manager to sign a 28E Agreement with the �Ll -�� 1 Iowa Department of Revenue for tobacco enforcement. Comment: The State provides funds for enforcement for Iowa's tobacco, alternative nicotine and vapor product laws and is willing to provide funding to the City for FY25 for compliance checks and enforcement checks for Iowa's tobacco, alternative nicotine, and vapor product laws. This resolution authorizes the City Manager to sign a 28E Agreement for Tobacco, Alternative Nicotine and Vapor Product Enforcement. Agreements made pursuant to Chapter 28E of the Iowa Code (aka, 28E Agreements) require Council approval. 7.d Tax abatement application - 2325 Naples Ave SW Resolution approving eligibility for a tax exemption on an improvement project on commercial property located at 2325 Naples Avenue SW, Iowa City, Iowa, pursuant to the Highway Commercial Urban Revitalization Plan. Comment: The City adopted the Highway Commercial Urban Revitalization Plan to incentivize commercial property owners to invest in their properties and qualify for a 3-year tax abatement on the actual value added by the improvements. To be eligible for the abatement, an application must be filed and approved by Council. This applicant constructed a new 6,400sf steel frame building within the Revitalization Area. 7.e Reimbursement Resolution for Fire Station #1 Improvements Project Resolution Declaring an Official Intent Under Treasury Regulation 1.150-2 to Issue aL Debt to Reimburse the City for Certain Original Expenditures Paid in Connection with Specified Projects. Comment: This resolution provides authorization to use cash on hand to pay for equipment and other construction expenses that may be incurred prior to the closing of the 2025 GO Bond issue and then for those expenses to be reimbursed by the proceeds from the Bond upon closing. Funds will be available in Account #Z4413 - Rehab of Sleeping Areas & Alerting System Station #1. 7.f Mercer City Park and City Park Court Renovation Project Resolution accepting the work for the Mercer Park and City Park Court Renovation Project. Comment: Work on the project was recently completed by McComas Lacina Construction, LC of Iowa City, Iowa, in substantial accordance with the plans and specifications. The Engineer's Report and Performance and Payment bonds are on file with the City Clerk. Project Estimated Cost: $ 963,000.00 . Project Bid Received: $1,082,697.10 • Project Actual Cost: $1,132,457.12 December 10, 2024 Iowa City City Council Agenda Page 4 7.g EPA Agreement for Landfill Compost Pad Improvements Project and Compost Turner D9g5 Resolution authorizing acceptance of Solid Waste Infrastructure for Recycling (SWIFR) Grant Program funds from the United States Environmental Protection Agency for the Compost Pad Improvements Project and Compost Turner. Comment: This resolution will accept federal funding from the US Environmental Protection Agency's Solid Waste Infrastructure for Recycling (SWIFR) Grant Program. The City's Resource Management Division applied for and received $4 million for the expansion of the Iowa City Landfill Compost Facility and the purchase of a compost turner. These projects will be funded through the Capital Improvements Plan (CIP) projects #L3333 — Compost Pad Improvement Project and #L3347 — Compost Turner. 7.h Riverside Drive Pedestrian Bridge at Iowa Avenue Rehabilitation Project Resolution canceling the Riverside Drive an Bridge at wa Avenue Rehabilitation Project, directing City Clerk Po post lnoti a of the Icoancelation on the Construction Update Network and on the Iowa League of Cities website. Comment: This item cancels the bidding process for the Riverside Drive Pedestrian Bridge at Iowa Avenue Rehabilitation Project. 8. Consent Calendar — Setting Public Hearings 8.a Rezoning - ACT Motion setting a public hearing for January 7, 2025, to consider an ordinance conditionally rezoning approximately 48.6 acres of property located north of N. Scott Blvd. and east of N. Dodge St. from Office Research Park (ORP) zone and Interim Development Research Park (ID -RP) zone to Mixed Use (MU) zone. (REZ24-0009) Comment: At its meeting on November 20, the Planning and Zoning Commission recommended approval of REZ24-0008 by a vote of 4-0. Approval of the rezoning would allow the development of non-residential and residential uses subject to the proposed conditions. 8.b Rezoning - Cardinal Heights Motion setting a public hearing for January 7, 2025, to consider an ordinance conditionally rezoning approximately 27.68 acres of land from Low Density Multi - Family Residential with a Planned Development Overlay (OPD/RM-12) to Low Density Multi -Family Residential with a Planned Development Overlay (OPD/RM-12) (REZ24-0010). Comment: At its meeting on December 4, the Planning and Zoning Commission recommended approval of REZ24-0010 by a vote of 7-0. Approval of the rezoning would amend an approved Preliminary OPD Plan to allow for an increase in height and a reduced front setback for one building on Lot 11, Cardinal Heights Part One. December 10, 2024 Iowa City City Council Agenda Page 5 er 8.c Rezoning - Western Homes Motion setting a public hearing for January 7, 2025, to consider an ordinance conditionally rezoning approximately 31.65 acres of property located East of Camp Cardinal Road and North of Gathering Place Lane from Medium Density Single -Family Residential with a Planned Overlay Development (OPD/RS-8) to Medium Density Single -Family Residential with a Planned Overlay Development (OPD/RS-8). (REZ24-0008) Comment: At its meeting on November 20, the Planning and Zoning Commission recommended approval of REZ24- 0008 by a vote of 4-0 subject to staffs recommended conditions plus one additional condition. The Commission added a condition that the requested height increase not be granted to the first 90 feet of the Building #103 area. Western Home Independent Living Services is requesting the rezoning to amend an approved Preliminary OPD Plan to allow for an increase in the maximum building height of Building #103 to 45' and the conversion of five single-family homes to a 16-unit elder apartment building with rehabilitation and wellness center. Consent Calendar — Correspondence 9.a Establish "Yield" control for Covered Wagon Drive at the intersection with Sand Prairie Drive. 9.b Prohibit parking on the east side of the 900 block of Harlocke Street. Prohibit parking on the east side of the 900 block of Harlocke Street from the end of the street to a point approximately 60 feet north. 9.c Removal of (10) moped parking spaces on the 300 Block of South Dubuque and the establishment of (1) 15 Minute Vehicle Zone from 6:30 am to 6 pm with a Tow Away Zone from 2 am to 6 am. Removal of (10) on -street moped parking spaces on the east side of the 300 block of South Dubuque Street and the establishment of (1) 15 Minute Vehicle Loading Zone from 6:30 am to 6 pm with a Tow Away Zone from 2 am to 6 am. Community Comment [items not on the agenda (until 7 PM)] Public comment is intended so that members of the public may be heard by Council. Because Community Comment is for items not properly noticed on the agenda, Council cannot engage in discussion or debate due to open meetings laws. Only in- person comments will be allowed for Community Comment. Public comment for specific agenda items, which must be directly related to that agenda item, may be made in -person or remotely. Individuals will be provided 3 minutes to speak. The Community Comment period will end at 7:00 p.m. unless an extension is needed to meet a minimum 30 minutes of total time allocated for the Community Comment period. The Mayor reserves the right to reduce the 3 minute period based on the number of individuals desiring to speak. Planning & Zoning Matters 11.a Zoning Code Amendment Ordinance amending Title sales oriented retail uses. Tobacco Sales Oriented Retail Uses 14, entitled "Zoning Code", to address tobacco (REZ24-0006) (Pass & Adopt) Comment: At its meeting on September 4, 2024, the Planning and Zoning Commission recommended approval of REZ24-0006 by a vote of 5-1 (Wade in the negative, Hensch absent). Following the Planning and Zoning Commission meeting, paragraph 8 of the ordinance has been added as a technical fix to account for the addition of 14-4E-5H in paragraph 7. Due to two prior substantive changes by Council, the December 10th meeting will be treated as the third and final reading. Action: a December 10, 2024 Iowa City City Council Agenda Page 7 12. Regular Formal Agenda 12.a Prohibited conduct on public buses Ordinance amending Title 6, entitled "Public Health and Safety," Chapter 8, entitled "Prohibited Conduct on Public Buses," Section 1, entitled "Definitions," to Se,Z remove "for a fare" language; and Section 2, entitled "Prohibited Acts," to update Y-1"l- language and add additional prohibited acts. (First Consideration) Comment: This action would update the code section that outlines acts that are prohibited on any city buses and will allow the Director of Transportation Services to establish administrative rules for actions not inconsistent ?kith anv ordinance or policy adopted by the City Council. Co� b) Action: Y I/ 1 u � j �1 , �' O Ale 1c CZ"���� 5 11 12.b Dimensions for New Patios in Rental Housing Ordinance amending Title 17, entitled "Building and Housing," Chapter 5, entitled "Housing Code," to clarify the dimensions of new patios in Section 17-5-18Q and to clarify parking is not allowed on patios. (First Consideration) e Comment: In 2017 Council enacted Section 17-5-18Q of the City Code to limit construction of new paving in rear yards to ensure open space for tenants. Paved patios are allowed to be constructed, but there are no dimensional limits on the size of patios. This ordinance imposes size limits on newly constructed patios and also clarifies parking is not allowed on patios. Action: 1, ray t.kS _ C� C� i-� I �P r a L-)<�P_i' Im 12.c Lifting Tobacco Moratorium Resolution lifting the moratorium on the issuance of new tobacco permits in Iowa City, Iowa adopted May 7, 2024 via Resolution 24-129. Comment: This Resolution lifts the moratorium placed on issuance of new tobacco Se49 permits before the scheduled December 31, 2024 expiration. Following publication 1 ,C� of the tobacco retailer separation distance zoning ordinance, placing it into effect, the moratorium shall be lifted. V - Action: W 12.d Iowa City 2025 State Legislative Priorities �j Resolution establishing the City of Iowa City's 2025 state legislative priorities. Comment: Prior to the start of each State of Iowa legislative session, the City Council traditionally adopts state legislative priorities by formal resolution and communicates the City's positions on those issues to our elected delegation. The City's 2025 state legislative priorities were developed based on issues impacting 'I r Cam, the community and City Council priorities, including the City's 2023-2028 Strategic Plan. Comment: In 2022, City Council engaged in a strategic planning process to define �ee- the City's guiding values, prioritize significant new projects and initiatives, and _C\�40L establish an aspirational vision for the City's future. In October 2024, City Council reviewed the plan and reaffirmed its vision and strategies but revised some action steps to make adjustments, provide clarity, account for changing circumstances, and to further focus City resources. A resolution to update the Strategic Plan in alignment with these changes has been drafted for Council's formal consideration. City staff will continue to be responsible for coordinating implementation and execution of these goals through Fiscal Year 2028. Comment: The Ad Hoc Truth and Reconciliation Commission (TRC) presently expires on December 31, 2024. The TRC voted to request an extension to June 30, 2025 so they can contract with an outside consultant to draft their final report. Action: rI D Setting Special Election Resolution setting a special election to fill the Council vacancy created by Andrew Dunn's resignation Comment: This resolution gives notice that Council intends to hold a special �L election to fill the impending vacancy created by Councilor Dunn's resignation, e effective January 1, 2025. The resolution sets a special election date for March 4, 2025, with a February 4, 2025 primary election, if needed. 51V1 Action: 13.
