Executive Summary:
As directed by Title 9, Chapter 1, Section 3B of the City Code, this is to advise the City
Council of the following action:
Pursuant to Section 9-1-3A (5); Establish "Yield" control for Nevada Avenue at the
intersection with Whispering Meadow Drive.
Background / Analysis:
This action is being taken to establish right-of-way at the intersection as a result of the recent
extension of Whispering Meadow Drive.

Good evening, my name is Ray Nepple. My wife and I reside at 2438 Walden
Court. Hopefully the materials I provided give you an overview of the issues that
need immediate attention. We moved here in August of 2016.
Surface water along with poor drainage between the condos has allowed the
street to settle in front of thirteen condo owners. The 30 foot long sidewalk is the
evidence our condo has settles and nose dived over two inches. Sad when it is no
longer safe for a seventy eight year old citizen to get his mail.
Twenty five foot of cement cracks has appeared this summer in the driveway of
the duplex condo next door. The water shutoffs are part of that driveway our
service line runs under the patio to the back of the condo. The city should have
some interest in preserving water supply to the 26 condos. The north occupant of
that condo has surface water running from the condo diagonally to the front out
creating a ravine and out onto the street.
The sink hold out back of our condo is adjacent to MidAmerican Gas -Electric,
Century Link, Mediacom and I On who provide underground service to the
commons area is in dire need of a French drain. It is time for the city to take
action and protect their investment.
Radon is prevalent at Walden Court -the second leading cause of lung cancer.
Iowa ranks second. Is my health being jeopardized by the poor drainage of the
surface water?
MidAmerican Basement as well as VJ Engineering has submitted their proposals.
Our current and past board of directors has refused to acknowledge there is a
problem or take any action on the matter.
To install a French drain is going to take the cooperation of Walden Court, the City
and Storm Water Management. The retention basin VJ Engineering as well as
Walden Wood Towns LLC that's not much to ask in return in paying $78,000
property taxes yearly.
My wife, Marlene and I walk every day when the weather is nice. We walk to
Weber Elementary School. What's very disturbing is the weedy mess and insects
from the prairie. To the tree line are the gas lines, on the north side of the
sidewalk on Rohert Street to the north to Walden Woods Town. The city has
refused to enforce the tall grass and weed ordinance this fall. Not mowing this
area is a potential fire hazard, especially in a drought year with a statewide burn
ban in effect. Dead trees, branches, and vegetation clean up should be a yearly
job. Next time you drive on Rohert toward Weber look at the eye sore on the
north side and the opposite on the south side of the street. As the tree line
deteriorates and the trees die more and more of the field the will be exposed
which runs the length of the condo and then some. Also the lack of erosion
control over the years.
We were the last of the 26 condos to be appraised this year. He asked if we had
any concerns. I replied the prairie, weeds, and insects. He smiled and said it was
unanimous; all twenty six owners had the same concerns. Maybe the prairie
should go like the gas stations.
