Resolution approving applications for retail tobacco, tobacco products, alternative
-�� nicotine products, vapor products, and device retailer permits, as required by Iowa
Code 453A.47A and Senate File 345.
6. Consent Calendar - Resolutions and Motions
6.a Police Labor Relations Organization Tentative Agreement
Motion to approve the Tentative Agreement between the City of Iowa City and
the Police Labor Relations Organization of Iowa City.
Comment: This is a five -year collective bargaining agreement for Fiscal Years
2026-2030. The parties participated in the collective bargaining process in
accordance with Chapter 20 of the Iowa Code and reached a voluntary five-year
tentative agreement. The agreement includes wage settlements for three years, an
increase to the employee health insurance premium contribution in FY28, and re -
openers for wages and insurance in fiscal years 2029-2030. The agreement also
includes several language updates.
6.b Designating Authorized Officials
Resolution designating the authorized officers or employees to conduct
business with authorized banking institutions.
Comment: This resolution authorizes officers or employees to conduct official
banking business on behalf of the City.
6.c 28E Agreement -Alcohol Compliance Checks
Resolution authorizing the City Manager to sign a 28E Agreement with the
Iowa Department of Revenue for alcohol enforcement.
Comment: The Iowa Dept. of Revenue is authorized to provide enforcement for
Iowa's alcoholic beverage laws and is willing to provide funding up to $3,000 for
FY25 to the City for engaging in compliance checks and enforcement checks for
Iowa's alcoholic beverage laws. The State has provided funding in recent years for
tobacco compliance and enforcement, but this is the first instance of funding for
alcohol.
6.d Mercer Scanlon Roof Repair Project
Resolution accepting the work for the Mercer Scanlon Roof and
Skylight Improvements Project.
Comment: The Mercer Scanlon Roof and Skylight Improvements Project was
completed by Dryspace, Inc. of Cedar Rapids, Iowa, in substantial accordance
with the plans and specifications. The Engineer's Report and Performance,
Payment and Maintenance Bond are on file with the City Clerk.

6.e 2024 Water Pavement Patching Project
Resolution accepting the work for the 2024 Water Pavement Patching Project.
----- Comment: Work on the project was recently completed by B.G. Brecke, Inc. of
Cedar Rapids, Iowa in substantial accordance with the plans and specifications.
The Engineer's Report and Performance, Payment and Maintenance Bond are
on file with the City Clerk.

6.f Pine Grove Estates Part 2
Resolution accepting the work for the sanitary sewer public improvements for Pine
_ Grove — Part Two, and declaring public improvements open for public access and
use.
Comment: The construction of the sanitary sewer public improvements for Pine
Grove — Part Two have been completed in substantial accordance with the
plans and specifications on file with the Engineering Division of the City of Iowa
City.
6.g Parks & Recreation Fees
Resolution establishing a schedule of fees for Parks and Recreation services
and programming and rescinding Resolution No. 23-44.
Comment: The City Code requires the Parks and Recreation Department to submit
a schedule of fees and charges for approval by City Council. Fees were approved
for an increase in FY24 but rates were kept static for FY25. Staff generally
recommends a fee increase every other year. Staff is proposing a FY26 fee
schedule that carries increases for most services in the realm of 3-8%, which has
been approved by the Parks and Recreation Commission.

7. Consent Calendar - Setting Public Hearings
7.a City Park Pool Replacement Project
Resolution setting a public hearing on February 18, 2025 on project manual
and estimate of cost for the construction of the City Park Pool Replacement
1)1SProject, directing City Clerk to publish notice of said hearing, and directing the
City Engineer to place said project manual on file for public inspection.
Comment: This agenda item begins the bidding process for the City Park Pool
Replacement Project. This item continues the process to replace the 70+ year old
City Park Pool with a new pool at the same site. City Park Pool Conceptual
Design A was approved by Council as the preferred option after an extensive
public input and survey process. The concept design includes six 50-meter lap
lanes, a zero -depth entry leisure pool with children's activities, a separate diving
pool with low and high diving boards, a new bath house and a separate filter
building. The final design has the leisure pool and lap pools separated to provide
flexibility for operations.

Public comment is intended so that members of the public may be heard by Council.
Because Community Comment is for items not properly noticed on the agenda,
Council cannot engage in discussion or debate due to open meetings laws.
Only in- person comments will be allowed for Community Comment. Public comment
for specific agenda items, which must be directly related to that agenda item, may be
made in -person or remotely.
Individuals will be provided 3 minutes to speak. The Community Comment period
will end at 7:00 p.m. unless an extension is needed to meet a minimum 30 minutes
of total time allocated for the Community Comment period.
The Mayor reserves the right to reduce the 3 minute period based on the
number of individuals desiring to speak. Additional comments can be sent to
the City Council via council@iowa-city.org or through the City Clerk's Office.

9.a Rezoning - Cardinal Heights
Ordinance conditionally rezoning approximately 27.68 acres of property located
east of Camp Cardinal Blvd and west of Camp Cardinal Rd from Low Density

Comment: At its meeting on December 4, the Planning and Zoning Commission
recommended approval of REZ24-0010 by a vote of 7-0. Approval of the rezoning
would amend an approved Preliminary OPD Plan to allow for an increase in height
and a reduced front setback for one building on Lot 11, Cardinal Heights Part
One.

9.b Rezoning - Western Homes
Ordinance conditionally rezoning approximately 31.65 acres of property located
east of Camp Cardinal Road and north of Gathering Place Lane from Medium
Density Single -Family Residential with a Planned Overlay Development
(OPD/RS-to Medium Density Single -Family Residential with a Planned Overlay
Development (OPD/RS-8). (REZ24-0008) (Pass & Adopt)
Comment: At its meeting on November 20, the Planning and Zoning Commission
recommended approval of REZ24- 0008 by a vote of 4-0 subject to staffs
recommended conditions plus one additional condition. The Commission added a
condition that the requested height increase not be granted to the first 90 feet of
the Building #103 area. Western Home Independent Living Services is requesting
the rezoning to amend an approved Preliminary OPD Plan to allow for an
increase in the maximum building height of Building #103 to 45' and the
conversion of five single-family homes to a 16-unit elder apartment building with
rehabilitation and wellness center.

10.a Charter Amendments
Ordinance amending the Iowa City Charter as recommended by the
Charter Review Commission. (Second Consideration)
Comment: The recommendations of the Charter Review Commission were
submitted to Council by written report dated December 17, 2024 and presented
to Council at its work session on January 7, 2025. The Charter requires that the
Council either adopt the Commission's recommendations or submit them to the
voters. In accordance with Council direction, the proposed ordinance will enact all
of the Commission's recommendations.

10.b Joint law enforcement facility study
Resolution approving Cost Sharing Agreement with Johnson County for
exploration of functional parameters and conceptual requirements for a joint law
enforcement facility shared with Johnson County.
Comment: The Resolution approves paying 50% of the County's cost in hiring
SZIP—� Shive-Hattery to explore feasibility of a joint law enforcement facility to be shared
by Iowa City and Johnson County. The City's 50% share of the consultant cost is
$31,900 plus 50% of expenses.
