Executive Summary:
The current AFSCME collective bargaining agreement, effective through June 30, 2026,
included a limited re -opener in the final year. The City participated in collective bargaining
with AFSCME in accordance with Chapter 20 of the Iowa Code. The parties participated in a
bargaining session on March 11, 2025 and reached a tentative agreement (TA). The tentative
agreement is subject to both City Council approval and union ratification. The City was
notified on April 8, 2025 that the union ratified the TA. City Council approved the TA on April
15, 2025.
Background / Analysis:
The AFSCME contract limited re -opener for fiscal year 2026 was voluntarily settled.
Negotiated wage adjustments provide for a 2.75% across the board increase in July 2025.
The fiscal year 2026 AFSCME pay plan is attached. The position listing included in the
AFSCME contract which identifies AFSCME positions by pay grade has also been updated to
reflect position changes that have been approved by City Council since the current collective
bargaining agreement was approved by Resolution 21-111 on May 4, 2021.

Resolution authorizing Fiscal Year 2026 pay plan for AFSCME employees
Whereas, the City of Iowa City (hereinafter the City) and the American Federation of State,
County and Municipal Employees Local #183, AFL-CIO (hereinafter the Union), through their
designated bargaining representatives, have negotiated a fiscal year 2026 limited re -opener of
the collective bargaining agreement in effect from July 1, 2021 through June 30, 2026, and
Whereas, the re -opener settlement resulted in an updated pay plan for AFSCME employees for
fiscal year 2026 a copy of which is attached to this resolution; and
Whereas, the City desires to authorize the negotiated FY26 pay plan, finding that it will promote
efficient municipal operations, thereby providing residents of the community with municipal
services.
Now therefore be it resolved by the City Council of the City of Iowa City, Iowa that the fiscal year
2026 AFSCME pay plan be authorized.

Administrative/Confidential and Executive Pay Plans FY26
Executive Summary:
Classification and compensation plans for Administrative, Confidential and Executive
employees are recommended for approval. Recommended pay plans have been restructured
to increase entry level wages for non -bargaining positions to be more competitive with the
external market, to achieve more consistent step progression across pay grades, and to
mirror the 2.75% across the board wage increase negotiated for AFSCME employees.
Background / Analysis:
The City and Iowa City Public Library recently negotiated a limited re -opener for the final year
of the current collective bargaining agreement with AFSCME. This agreement consisted of a
2.75% wage settlement for FY26. A classification and compensation plan for Administrative,
Confidential and Executive employees has been prepared which mirrors the 2.75% across
the board wage settlement with AFSCME to maintain consistency in wage increases for the
majority of City positions. The recommended pay plan also reflects a modified structure
aimed to increase the entry level wage for non -bargaining positions to be more competitive
with the market at the lower end of our pay structure and to achieve more consistent step
progression across pay grades. Current employees will be re -assigned to the new pay plan at
the step consistent with their current salary plus the 2.75% across the board increase and will
maintain their current evaluation schedule for future step increases.
Staff recommends that the classification and compensation plans for Administrative,
Confidential and Executives employees for FY26 be approved.

Administrative, Confidential and Executive employees for fiscal year 2026.
Whereas, the City of Iowa City employs certain employees referred to as Confidential,
Administrative, and Executive personnel; and
Whereas, it is necessary to establish position classification and compensation ranges for said
personnel.
Now, Therefore, be it resolved by the City Council of the City of Iowa City, Iowa that:
Confidential, Administrative, and Executive employees shall receive compensation as
established by the FY26 Confidential, Administrative, and Executive Classification and
Compensation plans as attached.

Executive Summary:
The City Code allows non-profit entities by agreement to sell and their patrons to possess
alcohol in a city park and on public right-of-way under limited circumstances. This resolution
authorizes the City Manager to sign two agreements (reflecting two alcohol permits for
different time periods) with Riverside Theatre for the sale and possession of beer and wine
during performances in June 2025 in a demarcated area in and around Riverside Festival
Stage in City Park. The agreements are the same as past years.

Whereas, section 4-5-3D of the City Code allows non-profit entities by agreement to sell,
consume, and possess alcohol in a city park, on public right-of-way or on a city ground
excluding public buildings under limited circumstances; and
Whereas, Riverside Theatre would like to be able to sell beer and wine during performances in
June 2025 in a demarcated area in and around Riverside Festival Stage in City Park; and
Whereas, it is in the City of Iowa City's interest to execute the attached agreements.
Now, therefore, be in resolved by the City Council of the City of Iowa City, Iowa that:
The City Manager is authorized to sign the attached agreements and any needed amendments.

AGREEMENT
BETWEEN THE CITY OF IOWA CITY AND RIVERSIDE THEATRE
TO ALLOW THE TEMPORARY AND LIMITED SALE, CONSUMPTION, AND
POSSESSION OF BEER AND WINE IN CITY PARK
This Agreement is made between Riverside Theatre (hereinafter "Riverside") and
the City of Iowa City, a municipal corporation (hereinafter "City"), in Iowa City, Iowa.
WHEREAS, Riverside is an "authorized entity" as that term Is defined in section 4-5-
3D of the City Code;
WHEREAS, Riverside has applied for a license to sell beer and wine for 119 E.
College Street, Iowa City, Iowa and intends to apply to transfer said license to an area in
City Park in and around the Riverside Theatre Festival Stage; and
WHEREAS, the parties wish to enter into an agreement to allow Riverside to sell
beer and wine and to allow persons to possess and consume beer and wine under limited
circumstances in City Park during performances.
THE PARTIES THEREFORE AGREE AS FOLLOWS:
1. Authorized Site. in consideration for Riverside's promises herein, the City
agrees to allow Riverside control over an area south and east of the festival
stage and the seating area as shown on the diagram, which Is attached,
marked Exhibit A, and incorporated herein ("authorized site").
2. Term. This agreement shall commence on June 3, 2025, and shall expire on
June 16, 2025.
3. Access. Riverside shall take all reasonable steps to ensure that every person on
the authorized site has a ticket or invitation to that days event or is an employee
of, an independent contractor of, or volunteer for Riverside and shall exclude any
person who is not.
4. License. This agreement is void if Riverside does not have a license to sell beer
or wine on the authorized site at any time during the period of June 3, 2025.
through June 16, 2025.
5. Sale of Been Wine. Riverside shall only sell beer or wine to a person who is over
twenty-one (21) years of age and who has a ticket or invitation to that days
event or is an employee of, an independent contractor of, or a volunteer for
Riverside, Further, Riverside shall only sell beer or wine from 6:00 pm to 10:00
on evenings of events, which weather permitting will be Thursdays through
Sundays.
6. Advertisement. Riverside shall not, nor shall it allow anyone to, erect or place
any sign or other matter advertising any brand of alcoholic liquor, beer, or wine
upon the authorized site. Notwithstanding any other provision, sponsorship
signage unrelated to businesses selling alcohol, beer, wine, or tobacco will be
allowed.
7. Inspection. City staff, including the Iowa City Police Department, may
periodically inspect the authorized site without any prior notice to determine
compliance with the terms of this agreement.
8. Debris and Tresh. Riverside shall be solely responsible for collecting all debris
and trash from the authorized site, and the City shall then remove the debris and
trash. If Riverside fails to do so and if City staff has to collect the debris and
trash from the authorized site, Riverside may be responsible for the cost incurred
by the City, including staff time, and shall pay the costs in full within thirty (30)
days of receiving an Invoice.
9. Insurance.
a) Premises Insurance. From June 3, 2025, through June 16, 2025,
Riverside shall carry comprehensive general liability insurance for bodily
injury and property damage on the authorized site in the amount of
$1,000,000 (one million dollars) for each occurrence and $2,000,000 (two
million dollars) in the aggregate, shall name the City as an additional
insured, and shall include the Governmental Immunities Endorsement, a
copy of which is attached, marked Exhibit B, and Incorporated herein.
Riverside shall furnish a copy of a certificate of insurance for same,
satisfactory to the City at the time of execution of this agreement.
Riverside shall provide thirty (30) days notice to the City before
cancellation of said insurance, and said cancellation shall automatically
terminate this Agreement.
b) Dram Shoo Insurance. From June 3, 2025, through June 16, 2025,
Riverside shall carry "dram shop' insurance in compliance with Iowa
Code section 123.92, as amended, in the amount of $1,000,000 (one
million dollars). Riverside shall provide thirty (30) days notice to the City
before cancellation of said insurance, and said cancellation shall
automatically terminate this Agreement.
10. Indemnification. Riverside shall pay on behalf of the City all sums which the
City shall be obligated to pay by reason of any liability imposed upon the City
for damages of any kind resulting from the use of the authorized sight or sale,
consumption, or possession of beer or wine on the authorized site, whether
sustained by any person or person, caused by accident or otherwise and shall
defend at Its own expense and on behalf of the City any claim against the City
arising out of the use of the authorized site or sale, consumption, or possession
of beer or wine on the authorized site.
11. No Smokinc. Smoking, including the use of electronic cigarettes, is prohibited
In the authorized site, and Riverside shall post a no -smoking a sign at the front
entrance to the authorized site and two signs inside the authorized site. The
signs shall comply with Iowa Code Section 1420.6, as amended. Electronic
cigarette means vapor product as defined in Section 453A.1 of the Code of
Iowa, as amended.
12. Non -Discrimination. Riverside shall not discriminate against any person in
employment or public accommodation because of race, religion, color, creed,
gender identity, sex, national origin, sexual orientation, mental or physical
disability, marital status or age. "Employment" shall include but not be limited to
hiring, accepting, registering, classifying, promoting, or referring to employment.
"Public accommodation" shall include but not be limited to providing goods,
services, facilities, privileges and advantages to the public.
13. Termination. The City may terminate this agreement upon written notice for
violation of any provision of this agreement.
14. Assignment and Subletting. Riverside shall not assign or sublet this agreement
without prior written approval of the City.
15. Entire Agreement. This constitutes the whole agreement between the parties,
and may be modified in writing only, duly signed by the parties.

Governmental Immunities Endorsement
1. Non -waiver of Government Immunity. The insurance carrier expressly agrees
and states that the purchase of this policy and the including of the City of Iowa
City, Iowa as Additional Insured does not waive any of the defenses of
governmental immunity available to the City of Iowa City, Iowa, under Code of
Iowa Section 670.4 as it now exists and as it may be amended from time to
time.
2. Claims Coverage. The insurance carrier further agrees that this policy of
insurance shall cover only those claims not subject to the defense of
governmental immunity under the Code of Iowa Section 670.4 as it now exists
and as it may be amended from time to time. Those claims not subject to
Code of Iowa Section 670.4 shall be covered by the terms and conditions of
this insurance policy.
3. Assertion of Government Immunity. The City of Iowa City, Iowa, shall be
responsible for asserting any defense of governmental immunity, and may do
so at any time and shall do so upon the timely written request of the insurance
carrier. Nothing contained in this endorsement shall prevent the carrier from
asserting the defense of governmental immunity on behalf of the City of Iowa
City.
4. Non -Denial of Coverage. The insurance carrier shall not deny coverage under
this policy and the insurance carrier shall not deny any of the rights and
benefits accruing to the City of Iowa City, Iowa under this policy for reasons of
governmental immunity unless and until a court of competent jurisdiction has
ruled in favor of the defense(s) of governmental immunity asserted by the City
of Iowa City, Iowa.
5. No Other Change in Policy. The insurance carrier, the City of Iowa City, Iowa
agree that the above preservation of governmental immunities shall not
otherwise change or alter the coverage available under the policy.

Governmental Immunities Endorsement
1. Non -waiver of Government Immunity. The insurance carrier expressly agrees
and states that the purchase of this policy and the including of the City of Iowa
City, Iowa as Additional Insured does not waive any of the defenses of
governmental immunity available to the City of Iowa City, Iowa, under Code of
Iowa Section 670.4 as it now exists and as it may be amended from time to
time.
2. Claims Coverage. The insurance carrier further agrees that this policy of
insurance shall cover only those claims not subject to the defense of
governmental immunity under the Code of Iowa Section 670.4 as it now exists
and as it may be amended from time to time. Those claims not subject to
Code of Iowa Section 670A shall be covered by the terms and conditions of
this insurance policy.
3. Assertion of Government Immunity. The City of Iowa City, Iowa, shall be
responsible for asserting any defense of governmental immunity, and may do
so at any time and shall do so upon the timely written request of the insurance
carrier. Nothing contained in this endorsement shall prevent the carrier from
asserting the defense of governmental immunity on behalf of the City of Iowa
City.
4. Non -Denial of Coverage. The insurance carrier shall not deny coverage under
this policy and the insurance carrier shall not deny any of the rights and
benefits accruing to the City of Iowa City, Iowa under this policy for reasons of
governmental immunity unless and until a court of competent jurisdiction has
ruled in favor of the defense(s) of governmental immunity asserted by the City
of Iowa City, Iowa.
5. No Other Change in Policy. The insurance carrier, the City of Iowa City, Iowa
agree that the above preservation of governmental immunities shall not
otherwise change or alter the coverage available under the policy.

Executive Summary:
The Statewide Transportation Alternatives Set -Aside (TA Set -Aside) Program supports the
construction and improvement of bicycle and pedestrian infrastructure. The program, which
emphasizes the expansion of multi -modal trail networks through the completion of trail
linkages as well as projects that improve access and safety for all transportation modes,
provides funding to reimburse up to 80 percent of eligible costs or up to the approved grant
maximum, whichever is less. The Iowa DOT recently announced a supplementary application
cycle of the grant program with a deadline of May 16.
The Iowa DOT has programmed reconstruction of the Highway 6 Bridge over the Iowa River
for 2028. The City recently applied for and secured TA Set -Aside funding to complete
pedestrian and bicycle facilities to provide a continuous connection between S. Gilbert Street
on the east and Orchard Street to the west to be constructed in coordination with the bridge
project. In light of the new round of TA -Set -Aside funding, the City now proposes to extend a
north -south trail segment of the Iowa River Corridor Trail along the west bank of the Iowa
River, between W. Benton Street and McCollister Boulevard.
Background / Analysis:
The proposed project involves constructing approximately 1.5 miles of 10-foot-wide hard
surface trail and side path (wide sidewalk) along the west side of Iowa River and along S.
Riverside Drive/Old Highway 218, from W. Benton Street to McCollister Boulevard. This will
result in a continuous route between City Park and McCollister Boulevard.
The proposed multi -use trail will provide a safe and efficient alternative for non -vehicular
users to access the Downtown and University Campus through a busy commercial corridor
where pedestrian and bicycle facilities are currently absent or insufficient. The proposed
segment will tie into a planned trail along the Highway 6 corridor —a project that recently
secured funding through the first round of the Statewide TA Set -Aside Program and which will
be carried out separately. This project will also provide pedestrian and bicycle access to the
Iowa City Airport, which has been a goal of the Airport Commission. Construction of the trail
segment is expected to follow the Iowa DOT's reconstruction of the Highway 6 Bridge over
the Iowa River.
The proposed project to complete the Iowa River Corridor Trail along the west bank of the
river is identified in the 2017 Iowa City Bicycle Master Plan and is listed as an unfunded item
in the City's Capital Improvement Program (CIP). Approval of this resolution is required for
the City of Iowa City to submit a qualifying application for TA Set -Aside funding.

Whereas, the Iowa Department of Transportation administers the Statewide Transportation
Alternatives Set -Aside Program (TA Set -Aside), the purpose of which is to fund the expansion of
impactful multi -modal facilities, and
Whereas, a supplementary application cycle of the Statewide Transportation Alternatives (TA Set -
Aside or TAP) program was recently released; and
Whereas, the southern terminus of the Iowa River Corridor Trail along the west bank of the Iowa
River is currently at Benton Street, and the planned trail would extend bicycle and pedestrian
facilities from Benton Street to McCollister Boulevard; and
Whereas, there are currently no bicycle or pedestrian facilities along Riverside Drive, south of
Highway 6; and
Whereas, the Iowa Department of Transportation has programmed the reconstruction of the
Highway 6 Bridge over the Iowa River in 2028, and the construction of the proposed trail would be
coordinated with the reconstruction of said bridge; and
Whereas, the adopted Iowa City Bicycle Master Plan (2017) recommends the construction of this
trail; and
Whereas, a requirement of the TA Set -Aside Program is a resolution officially endorsing the
application and the assurances that any funded improvements will be adequately maintained.
Whereas, the City Council finds said proposal to be in the public interest.
Now, therefore, be it resolved by the City Council of the City of Iowa City, Iowa, that:
1. The City hereby officially endorses and directs City staff to submit a TA Set -Aside
application to the Iowa DOT before the May 16, 2025, deadline for a multi -use paved trail,
along the west bank of the Iowa River between Benton Street and McCollister Boulevard
and agrees to adequately maintain any funded improvements.
2. The City Engineer or designee is hereby authorized to execute the "Application
Certification for Local Government".
3. The City Manager or designee is hereby authorized to execute all necessary agreements
and documents for said grant with the Iowa Department of Transportation.

Executive Summary:
On March 13, 2025, a Request for Proposal was released via the City of Iowa City bidding
software lonwave. Proposals were due by 2:30 on April 2, 2025. The City received three
proposals from Elliott Oil Company, Mansfield Oil Company, and Agriland FS Inc. Two
representatives from the Equipment Division and one representative from the Transportation
Services Department reviewed and scored the proposals. After careful consideration the
evaluation committee decided to recommend Elliott Oil Company (transport deliveries) and
Elliott Bulk Services (tank wagon deliveries) for award of Request for Proposal 25-117 Fuel
Contract for the City of Iowa City.
Background / Analysis:
Services for this contract will include the purchase and delivery of Gasohol and Diesel fuel for
the City of Iowa City for a period of one year. Elliott Oil has fulfilled this task for the last five
years and has proven to be exceedingly dependable in the execution of this contract. Their
prices have been determined to be fair and reasonable given the turbulent fuel market.
Over the course of this 1-year contract, the city expects to expend approximately $2,000,000
for this project. Transit has this expenditure budgeted under account number 71810230-
465030 and expects to spend approximately $567,000. Equipment has $530,000 of this

Executive Summary:
On March 13, 2025 the City's Purchasing Division issued Request for Bid 25-09 for the
supply and delivery of pebble quicklime for the Iowa City Water Treatment Plant through its
online bidding platform. Two bids were received prior to the bid deadline on April 4, 2025.
Purchasing and Water staff reviewed the bids for responsiveness and responsibility. MLC
(Mississippi Lime Company) of St. Louis, MO had the lowest responsive, responsible bid.
Background / Analysis:
Pebble quicklime is used in the water treatment process to adjust PH and reduce hardness,
helping ensure safe, clean drinking water. The current contract for this material will expire on
June 30, 2025 and a new agreement is needed to ensure uninterrupted supply. The new
contract will begin on July 1, 2025. The initial term will last one (1) year with the option to
renew for four (4) one-year terms, up to a total of five (5) years.
The City anticipates spending approximately $500,000.00 during the initial one-year term of
the new contract and similar amounts annually in future renewals. Because this exceeds the
City Manager's $200,000.00 spending authority, City Council approval is required. This
resolution will approve the contract award to MLC (Mississippi Lime Company) and authorize
the City Manager to effectuate reasonable and appropriate amendments or renewals of the
contract.

Executive Summary:
This agenda item approves the consultant agreement with Neumann Monson Architects, Inc.
of Iowa City, Iowa for the architectural and engineering consultant services for the training
addition of the Animal Care and Adoption Center.
Background / Analysis:
Friends of the Animal Center Foundation (FACF) raises money to support the needs of the
Iowa City Animal Care and Adoption Center. The FACF board, in coordination with Animal
Shelter staff, have identified an addition as aiding in the services the Center provides. A
study was conducted in 2024 to identify the preferred location and configuration for the
addition. The preferred option was an approximately 1,400 SF addition to the south portion of
the building, that will provide one large multi -purpose room that can serve as enclosed
training space, meeting/event space or overflow animal housing.
An agreement to pay the cost of the Animal Center Addition was entered into by FACF and
the City in February of 2025 that outlines the projected project cost and payment schedule.
FACF intends to fundraise and provide 100% of the project cost.

Consultant Agreement
This Agreement, made and entered into this 6th day of May , 2025, by and
between the City of Iowa City, a municipal corporation, hereinafter referred to as the City, and
Neumann Monson Architects, Inc., of Iowa City, Iowa, hereinafter referred to as the Consultant.
Whereas, the City desires to obtain the services of a qualified consulting firm to provide preliminary
design, final design, preparefion of a project manual for bidding, bidding assistance, and
constructions services for the Animal Shelter- Training Annex Project; and
Whereas, the City, with financial assistance from Friends of the Animal Center Foundation (FACF),
desires to construct an addition to the Animal Care and Adoption Center facility to conduct training
of animals; and
Whereas, the City issued a Request for Qualifications, On -Call Professional Design and
Engineering Services (2023-2025), October 12, 2022, to private consulting firms interested in
providing design and engineering services related to public improvement projects in the City of Iowa
City; and
Whereas, submittals were received from consulting fines and evaluated by a selection committee;
and
Whereas, Consultant was selected based on qualifications, key personnel, project approach, and
fees and rates; and
Whereas, Consultant provided preliminary design services in 2024 that resulted in 3 options for a
proposed addition and layout that resulted in selection of Option 3 — Addition to South by City staff
and FACF Board Members; and
Whereas, funds are available in the Animal Shelter— Training Annex Project, Account V4449; and
Now, therefore, it is agreed by and between the parties hereto that the City does now contract with
the Consultant to provide services as set forth herein.
I. Scope of Services
Consultant agrees to perform the following services for the City, and to do so in a timely and
satisfactory manner.
The scope of this Agreement includes professional design services; Architectural, Structural
Engineering, Mechanical Engineering, Electrical Engineering, Civil Engineering, Topographic
Survey, and Geotechnicel Soil Bonngs; related to the design of a 1,500 GSF mufti -purpose addition
to the Iowa City Animal Care and Adoption Center. The addition is to be an extension of the main
north/south spine of the existing facility. Services will include the following:
- Combined Schematic (SD) and Design Development (DD) Phase
- Contract Document (CD) Phase
- Bidding (BN) Phase
- Construction Administration (CA) Phase

Exhibit A, incorporated herein by this reference, provides a further description of each Scope of
Service Phase.

IV. General Terms
A. The Consultant shall not commit any of the following employment practices and
agrees to prohibit the following practices in any subcontracts.
To discharge or refuse to hire any individual because of their race, color,
religion, sex, national origin, disability, age, marital status, gender identity, or
sexual orientation.
To discriminate against any individual in terms, conditions, or privileges of
employment because of their race, color, religion, sex, national origin,
disability, age, marital status, gentler identity, or sexual orientation.
B. Should the City terminate this Agreement, the Consultant shall be paid for all work
and services performed up to the time of termination. However, such sums shall not
be greater than the "not -to -exceed" amount listed in Section III. The City may
terminate this Agreement upon seven (7) calendar days' written notice to the
Consultant.
C. This Agreement shall be binding upon the successors and assigns of the parties
hereto, provided that no assignment shall be withoutthe written consent of all Parties
to said Agreement.
D. It is understood and agreed that the retention of the Consultant by the City for the
purpose of the Project shall be as an independent contractor and shall be exclusive,
but the Consultant shall have the right to employ such assistance as may be required
for the performance of the Project.
E. It is agreed by the City that all records and files pertaining to information needed by
the Consultant for the project shall be available by said City upon reasonable request
to the Consultant. The City agrees to furnish all reasonable assistance in the use of
these records and files.

F. It is further agreed that no Party to this Agreement shall perform contrary to any
state, federal, or local law or any of the ordinances of the City of Iowa City, Iowa.
G. At the request of the City, the Consultant shall attend meetings of the City Council
relative to the work set forth in this Agreement. Any requests made by the City shall
be given with reasonable notice to the Consultant to assure attendance.
H. The Consultant agrees to furnish, upon termination of this Agreement and upon
demand by the City, copies of all basic notes and sketches, charts, computations,
and any other data prepared or obtained by the Consultant pursuant to this
Agreement without cost, and without restrictions or limitation as to the use relative
to specific projects covered under this Agreement. In such event, the Consultant
shall not be liable for the City's use of such documents on other projects.
I. The Consultant agrees to furnish all reports, specifications, and drawings with the
seal of a licensed professional as required by Iowa law.
J. The City agrees to lender the Consultant all fees in a timely manner, excepting,
however, that failure of the Consultant to sa6sfactodly perform in accordance with
this Agreement shall constitute grounds for the City to withhold payment of the
amount sufficient to property complete the Project in accordance with this
Agreement.
K. Should any section of this Agreement be found invalid, it is agreed that the remaining
portion shall be deemed severable from the invalid portion and continue in full force
and effect.
L. Original contract drawings shall become the property of the City. The Consultant
shall be allowed to keep reproducible copies for the Consultants own fling use.
M. Fees paid for securing approval of authorities having jurisdiction over the Project will
be paid by the City.
N. Upon signing this Agreement, Consultant acknowledges that Section 362.5 of the
Iowa Code prohibits a City officer or employee from having an interest in a contract
with the City, and certifies that no employee or officer of the City, which includes
members of the City Council and City boards and commissions, has an interest,
either direct or indirect, in this Agreement, that does not fall within the exceptions to
said statutory provision enumerated in Section 362.5.
O. Indemnification
To the full extent permitted by law, Consultant agrees to defend, indemnify,
and hold ham less the City against any and all claims, demands, suits, less,
expenses, including attorneys fees, and for any damages which may be
asserted, claimed or recovered against or from the City by reason of
personal injury, including bodily injury or death, and property damages,
including loss of use thereof, mused by Consultant's negligent acts, errors
or omissions in performing the work and/or services provided by Consultant
to the City pursuant to the provisions of this Agreement.
2. Consultant assumes full responsibility for any and all damage or injuries
which may result to any person or property by reason of Consultants
negligent acts, errors or omissions in connection with the work and/or

services provided by Consultant to the City pursuant to this Agreement, and
agrees to pay the City for all damages caused to the Cily's premises resulting
from the negligent acts, errors or omissions of Consultant.
The Consultant's obligation to indemnify the City shall not include the
obligation to indemnify, hold harmless, or defend the City against lability,
claims, damages, losses, or expenses, including attorney fees, to the extent
roused by or resulting from the negligent act, error, or omission of the City.
4. For purposes of this paragraph, the tens "Consultant" means and includes
the Consultant, its officers, agents, employees, sub -consultants, and others
for wham Consultant is legally liable, and the term "City means and includes
the City of Iowa City, Iowa its Mayor, City Council members, employees, and
volunteers.
P. Insurance
The Consultant agrees at all times material to this Agreement to have and
maintain professional liability insurance covering the Consultant's liability for
the Consultant's negligent acts, errs and omissions in the sum of
$1,000,000 Per Claim, $1,000,000 Annual Aggregate, or a $1,000,000
Combined Single Limit. To the fullest extent permitted by applicable state
law, a Waiver of Subrogation Clause (endorsement) shall be added.
Consultant agrees to provide the City a certificate of insurance evidencing
that all coverages, limits and endorsements required herein are maintained
and in full force and effect, and certificates of Insurance shall provide a
minimum thirty (30) day endeavor to notify, when available by Consultant's
insurer. If the Consultant receives a non -renewal or cancellation notice from
an insurance carrier affording coverage required herein, or receives notice
that coverage no longer complies with the insurance requirements herein,
Consultant agrees to notify the City within five (5) business days with a copy
of the non -renewal or cancellation notice.
C. Standard of Care
1. The Consultant shall perform services for, and furnish deliverables to, the
City pertaining to the Project as set forth in this Agreement. The Consultant
shall possess a degree of looming, care and skill ordinarily possessed by
reputable professionals, practicing in this area under similar circumstances.
The Consultant shall use reasonable diligence and professional judgment in
the exercise of skill and application of teaming.
2. Consultant represents that the Services and all its components shall be free
of defects caused by negligence; shall be performed in a manner consistent
with the standard of care of other professional service providers in a similar
Industry and application; shall conform to the requirements of this
Agreement; and shall be sufficient and suitable for the purposes expressed
in this Agreement.
All provisions of this Agreement shall be reconciled in accordance with the
generally accepted standards of the Engineering Profession.

4. Consultant's obligations under this Section shall exist without regard to, and
shall not be construed to be waived by, the availability or unavailability of any
insurance, either of City or Consultant.
R. There are no other considerations or monies contingent upon or resulting from the
execution of this Agreement, it is the entire Agreement, and no other monies or
considerations have been solicited.
S. This Agreement shall be interpreted and enforced in accordance with the laws of the
State of Iowa. Any legal proceeding instituted with respect to this Agreement shall
be brought in a court of competent jurisdiction in Johnson County, Iowa. The parties
hereto hereby submit to personal jurisdiction therein and irrevocably waive any
objection as to venue therein, including any argument that such proceeding has
been brought in an inconvenient forum.

Consultant will maintain meeting minutes for stakeholder input meetings, design review meetings,

Combined Schematic Design (SD) and Design Development Phase:
Develop documents that consist of Drawings and Specifications, that sufficiently detail the

The Iowa River trail bridge located to the east of the Riverside Drive and Myrtle Avenue

The trail bridge replacement is to be an engineered retaining wall. The retaining wall will
have a reduced life cycle cost compared to the trail bridge it replaces while allowing trail

This agreement is an updated version of the 2012 28E agreement that outlines provisions to
provide fire and emergency services through mutual aid to all partner agencies in Johnson

Executive Summary:
The Housing and Community Development (HCDC) bylaws provide that 3 consecutive,
unexplained absences will result in a recommendation to City Council to discharge the
member. Commissioner Daouda Balde has had 4 consecutive, unexplained absences, and
HCDC voted to recommend Council remove him. Under state law, persons appointed to
offices have the right to notice and to be heard. The resolution directs the City Clerk to
provide the Commissioner with a copy of the resolution by certified mail, which informs him of
the right to ask for a hearing before the City Council.
Background / Analysis:
Staffs routine notifications to Commissioners for meetings consist of emailing a copy of the
meeting packet and a calendar invite. Commissioner Baldo has attended only one HCDC
meeting since his appointment in May 2024, which was in October. At some point staff
began to mail hard copies of the agenda packet to Commissioner Balde as well. Staff also
made multiple attempts to contact Commissioner Balde by email and telephone with no
response.
Staff emailed and mailed a letter dated 3/27/25 to Commissioner Balde regarding the
planned discussion of discharging him from HCDC at the April 21 meeting. He did not
appear at the April 21 HCDC meeting, and HCDC passed a motion recommending Council
remove him.
If Council passes the resolution, the removal is not effective for 30 days after the City Clerk
mails him a copy during which Commissioner Balde may request a hearing before the City
Council.

CALL MEETING TO ORDER:
Vogel called the meeting to order at 6:30 PM.
CONSIDERATION OF MEETING MINUTES: MARCH 24, 2025:
Dennis moved to approve the minutes of March 24, 2025. Kiche seconded the motion. A vote was taken
and the minutes were approved 5-0.
PUBLIC COMMENT FOR TOPICS NOT ON THE AGENDA:
None.
CONSIDER A RECOMMENDATION TO AMEND THE HCDC BY-LAWS:
Vogel explained that at the last meeting the Commission discussed the reasoning for changing the
membership and stated tonight was another prime example where they could not get the number of
members present needed to have a quorum. Luckily, Borgen was able to join by Zoom. Also, currently
there are only seven active members and there's two vacancies.
Dulek provided an overview of the memo in the packet and noted the Commission doesn't have to make
a recommendation as to the how they move to a seven member group, but they can provide their input for
City Council. She also suggests that they consider staggering the membership. Currently there are three
members with terms that will end in 2025, one member's term that will end in 2026, as well as the two
vacancies right now would be for terms expiring in 2026. Dulek noted that Commissioner Kiche's term
has already been renewed to the end of 2028 so if the Commission wants just two terms to expire in
2028, they would have only one open vacancy to start this summer because Commissioner Kiche is

already appointed to serve through 2028. The Commission also plans to discuss potential discharge of a
current Commissioner on the next item and that would change the number of available vacancies.
Vogel stated regarding the recommendations he really likes the 2/2/3 and maybe it would make sense to
put Kiche in one of those first sections as the one that would end in 2028 since he's already been
appointed. Vogel will serve through 2026 and would probably offer to serve again unless Council decided
otherwise. Then the three that end in 2027 are Kivarkis, Krotz and Balde. He likes the idea of three
appointments ending in 2028.
Dennis asked if they have to fill one year terms and two year terms, could the applicant specify what they
are interested in? Dulek confirmed they could and that Council could also consider appointing for the one
year term plus a full next term. She noted Council is aware of the conversation regarding going from nine
members to seven and that's why they haven't made appointments.
Kivarkis asked how long it would take to transition to seven members. Dulek explained that the next steps
would be a Rules Committee meeting and then perhaps at the second meeting in May, Council can
decide whether they agree to go to a seven person Commission.
Kivarkis moved to recommend that City Council approve the proposed change to the by-laws to
change from a nine -person Commission to a seven -person Commission. Motion seconded by
Kiche and passed with a vote of 5-0.
Kivarkis moved to recommend a staggered 2-2-3 appointment schedule for the Commission
beginning in 2025. Motion seconded by Kiche and passed with a vote of 5-0.
CONSIDER A RECOMMENDATION TO CITY COUNCIL TO DISCHARGE COMMISSIONER:
Vogel stated that Daouda Balde was appointed to the Commission. Last October, he did come to one
meeting, but since then they've been unable to communicate with him. He noted City staff has reached
out via mail and phone. Vogel is asking that the Commission make the recommendation to Council to
discharge Balde from his position so that they have a slot open for a new interested party to serve.
Kiche noted looking at the attendance report in the agenda packet, it shows Balde only attended one out
of the four meetings and two of the absences are marked OE, which means they are excused. Looking at
the by-laws of the Commission, Section E states three consecutive, unexplained absences of a member
from regular meetings will result in a recommendation to the City Council from the Commission to
discharge said member and appoint a new member. At this moment, it appears that the Commissioner,
who is not here, has not missed three consecutive meetings.
Thul explained that all absences in the minutes have been recorded as excused because there is not an
established criteria for what is considered excused and what isn't. This year staff have moved towards
what other board and commission do by using "present" and "absent" in the minutes instead. Thul
continued that staff have not had any communication with this Commissioner explaining the absences.
They've tried phone calls, emails, and mail. Staff sent a letter in January about the general importance of
attending Commission meetings. Additionally, prior to this meeting, staff sent a letter via mail and email
letting him know that this item would be on the agenda. They also sent a copy of the packet.
Vogel noted one more important piece of clarification is that only the dates of meetings they were actually
able to hold are shown on the attendance list. There were meetings the Commission had to cancel
because of lack of quorum as well and he did not respond to those meeting invites either. So there has
been more than three unexplained absences.
Thul stated that there are people that have missed meetings that have reached out to say that they
couldn't attend. Those are treated differently than unexplained absences.

Kiche noted it is important to have all that information in the public record so all can see the issue.
Thul can see how it would be helpful to show the meetings that were cancelled due to lack of quorum in
the attendance sheet as well for transparency. She has seen other boards and commissions do that in
the minutes.
Kiche supports this. It is important to note situations where they have those long duration vacancies
because it puts the Commission in a very bad situation.
Vogel agreed that they should note who was present even if the meeting is cancelled so Council can see
who is making the effort to show up.
Dennis agreed and stated she researched other City boards and commissions and found that the HCDC
is one of the largest with nine members. She continued that the Commission has missed two meetings
that are really important to the community.
Borgen agrees with the smaller commission and added that participating is one of the best things they
can give to the Commission.
Dulek stated next steps is Balde will get a letter if the Commission votes to remove him. It will go on the
City Council agenda, and he will have the opportunity to come to City Council and explain if he wants to
resist it. The resolution will clarify what meetings he did not attend and that it was without explanation.
Commissioners thanked Dulek.
Dennis moved to recommend that City Council discharge Daouda Balde from the HCDC. Motion
seconded by Kivarkis and passed with a vote of 5-0.
STAFF & COMMISSION UPDATES:
Thul noted this week is National Community Development Week and pointed out two flyers in the packet
that highlight the impact of the federal Community Development Block Grant and HOME Investment
Partnership Program funds. The flyers include some of the local projects that have come through
recommendations from the Commission. Thul continued that the National Community Development
Association released a CDBG impact report today that was sent to all congressional offices to showcase
the importance of the CDBG program and to call for a funding increase. DVIP's new shelter was featured
in the report. April is also Fair Housing Month and there's a press release in the packet that has some
educational opportunities and general information about housing discrimination.
Kubly noted tomorrow the Johnson County Affordable Housing Coalition is hosting a bus tour for people
to showcase affordable housing projects. One is at the Peninsula on 1310 Foster Rd, which is a rental
housing partnership with The Housing Fellowship that the Housing Authority owns and manages. They
will also be driving by the North Summit property that they intend to develop. Vogel noted that the
previous chair, Kaleb Beining, attended the bus tour and had a positive experience. Kubly agreed and
encouraged commissioners to attend in future years if they are interested.
Vogel stated something he would like to discuss is the issue with low barrier temporary housing, like the
homeless camps around town. There's nothing in the housing code that really addresses it. He
acknowledged it puts the housing inspectors in a tight spot when they're trying to tread the line of
"everybody needs to follow the rules," but at the same time, trying to be considerate and understanding of
people that are in situations of need.
Dennis noted it's happening all over the country, and the City should not adopt what other communities
have done, such as fines and or incarceration. That is taking a step backwards.

Vogel agrees and thinks they need to go the other way and have protections in place in the housing code
that would protect low barrier housing to be established because right now there are no rules.
Dennis stated it might help to have the staff person from the shelter come in and really talk about what
they're doing to go out and try and connect with folks. It can take a long time, especially when somebody
has significant mental illness, to get them to even respond and not want to flee.
Kivarkis thinks it's almost impossible to find a general solution for an individual problem. To understand
and connect to these people, to help them if they are willing to receive help is a good idea but it's a very
complex situation.
Kiche stated regarding the situation of homelessness, he was on the Truth and Reconciliation
Commission and they were looking for some data on homelessness across the state, but for some reason
they didn't get anything. They did not show up even to give a presentation on the situation. He noted the
City did a survey during the planning process this year, but he hasn't looked at that report yet. They need
to look at that report and really dig deep on the situation of collecting data. They will need a lot of
information to help the City Council make decisions.
Vogel asked staff to put something together from Shelter House for a future agenda. It would be good to
know what kind of access they have to facilities.
Thul stated they will add an that to a future agenda. Normally at the May meeting they would have the
Annual Action Plan on the agenda, but it may be June before the Commission sees that because of the
delays with the federal budget.
Kiche stated he was looking at the reports they got. The people who receive the CDBG grants always
send a report on whom they are serving and things like that. He is interested in how people served are
showing progress because they could be serving the same persons every cycle. If they're just interested
in the counts to justify things, that is easy, but he also wants to see the issue of efficiency and how well
are people graduating from some of the programs. They might also want to see waiting lists of those who
want services but can't get them because there are fewer capacities.
Dennis noted a lot of that information will come through with the applications that they receive.
Thul stated that the agencies also submit narrative data that may speak to that. With 20 agencies, staff try
not to overwhelm the Commission with pages and pages of narrative, but if they're interested in reading
that information staff can definitely provide that as well.

Resolution to remove Commission member Daouda Balde
from the Housing and Community Development Commission
due to multiple unexplained absences.
Whereas, Article 4, Section E of the Housing and Community Development Commission By -
Laws provides three (3) consecutive, unexplained absences of a Commission member will
result in a recommendation by the Commission to City Council to discharge the member and
appoint a new member; and
Whereas, City Council appointed Daouda Balde to the Housing and Community Development
Commission May 21, 2024, and he has only attended one meeting; and
Whereas, Commissioner Daouda Balde has had more than three (3) consecutive, unexplained
absences from the Housing and Community Development Commission, namely on January 13,
2025, January 27, 2025, March 24, 2025, and April 21, 2025; and
Whereas, Section 372.15 of the Iowa Code governs the process for removal of all persons
appointed to city office and includes notice and the right to be heard; and
Whereas, on April 21, 2025, the Housing and Community Development Commission passed a
motion recommending City Council remove Daouda Balde from the Housing and Community
Development Commission.
Now, therefore, be it resolved by the City Council of the City of Iowa City, Iowa, that:
1. Pursuant to Article 4, Section E of the Housing and Community Development Commission
by-laws and Section 372.15 of the Iowa Code, Daouda Balde is removed from the
Housing and Community Development Commission.
2. The City Clerk is directed to mail a copy of this resolution to Daouda Balde by certified
mail.
3. Daouda Balde, upon written request filed with the City Clerk within thirty (30) days of the
date of mailing a copy of the resolution, will be granted a public hearing before the Council
on all issues connected with his removal. The hearing will be held within thirty (30) days
of the date the request is fled unless Daouda Balde reasonably requests a later date.
Following the public hearing, the Council will either confirm its earlier decision of removal
or reinstate Daouda Balde to the Housing and Community Development Commission.
4. If no hearing is requested by Daouda Balde, removal will be effective thirty (30) days after
the date on which a copy of the resolution is mailed to Daouda Balde. If a hearing is
requested, Daouda Balde will remain on the Housing and Community Development
Commission pending final resolution by City Council.

Executive Summary:
This agenda item begins the bidding process for the Rundell Street Pump Station Vault
Modifications Project. This project generally includes repairs to an existing storm water pump
station.
Background / Analysis:
The Rundell Street Pumping Station was constructed in 1983 and some components have
reached the end of their useful life expectancy.
The pumping station is comprised of one wet well that contains two submersible pumps and
a separate wet well that contains two axial flow propeller pumps. The two wet wells are
connected via a 54-inch gravity sewer.
The submersible pumping station work consists of the replacement of two submersible
pumps and appurtenances, check valves, isolation valves, and electrical equipment;
replacement of the existing 14-foot by 14-foot concrete top slab and access doors;
preparation and painting of the existing ductile iron piping to remain; and rehabilitation of the
existing trash screen anchors and supports.
The propeller pumping station work consists of installation of concrete curbing and an
equipment pad for the new City -provided control panel and replacement of the solenoids in
the oil reservoir enclosure.
Additionally, work includes accessibility improvements related to the vault lid and surrounding
sidewalk, replacement of curb ramps at all four corners of the Rundell Street and Center
Avenue intersection, installation of a utility meter cabinet, installation of a new equipment pad
to raise the existing transformer, and miscellaneous restoration.

Executive Summary:
The City will receive bids on May 6, 2025 for the Series 2025, Tax -Exempt General Obligation Bonds.
The City Council will receive a summary of those bids that night and then consider approval of the
lowest bid.
Background / Analysis:
The City issues bonds every spring to fund the current year's capital improvement projects
listed in the Five -Year Capital Improvement Program. The City Council adopted the 2025
capital improvement program on April 15, 2025.
The 2025 projects funded from general obligation bonds total $14,325,000. With issuance
costs and contingencies, the total funding requirements from the 2025 general obligation
bonds is $14,535,000. This amount is subject to change depending on the bids received.
Bids will be received by the City and Speer Financial at 11:00am on May 6, 2025. The results
of the sale will be summarized, and the bidder of the lowest interest rate will be
recommended to be awarded the sale.

Profile
Iowa City is a large city that serves as the county seat of Johnson County. The city's population is currently estimated at about 76,000
residents. The city provides public safety (police and fire), public works, recreation and other general government services. The city's
major business -type activities include sewer, sanitation, water, parking transit and stormwater.
Detailed credit considerations
The city's healthy financial profile will remain a credit strength, even with planned reserve draw downs, because of its currently strong
reserves, favorable revenue trends and conservative budgeting practices. For fiscal 2024 the city's available fund balance ratio totaled a
very healthy 106% of revenue across all funds, while cash was around 124%of revenue (see exhibit 2). The city had originally budgeted
for $11 million draw in general fund for capital, but ended with a $11 million increase, driven by unspent American Rescue Plan (ARPA)
funds, delayed capital, expenditure savings related to salaries and benefits and health insurance. The city's economic base will continue
to grow given its diversity and ties to the University of Iowa and its associated University of Iowa Hospitals & Clinics, which is the only
academic medical center in Iowa (Aaa stable). As of fiscal 2024 the city's long-term liabilities ratio is moderate at 123%of revenue (see
exhibit 3).
For fiscal 2025 June 30 year-end) city officials anticipate a planned spend down of around $19.5 million in the general fund for capital
projects and unspent ARPA funds. Other govemmental and business type funds are largely balanced for the year. The fiscal 2026
budget reflects a $2.9 million deficit in the general fund for capital projects, and affordable housing pmjects. Across all funds the city
budgeted for generally balanced operations. Despite these planned draws available fund balance and cash are likely to remain very

Iowa cities participate in two cost sharing plans, the Iowa Public Employees' Retirement System (IPERS) and Municipal Fire and Police
Retirement System of Iowa (MFPRSI). Based on reporting by IPERS and MFPRSI, we project that cities' ANPLS will increase by around
15% in fiscal 2024, driven in part by salary increases which exceeded actuarial assumptions. While results will vary across US public

City Council consider adopting the proposed Resolution Declaring All Are Welcome in Iowa
City.

Resolution Declaring All Are Welcome in Iowa City, Iowa
Whereas, equal rights under the law and liberty for all is foundational to our nation and
government; and
Whereas, the Declaration of Independence states, "We hold these truths to be self-
evident, that all [people] are created equal, that they are endowed by their Creator with
certain unalienable Rights, that among these are Life, Liberty and the pursuit of
Happiness"; and
Whereas, the Iowa stale motto states, "Our liberties we prize and our rights we will
maintain'; and
Whereas, the Iowa Civil Rights Act passed in 1965 and amended in 2007 includes
employment, housing, public accommodations, education, and credit considerations as
areas of life that cannot be used for discrimination based on a person's color, creed,
gender identity, marital status, national origin, disability, race, religion, sex, and sexual
orientation; and
Whereas, many Iowans are experiencing anger and fear due to several laws passed in
Iowa in 2023 and 2024, including the Religious Freedom Restoration Act (RFRA), which
codifies religious exemptions allowing individuals to use religious beliefs as legal
justification to discriminate against other Iowans who are then deprived of their rights
and liberties; and
Whereas, discrimination and inequality erode the founding principles of our society and
government; and
Whereas, equal rights under the law and liberty for all require that anti -discrimination
protections be considered a compelling government interest and the least restrictive
means of achieving that interest. A religious liberty claim should not be elevated above
or overrule by law other equally important rights and liberties; and
Whereas, no person should be allowed to use religion, religious freedom, or any other
reason as justification to discriminate against another person based on color, creed,
gender identity, marital status, national origin, disability, race, religion, sex, sexual
orientation, reproductive status, violence survivor status; and
Whereas, Iowans are leaving our communities and the state due to the dangers of
RFRA and other laws passed by Iowa lawmakers that send a message contrary to our
state's motto and the promise that All Are Welcome in Iowa; and
Whereas, these laws, including RFRA, harm the reputation of our state and the best
interests of its business community as well as cities and counties large and small, urban
and rural; and

Whereas, Iowa City, Iowa aims to create a community where discrimination has no
place. It also recognizes ensuring complete safety or freedom from discrimination is a
complex, ongoing effort and collaboration among individuals, organizations, and
government; and
Whereas, Iowa City, Iowa is located within the bounds of Johnson County where the
Johnson County Supervisor adopted the "All Are Welcome" resolution on December 5,
2024.
Now, therefore, be it resolved by the City Council of Iowa City, Iowa, that:
1. The City of Iowa City is committed to promoting a united vision where All Are
Welcome in Iowa City and further commits Iowa City to being a discrimination -free
community. We recognize our responsibility to foster a community that actively
works towards inclusivity, equity, and the protection of rights for all, even as we
acknowledge the ongoing nature of this work.
2. Be it further resolved, the City of Iowa City encourages businesses, housing
developments and landlords, non-profit organizations, houses of worship,
educational institutions, and neighborhood associations to unite in the message
All Are Welcome in Iowa City, Iowa and declare themselves as a discrimination -
free partner.
