HomeMy WebLinkAboutPN - NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS- FY26 NOI-RRF - PUBLISH 8-1-25 (Tier 1)NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS FOR TIERED PROJECTS AND PROGRAMS Date of Publication: August 1, 2025 City of Iowa City 410 East Washington Street Iowa City, Iowa 52240 (319) 356-5230 On or after August 12, 2025 the City of Iowa City will submit a request to the U.S. Department of Housing and Urban Development for the release of Community Development Block Grant (Grant #B-25-MC-19-0009) funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake the following projects: Tier 1 Broad Review Project Title: FY26 CDBG Homeowner Housing Rehabilitation – City of Iowa City Purpose: The City will provide funds to rehabilitate single family housing occupied by LMI income homeowners throughout Iowa City. The program is administered by the City of Iowa City and includes activity delivery costs. Location: Iowa City Estimated Cost: CDBG funds of $250,000 Level of Environmental Review Citation: 24 CFR 58.35(a)(3)(i) The Environmental Review Record (ERR) will be made available to the public for review electronically or via U.S. Mail. Please submit your request by U.S. mail to the Neighborhood Services Department, City of Iowa City, 410 East Washington Street, Iowa City, IA 52240 or by email to bthul@iowa-city.org. The ERR can also be accessed online at the following website: https://cpd.hud.gov/cpd-public/environmental-reviews. An ERR that documents the environmental determinations for these projects is on file at the Neighborhood and Development Services Department, City of Iowa City, 410 East Washington Street and may be examined or copied weekdays 8A.M. to 5P.M. Tier 2 site specific reviews will be completed for laws and authorities not addressed in the tier 1 broad review for each address under these projects. Tier 2 Site Specific Review: Site-specific reviews will cover the following laws and authorities not addressed in the Tier 1 broad review for these projects: Airport Hazards (24 CFR Part 51D); Flood Insurance (42 USC 4001-4128 and 42 USC 5154a); Contamination and Toxic Substances (24 CFR 50.3(i) & 58.5(i)(2)); Endangered Species (Endangered Species Act of 1973, section 7; 50 CFR 402); Floodplain Management (Executive Order 11988, particularly section 2(a); 24 CFR 55); Historic Preservation (National Historic Preservation Act of 1966, sections 106 and 110; 36 CFR 800); Noise Abatement and Control (Noise Control Act of 1972, as amended by the Quiet Communities Act of 1978; 24 CFR 51B); Wetlands Protection (Executive Order 11990, sections 2 and 5);. Mitigation Measures/Conditions/Permits (if any): None required for Tier 1. No funds will be committed to individual site-specific projects prior to completion of a Tier 2 site specific review as described above. As scopes of work are developed, mitigation measures may be implemented when compliance with related regulations is required as described in the Environmental Review Record. The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements as cited above. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the Iowa City Department of Neighborhood and Development Services (410 E Washington St, Iowa City, IA) or via email to bthul@iowa-city.org. All comments received on or by August 12, 2025 will be considered by the City of Iowa City prior to authorizing submission of a request for release of funds. RELEASE OF FUNDS The City of Iowa City certifies to HUD that Geoff Fruin, Certifying Officer, in his capacity as City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows recipients to use HUD program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and the City of Iowa City’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Iowa City; (b) the City of Iowa City has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted via email in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the HUD office at CPDRROFOMA@hud.gov.
