CPRB — Draft Minutes July 08, 2025 Page 2 Old Business: Discussion of Senate File 311 and the future of the CPRB: The Board discussed the memorandum from the City Manager and the Police Chief. The discussion centered around option #2 (Informal Staff Led Engagement), such as a Police Chief's Advisory Committee. Board member Braddock asked Police Chief Liston what he envisioned the Committee would be like. Liston said he would like to see a core group of people with a good representation of the community be involved at meetings, which likely would be held every quarter and possibly more. Liston stated that he'd like to have a more flexible engagement with the community by not being held to the constraints of a Council appointed board and would like to have the community be able to come to the meetings and share concerns and have good conversations with them. The Board unanimously agreed to option #2. Motion by Jensen, seconded by Hobart -Collis to accept option #2 from the memo from the City Manager and the Police Chief, and to authorize Chair Jensen to draft the recommendation letter to the City Council. BOARD'S RESPONSIBILITY: Under the City Code of the City of Iowa City, the Board's responsibilities are as follows: 1. The Board forwards all complaints to the Police Chief, who completes an investigation. (Iowa City Code Section 8-8-7(A).) 2. When the Board receives the Police Chiefs report, the Board must select one or more of the following levels of review, in accordance with Iowa City Code Section 8-8-7(B)(1): a. On the record with no additional investigation. b. Interview /meet with complainant. c. Interview /meet with named officer(s) and other officers. d. Request additional investigation by the police chief, or request police assistance in the board's own investigation. e. Perform its own investigation with the authority to subpoena witnesses. f. Hire independent investigators. 3. In reviewing the Police Chiefs report, the Board must apply a "reasonable basis" standard of review. This means that the Board must give deference to the Police Chiefs report, because of the Police Chief's professional expertise. (Iowa City Code Section 8-8-7(13)(2)).) 4. According to Iowa City Code Section 8-8-7(B)(2), the Board can recommend that the Police Chief reverse or modify the Chiefs findings only if: a. The findings are not supported by substantial evidence; or b. The findings are unreasonable, arbitrary or capricious; or c. The findings are contrary to a police department policy or practice, or any federal, state or local law. 5. When the Board has completed its review of the Police Chiefs report, the Board issues a public rep.o,q to the_otyrggc� LThe public report must include: (1) detailed findings of fact, and (2) a clearly afficulated conclusion explaining why and the extent to which the complaint is either "sustained",pr;'nat sustained ". (Iowa City Code Section 8-8-7(B)(3)).) 6. Even' if the Board finds that the complaint is sustained, the Board has no authority to discipline the officer involved. BOARD'S PROCEDURE: The Complaint was initiated by the Complainant on 12/17/2024. As required by Section 8-8-5(B) of the City Code, the Complaint was referred to the Chief of Police for investigation. The Chiefs Report was filed with the City Clerk on 03107/2025. As per Section 8-8-6(D) of the City Code, the Complainant was given the opportunity to respond to the Chiefs report. The Board voted on 05/13/2025 to apply the following Level of Review to the Chiefs Report: "Request additional investigation by the Police Chief or City Manager, or request police assistance in the Board's own investigation, pursuant to Iowa City Code Section 8-8-7 (13)(1)(d). The Board met to consider the Report on 05/13/2025 and 06/10/2025. Prior to the 05/13/2025 and 06/10/2025 meetings, the Board had the opportunity to review the complaint, the Police Chief's report, and to watch and listen to body worn camera and/or in -car camera footage showing the interaction between the officers and the complainant and the subsequent search of the vehicle. FINDINGS OF FACT: Iowa City Police Officers observed the Complainant get into the driver's seat of a vehicle and begin to drive off, exiting the parking lot at the Kwik Star. Officers were also aware the Complainant had a suspended driver license from previous interactions. The Officers conducted a traffic stop due to the suspended driver license. When the Officers approached the vehicle, the Complainant reached into the center console of the vehicle and then began rummaging in a backpack, ignoring the Officer directions to exit the vehicle, which the Complainant eventually did. Once out of the vehicle, the Complainant was detained in handcuffs and was searched. Officers explained the danger of his actions by ignoring the commands and reaching in the backpack. Officers detected the odor of marijuana coming from the car and one Officer conducted a probable cause search of the vehicle. The remnants of marijuana were located in the vehicle. The other Officer observed an iPad in the front passenger area and checked the serial number to determine if it was stolen. While the Complainant was in the back of the squad car, the Officer explained to the Complainant he was stopped because of a suspended license. The Complainant was issued a citation for driving with a suspended license and released. COMPLAINANT'S ALLEGATION #1: Violation of Section 329,,4.94, f) of4he_ Depart#pent's standards of conduct, which prohibits "Discourteous, disrespectful or discri'mih0bry tr�6athl6nfo'f9ny member of the public, or any member of the Department or the City." Chief's conclusion: Not sustained Board's conclusion: Not sustained Basis for the Board's conclusion: The Complainant alleges he was harassed by a member of the Iowa City Police Department. A review of body camera footage from the event shows the officers were not discourteous, disrespectful or discriminatory in their interactions with the Complainant. COMPLAINANT'S ALLEGATION #2: Violation of Section 300.3 of the Department's Use of Force policy, which provides as follows: "Officers shall use only that amount of force that reasonably appears necessary given the facts and circumstances perceived by the officer at the time of the event to accomplish a legitimate law enforcement purpose. The application of any use of force compliance shall be discontinued once the officer determines that compliance has been achieved." Chiefs conclusion: Not sustained Board's conclusion: Not sustained Basis for the Board's conclusion: The Complainant alleges he was compliant and got out of the vehicle when directed. A review of body camera footage shows the Complainant failed to comply with officer directions. Further, the video showed the Complainant reaching into the center console of the vehicle and into a backpack, while the officers repeatedly instructed the Complainant to exit the vehicle. The officer's decision to direct the Complainant out of the vehicle was reasonable due to the potential threat of the Complainant retrieving a hidden weapon. The Complainant was handcuffed until he could be searched for weapons, which was reasonable and consistent with the Use of Force policy. COMPLAINANT'S ALLEGATION #3: Violation of Section 312.3 of the Department's Search and Seizure policy, which provides as follows: "The U.S. Constitution generally provides that a valid warrant is required in order for a search to be valid. There are however several exceptions to the rule that permit a warrantless search. Examples of law enforcement activities that are exceptions to the general warrant requirement include but are limited to, searches pursuant to: Valid consent; incident to a lawful arrest; Legitimate community caretaking interests; Vehicle searches under certain circumstances; Exigent circumstances." Chief's conclusion: Sustained Board's conclusion: Sustained Basis for the Board's conclusion: The odor of marijuana coming from the Complainant's vehicle gave the officer probable cause to search without a warrant because of the automobile exception to the warrant requirement. The officer's search for a serial number on the Pad was outside of the scope of the probable cause search for drugs. Although no action was taken based on the search of the serial number, this search was invalid. COMMENTS: COMMUNITY POLICE REVIEW BOARD FY25 ANNUAL REPORT GENERAL RESPONSIBILITIES Established in 1997, by ordinance #97-3792, the Iowa City Police Citizens Review Board formerly known as Citizens Police Review Board and now known as Community Police Review Board (hereafter referred as the CPRB), consisted of seven members appointed by the City Council. The Board was established to review investigations into claims of police misconduct, and to assist the Police Chief, the City Manager, and the City Council in evaluating the overall performance of the Police Department by reviewing the Police Department's investigations into complaints. The Board is also required to maintain a central registry of complaints and to provide an annual report setting forth the numbers, types, and disposition of complaints of police misconduct. The Board shall hold at least one community forum each year for the purpose of hearing views on the policies, practices, and procedures of the Iowa City Police Department. To achieve these purposes, the Board complies with Chapter 8 of the Iowa City Code and the Board's By -Laws and Standard Operating Procedures and Guidelines. ACTIVITIES AND ACCOMPLISHMENTS FOR FISCAL YEAR 2025 Meetings The CPRB tentatively holds monthly meetings on the second Tuesday and special meetings as necessary. During FY25 the Board held 13 meetings which included 1 Community Forum. ICPD Policies/Procedures/Practices Reviewed By CPRB The ICPD regularly provided the Board with monthly Use of Force Reports, Internal Investigation Logs, Demographic Reports, and various Training Bulletins. The Department also provided various General Orders for the Board's review and comment. A senior member of the Police Department routinely attended the open portion of the CPRB meetings and was available for any questions Board members had regarding these reports. Presentations In October 2024 the Board held its 17th Community Forum required by the City Charter. Board members introduced themselves and shared a summary of the Board duties. No correspondence was received from the public. The forum was then opened to the public. Topics of discussion included what is the Board's authority, what is the role of the Staff Attorney, has the Board ever subpoenaed anyone, the amount of time police spend on matters not associated with police work, concerns about bicycles and scooters on sidewalks in the Ped Mall area, cameras not available to attest to an accident, the importance of the Board to the community, the possibility of mediation between the complainant and the officer, procedures and follow-up, and the Board's responsibilities beyond complaints and into advocacy at the City or State level. Board Members In October 2024 officers were nominated and voted on with Saul Mekies as Chair and Jerri MacConnell as Vice -Chair. Ricky Downing resigned from the Board in January 2025, and Maurine Braddock was appointed to fill the remainder of his term. Jerri MacConnell resigned from the Board in May 2025, and to date, no appointment has been made to fill the remainder of her term. Saul Mekies's term ended June 30, 2025, and Audrey Moeller was appointed to replace him. Due to the resignation of MacConnell and the completed term for Mekies, officers were nominated and voted on with Melissa Jensen as Chair and David Schwindt as Vice -Chair in June 2025. The Police Chief summarizes the results of these investigations and indicates in a report (the Chief's Report) to the CPRB whether allegations are sustained or not sustained. (If complaints are made against the Chief, the City Manager conducts the investigation and prepares and submits the reports.) The Board reviews both the citizens' complaint and the Chief's Report and decides whether its conclusions about the allegations should be sustained or not sustained. The Board prepares a report which is submitted to the City Council. Of the 13 allegations listed in the 13 complaints for which the Board reported, 1 was sustained, 11 were not sustained, and 1 allegation was not supported by the Board. Comments The Board made comments and/or recommendations for improvement in police policy, procedures, or conduct in 1 report. Complaint #24-05 An additional allegation was included in the Chiefs report: General Order 99-08, Body Worn Cameras & In -Car Recorders. The Board discussed during their September 10, 2024, meeting that the Complainant did not directly include this in their complaint report, thus the Board does not support that this was an allegation from the complainant and should not be documented as such. The Board understands, however, that General Order 99-08 will be amended in response to the circumstances involved in this complaint. Name -Clearing Hearings The ordinance requires that the Board not issue a report critical of the conduct of a sworn officer until after a name -clearing hearing has been held. During this fiscal period, the Board did not schedule any name -clearing hearings. Complaint Histories of Officers City ordinance requires that the annual report of the CPRB must not include the names of complainants or officers involved in unsustained complaints and must be in a form that protects the confidentiality of information about all parties. In the 13 complaints covered by the FY25 annual report, a total of 13 officers were involved with allegations against them. The new law prohibits a citizen board from reviewing the conduct of police officers. This change is effective August 16, 2025. The City Council has requested the Community Police Review Board (CPRB) provide a recommendation on how best to adjust to the new law. At the CPRB meeting on July 8, 2025, the board discussed the upcoming changes and our beliefs and recommendations on the best way forward. We also reviewed the memorandum from the City Manager and the Police Chief. As noted, under option #1 of the memorandum, the CPRB would be restricted from reviewing officer conduct, and while department policies could still be reviewed, there would be limited public engagement. The CPRB agrees the formal nature of a City Council appointed Commission introduces some impactful limitations For example, formal agendas can limit timely conversations between the members and the public. Option #2 as presented, references an informal staff led engagement effort and provides more flexibility with meeting restrictions, audiences and locations. An informal approach allows for greater real-time discussion and a wider variety of topics. This structure would be less formal with meetings not recorded or subjected to the restrictions of the State of Iowa Open Meetings law. CPRB Recommendation: The Board agrees SF311 removes the primary purpose for which the CPRB was originally created. With the ability to receive and to review officer conduct no longer an option, any community impact would be limited. While Police Department policies have also been reviewed, the general orders are now available to the public online. Annual forums have been held over the years with limited success, again related in part to the constraints of the meeting agenda. With the original primary purpose no longer an option, there would be limited scope and impact. The CPRB unanimously recommends dissolving the Board, and reallocating time and resources to a staff led process with the goal to strengthen trust & involvement across the community. The Board recommends the advisory committee would be informal in structure with efforts lead by the Chief of Police. A wide variety of community representatives, with diverse backgrounds and experience should be engaged. Varying staff, external partners, and other representative involvement would help increase the understanding of community issues, resources available, and assist with community policing efforts. Open discussions and two-way communication are very important. Topics should include discussions on public safety and police department operations. Other discussions could be related to current events or hot topics, and be based on national, state, and local events. To begin, the CPRB recommends meetings be held on a quarterly basis with additional meetings, as needed. The Board believes this approach allows for greater flexibility and helps address some of the restrictions which have occurred due to the previous formal board structure. I am grateful to have been able to attend the last year of the Board's public meetings. To the Review Board Members, I appreciate the long hours you dedicated to being civilian liaisons for the Iowa City Police Department. You taught me that Iowa City is filled with skilled, interesting people. My thanks go to each of you for all you have shared. I know you will continue to teach what you have learned!Thank You! For the last five years, I have focused on the Truth Download 2020 Vision teens'needs. Local peacekeepers made it possible for me to explain the intent of laws, teen-usable de-escalation techniques, and how to document discrimination.Tutoring, and partnering with black at-risk teens,their counselor, and parents, has been a 24/7 on- call joy for me.Their success in school, and their ability to thrive non-violently, despite injustice—all of them have stories to tell. Ten of the fourteen young people have grown and entered their college years. That has given me time to hear from Iowa City community members about their concerns.The fear of retribution at their work or their family's workplace is heartbreaking. It's hard to believe this is still America... Iowa City's Council has reason for pride and for gratitude that town and county funds are available. Leadership carries the same humbling responsibility that law enforcement must manage 24/7. Profiling in law enforcement is the same as using any ideology, identity, personal preference, or prejudice as a basis for governmental decisions. Policing and Governance are intended to protect and benefit everyone within a jurisdiction,town, and county. Iowa City thrives because the City Council has always created opportunities and had resources to support community needs. Governmental bodies strive to be aware of their entire constituency not just those who agree with their personal beliefs. Some of the Council's best intentions have alienated layers of black minorities. I hope those community members will speak out, but DEI or equity or inclusion said out loud in public is personally dangerous. But I'm an old nobody,with nothing to lose, so I will tell you when I hear troubles you should know. That said,this old nobody was shocked to see my own personal beliefs overturned this month. Much to my fear and dismay, I have five grandsons and grandnephews in the military. One grandson is married, gay, and has given 10 years with three deployments in service of the USA.A few weeks ago, he refused to help ICE so, instead of retiring as planned from the military next month,a Stop-Loss Orderwas given bythe DOD for him to deployto Iraq for a year. 1 My shock is that I'm relieved he will be under Military Command instead of on call for every whim of Iowa's or Washington, DC's Civilian Leadership.
