Summary of Minutes
August 5, 2025
Iowa City City Council special formal meeting, 3:30 p.m. held at City Hall — Emma J.
Harvat Hall, 410 E. Washington Street. Mayor Teague presiding. Council members
present: Alter, Bergus, Harmsen, Moe, Salih, Teague, Weilein. Staff members present:
Fruin, O'Brien, Lehmann, Goers, Grace, Caro. Unless otherwise noted, all actions were
affirmative and unanimous.
Moved by Alter, seconded by Salih, to adjourn to executive session to discuss
strategy with counsel in matters that are presently in litigation or where litigation is imminent
where its disclosure would be likely to prejudice or disadvantage the position of the
governmental body in that litigation. The Mayor declared the motion carried and
adjourned into executive session 3:31 p.m.

11.f Ordinance amending Title 12, Chapter 5, Franchise Fees to repeal the one
percent (1%) franchise fee and enact a two percent (2%) franchise fee on the
gross revenue derived from the distribution, delivery, and retail sale of
electricity and natural gas by franchisees including MidAmerican Energy
Company, or other natural gas providers utilizing the distribution system of
MidAmerican, to customers within the current or future corporate limits of the
City of Iowa City, and to describe the purpose for the revenue collected.

11.g Resolution authorizing the City Manager to sign a Memorandum of

Motion to amend Section 1. to add "permanent" to the following: "25% shall be used to
preserve existing affordable housing stock, increase shelter, aad transitional, and permanent
housing supports, and increase access to and the supply of affordable housing for households
with low incomes.". Moved by Oliver Weilein, seconded by Megan Alter. Motion
Passed. (7 Ayes)
Motion to amend Section 1. removing "shall be used" from the following: "25%shall he -used to
preserve existing affordable housing stock, increase shelter, transitional, and permanent housing
supports, and increase access to and the supply of affordable housing for households with low
incomes. 10% shaA-be mgd for maintenance and construction of public streets, sidewalks, trails,
parks, and facilities as designated by City Council. 15%shall -be-used for community
partnerships, including, but not limited to, partnerships that support intergovernmental, economic
development, arts and culture, and social service priorities as
designated by City Council.". Moved by Laura Bergus, seconded by Joshua
Moe. Motion Passed. (7 Ayes)
11.1 Resolution adopting an assessment schedule of unpaid mowing, clean-up of
property, snow removal, sidewalk repair, and stop box repair charges and
directing the Clerk to certify the same to the Johnson County Treasurer for
collection in the same manner as property taxes.
Motion to approve resolution 25-196. Moved by Megan Alter, seconded by Joshua
Moe. Motion Passed. (7 Ayes)
11.j Resolution calling for the City of Iowa City to boycott the investment of any
and all public monies from entities complicit in the current and ongoing
humanitarian crisis in Gaza, including all entities assisting Israel in the
oppression of the Palestinian people.

4. Recap of the State of Iowa legislative session
Deputy City Manager Chris O'Brien and lobbyist Doug Stryke, Carney Appleby provided a
comprehensive overview of the 2025 Iowa legislative session, highlighting key bills, budget
challenges, and anticipated future actions. Key legislative Action Affecting Cities were as
follows:
• Civil Service Reform (Senate File 311)
• Diversity, Equity, and Inclusion (DEI) Ban
• Open Meetings Law
• Cancer Presumption Bill
• Accessory Dwelling Units (ADUs)
• Franchise Fees, Trash Opt -Outs, PSAP Funding
Individual Council members asked lobbyist Stryke questions. City Attorney Goers and City
Manager Fruin provided additional information.
5. Local Option Sales Tax Discussion [Continued from June 171
The council resumed its discussion on the local option sales tax (IP 4), scheduled for the
November 4th general election ballot. They reviewed outcomes from the June 17 meeting,
including proposed fund allocations:
• 50% for property tax relief (as required by law)
• 25% for affordable housing
• 10% for infrastructure and public facilities
• 15% for community partnerships
There is no sunset clause included.
Two versions of draft ballot language were shared:
• Attachment 1 — the Council's original draft
• Attachment 2 — a more concise alternative proposed by staff for voter clarity, without
changing the scope of the measure
Staff emphasized that either version is acceptable from a policy standpoint and left the
decision to the Council, stressing the importance of choosing what best serves the city's
long-term interests.
Councilors had additional discussion regarding the sunset clause and the draft ballot
language. Individual Council members asked questions and expressed their views. City
Manager Fruin provided additional information.
Action: Staff will work on a final LOST resolution to be presented on the August 5t" agenda.
The Council left the previously agreed upon language and percentage allocations
unchanged (minus one noted typo) and affirmed that no sunset of the tax will be proposed.
Staff will begin to work on developing educational materials for the public and draft
correspondence to the City Council outlining the education and advocacy limitations in State
Code.
